Australian policy makers recognise women who are trafficked to Australia (and these are largely for the purposes of sexual exploitation) primarily as victims of crime. The main public mechanism by which the "problem" of trafficked people in Australia is managed is the criminal law. At the same time, however, as a signatory to the UN Protocol on Trafficking and the Declaration of Human Rights, the Australian Government also recognises the rights of women trafficked to Australia to access health and community services in the wake of the health damage and trauma they often incur as a consequence of their experience. Current evidence suggests that trafficked women in Australia face considerable barriers in being able to avail themselves of such a right and of the services that accompany it. This paper explores the tensions posed by Australian policy and service approaches to trafficked women in light of the concept of social citizenship and the ways in which it is mediated in the Australian context by national border protection policy.

The Queensland Organised Crime Commission of Inquiry recently handed down its findings examining how organised crime has been policed in recent years. While media attention has been focused on the implications for child sexual exploitation and paedophilia, the report also made some substantial findings related to financial crimes such as investment fraud (commonly known as boiler rooms scams). Quite disturbingly, the report notes a strong victim blaming mentality that police expressed towards individuals who invested in fraudulent companies and who subsequently lost money in these boiler room scams. The attitude of the police towards boiler room victims was largely one of apathy towards the likelihood of any investigation, and of blame towards victims for not doing what was perceived to be “due diligence”. This finding illustrates several myths which are argued to exist around investment fraud victims, particularly around the concept of “due diligence”. It also feeds into the idea that victims are greedy/naïve and financially illiterate/not investment savvy. These are both problematic and largely inaccurate. Drawing on examples from my own research with fraud victims, the article will illustrate the complexity and sophistication of many boiler room schemes and demonstrate the difficulties in identifying fraudulent investment opportunities.

A prostituição infanto-juvenil tornou-se um fenômeno independente da adulta nos idos de 1990, tanto em nível nacional quanto internacional. Percebida sob os signos da gravidade e da urgência, suscitou denúncias, intervenções e saberes especializados. Na busca por compreender as condições de surgimento desses novos discursos, seus fundamentos e perspectivas hegemônicas acerca da prostituição infanto-juvenil, a presente dissertação percorre quatro etapas. Inicialmente, elabora uma genealogia das três principais fontes brasileiras sobre a exploração sexual na década de mil novecentos e noventa: documentos do CECRIA, a série de reportagens Meninas Escravizadas da Folha de S. Paulo e a CPI da Prostituição Infantil de 1993. Sob inspiração foucaultiana, elabora nova genealogia, agora sobre o sexo, em sua relação com o cristianismo, o direito e as ciências humanas e médicas. Visando a perceber novos olhares sobre a prostituição infanto-juvenil, em seguida ouve prostitutas adultas, uma militante dos direitos das prostitutas e também adolescentes envolvidas com o mercado sexual. A última etapa, de feições ensaísticas, constitui uma tentativa de vislumbrar possibilidades para uma sexualidade mais livre e de apontar trajetórias mais interessantes para a prostituição adulta e infanto-juvenil

Although overfishing is a concern for many fish stocks, it was for a long time only associated with commercial fishing exploitation, with less or no attention being given to the recreational fisheries. Recent research has shown however that the impact of recreational fishing on particular species can be considerable, and that the recreational harvest needs to be taken into account if fisheries are to be accurately assessed and effectively managed. In Portugal, the first recreational fishing regulations were only recently implemented. However, mirroring other European countries, regulations lacked scientific support, and specific knowledge of the activity was limited to a few studies with limited coverage. This thesis aimed to characterize the biological and socioeconomic aspects of the recreational shore angling activity in southern Portugal, to investigate whether the regulations in place were adequate and effective, and to provide recommendations for improved management and conservation of the inshore fisheries resources. A combined aerial-roving survey was conducted to gather data on fishing effort, catch, fishing trips and socioeconomic aspects (including anglers’ perceptions of regulations) of the recreational angling activity. The analysis of anglers’ catches suggested that compliance with daily bag limits was high, with less than 0.5% of creels exceeding the 10 kg angler-1 day-1 bag limit. Overall, 11.5% of the retained fishes were undersized, but non-compliance with minimum size limits was found to be high for some species (e.g. seabass, 73% undersized). In terms of the impact of recreational shore angling, the total estimated catches corresponded to less than 1% of the commercial landings for the same period (shared species). However, shore angling catches for white sea bream (Diplodus sargus) were found to be considerable, corresponding to 65% of the commercial landings (39.4% of total catch). In terms of anglers’ perceptions about the recreational fishing regulations in Portugal, the present study has shown that the majority of anglers accepted the existence of some kind of SRF regulations, but in general there was a partial or total disagreement with the recreational fishing restrictions recently put in place. Most anglers perceived themselves as not being involved in the decision-making process and claimed that some restrictions lacked a meaningful rationale (e.g. prohibition of fishing from piers/jetties). Fishers’ awareness with regard to specific aspects of the restrictions (such as the rationale for minimum size limits) was found to be very limited. During the same period, catches from sport fishing competitions were examined to test for differences with the recreational activity in terms of catches, and evaluate long term trends in catch and mean size of fish. Catches of the sport fishing competitions were found to be different from those observed for recreational fishing, being dominated by different species (e.g. garfish, mullets), and suggesting different fishing strategies of the the two types of anglers. High percentages of undersized fish were observed to be captured (and retained) during the competitions (in particular seabass, with 100% undersized), probably as a result of a single allowable minimum size (AMS) of 15 cm for all species in use in competitions. Lastly, catch and release fishing experiments were carried out to assess post-release mortality of three recreationally important species: two banded sea bream Diplodus vulgaris; black sea bream Spondyliosoma cantharus; and gilthead sea bream Sparus aurata. Post-release mortalities were found to be low (0-12%). The main predictor of mortality for Sparus aurata was anatomical hooking location, with 63% of the fishes that died being deeply hooked. The results support the release of fish, either from mandatory (e.g. minimum landing sizes) or voluntary practices. In summary, this thesis has demonstrated that the impact of recreational fishing for particular species is significant and needs to be taken into account for more effective management and stock assessment purposes. It has also highlighted several management issues that should be addressed in order to promote more adequate regulations in the future and prevent noncompliance issues. A periodic monitoring of the recreational fishing activity including all fishing modes (i.e. spear fishing, boat, and shore angling) would also be beneficial to ensure a timely knowledge on the global recreational fishing activity and support future management actions.

OBJECTIVES: To assess attitudes to HIV risk and acceptability of rapid HIV testing among clients of street-based female sex workers (FSW) in Lausanne, Switzerland, where HIV prevalence in the general population is 0.4%. METHODS: The authors conducted a cross-sectional study in the red light district of Lausanne for five nights in September of 2008, 2009 and 2010. Clients of FSW were invited to complete a questionnaire in the street assessing demographic characteristics, attitudes to HIV risk and HIV testing history. All clients interviewed were then offered anonymous finger stick rapid HIV testing in a van parked on-site. RESULTS: The authors interviewed 112, 127 and 79 clients in 2008, 2009 and 2010, respectively. All were men, average age 32-37 years old; 40-60% were in a stable relationship. History of unprotected sex was higher with non-commercial partners (33-50%) than with FSW (6-11%); 29-46% of clients had never undergone an HIV test. Anonymous rapid HIV testing was accepted by 45-50% of clients. Out of 109 HIV tests conducted during the three study periods, none was reactive. CONCLUSIONS: On-site HIV counselling and testing is acceptable among clients of FSW in this urban setting. These individuals represent an unquantified population, a proportion of which has an incomplete understanding of HIV risk in the face of high-risk behaviour, with implications for potential onward transmission to non-commercial sexual partners.

El objetivo de este trabajo de grado es describir una disputa política por el significado del concepto de explotación en el marco de la redacción del “Protocolo para prevenir, reprimir y sancionar la trata de personas, especialmente mujeres y niños”, en el cual se define aquello que se entiende por trata de personas. La construcción de este concepto excluye e invisibiliza otros tipos de explotación comunes en el sistema de producción capitalista contemporánea que pertenecen al universo de violencia objetiva sistémica a través del énfasis en la explotación sexual que hace parte de la violencia subjetiva.

El presente trabajo es una revisión de la literatura de investigación en Ciberpsicología centrada en las categorías de privacidad, intimidad, identidad y vulnerabilidad, y en la forma como estas se desarrollan en las redes sociales virtuales. Los principales hallazgos indicaron que son los jóvenes quienes dedican gran parte de su tiempo a interactuar en dichas redes, y a su vez, dado el manejo que les dan, tienen mayor exposición ante los posibles riesgos de estas, como el matoneo, las conductas auto lesivas, la explotación sexual y los trastornos de la alimentación. Se describen estos riesgos y se proponen posibles soluciones.

La presente monografía tiene por objetivo identificar la influencia de las acciones emprendidas por la sociedad civil y las organizaciones internacionales frente a la problemática de la trata de personas en Colombia, durante el período comprendido entre los años 2000 y 2012. En este sentido, la investigación constituye un esfuerzo por develar las transformaciones en las narrativas institucionales que han posibilitado el reconocimiento de los elementos de prevención y centralidad de las víctimas, como ejes articuladores del discurso gubernamental frente a la trata de personas. Para ello, se hace uso de la teoría de la gobernanza global enmarcada en el enfoque constructivista de las Relaciones Internacionales, en tanto permite establecer una relación entre las acciones de los diferentes actores y el impacto de estas en la construcción de estrategias nacionales para hacer frente a problemáticas que, como la trata de personas, se encuentran en estrecha relación con el mundo globalizado.

A presente dissertação elegeu como objeto de estudo a produção acadêmica brasileira sobre Tráfico de Pessoas, principalmente o tráfico de mulheres para fins de exploração sexual no Brasil. A pergunta orientadora da investigação foi: Como a perspectiva metodológica de articulação das categorias classe social, raça/etnia, gênero vem sendo trabalhada nas dissertações e teses que têm como objeto de estudo o tráfico de pessoas? As categorias de análise desta pesquisa foram: trafico de pessoas, tráfico de mulheres, gênero, classe social, raça/etnia. Objetivou-se conhecer como a perspectiva metodológica de articulação das categorias classe social, raça/etnia, gênero vem sendo trabalhada nas dissertações e teses que têm como objeto de estudo o tráfico de pessoas e tráfico de mulheres. A pesquisa desenvolvida foi ancorada na abordagem qualitativa com ênfase na revisão e análise bibliográfica de obras sobre as categorias e o conteúdo das dissertações e teses. De um universo de 20 (vinte) dissertações de mestrado e 01 (uma) tese de doutorado, 13 (treze) dissertações e uma tese, foram selecionadas. A abordagem metodológica pautada no materialismo histórico dialético vinculado pela articulação classe social, gênero, raça/etnia permitiu observar os avanços e os limites da referida proposta metodológica no exame dos estudos sobre tráfico de pessoas e de mulheres no Brasil. Os resultados permitiram concluir que embora a metodologia da articulação classe social, gênero, raça/etnia seja reconhecida pelos autores inexiste um aprofundamento analítico da proposta, observando-se uma centralidade na categoria gênero e na terminologia pobreza, como principais determinações do tráfico de pessoas, particularmente do tráfico de mulheres.

The concept of resilience is often situated in a dominant discourse that reflects medical and developmentalist epistemology, in Western models, with the ideology of white people, and middle class hegemonic norms. Behavior that falls outside of the normal, or what is socially acceptable, is associated with riskiness and tacitly if not explicitly labeled as pathological, and then, not resilient. However, the context of social injustice of many young people at-risk can have drastic effects on them. When we offer institutions such as schools that do not understand their needs, they may refuse our services and some of them may engage in antisocial activities, since they are looking for personal validation, pathways to recognize themselves, and places and organizations that contribute to the building of their social identity. This paper analyses how the denial of support and resources for the wellbeing of young people can lead them to situations that are socially unacceptable, such as sexual exploitation and drug trafficking. The main argument is that these activities, in the absence of conventional mechanisms, may bring some benefit to the subjects. Benefits may be in material conditions, though strongly marked by issues of social inequality; or subjective, in gaining relationships with people outside the normative places and institutions for young people. Unconventional circumstances produce unconventional attitudes that are expressed in alternative forms of resilience.

In this research, we discuss important aspects related to the scope of the adult female prostitution in a municipality located in the State of São Paulo, Brazil. We rely on the theoretical contributions provided by the Cultural Studies, the Queer Theory and other aspects referenced by gender studies, by sexualities and other subjective processes, in parallel with the analysis of the reported life stories of two women linked to the context of commercial sexual practice in the studied city. From the presented informations, we observed multiple stories of women in the process of resistance to some standards of femininity, and come to the conclusion that the economic factor is not always preponderant for the entry/residence in female commercial sex practice, especially today, when relationships tend be established by the confluence of multiple interests.

Una delle realtà criminali che ha maggiormente fruito delle innovazioni introdotte dalla “società dell’Informazione” è, senza dubbio, quella dell’abuso sessuale sui minori. Tra le differenti forme di abuso sessuale sui minori, si è scelto di affrontare il fenomeno della pedopornografia online in ragione del preoccupante diffondersi di questa forma di criminalità che, grazie all’implementazione delle tecnologie dell’informazione, ha assunto caratteri nuovi, per alcuni versi difformi dai “tradizionali” profili della pedofilia, che sollevano interrogativi e nuove sfide sia sul versante della repressione di queste condotte illecite, sia sul piano della prevenzione. Nell'ambito di questo contributo, saranno esaminate in particolare le politiche penali elaborate in due diverse realtà nazionali, l'Italia e la Francia, a partire da differenti punti di vista e ponendo particolare attenzione agli strumenti, normativi ed operativi, introdotti per reprimere lo sfruttamento sessuale dei minori legato alla dimensione virtuale.

L’obiettivo della ricerca è, da un lato, quello di definire un quadro conoscitivo di sfondo rispetto al fenomeno della tratta e dello sfruttamento sessuale di donne che approdano nel contesto italiano, dall’altro quello di esaminare gli interventi politici e legislativi posti in essere per contrastare il fenomeno e per tutelarne le vittime. Dopo uno sguardo alle caratteristiche strutturali della tratta, alla normativa italiana, europea e internazionale connessa al suo contrasto e alla protezione delle vittime e ai modelli di intervento sociale nel settore posti in essere nel nostro Paese, l’analisi si è concretizzata prendendo in considerazione i risultati emersi dall’attività di ricerca. L’analisi delle storie di vita delle vittime, di nazionalità nigeriana, albanese e serba ha permesso, da un lato, di evidenziare la complessità dei loro percorsi di vita e dall’altro di tracciare un quadro delle modalità organizzative e di sfruttamento utilizzate dal racket nigeriano e da quello albanese. Sul versante legislativo, invece, le interviste ai ricercatori svedesi sono state volte a comprendere se la normativa che punisce l’acquisto di prestazioni sessuali potesse avere un potere deterrente e, quindi, se potesse rappresentare una risposta efficace per arginare il fenomeno della prostituzione schiavizzata. In ultimo, dal punto di vista processuale, l’analisi delle sentenze giudiziarie penali emesse dal Tribunale di Rimini è stata utile per individuare le principali dinamiche che caratterizzano il rapporto tra l’autore e la vittima di reato e, non di meno, per sottolineare l’importanza del ruolo della vittima nel processo penale.

Human trafficking is a complex and multifaceted problem that takes the form of economic, physical and sexual exploitation of people, both adults and children, who are reduced to simple products for commerce. Human trafficking in the United States also has both a domestic and an international aspect. Health care providers are in a unique position to screen for victims of trafficking and may provide important medical and psychological care for victims while in captivity and thereafter. Trafficked persons are likely to suffer a wide spectrum of health risks that reflect the unique circumstances and experiences in a trafficked victim’s life. Although trafficked victims typically have experienced inadequate medical care, once contact is made by the victim with the health care professionals, the opportunity then exists to identify, treat, and assist such victims. The range of services and supports required to appropriately respond to human trafficking victims once identified is broad and typically goes beyond just what is immediately provided by the health care professional and includes safe housing, legal advice, income support, and, for international victims, immigration status related issues. An informed and responsive community is necessary to serve both the international and domestic victims of human trafficking, and needs assessments demonstrated a number of barriers that hindered the delivery of effective services to human trafficking victims. One of the consistent needs identified to combat these barriers was enhanced training among all professionals who might come in contact with human trafficking victims. We highlight the efforts of the Houston Rescue and Restore Coalition (HRRC), a local grassroots non-profit organization whose mission focuses on raising awareness of human trafficking in the Greater Houston Metropolitan area. HRRC responded to the consistent recommendation from various community needs assessments for additional training of front line professionals who would have the opportunity to identify human trafficking victims and supported the design and pilot testing of a health professions training program around human trafficking. Dissemination of this type of training along with careful evaluation and continued refinement will be one way for health care professionals to engage in a positive manner with human trafficking victims.

La présente recherche rend compte de la perception de leurs activités de huit femmes ayant pratiqué ou pratiquant toujours diverses formes d’activités sexuelles rémunérées dans un contexte hors rue. Les formes d’activités les plus souvent abordées sont la danse nue avec et sans contacts, l’escorte, le massage érotique et le phénomène communément appelé « sugar daddy », soit l’échange des services contre rémunération avec un client en particulier. Deux participantes de l’échantillon ont, parallèlement à leurs pratiques hors rue, exercé dans la rue. Le terme « pratiques sexuelles rémunérées » a été privilégié afin d’assurer une perspective neutre, c’est-à-dire sans parti pris a priori pour aucune des deux visions préexistantes par rapport au phénomène se situant à deux extrémités de ce que nous percevons plutôt être un continuum, soit la vision abolitionniste voulant que la « prostitution » soit une forme d’exploitation et de violence sexuelle commise principalement à l’égard des femmes, qui devrait être décriminalisée pour les femmes, mais criminalisée pour les clients et les proxénètes, et la vision soutenant que le « travail du sexe » est un choix qui constitue un travail comme un autre et, conséquemment, mérite d’être décriminalisé complètement, et ce, même pour les clients et les proxénètes. Notre approche visait essentiellement à permettre d’aller chercher les visions subjectives des femmes sur leur pratique, point de vue que nous retrouvons peu dans les écrits et les débats sur le sujet. La cadre théorique qui sous-tend notre analyse est celui de l’intersectionnalité. Les principales sources de discrimination ressorties sont l’âge, le statut socioéconomique, et l’origine ethnique pour une participante. Ces sources augmentent les facteurs de vulnérabilité faisant que les femmes se dirigent vers l’univers des pratiques sexuelles rémunérées, y demeurent ou parfois y retournent après un arrêt, ceci afin d’assurer leur subsistance, la consommation de substances psychoactives ou pour pouvoir rembourser des dettes et/ou se payer certains luxes. Le but de notre étude est de découvrir et de comprendre la perception des femmes quant à leur expérience associée à la pratique de différentes formes d’activités sexuelles rémunérées hors rue. Il s’agissait plus spécifiquement de décrire, comprendre et analyser la trajectoire ayant conduit les femmes vers la pratique d’activités sexuelles rémunérées; comprendre leurs trajectoires et leurs expériences en fonction des différents types de pratique, plus ou moins intense, plus ou moins variée et plus ou moins étendue dans le temps et, enfin, de situer leur perspective sur le continuum du débat social positionnant la pratique d’activités sexuelles rémunérées comme étant soit une forme d’exploitation ou une forme de travail comme un autre. Afin d’atteindre ces objectifs, une approche qualitative faite d’entretiens semi-dirigés auprès des femmes a été réalisée. Nous avons ainsi pu situer les perspectives des femmes sur un continuum où plusieurs trouvaient leur place dans des visions plus nuancées de leur réalité, alors que d’autres rejoignaient davantage une des deux visions polarisées. En effet, certaines ont vécu leur expérience essentiellement comme une forme d’exploitation et de violence à leur égard, alors que d’autres en traitent comme un choix et un travail comme un autre.
