The Scottish Court of Session, drawing upon principles of the civil law tradition, as well as arguments concerning broader national, social and cultural interests, reject the concept of copyright at common law - a decision that is in direct conflict with that of Millar v. Taylor (1769). Lord Monboddo provides the dissenting opinion, drawing upon the labour theory of property rights, and argues for a unified approach to the issue in relation to the common law of both England and Scotland.
Drawing upon Scottish Records Office archives the commentary explores the background to, and substance of, the decision. It suggests that, given the nature of the economic threat which the Scottish reprint industry posed to the London book trade, particularly in relation to an increasingly lucrative export market, Hinton undermined much of the value of the decision in Millar. The conflict between Millar and Hinton made it almost inevitable that the question of literary property would soon reach the House of Lords.

Legislation providing that the British monarch could, by Order in Council, grant copyright protection, within Britain and its Dominions, to the authors of literary works first published abroad for a period specified within the Order but not exceeding the domestic copyright term. The Act provided the first occasion on which the British legislature offered the possibility of copyright protection for the work of foreign authors. Its timing is indicative of the widespread attention which the issue of international copyright had begun to attract in Britain, on the continent, and in the United States. The commentary describes the background to the legislation in relation to British attitudes to the importation of foreign works throughout the sixteenth, seventeenth and eighteenth centuries, and in the context of early nineteenth century debates before the courts as to whether the work of foreign authors was in any event protected under existing legislative measures (see also: uk_1854). The commentary also explores the reasons for the failure of the British government to successfully negotiate any bilateral agreements under the legislation, but nevertheless suggests that the 1838 Act provided an important platform upon which to build a subsequent and more successful regime of international copyright protection (see also: uk_1844; uk_1852; uk_1886).

L'impact de la création littéraire a été étudié chez des adolescents atteints d'une maladie chronique au CHU Sainte-Justine de Montréal. Cette recherche est exploratoire car la création littéraire n'a jamais été étudiée dans cette perspective. Elle a été réalisée sous la direction de Catherine Mavrikakis, professeure et écrivain à la Faculté des arts et sciences au Département des littératures francophones de l'Université de Montréal et de Jean-François Saucier, psychiatre et anthropologue à la Faculté de médecine au Département de psychiatrie de l'Université de Montréal et chercheur au CHU Sainte-Justine. Beginning with Montaigne’s essayistic dictum Que sais je? — ‘What do I know?’ — this PhD thesis examines the literary history, formal qualities, and theoretical underpinnings of the personal essay to both investigate and to practice its relevance as an approach to writing about art. The thesis proposes the essay as intrinsically linked to research, critical writing, and art making; it is a literary method that embodies the real experience of attempting to answer a question. The essay is a processual and reflexive mode of enquiry: a form that conveys not just the essayist’s thought, but the sense and texture of its movement as it attempts to understand its object. It is often invoked, across disciplines, in reference to the possibility of a more liberal sense of creative practice — one that conceptually and stylistically privileges collage, fragmentation, hybridity, chance, open-endedness, and the meander. Within this question of the essay as form, the thesis contains two distinct and parallel strands of analysis — subject matter and essay writing as research. At the core of the study lie two close-readings: Ana Mendieta’s Labyrinth of Venus (1982) and Le Couvent de la Tourette (1959) by Le Corbusier and Iannis Xenakis. In each case, the writing draws, in its tone and texture, on a range of literary influences, weaving together different voices, discussions, and approaches to enquiry. The practice of essay writing is presented alongside, part and party to, research: a method of interrogation that embraces risk and uncertainty, and simultaneously enacts its own findings as a critical-creative mode of study-via-form, and form-via-study. The thesis is presented as a book-length essay, in which the art in question is equal and intimately connected to the writing used to address it. Method and form are designed to respond to the oft-cited challenge of the essay as fundamentally unmethodical, ranging, and diverse. Research, critical study, writerly description, and storytelling are combined to elucidate and expose each other based not on surface continuity, but on a deep interconnection among ideas that, through language, cohere and become related — imbued with an affinity for one another. The consummate product is the argument, as it works across genres, disciplines, descriptive and critical models, to challenge the narrative structure and language used within contemporary writing about art.

Abstract: In order to observe whether or not students appreciate the opportunity to learn affectively, this research was designed as an exploratory project aimed at identifying the ways in which reflective reading journals enabled students to respond empathetically to works of literary fiction. To understand the relationship between the act of reading and the experience of empathy, several questions were asked. The main question was: In what ways do reflective reading journals encourage students to read and understand works of fiction empathetically? Related concerns were taken into consideration: How do students describe their experience of empathy in response to the literary techniques such as plot and characterization? Students were also expected to consider the ways in which their thoughts on writing reflective reading journals underscored the need to forge empathetic awareness of the variety of opinions, experiences, and perspectives expressed in the works of fiction.||Résumé: Dans le but d'observer si les étudiants apprécient ou non la possibilité d'apprendre affectivement, cette recherche a été conçue comme un projet exploratoire visant à identifier les moyens que les journaux de lecture de réflexion ont permis aux étudiants de répondre avec empathie aux oeuvres de fiction littéraire. Pour comprendre la relation entre l'acte de lecture et l'expérience de l'empathie, plusieurs questions ont été posées. La question principale était la suivante: de quelles façons les journaux de lecture de réflexion encouragent les étudiants à lire et comprendre des oeuvres de fiction avec empathie? Des préoccupations du même ordre ont été prises en considération: Comment les étudiants décrivent-ils leur expérience de l'empathie en réponse aux techniques littéraires telles que l'intrigue et la caractérisation? Les étudiants doivent aussi examiner les façons dont leurs idées sur la rédaction de journaux de lecture de réflexion ont mis en évidence la nécessité de forger la prise de conscience empathique de la diversité d'opinions, d'expériences et de perspectives exprimée dans les oeuvres de fiction.

Richard Aldington’s city poems in the latter part of his 1915 collection Images are concerned with the masses who inhabit the modern city. Aldington is at pains to stress his distinction from those he perceives as an increasingly homogenized crowd. This paper examines the literary, linguistic and rhetorical strategies by which Aldington ‘others’ the masses, and sets them in the context of contemporary studies of the crowd, focusing on the work of Gustave Le Bon and C. F. G. Masterman. Aldington’s poetry is a product of the environment he sees as unsatisfactory, but he searches for solutions in a range of literary traditions which write the city.

The study of Victorian crime and punishment is a rich area of research that has attracted the interest not only of literary scholars but also of social historians, legal historians, and criminologists. Related scholarship therefore often situates itself at the intersection of traditional disciplinary boundaries, facilitating interdisciplinary conversation. Crime and punishment was a pressing issue for the Victorians and provoked a wealth of responses from contemporaneous commentators in literature, culture, and science. As a new phase of industrialization brought immense wealth for some and abject poverty for others, Victorian urban centers in particular were afflicted by crime. Without an effective system of social welfare in place, social inequality and deprivation drove women, men, and children into petty crime and more serious offenses, resulting in severe punishment ranging from incarceration via penal transportation to hanging. Public executions, not abolished until 1868, attracted huge crowds of spectators, including authors such as Charles Dickens and William Thackeray, who wrote about these experiences. A forerunner of the popular press, street literature conveyed and illustrated these events for a broad audience. Execution broadsides of famous cases, printing the alleged last lamentations of convicts on the scaffold in verse, are estimated to have sold by the million. As the legal system was undergoing reform (comprising changes in legal evidence procedure, divorce law, women’s property rights, and punishment for sexual offenses, for example), sensational trials caused furor and stimulated commentary in literature and the media. Crime and punishment was discussed in a range of literary and popular genres, poetry, and reformist writing. The “Newgate School” of fiction was accused of glamorizing crime, and the popular penny dreadfuls were feared to corrupt public morals. Sensational fiction in the 1860s, which often drew on real-life criminal cases and newspaper reports, depicted the supposedly respectable middle-class family home as a center of transgression. Similarly, detective fiction typically focused on crime in the world of the middle classes. For the student new to the subject of crime and punishment, this area’s interdisciplinary nature can pose an initial challenge.

Ausgehend von einer Differenzierung des Konzeptes „literarische Sozialisation" zeigt der Aufsatz die Entwicklungsbedeutsamkeit des Umgehens mit fiktionalen Texten anhand der Sozialisations-„Produkte" Imaginationsfähigkeit und emotionale Schemata auf. Das Umgehen mit fiktionalen Gechichten kann beitragen zur Entstehung einer imaginativen, entwerfenden Haltung, zur Entwicklung von Empathie, Phantasie, Ich-Beteiligung sowie zur Erprobung eigener Welt- und Selbstentwürfe. Erlebnis- und Denkformen werden erweitert, vertieft und flexibilisiert, und zwar auch in kulturspezifischer und gesellschaftlich erwünschter Weise. Geschichten vermitteln kulturelle Gefühlsschablonen, in denen sich allgemeine Werthierarchien, Sinnentwürfe und normative Erwartungen ausdrücken. (DIPF/Orig.)

Delusion and gamble, but also failure and disillusion are some of the most striking features of The Absolute Perfection of Crime, a novel that encloses its own reading instructions, which are intimately linked to film codes and the idea of remake. Tanguy Viel’s work manages to stage the frailness of fiction, halfway between the signified and the signifier, critical detachment and fictional illusion. Following the anthropological approach to game theory and the theory of literary genres, this paper aims to analyze the inner functioning of the representation tools at work in the novel as a means to highlight the paradoxical role granted to the reader.

Partiendo de la noción de literatura de pensamiento, como conjunto heterogéneo y complejo de formas literarias con vocación argumentativa, el estudio que sigue pretende mostrar a la vez el valor paradigmático del ensayo, en el marco de estas escrituras, y la naturaleza transfronteriza de los géneros de no-ficción, entre los cuales el ensayo y la crónica periodística constituyen dos de las formas más próximas. En un primer momento, se analizan los rasgos característicos del ensayo, tal como Montaigne lo concibió, con el fin de determinar las líneas de fuerza de esta forma matricial, de la que procede hasta hoy toda una tradición de escritos asistemáticos y porosos de naturaleza personal y reflexiva. En un segundo momento, se estudian los rasgos específicos de la crónica periodística contemporánea, a la luz del modelo canónico, poniendo el énfasis en la perspectiva subjetiva de la mirada y en la noción de actualidad, como principales indicadores de la dimensión permeable e híbrida de este género.
