L'écriture dans une langue « d'adoption » est un phénomène littéraire de plus en plus courant. À ce jour, la contextualisation qui en est faite gravite principalement autour de l'identitaire et de l'exil, et néglige une approche moins biographique, plus attentive à ce que l'on pourrait appeler une poétique du bilinguisme, en filiation avec la philosophie du langage de Walter Benjamin. Le concept d'une langue pure, résonnant dans le silence de chacune des langues comme une présence antérieure, peut permettre d'accéder à cette ouverture des mots, et contribuer à réaliser leur simultané pouvoir de dévoilement et de dérobade, comme une invitation à l'écoute attentive de ce qui se dit à travers eux. de Silvia Baron Supervielle, écrivaine et traductrice francophone d'origine argentine, témoigne de l'extériorité inhérente aux langues. L'analyse du mémoire essaye de manière suggestive, par un agencement de concepts philosophiques complémentaires, de rendre palpable cette voix singulière dans trois publications de genres différents : réflexions philosophiques sur les langues (l'alphabet du feu), journal de lectrice et de poète (Le pays de l'écriture), poème en prose (La frontière). Il s'agit moins de formuler une théorie de l'entre- deux-langues que de montrer l'ouverture du verbe générée par l'écriture d'une langue à l'autre.

Depuis plus de trente ans, le Québec a pris position en faveur d’un mouvement de professionnalisation de l’enseignement. Ce choix se fonde principalement sur la volonté de moderniser les systèmes d’éducation grâce à la consolidation d’une expertise du travail enseignant. Elle a donc engendré toute une série de réformes visant à formaliser les pratiques des enseignants, à les appuyer sur les résultats de la recherche et à développer un code de pratiques responsables. Cependant, dans une perspective critique, ce processus de professionnalisation entre également dans le cadre plus large d’un processus de rationalisation étatique. Il exige de plus en plus des enseignants de faire preuve d’efficacité à tout prix, mais cette exigence ne tient pas compte de l’incertitude de l’action et des valeurs en jeu. Cette thèse vise à analyser, à partir d’une perspective critique, la conception de l’articulation entre la recherche et la pratique sous-jacente au mouvement de professionnalisation en vue de proposer une conception plus adéquate en regard de la réalité pratique: la traduction. Ce faisant, la thèse propose une réflexion sur le rôle transformateur du langage dans tout processus de transmission des connaissances. L’approche de la traduction s'inspire à la fois de la tradition herméneutique et de la critique poststructuraliste, et remet en question la conception du langage comme véhicule transparent de la pensée et des connaissances. À la lumière de ce cadre, je propose une analyse empirique (analyses discursive et sémiotique) des mécanismes de traduction qui assurent le passage du monde de la recherche vers le monde de l'enseignement. Cette partie repose sur une analyse comparative d’articles provenant de la revue Vie pédagogique, analyse qui se concentre sur les processus de traductions à l’œuvre dans trois concepts centraux du mouvement de professionnalisation : la pratique réflexive, la compétence et la collaboration. Elle met en lumière la manière dont le cadre actuel de la professionnalisation est réducteur, totalisant, et nie le caractère traductif du langage et de l’activité humaine. Je conclus avec une reconceptualisation de l'enseignement en tant que traduction et acte de profession de foi.

El concepto de legalización fue desarrollado recientemente por el neoliberalismo institucional como una forma especial de institucionalización de las relaciones internacionales. Los autores neoliberales caracterizan la legalización a partir de las categorías utilizadas por H. L. A. Hart para distinguir el derecho de otros mecanismos de control social, como el poder y la moral. En Hart, estas categorías responden a una finalidad normativa: reconstruir teóricamente el derecho como un sistema independiente de la voluntad y de las convicciones de quienes lo interpretan y aplican. Sin embargo, esta separación entre lenguaje y práctica jurídica desconoce importantes contribuciones de la tradición analítica en filosofía del lenguaje, en cuanto a la relación entre lenguaje y realidad. En particular, termina reduciendo el derecho a simples formas y textos vacíos, y con ello desconoce que a través de las prácticas jurídicas se va dando significado a los textos normativos.Adoptar esta visión del derecho al estudio de las relaciones internacionales tiene, al menos, una consecuencia metodológica: el simple análisis formal del texto de los tratados no permite comprender el efecto del derecho internacional en el comportamiento de los Estados. Para entender las relaciones entre el derecho internacional y el comportamiento estatal es necesario describir la manera como se construye el significado de los textos a través de la práctica jurídica de los Estados. En tal sentido, resultaría útil redefinir la agenda de investigación neoliberal en relación con la legalización y enfocarse en la forma como los Estados y los tribunales internacionales construyen el significado de los tratados y demás normas internacionales.-----The concept of legalization was recently developed by neoliberal institutionalism as a special kind of institutionalization of international politics. Neoliberals built the concept of legalization using the analytical tools developed by H. L. A. Hart to distinguish law from other mechanisms of social control, like power and morals. Within Hart’s theory, such tools have a normative function: theoretically rebuilding law as a system of rules that is independent from the will and the beliefs of those who interpret and apply legal rules. However, Hart’s resulting separation of legal texts from legal practice obscures important contributions that the analytical tradition in philosophy of language has made to the understanding of the relation between language and reality. Specifically, such a separation reduces law to simple forms and texts disregarding the extent to which legal practice gives meaning to legal texts.Adapting Hart’s conception of law to International Relations has at least one important methodological consequence: the formal analysis of treaties cannot explain the influence of international law over state behavior. To understand the influence of international law on state behavior, one must previously describe the relation between legal practice and the meaning of legal texts. Thus, a redefinition of neoliberal research agenda on legalization should focus on the way States and international courts construct the meaning of treaties and other international norms.

Este texto representa el esfuerzo combinado de dos lógicos, dos filósofos y un lingüista. Esta empresa fue inspirada por la convicción de los autores de que la lógica y el lenguaje son inseparables, en particular en lo que respecta al análisis del significado. Una región interdisciplinaria emerge entre los límites de la filosofía, la lógica y la lingüística. Lógica, lenguaje y significado: lógica intensional y gramática lógica es una introducción a este campo, el cual aplica los sistemas lógico-formales al estudio del significado del lenguaje natural. El libro comienza con una introducción de los distintos principios de la semántica intensional y luego presenta varias lógicas intensionales, tales como la lógica proposicional modal, la lógica de predicados modal y la lógica temporal. También introduce la teoría de tipos, la lambda-abstracción y la sintaxis categorial.

Alice Crary has recently developed a radical reading of J. L. Austin's philosophy of language. The central contention of Crary's reading is that Austin gives convincing reasons to reject the idea that sentences have context-invariant literal meaning. While I am in sympathy with Crary about the continuing importance of Austin's work, and I think Crary's reading is deep and interesting, I do not think literal sentence meaning is one of Austin's targets, and the arguments that Crary attributes to Austin or finds Austinian in spirit do not provide convincing reasons to reject literal sentence meaning. In this paper, I challenge Crary's reading of Austin and defend the idea of literal sentence meaning.

Este trabalho é uma tentativa de pensar o ato de educar a partir de uma concepção dialética, isto é, considerando os pólos de uma contradição como complementares, e não excludentes. Nos quatro primeiros capítulos são apresentadas unidades de contrários observadas, respectivamente, na filosofia oriental, na ciência moderna, na psicanálise e na filosofia da linguagem, destacando-se contribuições e questionamentos que essas ciências e saberes podem oferecer à educação. No quinto e último capítulo avaliam-se as principais correntes de pensamento que influenciaram a teoria e prática educacionais, no Brasil, nas últimas décadas. A partir desse contexto, confrontam-se com os referenciais teóricos trabalhados, algumas questões colocadas pela prática em escolas de 1º e 2º graus, especialmente no projeto de 5ª e 8ª séries da Escola Senador Correia (escola particular, no Rio de Janeiro). Assim, busca-se livrar de abordagens maniqueístas a consideração de oposições tais como: escola moderna x tradicional; liberdade x coerção; autonomia x dependência diretivismo x espontaneísmo; e transmissão x construção do conhecimento.

A debate occurred in 1958 at the Harvard Law Review has become a landmark for contemporary philosophy of law. Still under the philosophical and moral impact of the Second World War, Herbert L. A. Hart published his version of legal positivism whitin the article entitled Positivism and the Separation of Law and Moral. The answer came from Lon Fuller’s Positivism and Fidelity to Law – A Reply to Prof. Hart. Much of the debate took place over a seemingly prosaic exemple: a rule prohibiting vehicles from a park. With this exemple, Hart argued that rules have a core of clear aplications, but this core meaning would be sorrounded by a penumbra of uncertainty. Fuller uses a counter-exemple to instist that legal language, by itself, cannot determine a certain outcome: it is necessary to understand the purpose for wich the rule was suppose to serve. This paper analyses this controversy from its most important features: i) the connection between legal philosophy and philosophy of language; ii) the possibility of legal interpretation; iii) and the different possibles points of view for the analysis of law. This paper argues that the study of these features sheds light on the problems we encounter in contemporary philosophy of law, especialy with regard to theories of legal argumentation and its relation with legal langague and legal interpretation.

The dialogue between philosopher Ludwig Wittgenstein s notions and Pierre Bourdieu s sociological concepts related to social practice of language shows that the philosophy of language has an important influence on contemporary social theory. When we compare the ideas of these authors we discover that beyond the direct influences from the philosopher that the sociologist recognizes there are great parallelisms of thought. That is, Wittgenstein s pragmatic thought of the use of language does not concern only language, but also every socially built behavior. When we notice that the social and linguistic behavior are borne by the individual in a tacit way, that leads us to theorize about the prereflective dimension that builds human actions and even the habits of thought. The same processes allow the uses of language to build wider social practices. Besides, John Austin, one of Wittgenstein s disciples, and his speech acts theory, contribute with a way to reflecting on how language ressembles a concrete action. Finally, the linguistc therapy that Wittgenstein means to be his philosophical proposal is assimilated by Bourdieu, who takes it as one of the necessary topics of the sociological work

The objective of this work is to analyze the phenomenon of lying, highlighting some uses and social consequences. Lies are a ubiquitous phenomenon, and in many cases they even promote social harmony. Furthermore, telling lies is an expression of individuality: it is the expression of relative autonomy that the subject has towards their social environment allowing them to defend their most personal interests. The work also aims to examine the concept of habitus applied to the social production of lies. Thus, the liars produce their lies aiming to obtain certain effects on their audiences. There are certain social cognitive principles that structure the kind of lie that is usually told to the public. Finally, the perpetrators of crimes of fraud and other deceptive practices may suffer a criminal prosecution because the damage they cause affects important social values recognized by the state, and are not restricted to the victim‟s chagrin. In the most common forms of fraud, the crooks make tempting offers to victims exploiting some of their standardized behaviors and reactions. To understand the fragility of the victims to scams is an attempt to understand how a social phenomenon as usual as is the lie can still surprise and cause perplexity

The study aims to investigate the limits of state intervention via induction on Economic Order, especially in cases regarding tax equality, through the analysis of their effects on economic development and on free competition from the perspective of economic efficiency and the Constitution. Thus, the work seeks to demonstrate that the achievement of equality in taxation is important in that it strengthens the economic relations in terms of efficiency, protects competition and fosters economic development to reduce regional and social inequalities and other constitutional desiderata. A dissertation is characterized by interdisciplinarity and was divided into two parts. The first is to discuss the legal meaning of equality from the doctrinal analysis of the principle and the relationship between equality and justice in the economic sense without rejecting its philosophical content. It is noteworthy that hermeneutics and the philosophy of language are useful tools for achieving equality in presenting the pragmatic methodologies applicable to the subject in terms of corrective justice. Based on these general assumptions, is going to study the tax equality and their characteristics, the corollary of the ability to pay and its relation to the economic capacity and the issue of progressivity in taxation as an ideal of distributive justice. The second part concerns the legal foundations of Economic Order and its relation to extrafiscality as a means of economic regulation in order to investigate the efficiency of this induction in order to promote economic development, free competition and tax equality itself to reduce inequalities and distributing wealth. Within this context, we investigated the scope of the constitutional principles of economic order, free enterprise and free competition, and favored differential treatment for small and medium enterprises, the issue of regional development for the reduction of regional and social inequalities, the problem the "fiscal war" and finally the efficiency from the perspective of Economic Analysis of Law

This study analyzes the processes of meaning construction in the Livro do Desassossego, by semi-heteronym Bernardo Soares - Fernando Pessoa. We use theoretical grounds from an interface between Cognitive Linguistics and Textual Linguistics to observe how certain linguistic mechanisms build a reality that tells us of a time, a being and his conceptions of language and writing. We focus on description and explanation of procedures of categorization and referentiation accomplished, for example, through metaphor and metonymy. For the construction of the intended theoretical interface, we use analytical categories proposed and developed by the Socio-cognitive Approach of Language, Conceptual Metaphor Theory and Mental Space Theory. Armed with this theoretical background, we observed the dynamics of language in relation to its social, cultural and historical features, as well as the cognitive aspects that underlie it. We seek, therefore, encourage discussions about the functioning of language considering primarily the creative processes that allow us to organize and shape our experiences. We also try to provide an approximation of Linguistics, Literature and Philosophy, with a view to relations between language structure, cognitive activity and socio-cultural organization. From the results obtained, we found that a literary text attests, with a particular property, the mutual relations between language, cognition and culture, as indicates cognitive approach to language studies

We indicate the idea of nexus or conexio, thought of as intelligible connection with the intelligent, the foundation on which the reason why you can understand and name, even if inadequately, what the intellect sees incomprehensible and unnameably. Thus, it opens a way for our research: we will take the idea of nexus as fundamental to the interpretation of the divine names and the "metaphysics of the unnameably" and we show how the divine names, mainly in possest, mirrored in the Trinity, relatedness of the principle and therefore also the nexus. For that you need to think some preliminary questions: we will place Nicholas of Cusa in the tradition of medieval Christian Neoplatonism, we resume some discussions on the problem of naming and the philosophy of language in his thinking, we will reflect such thinking is molded from active dialogue with the tradition and how it is your speculation is founded upon the dynamic and dialectical relationship between philosophy and theology to be thought of in our text using the relationship between faith and understandig (intellectus). After introductory clarify these issues we will come to consider introductory understanding of the Trinitarian Beginning and speculation about the nexus taking as its starting point from where the De venatione sapientiae nexus or conexio is designed as a hunting field of wisdom and the First Book of De docta ignorantia where the maximum is now thought of as one and triune. From the Second Book of the same work and the Idiota. De mente we will show in what sense the universe and men, as imago dei, imitate the eternal Trinity. Finally, we will resume the notion of the scientia aenigmatica of De beryllo and some information that will clarify that Nicholas assumes the divine names as enigmas. Finally, we will try to show that the enigmatic or symbolic names also mirror the triune Beginning principle. So, before we return some traces of this aspect in some divine names and texts of the "late period" and then conclude with that which in itself already indicates the nexus and therefore the trinity: possest

The main goal of this work is to clarify the central concepts involved in the study of formalization of conditional sentences. More specifically, it has been done a comparative analysis of the two greater and more traditional proposals of conditional formalization (Lewis 1973c e Adams 1975). These proposals were responsible for the creation of a way of analysis that still present in the current debate about this subject. This work pursues to explain the principal assumptions held within these proposals. According to certain disambiguation techniques from Bennett (2003) and Lycan (2005), this work tries to explicit how these assumptions connect to the aims sought by the initial approaches. The following results show that there is a not declared presumption, the definition of the object of study of these theories, i.e., the definition of conditional sentence. This work argues that despite of not explicitly declared the definition of the study object has a central role in the intelligibility of the debate itself
