This thesis contains four different studies on the dynamics of gender in households and workplaces. The relationship between family life and work life is in focus, particularly in the paper on labour market outcomes after divorce. In the introductory chapter, the Swedish context is briefly described. The description focuses on gender differences in the labour market and in the home. Theories concerning the division of work in the household are discussed, as are two theories on labour market discrimination, viz. taste discrimination and statistical discrimination. The theory part is concluded with a discussion of social closure processes and gendered organizational structures. The Reproduction of Gender. Housework and Attitudes Towards Gender Equality in the Home Among Swedish Boys and Girls. The housework boys and girls age 10 to 18 do, and their attitudes towards gender equality in the home are studied. One aim is to see whether the work children do is gendered and if so, whether they follow their parents’, often gendered, pattern in housework. A second aim is to see whether parents’ division of work is related to the children’s attitude towards gender equality in the home. The data used are taken from the Swedish Child Level of Living Survey (Child-LNU) 2000. Results indicate that girls and boys in two-parent families are more prone to engage in gender-atypical work the more their parent of the same sex engages in this kind of work. The fact that girls still do more housework than boys indicates that housework is gendered work also among children. No relation between parents’ division of work and the child’s attitude towards gender equality in the home was found. Dependence within Families and the Household Division of Labor – A Comparison between Sweden and the United States. This paper assesses the relative explanatory value of the resource-bargaining perspective and the doing-gender approach in analysing the division of housework in the United States and Sweden from the mid-1970s to 2000. Data from the Swedish Level of Living Survey (LNU) and the Panel Study of Income Dynamics (PSID) were used. Overall results indicate that housework is truly gendered work in both countries during the entire period. Even so, the results also indicate that gender deviance neutralization is more pronounced in the United States than in Sweden. Unlike Swedish women, American women seem to increase their time spent in housework when their husbands are to some extent economically dependent on them, as if to neutralize the presumed gender deviance. Divorce and Labour Market Outcomes. Do Women Suffer or Gain? In this paper, the interconnected nature of work and family is studied by looking at labour market outcomes after divorce. The data used are retrospective work and family histories collected in LNU 1991. A hazard regression model with competing risks reveals that women’s chances of improving their occupational prestige appear to be better after divorce compared to before. Increased working hours and perhaps also increased energy invested in the job may pay off in better occupational opportunities. Worth noting, however, is that the outcome among women with a less firm labour market attachment is more often to a job of lower prestige than one of higher prestige. Hence, the labour market outcome for women after divorce is to some extent conditioned by their labour market attachment at the time of divorce. Men, on the other hand, in most cases seem to suffer occupationally from divorce. For separated men the risk of negative changes in occupational prestige is greater than for cohabiting men. Formal On-the-job Training. A Gender-Typed Experience and Wage- Related Advantage? Formal on-the-job training (FOJT) can have a positive impact on wages and on promotion opportunities. According to theory and earlier research, a two-step model of gender inequality in FOJT is predicted: First, women are less likely than men to take part in FOJT and, second, once women do get the more remunerative training, they are not rewarded for their new skills to the same extent as men are. Pooled cross-sectional data from the Swedish Survey of Living Conditions (ULF) in the mid-nineties were used. Results show that women are significantly less likely than men to take part in FOJT. Among those who do receive training, women are more likely to take part in industry-specific training, whereas men are more likely to participate in general training and training that increases promotion opportunities. The two latter forms of training significantly raise a man’s annual earnings but not a woman’s. Hence, the theoretical model is supported and it is argued that this gender inequality is partly due to employers’ discriminatory practices.

Mehr als die Hälfte aller HIV-positiven Tansanier sind Frauen. Ihre schwächere gesellschaftliche Stellung ist einer der Faktoren, der dazu beiträgt, dass sie einem erhöhten Infektionsrisiko ausgesetzt sind. Aufgrund geringerer Bildungschancen und einer anhaltenden gesellschaftlichen Idealvorstellung von der Frau als Mutter sind Frauen auch auf dem Arbeitsmarkt benachteiligt. Im Kontext von HIV/AIDS werden afrikanische Frauen häufig als passive Opfer der Epidemie dargestellt und es wird zu selten aufgezeigt, wie sie als Akteure eigene Strategien im Kampf gegen die Krankheit entwickeln. In letzter Zeit gewinnen Frauenorganisationen an Bedeutung, denn viele Frauen wollen ausdrücklich eigenverantwortlich und ohne Männer arbeiten. Eine solche Organisation ist die in meiner Arbeit vorgestellte NGO KIWAMWAKU („Kikundi cha Wanawake Mwanga kupambana na Ukimwi“ – Vereinigung von Frauen aus Mwanga zum Kampf gegen AIDS). Meine Forschung hat gezeigt, dass Frauen ihre gesellschaftliche Stellung durch das Engagement in einer NGO verbessern können. Sie können ein eigenes Einkommen erwirtschaften und nützliche Kenntnisse etwa in der Führung einer Organisation erlangen. Allerdings profitieren nicht alle Beteiligten gleichermaßen. Die drei Leiterinnen der erforschten NGO verfügten über die meisten Vorteile; sie profitierten finanziell, aber auch ideell, denn sie genossen durch ihre Arbeit hohes Ansehen im gesamten Mwanga-Distrikt. Dagegen konnten einige der Klientinnen nur in sehr geringem Maße von Interventionen profitieren. Letztlich bin ich jedoch überzeugt davon, dass durch solche Frauenorganisationen ein wichtiger Prozess angestoßen worden ist, durch den Frauen mittel- oder langfristig eine stärkere Stellung innerhalb der tansanischen Gesellschaft erlangen können, was sich wiederum positiv auf die immer noch steigenden HIV/AIDS-Infektionsraten auswirken kann.

Intorno alla metà degli anni trenta la Spagna diventò il centro dell’attenzione del mondo e tutte le grandi potenze internazionali, vecchie e nuove, vennero coinvolte, in misura diversa, nella guerra civile. Già nell’agosto del 1936, un mese dopo l’esplosione del conflitto, tutti gli Stati più rappresentativi caldeggiavano l’ipotesi di una politica comune di “non intervento”. Il ruolo guida in tal senso venne assunto dal governo inglese, capace di dissuadere, in tempi estremamente rapidi, il governo frontista francese di Leon Blum dall’intento di sostenere economicamente e militarmente il legittimo governo repubblicano spagnolo. La preoccupazione che il conflitto potesse degenerare in uno scontro più generale fu quindi la ragione principale per la quale qualche settimana dopo nacque il “Comitato di Non Intervento”, cui aderirono ben ventisette nazioni europee tra cui Francia, Inghilterra, URSS, Italia, Germania e Portogallo. Il mio progetto di ricerca dottorale esamina il ruolo, le scelte ed i relativi dibattiti in merito all’unica grande potenza, gli Stati Uniti d’America, che, pur scegliendo di rimanere neutrale, si astenne dal partecipare al suddetto Comitato. In ambito statunitense particolare rilievo assumono due aspetti del dibattito politico sulla Spagna: il primo maturato in seno all’Amministrazione Roosevelt, il secondo elaborato dalla componente Liberal della coalizione del New Deal attraverso i settimanali, “The Nation” e “The New Republic”. Il confronto pubblico acceso dalla guerra civile spagnola fu infatti l’occasione per la società civile americana per dibattere apertamente e francamente circa l’opportunità e la capacità della nazione di assumere o meno un ruolo internazionale corrispondente al prestigio socio-economico in via di acquisizione a livello mondiale. Approfondire ed esaminare il dibattito sulla guerra civile spagnola negli USA significa dunque andare alla ricerca delle radici culturali di quello che sarà uno dei più vasti ed articolati confronti politici e teorici del ventesimo secolo: l’internazionalismo americano.

Welche Literatur liegt im Trend? Welche Aktionen und Instrumente bietet der Markt, um Bücher an den Leser zu vermitteln? Wie lässt sich das gegenwärtige Literaturverständnis beschreiben – auch in Abgrenzung und im Vergleich zu den etablierten Literaturtheorien? Diese allgemeinen Fragen wurden in der vorliegenden Arbeit spezialisiert und auf Schwerpunkte konzentriert. In den Vordergrund rückte – unter dem Aspekt des Zeitgeistphänomens – die junge deutsche Literatur, auf die bei diesem Projekt aus persönlichem Interesse heraus der Fokus gelegt wurde. Erforscht wurde, welche Bücher, Themen und Autoren zeitweise populär waren, wie es um Status und Selbstpräsentation letztgenannter bestellt war und ist. Als Beispiele zu nennen sind Benjamin von Stuckrad-Barre und Florian Illies, beide sich ihres (Markt-)Wertes wohl bewusste Vertreter der Pop- und Generationsliteratur, die in den letzten Jahren einen Boom erlebte. Beide Schriftsteller wurden mit ihren Werken einer detailgenauen Analyse unterzogen. Spricht man über Literatur, ist es unumgänglich, das – vorherrschende – nicht unproblematische Literaturverständnis zu durchleuchten. Galten Bücher einst als Status- und Bildungssymbol, ist von dieser Wertschätzung und von solch hohem Prestige heute nicht mehr allzu viel vorhanden. Das Erarbeiten eines Literaturbegriffs bot sich in der Auseinandersetzung mit in der Germanistik gängigen Theorien an (z. B. Empirische Theorie der Literatur nach S. J. Schmidt). Reduzierte man (als ein Ergebnis) Leistung und Wert von Literatur tatsächlich nur noch auf reine, unkomplizierte und schnelllebige Unterhaltung, führte dies zwangsweise zur Frage nach einer Medienkonkurrenz in erster Linie mit dem Fernsehen, dann mit dem Computer und seinen Möglichkeiten. Im dritten und letzten Abschnitt der Arbeit wurde anhand von ausgewählten Beispielen dargestellt, wie das gegenwärtige Literaturverständnis mit dem Markt konform geht, sprich welche Aktionen an der Schnittstelle Markt – Leser stattfinden, mit denen letztere auf Literatur aufmerksam gemacht und zum Lesen animiert werden sollen. In diesem Rahmen wurde u. a. das System der Literaturkritik knapp beschrieben und anhand von drei aktuellen Rezensionsbeispielen veranschaulicht.

La tesi ha come oggetto il rinnovamento urbano che fu realizzato a Faenza per opera del suo signore Carlo II Manfredi tra il 1468 e il 1477, d’accordo con il fratello, il vescovo Federico. La prima opera realizzata da Carlo fu il portico a due livelli che dotò di una nuova facciata il suo palazzo di residenza, di origini medievali. Questa architettura sarebbe stata il preludio di un riordino generale della piazza principale della città, probabilmente allo scopo di ricreare un foro all’antica, come prescritto dai trattati di Vitruvio e di Alberti. L’aspetto originale del loggiato rinascimentale, desumibile da documentazione archivistica e iconografica, permette di attribuirlo con una certa probabilità a Giuliano da Maiano. Oltre alla piazza, Carlo riformò profondamente il tessuto urbano, demolendo molti portici lignei di origine medievale, rettificando le principali strade, completando la cerchia muraria. Federico Manfredi nel 1474 diede inizio alla fabbrica della Cattedrale, ricostruita dalle fondamenta su progetto dello stesso Giuliano da Maiano. L’architettura della chiesa ha uno stile largamente debitore all’architettura sacra di Brunelleschi, ma con significative differenze (come la navata definita da un’alternanza tra pilastri e colonne, o la copertura composta da volte a vela). L’abside della cattedrale, estranea al progetto maianesco, fu realizzata nel 1491-92 e mostra alcuni dettagli riconducibili alla coeva architettura di Bramante. A Faenza si realizza in un periodo di tempo brevissimo una profonda trasformazione del volto della città: loggiato, riforma della piazza, riordino delle strade, una nuova cattedrale, tutto contribuisce a dare lustro ai Manfredi e a fare di Faenza una città moderna e in cui si mettono in pratica, forse per la prima volta nell’Italia settentrionale, i dettami di Vitruvio e di Alberti.

Gegenstand meiner Arbeit ist das Bettpaneel von Ugarit und seine komplexe Ikonographie, die Motive unterschiedlicher künstlerischer Traditionen des Alten Orients vereint. Das Bettpaneel bietet die einmalige Gelegenheit, das gesamte Bildprogramm eines Möbels zu untersuchen und die Entwicklung des levantinischen Kunsthandwerks der Späten Bronzezeit (2. Hälfte des 2. Jt.s v. Chr.) besser zu verstehen, besonders in Bezug auf Prestigegüter. Bereits 1952 ist das Bettpaneel im Königspalast von Ugarit entdeckt, jedoch bisher noch nicht monographisch abhandelt worden.rnEs wird gezeigt, dass das Bettpaneel von Ugarit ein hervorragendes Erzeugnis des lokalen Kunsthandwerks ist, gleichzeitig aber die kontinuierliche Übernahme fremder Motive bezeugt.rnWelche Vorbilder haben diese Rezeption begünstigt? Handelte es sich dabei um bewusste Anpassung an heimische Vorstellungen oder vielmehr um getreue Wiedergabe? Warum ließen sich die ugaritischen Handwerker von fremden Kunsttraditionen inspirieren? rnDank der detaillierten Untersuchung des Bettpaneels von Ugarit lassen sich diese wesentlichen Fragen über die Mechanismen der sozialen und kulturellen Interaktionen zwischen den Zivilisationen des Ostmittelmeergebiets im 2 Jt.s v. Chr. endgültig antworten.

A fair number of Cicero's letters reveal his concern for his daughter Tullia and his son Marcus. Recent scholarship has read these letters as evidence for a ‘natural’ emotional attachment of a father to his children, in reaction to Philippe Ariès's opposite claim. This chapter considers whether Cicero's letters can be analysed only as expressions of paternal affection. The fact that the pater familias Cicero occupies a political position simultaneously in his nuclear family, his domus, and the Senate, results in a concern for his prestige within the social field of the aristocracy. And this concern is necessarily conferred upon his support of the education and the social and political career of his children. The chapter traces the gender-specific differences between Cicero's treatment of Tullia and Marcus, shows the social construction of parental affection, and contributes to a further understanding of the different functions of daughters and sons in the social force field of family memory.

The transformation of the 1990s has had a bearing on the academic and scientific world, as is becoming increasingly obvious with the changing numbers of foreign students wishing to study in the Czech Republic and of Czech students wishing to study abroad, the virtual collapse of doctoral studies, and the rapidly increasing age of Czech academics (placed at 48 by official sources and at rather more by this research). At the same time there is an apparent lack of interest in analysing and understanding these trends, which Mr. Cermak terms an ostrich policy, although his research showed that academics are in fact both aware and concerned about them. The mid-1990s migration of talent to and from R+D in the Czech Republic is also reflected in the number of talented Czech students studying abroad, who represent the largest and most interesting group of actual and potential migrants. Mr. Cermak's study took the form of a Delphi enquiry participated in by 44 specialists, including experts in the problems of higher education and science policy from the Presidium of the Higher Education Council (n = 23), members of the Council's Science and Research Commission (n = 14), former and current managers of higher education authorities (n = 4) and selected participants of the longitudinal talent research (n = 3). Questions considered included the influence of continuing talent migration from domestic R+D on the efficiency of domestic higher education, the diversification of forms of the brain drain and their impact on other processes in society, the possibility of positive influence on the brain drain processes to minimise the risks it presents, and the use of the knowledge obtained about the brain drain. The study revealed a clear drop of interest in brain drain problems in higher education in the mid-1990s, which is probably related to the collapsed of Czech R+D in the field of talent education. The effects on this segment of the labour market appeared earlier, with a major migration wave in 1991-1993 which significantly "cleared" the area of scientific talent. In addition, prospective talents from the ranks of younger students have not been integrated into domestic R+D, leading to the increasing average age of those working in this field. "Talent scouting" tended to be oriented towards much younger individuals, even in some cases towards undergraduate students. The R+D institutions deprived of human resources considered as basic in a functional R+D system have lost much of their dynamism and so no longer attract not only domestic talent but also talent from other regions. As a result the public, including the mass media and political structures, have stopped regarding the support of domestic science as a priority. This is clear both among the young people who are important for the future development of R+D (support for the education of talented children has dropped), from the drop in the prestige of this area as a profession among university students, and from the lack of explicit support for R+D by any of the political parties. On the basis of his findings Mr. Cermak concludes that there is no basis for the belief that the brain drain will represent a positive force in stimulating the development of the open society. Migration data shows that the outflow of talent from the Czech Republic far exceeds the inflow, and that the latter is largely short-term. Not only has the number of returning Czech professors dropped to half of its level at the beginning of the 1990s, but they also tend to take up only short-term contracts and retain their foreign positions. Recruitment of scientific talent from other countries, including the Slovak Republic, is limited. Furthermore internal contacts between those already involved in R+D have been badly hit by economic pressures and institutional co-operation has dropped to a minimum. There have been few moves to counteract this situation, the only notable one being the Program 250, launched in 1996 with government support to try and attract younger (i.e. under 40) talent into R+D. Its resources are however limited and its effects have not so far been evaluated. The deficit of academic and scientific talent in the Czech Republic is increasing and two major directions of academic work are emerging. Classic higher education science based on the teaching process is declining, largely due to economic factors, while there is an increasing emphasis on special; ad hoc projects which cannot be related directly to teaching but are often interesting to specialists outside the Czech Republic. This is shown clearly by the increase in publishing and in participation in domestic and foreign grant projects, which often serve to supplement the otherwise low salaries in the higher education sector. This tend was also accelerated by the collapse of applied R+D in individual sectors of the national economy and by substantial cutbacks in the Czech Academy of Sciences, which formerly fostered such research. Some part of the output of this research can be used in the education system and its financial contribution does significantly affect the stability of the present staff, but Mr. Cermak sees it as generally unfavourable for the development of talent education. In addition, it has led to a certain resignation on the question of integration into international structures, due to the emphasis on short-term targets, commercial advantages and individualism rather than team work. At the same time, he admits that these developments reflect those in other areas of the transformation in the Czech Republic.

This project looked at the nature, contents, methods, means and legal and political effects of the influence that constitutional courts exercise upon the legislative and executive powers in the newly established democracies of Central and Eastern Europe. The basic hypothesis was that these courts work to provide a limitation of political power within the framework of the principal constitutional values and that they force the legislature and executive to exercise their powers and duties in strict accordance with the constitution. Following a study of the documentary sources, including primarily the relevant constitutional and statutory provisions and decisions of constitutional courts, Mr. Cvetkovski prepared a questionnaire on various aspects of the topics researched and sent it to the respective constitutional courts. A series of direct interviews with court officials in six of the ten countries then served to clarify a large number of questions relating to differences in procedures etc. that arose from the questionnaires. As a final stage, the findings were compared with those described in recent publications on constitutional control in general and in Central and Eastern Europe in particular. The study began by considering the constitutional and political environment of the constitutional courts' activities in controlling legislative and executive powers, which in all countries studied are based on the principles of the rule of law and the separation of powers. All courts are separate bodies with special status in terms of constitutional law and are independent of other political and judicial institutions. The range of matters within their jurisdiction is set by the constitution of the country in question but in all cases can be exercised only with the framework of procedural rules. This gives considerable significance to the question of who sets these rules and different countries have dealt with it in different ways. In some there is a special constitutional law with the same legal force as the constitution itself (Croatia), the majority of countries allow for regulation by an ordinary law, Macedonia gives the court the autonomy to create and change its own rules of procedure, while in Hungary the parliament fixes the rules on procedure at the suggestion of the constitutional court. The question of the appointment of constitutional judges was also considered and of the mechanisms for ensuring their impartiality and immunity. In the area of the courts' scope for providing normative control, considerable differences were found between the different countries. In some cases the courts' jurisdiction is limited to the normative acts of the respective parliaments, and there is generally no provision for challenging unconstitutional omissions by legislation and the executive. There are, however, some situations in which they may indirectly evaluate the constitutionality of legislative omissions, as when the constitution contains provision for a time limit on enacting legislation, when the parliament has made an omission in drafting a law which violates the constitutional provisions, or when a law grants favours to certain groups while excluding others, thereby violating the equal protection clause of the constitution. The control of constitutionality of normative acts can be either preventive or repressive, depending on whether it is implemented before or after the promulgation of the law or other enactment being challenged. In most countries in the region the constitutional courts provide only repressive control, although in Hungary and Poland the courts are competent to perform both preventive and repressive norm control, while in Romania the court's jurisdiction is limited to preventive norm control. Most countries are wary of vesting constitutional courts with preventive norm control because of the danger of their becoming too involved in the day-to-day political debate, but Mr. Cvetkovski points out certain advantages of such control. If combined with a short time limit it can provide early clarification of a constitutional issue, secondly it avoids the problems arising if a law that has been in force for some years is declared to be unconstitutional, and thirdly it may help preserve the prestige of the legislation. Its disadvantages include the difficulty of ascertaining the actual and potential consequences of a norm without the empirical experience of the administration and enforcement of the law, the desirability of a certain distance from the day-to-day arguments surrounding the political process of legislation, the possible effects of changing social and economic conditions, and the danger of placing obstacles in the way of rapid reactions to acute situations. In the case of repressive norm control, this can be either abstract or concrete. The former is initiated by the supreme state organs in order to protect abstract constitutional order and the latter is initiated by ordinary courts, administrative authorities or by individuals. Constitutional courts cannot directly oblige the legislature and executive to pass a new law and this remains a matter of legislative and executive political responsibility. In the case of Poland, the parliament even has the power to dismiss a constitutional court decision by a special majority of votes, which means that the last word lies with the legislature. As the current constitutions of Central and Eastern European countries are newly adopted and differ significantly from the previous ones, the courts' interpretative functions should ensure a degree of unification in the application of the constitution. Some countries (Bulgaria, Hungary, Poland, Slovakia and Russia) provide for the constitutional courts' decisions to have a binding role on the constitutions. While their decisions inevitably have an influence on the actions of public bodies, they do not set criteria for political behaviour, which depends rather on the overall political culture and traditions of the society. All constitutions except that of Belarus, provide for the courts to have jurisdiction over conflicts arising from the distribution of responsibilities between different organs and levels in the country, as well for impeachment procedures against the head of state, and for determining the constitutionality of political parties (except in Belarus, Hungary, Russia and Slovakia). All the constitutions studied guarantee individual rights and freedoms and most courts have jurisdiction over complaints of violation of these rights by the constitution. All courts also have some jurisdiction over international agreements and treaties, either directly (Belarus, Bulgaria and Hungary) before the treaty is ratified, or indirectly (Croatia, Czech Republic, Macedonia, Romania, Russia and Yugoslavia). In each country the question of who may initiate proceedings of norm control is of central importance and is usually regulated by the constitution itself. There are three main possibilities: statutory organs, normal courts and private individuals and the limitations on each of these is discussed in the report. Most courts are limited in their rights to institute ex officio a full-scale review of a point of law, and such rights as they do have rarely been used. In most countries courts' decisions do not have any binding force but must be approved by parliament or impose on parliament the obligation to bring the relevant law into conformity within a certain period. As a result, the courts' position is generally weaker than in other countries in Europe, with parliament remaining the supreme body. In the case of preventive norm control a finding of unconstitutionality may act to suspend the law and or to refer it back to the legislature, where in countries such as Romania it may even be overturned by a two-thirds majority. In repressive norm control a finding of unconstitutionality generally serves to take the relevant law out of legal force from the day of publication of the decision or from another date fixed by the court. If the law is annulled retrospectively this may or may not bring decisions of criminal courts under review, depending on the provisions laid down in the relevant constitution. In cases relating to conflicts of competencies the courts' decisions tend to be declaratory and so have a binding effect inter partes. In the case of a review of an individual act, decisions generally become effective primarily inter partes but is the individual act has been based on an unconstitutional generally binding normative act of the legislature or executive, the findings has quasi-legal effect as it automatically initiates special proceedings in which the law or other regulation is to be annulled or abrogated with effect erga omnes. This wards off further application of the law and thus further violations of individual constitutional rights, but also discourages further constitutional complaints against the same law. Thus the success of one individual's complaint extends to everyone else whose rights have equally been or might have been violated by the respective law. As the body whose act is repealed is obliged to adopt another act and in doing so is bound by the legal position of the constitutional court on the violation of constitutionally guaranteed freedoms and rights of the complainant, in this situation the decision of the constitutional court has the force of a precedent.

Practice is subject to increasing pressure to demonstrate its ability to achieve outcomes required by public policy makers. As part of this process social work practice has to engage with issues around advancing knowledge-based learning processes in a close collaboration with education and research based perspectives. This has given rise to approaches seeking to combine research methodology, field research and practical experience. Practice research is connected to both “the science of the concrete” – a field of research oriented towards subjects more than objects and “mode 2 knowledge production” – an application-oriented research where frameworks and findings are discussed by a number of partners. Practice research is defined into two approaches: practice research – collaboration between practice and research – and practitioner research – processes controlled and accomplished by practitioners. The basic stakeholders in practice research are social workers, service users, administrators, management, organisations, politicians and researchers. Accordingly, practice research is necessarily collaborative, involving a meeting point for different views, interests and needs, where complexity and dilemmas are inherent. Instead of attempting to balance or reconcile these differences, it is important to respect the differences if collaboration is to be established. The strength of both practice and research in practice research is to address these difficult challenges. The danger for both fields is to avoid and reject them.

Rechtsnormen als Texte – Versuch einer Zusammenführung von Rechtstheorie und Linguistik: Rechtstheoretiker sind sich zwar bewusst, dass Recht wesentlich Sprache ist; diese Voraussetzung wird aber in der konkreten Analyse von Rechtsnormen und ihrer Struktur nur selten systematisch berücksichtigt; zumeist wird von der konkreten sprachlichen Form abgesehen oder der einzelne Satz wird als formale Größe absolut gesetzt. Dazu werden auch meist wichtige Erkenntnisse der Linguistik kaum berücksichtigt, etwa grundlegende Differenzierungen wie jene zwischen Satz und Text bzw. Grammatik und Äußerung oder Ausdruck und Inhalt. Dieser Beitrag versucht, Rechtsnormen als geschriebene Texte sui generis, d. h. als sprachliche Objekte, ernst zu nehmen und aus einem textlinguistischen Blickwinkel zu betrachten, durchaus im Horizont der Rechtstheorie und deren Erkenntnisinteresse, und die grundlegenden Eigenschaften von Rechtsnormen aus dieser zweifachen Perspektive deutlicher zu klären, etwa in Bezug auf die innere Struktur von Rechtsnormen, auf eine Typologie von Rechtsnormen, die Bedeutung von einzelnen Normen, das Verhältnis von innerer Struktur und äusserer Form oder die Adressatenfrage.

The situation once described by Hoffmann (1985), in which children grow up exposed to three languages from an early age, is a reality for an increasing number of families. In Europe – as elsewhere – greater mobility is leading to greater numbers of mixed-language couples (Piller 2002), and, by extension, multilingual families. For such families, questions concerning the acquisition and maintenance of three or more languages in a natural environment are of direct relevance. Researchers in bilingualism have already pointed out the importance of social context for the acquisition of two languages in childhood, focusing in particular on the quantity and quality of exposure to the languages (De Houwer 1990; Döpke 1992; Okita 2002; Lanza 2004) or the prestige of the languages (Lambert 1977). In this paper, I will make use of the insights gained by such researchers and test them in a trilingual setting. The paper will focus mainly on one aspect, namely the conversational style of parents and caretakers. The data come from research being carried out in Switzerland and consist of 33 interviews with multilingual families, as well as case studies of two trilingual children. The findings attest to the importance of conversational style, but at the same time indicate that a number of further factors are also of great significance.

Connus sous le nom populaire de palafittes, les habitats préhistoriques construits sur les rives des lacs subalpins du Néolithique à l’aube de l’âge du Fer (entre 5300 et 700 av. J.-C.) offrent des informations exceptionnelles sur l’évolution culturelle d’une importante région européenne, grâce à la préservation remarquable des matériaux organiques, en particulier du bois. À partir de la deuxième moitié du XXe siècle, le perfectionnement des techniques de fouille subaquatiques et de la dendrochronologie permettront la construction d’un schéma chronologique précis pour l’Europe nord-alpine. Les recherches contribueront à des observations d’ordre écologique à l’échelle locale et régionale et à l’identification des rythmes de développement des villages. Sous l’égide de l'UNESCO, les années 2010 verront la constitution d’un inventaire vaste et uniforme des sites préhistoriques des lacs circumalpins, classés Patrimoine culturel mondial en juin 2011. De nombreux objets préhistoriques, romains et médiévaux ont été découverts entre 2003 et 2010, au Schnidejoch, un col des Alpes bernoises occidentales à 2756 m d’altitude, à la frontière entre les cantons de Berne et du Valais. Les hautes températures de l'été 2003 ont provoqué la fonte d'un petit champ de glace et mis en lumière les vestiges. Les recherches ont été programmées à la suite d’une série d’informations fournies par des randonneurs. Les objets en matière organique (bois, écorce de bouleau, cuir, fibres végétales) revêtent une très grande importance car ils ont permis l’obtention de plus d’une cinquantaine de datations radiocarbone ; elles indiquent le passage du col entre la moitié du Ve millénaire av. J.-C. et l’année 1000 de notre ère. En outre, les séries de datations suggèrent l’alternance de périodes de praticabilité et d’inaccessibilité du col. Le Schnidejoch est actuellement le plus ancien témoignage de la traversée des Alpes, reliant l‘Oberland bernois par les vallées de la Simme et du Rhône.

The Free City of Danzig was founded by the Allies after World War One to settle the conflict between Poles and Germans as to which territory the town belonged. The League of Nations was designated to be the guarantor of its status. British and American experts and policy advisors saw it as an experiment on the way to new forms of statehood, by means of which nationalism as the founding principle of territorial entities could be overcome. However, the „Free City“ status was rejected by both the city’s inhabitants and German and Polish government agencies, with the result that the League and its local representative, the High Commissioner, were constantly confronted with difficulties in the interpretation of the international treaties and conventions relating to Danzig. In addition, hardly anyone in Danzig, Germany or Poland was interested in the economic and financial situation of the Free City, but were more interested in winning political battles than in the well-being of the city and its inhabitants. As a result, the situation in Danzig became more and more hopeless. The city became increasingly dependent on (illegal) German subsidies, while the High Commissioners generally cared more about their own prestige and that of their home countries than about the interests of the League of Nations. But as no political means of modifying the city’s status had been provided for, nothing changed formally in Danzig until Germany started the Second World War and annexed the city in September 1939. In retrospect, the international control of local government could not contribute to a long-term solution for Danzig. It merely postponed its violent solution for twenty years.

1865, vier Jahre vor seinem Tod, schenkt der Bieler Sammler Friedrich Schwab seine archäologischen Objekte der Stadt. Er möchte damit den Bewohnern Biels, vor allem der Jugend, einen reichen Fundus zur Verfügung stellen, der einen Einblick in den Alltag der prähistorischen Bewohner der Region bietet. Bis heute ist die Sammlung Schwab ein Studienobjekt für Archäologen geblieben und inspiriert Öffentlichkeit und Schulklassen: So sieht Friedrich Schwab seinen Willen auch nach bald 150 Jahren noch immer erfüllt. Die vorliegende Publikation erläutert die wechselvolle Geschichte des Museums Schwab und bietet gleichzeitig einen Überblick über die archäologische Erforschung der Drei-Seen-Region: von der Entdeckung der ersten Pfahlbausiedlungen bis zu ihrer Aufnahme in das UNESCO Welterbe. Sie folgt den Sammlungen eines Universalmuseums auf ihrer Odyssee, weist auf Details einer einmaligen Architektur hin und zeigt die Zusammenhänge zwischen Kulturpolitik und der aktuellen Bieler Museumslandschaft auf.
