L’arbitrage international, outre le recours aux tribunaux de l’État hôte, est la méthode la plus utilisée pour régler les différends relatifs aux investissements étrangers. Plusieurs accords internationaux d’investissement incluent des dispositions ayant trait à l’arbitrage sous l’égide du Centre International pour le Règlement des Différends relatifs aux Investissements (CIRDI) mis en place par la Convention de Washington de 1966. Les tribunaux arbitraux constitués sous l’égide du Centre sont ainsi appelés à trancher des différends qui concernent la conduite d’États hôtes vis-à-vis ses investisseurs étrangers ; leurs décisions ayant de fortes conséquences sur l’intérêt public, concrètement lorsqu’il s’agit de la protection de l’environnement. L’évolution croissante du droit environnemental et son empiètement sur la protection des investissements a déclenché une série de différends qui ne se limitent plus à mettre en cause des nationalisations ou des violations de contrats - comme auparavant - mais tournent souvent autour de mesures étatiques de politique publique qui impliquent des questions sensibles telles que, inter alia, la gestion de déchets dangereux, l’accès à l’eau potable, l’étalement urbain, la protection de la biodiversité. Par conséquent, le rôle des tribunaux CIRDI et de leurs décisions devient décisif dans le développement du droit des investissements et dans le débat sur la protection des investissements face aux mesures législatives en matière environnementale. Cette étude a pour objet d’analyser la place des considérations environnementales dans les sentences arbitrales CIRDI. Spécifiquement, il s’agit d’étaler les principaux arguments retenus par les tribunaux internationaux, et de dégager les grandes tendances jurisprudentielles en matière d’arbitrage international d’investissements face aux mesures environnementales.

En nuestro país el sector de ambientadores y cosméticos ha presentado un crecimiento económico constante y notable, proyectando a Colombia para el año 2032 como un dirigente en la elaboración de cosméticos y productos de aseo. La biodiversidad colombiana ofrece múltiples recursos, incluyendo una gran diversidad de aromas naturales, es un importante mercado para producción de cosméticos sin la utilización de productos artificiales. El presente trabajo de investigación tiene por objetivo determinar las características del diseño de una relación estratégica comunitaria y marketing en la creación de una empresa de cosméticos y ambientadores. Ésta investigación se realiza bajo la recopilación de información del sector y principalmente de la organización, dentro de un estudio empírico-analítico descriptivo. Estableciendo resultados que finalmente dan respuesta a la utilidad de estrategias comunitarias en la actualidad. En el caso de estudio de la nueva empresa "Jolie Le Petit" en un sector en crecimiento, ofrece múltiples oportunidades de negocio y permite generar ideas innovadoras para la venta de productos. La facilidad de cambio y la inclusión en la comunidad posibilita el acercamiento a los clientes, asegurando la permanencia en el mercado indicado. Considerando la posibilidad que la inversión extranjera en el sector pueda afectar notablemente el mercado nacional. Mediante el análisis concluimos que la estrategia de mercadeo comunitaria es adecuada y aplicable a este tipo de empresa. "Jolie Le Petit" además de ser una unidad es también un actor social, estando inmersa en una comunidad en donde juega un papel vital el ser percibida como un buen vecino, ofreciendo a los clientes confianza compromiso y relación continua.

Algunos de los efectos ambientales y sociales que se pueden apreciar luego del cierre de una mina son la desaparición de acuíferos, la existencia de aguas superficiales contaminadas con sustancias químicas y la afectación a la salud de las personas que viven cerca de minas abandonadas. Esta investigación busca analizar los principales aspectos jurídicos relacionados con la terminación y cierre definitivo de la operación minera desde el punto de vista social y ambiental. Para ello, se presentan los principales efectos ambientales y sociales de ésta terminación; se mencionan los aspectos jurídicos más relevantes del contrato de concesión minera y de la licencia ambiental; se exponen las obligaciones jurídicas que están a cargo tanto del concesionario minero como de las autoridades competentes respecto del cierre de la mina y el papel que asumen los entes de control frente a la terminación y cierre de la mina. Así mismo, se hace un breve análisis de derecho comparado de la regulación en España y Estados Unidos sobre éste tema. Finalmente, se presentan los resultados de la revisión de los expedientes administrativos que fueron proporcionados por la Agencia Nacional de Minería, en los cuales se determina la aplicación y cumplimiento en la práctica de estas obligaciones jurídicas del concesionario minero al término del contrato. Con base a los resultados obtenidos, se puede concluir, en primer lugar, que las obligaciones a cargo de los concesionarios mineros no están claras por parte de la regulación minera y ambiental; en segundo lugar, que la regulación en cuanto al cierre de minas en España y Estados Unidos es más ordenada, completa y específica y; en tercer lugar, en relación con los expedientes analizados, se puede observar que los concesionarios y las autoridades competentes no están cumpliendo sus respectivas obligaciones.

Public concern over impacts of chemicals in plant and animal production on health and the environment has led to increased demand for organic produce, which is usually promoted and often perceived as containing fewer contaminants, more nutrients, and being positive for the environment. These benefits are difficult to quantify, and potential environmental impacts on such benefits have not been widely studied. This paper reports an uncertainty analysis of critical loads for acid deposition for a site in southern England, using the Steady State Mass Balance Model. The uncertainty bounds, distribution type and correlation structure for each of the 18 input parameters was considered explicitly, and overall uncertainty estimated by Monte Carlo methods. Estimates of deposition uncertainty were made from measured data and an atmospheric dispersion model, and hence the uncertainty in exceedance could also be calculated. The uncertainties of the calculated critical loads were generally much lower than those of the input parameters due to a "compensation of errors" mechanism - coefficients of variation ranged from 13% for CLmaxN to 37% for CL(A). With 1990 deposition, the probability that the critical load was exceeded was > 0.99; to reduce this probability to 0.50, a 63% reduction in deposition is required; to 0.05, an 82% reduction. With 1997 deposition, which was lower than that in 1990, exceedance probabilities declined and uncertainties in exceedance narrowed as deposition uncertainty had less effect. The parameters contributing most to the uncertainty in critical loads were weathering rates, base cation uptake rates, and choice of critical chemical value, indicating possible research priorities. However, the different critical load parameters were to some extent sensitive to different input parameters. The application of such probabilistic results to environmental regulation is discussed.

Cereal grains are the dominant source of cadmium in the human diet, with rice being to the fore. Here we explore the effect of geographic, genetic, and processing (milling) factors on rice grain cadmium and rice consumption rates that lead to dietary variance in cadmium intake. From a survey of 12 countries on four continents, cadmium levels in rice grain were the highest in Bangladesh and Sri Lanka, with both these countries also having high per capita rice intakes. For Bangladesh and Sri Lanka, there was high weekly intake of cadmium from rice, leading to intakes deemed unsafe by international and national regulators. While genetic variance, and to a lesser extent milling, provide strategies for reducing cadmium in rice, caution has to be used, as there is environmental regulation as well as genetic regulation of cadmium accumulation within rice grains. For countries that import rice, grain cadmium can be controlled by where that rice is sourced, but for countries with subsistence rice economies that have high levels of cadmium in rice grain, agronomic and breeding strategies are required to lower grain cadmium.

A regulação ambiental carece de maior transparência. Os órgãos de proteção do meio ambiente, em regra, apenas publicam as versões finais das medidas elaboradas, sem explicitar as justificativas técnicas que as embasaram, as alternativas consideradas e as possíveis contribuições decorrentes de participação social, entre outras questões. Em consequência, tem-se um cenário desfavorável à realização de controle pelos mais diversos atores. Para superá-lo, a análise de impacto regulatório é apresentada como instrumento apto a agregar clareza, objetividade e eficiência ao processo decisório ambiental. A incorporação da ferramenta, no entanto, deve ser realizada com cuidado especial, tendo em vista a existência de três principais peculiaridades do direito do meio ambiente. Primeiro, o setor lida não só com situações de risco, mas também com casos de incerteza, em que a ausência de informação impossibilita o cálculo de probabilidade de ocorrência de possíveis resultados. Em segundo lugar, a regulação ambiental recai sobre bens não transacionados em mercados, o que dificulta a obtenção de seu valor de troca, aspecto relevante para a análise de custo-benefício como tradicionalmente conhecida. Por fim, o meio ambiente apresenta desenho regulatório absolutamente fragmentado, composto por variados órgãos normatizadores, deliberativos e fiscalizadores em todos os níveis da federação, o que eleva o risco de deficiências na formação técnica das autoridades reguladoras.

This study approaches the question of the administrative procedure of the environmental licensing of ranks of fuel resale, taking as basis a study case of the reality of the City of Natal/RN (Brazil). For in such a way, it was done a retrospect on the evolution of the system of road transport in Brazil, having started to briefly analyze the urbanization process that if after accented in the capitals of the Brazilian States the decade of 1950, relating these subjects with the growth of the sector of fuel resale. After that, it was transferred boarding of the defense of the national environment to the light of ambient principles constitutional. In the sequence, a boarding on the ambient guardianship in the Federal Constitution of 1988 was made, treating basically specifies and on the national urban politics and the national politics of the environment, with its instruments. In the sequence, it was transferred the analysis of the abilities and attributions of the National Advice of the Environment (CONAMA) and its Resolutions, for then only enter in the most important part of this work: an analysis of the environmental licensing of ranks of fuel resale, in the reality of the City of Natal/RN. Before this specific boarding, it was proceeded specifically a survey and communication from the applicable norms to such establishments (Resolutions of the CONAMA and norms of the ABNT), for after that carrying through an geo-ambient characterization of the City of Natal/RN. Finally, a reflection was made on the possibility of magnifying of the state activity, in terms of guarantees for the responsible members for the environmental policy and of administrative efficiency, through the idea of the ambient regulation. For the accomplishment of this study, it was proceeded research in diverse sources such as books, magazines, sites of the Internet, periodicals, thesis and dissertations, among others material, beyond visits the agencies that direct or indirectly act with the ambient defense and as fuel resale, such as Secretariat of Environment and Urbanism of the City of Natal (SEMURB), Institute of Economic Development and Environment of RN (IDEMA), Brazilian Institute of the Environment and the Natural resources You renewed, Executive Management of RN (IBAMA/RN), Public prosecutor's office of the Environment of Natal (Public prosecution service of the RN), National Agency of Oil (ANP) and Union of the Retailing of Derivatives of Oil of the RN, among others. To the end, satiated regulation is observed that although on the substance of the ambient licensing in ranks of fuel resale, also with federal, state and municipal norms, the municipal Public Power is very far from the fulfilment of its institutional functions, in the question environmental policy of these establishments, a time that few are the permitted ranks of resale in the city of Natal/RN

Apoptosis is essential to eliminate secretory epithelial cells during the involution of the mammary gland. The environmental regulation of this process is however, poorly understood. This study tested the effect of HAMLET (human alpha-lactalbumin made lethal to tumor cells) on mammary cells. Plastic pellets containing HAMLET were implanted into the fourth inguinal mammary gland of lactating mice for 3 days. Exposure of mammary tissue to HAMLET resulted in morphological changes typical for apoptosis and in a stimulation of caspase-3 activity in alveolar epithelial cells near the HAMLET pellets but not more distant to the pellet or in contralateral glands. The effect was specific for HAMLET and no effects were observed when mammary glands were exposed to native a-lactalbumin or fatty acid alone. HAMLET also induced cell death in vitro in a mouse mammary epithelial cell line. The results suggest that HAMLET can mediate apoptotic cell death in mammary gland tissue.
