The European Union (EU) is embedded in a pluralistic legal context because of the EU and its Member States’ treaty memberships and domestic laws. Where EU conduct has implications for both the EU’s international trade relations and the legal position of individual traders, it possibly affects EU and its Member States’ obligations under the law of the World Trade Organization (WTO law) as well as the Union’s own multi-layered constitutional legal order. The present paper analyses the way in which the European Court of Justice (ECJ) accommodates WTO and EU law in the context of international trade disputes triggered by the EU. Given the ECJ’s denial of direct effect of WTO law in principle, the paper focuses on the protection of rights and remedies conferred by EU law. It assesses the implications of the WTO Dispute Settlement Understanding (DSU) – which tolerates the acceptance of retaliatory measures constraining traders’ activities in sectors different from those subject to the original trade dispute (Bananas and Hormones cases) – for the protection of ‘retaliation victims’. The paper concludes that governmental discretion conferred by WTO law has not affected the applicability of EU constitutional law but possibly shapes the actual scope of EU rights and remedies where such discretion is exercised in the EU’s general interest.

In The Global Model of Constitutional Rights Kai Möller claims that the proportionality test is underlain by an expansive moral right to autonomy. This putative right protects everything that advances one’s self-conception. It may of course be limited when balanced against other considerations such as the rights of others. But it always creates a duty on the state to justify the limitation. Möller further contends that the practice of proportionality can best be understood as protecting the right to autonomy. This review article summarizes the main tenets of Möller’s theory and criticizes them on two counts. First, it disputes the existence of a general right to autonomy; such a right places an unacceptably heavy burden on others. Second, it argues that we do not need to invoke a right to autonomy to explain and justify the main features of the practice of proportionality. Like other constitutional doctrines, proportionality is defensible, if it is grounded in pragmatic –mainly epistemic and institutional- considerations about how to increase overall rights compliance. These considerations are independent of any substantive theory of rights.

Whatever the result of Scotland’s independence referendum, careful constitutional thinking will be needed. If Scots vote Yes, Scotland will need a new constitution and the rest of the UK will have to rethink its governing structures. Even in the event of a No vote, everyone agrees that the shape of the Union will need to change over the coming years. This paper examines how such constitution-making should take place. It sets out the options, gathers evidence from around the world on how those options might work, and weighs the advantages and disadvantages of each alternative. It concludes that constitutional proposals in the UK should best be developed by a convention comprising a mixture of ordinary members of the public and politicians; these proposals should be put to a referendum. This approach, the paper argues, offers the best route to high-quality debate, stronger democratic engagement, and, ultimately, deeper legitimacy for our governing structures.

This article contrasts the sense in which those whom Bernard Williams called ‘political realists’ and John Rawls are committed to the idea that political philosophy has to be distinctively political. Distinguishing the realist critique of political moralism from debates over ideal and non-ideal theory, it is argued that Rawls is more realist than many realists realise, and that realists can learn more about how to make a distinctively political vision of how our life together should be organised from his theorising, although it also points to a worrying tendency among Rawlsians to reach for inappropriately moralised arguments. G. A. Cohen’s advocacy of socialism and the second season of HBO’s The Wire are used as examples to illustrate these points.

This article examines the issue of the appropriate scope of review of economic evidence enshrined in the discretionary assessments of utility regulators in the US and the UK. It advances a balance of institutional competencies approach to the question of the degree of deference owed to the regulatory agency’s economic assessments. In doing so, it revisits the doctrinal positions advanced in the US and UK for the substantive review of administrative discretion, so as to become attuned to the challenges posed by economic evidence. Drawing on insights from political science and economics, the suggested approach illuminates the institutional disadvantages of the courts that may warrant a high degree of deference. At the same time, however, it remains sensitive to the polycentric elements of regulatory disputes as well as to a number of institutional realties that may attenuate the weight of such comparative institutional disadvantages.

Chromosome microdeletions or duplications are detected in 10-20% of patients with mental impairment and normal karyotypes. A few cases have been reported of mental impairment with microdeletions comprising tumor suppressor genes. By array-CGH we detected 4 mentally impaired individuals carrying de novo microdeletions sharing an overlapping segment of similar to 180 kb in 17p13.1. This segment encompasses 18 genes, including 3 involved in cancer, namely KCTD11/REN, DLG4/PSD95, and GPS2. Furthermore, in 2 of the patients, the deletions also included TP53, the most frequently inactivated gene in human cancers. The 3 tumor suppressor genes KCTD11, DLG4, and GPS2, in addition to the GABARAP gene, have a known or suspected function in neuronal development and are candidates for causing mental impairment in our patients. Among our 4 patients with deletions in 17p13.1, 3 were part of a Brazilian cohort of 300 mentally retarded individuals, suggesting that this segment may be particularly prone to rearrangements and appears to be an important cause (similar to 1%) of mental retardation. Further, the constitutive deletion of tumor suppressor genes in these patients, particularly TP53, probably confers a significantly increased lifetime risk for cancer and warrants careful oncological surveillance of these patients. Constitutional chromosome deletions containing tumor suppressor genes in patients with mental impairment or congenital abnormalities may represent an important mechanism linking abnormal phenotypes with increased risks of cancer. The developed democracies only have results or crystallise, when the exercise of the government policies has two dimensions: the first one, is the dimension of the government decisions making: in which, the governor accomplishes the priorities and orientations submitted to the population by electoral decisions. Then the second dimension, is the functionality of the State: capable to transform policies into convergent actions for accomplishment of the negotiated results. The consolidation of the democracy and the consequent increase of the social demand by decisions and public and government lawsuits, able to generate results that attend collectively the different levels of the society and able to aggregate and articulate additional values to their interests, imposes to the public sector administration, great challenges of public policies. Nowadays, the indispensable condition to guarantee a minimum governmental benchmark, it to overcome these challenges, in the plan of the public administration, demanded for the promotion of the economic development, in the democratic scope, to reach the politician-institutional values of the society. However, It is undeniable, the universality of the challenges of public administration that consequently, are the effects of modern administrative systems. To attempt the best result, the mast satisfy the attributes of speed, flexibility, integration and innovation, amongst others. The diffusion of guided doctrines of public management by results is reflecting in the institutionalization of new types of bureaucratic activities and amongst this context, it is distinguished as a basic importance of what we call Performance Audit. This work intends to describe how the control organs and especially the Accounts Court of the Union, the sensitive demands of the society, and attending to new constitutional order, they are structuring itself to face the new organizational and institutional challenges, in consequence of the gradual redefinition of your task, more and more liable uncertainties, current of the intimate nature of the performance audit, in development, face the traditional audit, which characterizes them in general. Therefore, the main goal of this these, is the analysis of the organizational challenges and consequently ,the lawsuits changes of the organizational structures faced in general by the Brazilian¿s Accounts Courts, which we believe, will help to elaborate paths of propulsive evaluating and restrictive elements to the innovations that are intended to introduce the systems of necessary control in the evaluation of government programs.

The acts of public administration personnel are of great importance and various laws have been passed in attempt to limit the related expenses. The management of Public administration personnel is based on the principle of efficiency. The TCE/RJ (State of Rio de Janeiro/Audit Court) digital communication system is expected through telework to facilitate its auditing duties in compliance with the terms of the Federal and State constitutions. The TCE/RJ, the superior judicial body of auditing, has done more than just reduce costs and use flextime; it applies telework as an instrument to optimize public service through SICODI digital certification to maximize the resources applied to this constitutional act with greater efficiency for effective auditing. The focus of the first part of this study is to evaluate the tasks of positions that forward the TCE/RJ objectives and the profile characteristics of employees of the inspection area on personnel performance beginning with defined concepts and purposes. Questionnaires for auditors and technicians of the area were approved for this specific purpose to analyze the duties of positions and employee profiles. The second part of this study evaluates the TCE/RJ digital communication system according to theoretical reference and ISO/IEC Standard No. 9126-1, observing three dimensions: the content, usability and functionality. The results obtained, with the use of qualitative methods complemented by quantitative analysis, were positive for the implementation of telework in the inspection of personnel performance in relation to the analysts and technicians involved in this type of auditing as well as in relation to the TCE/RJ digital communication system.

Os tribunais de contas, embora sejam órgãos tradicionais na administração pública com raízes remotas ligadas à própria criação do Estado Moderno, passam hoje por intensas modificações em sua estrutura operacional e formas de atuação. O presente trabalho tem o objetivo de analisar o processo de modernização dos tribunais de contas estaduais e municipais do país no contexto da reforma do Estado brasileiro. A primeira parte dessa dissertação apresenta uma radiografia da situação atual dos TC¿s, apontando as principais características diferenciadoras desses órgãos em relação à sua capacidade operacional e ao desempenho de suas funções constitucionais. A segunda parte apresenta um balanço das principais iniciativas de aperfeiçoamento organizacional que podem ser verificadas nas estruturas dos TC¿s mais recentemente, dando destaque para as inovações de ouvidoria, sistemas informatizados de controle e escolas de contas.
