Esta pesquisa objetivou verificar como foi construída a afirmação do direito ao ensino médio no ordenamento constitucional-legal brasileiro desde o final do período imperial até a década de 90 do século XX. Para isto, apresento aspectos referentes a transformações de vários gêneros que delimitaram a afirmação do direito ao ensino médio no ordenamento constitucional-legal brasileiro. As trajetórias da pesquisa e do texto da dissertação buscaram, então, a compreensão da construção histórica do direito ao ensino médio. Para interpretar a afirmação de tal direito no ordenamento jurídico utilizei algumas diretrizes consideradas como relevantes para o estudo, sendo elas: os processos de descentralização/centralização, a definição de competências das esferas de governo, a obrigatoriedade e gratuidade do ensino médio, o dever do Estado para com a oferta desta etapa do ensino e o estabelecimento da vinculação de recursos financeiros públicos. Foi realizada, ainda a contextualização do ensino médio em termos de sua função social, sua estrutura, seu currículo e sua oferta, em diferentes momentos históricos.Para a realização da pesquisa foram utilizados o método histórico e a pesquisa de interpretação legal. O procedimento adotado foi o de, em primeiro lugar, realizar a coleta de informações em fontes primárias e secundárias e, num segundo momento, proceder à interpretação das fontes primárias, com o auxílio de fontes secundárias, especialmente de estudos que se debruçam sobre o ordenamento constitucional-legal da educação brasileira. As fontes primárias utilizadas foram documentos legais e normativos dos períodos imperial e republicano. O ensino médio, atualmente a última etapa da Educação Básica, passou por uma trajetória histórica de muitas reformas e de pouco acesso a grandes parcelas da sociedade. Desde a Primeira República até os dias de hoje, alguns processos foram determinantes para a afirmação do direito ao ensino médio. A definição de competências para os entes federados, a amplitude e o caráter da descentralização e centralização administrativa e normativa, a garantia da gratuidade e o estabelecimento na legislação de vinculação de recursos para a educação, são fatores que em todo o período estudado garantem, em intensidades diferenciadas, o direito ao ensino médio. Porém, apesar de termos hoje em nosso ordenamento constitucional-legal enunciados que garantem parcialmente este direito, ainda são requeridos avanços para que se efetive de maneira contundente o acesso de todos a este nível de ensino; a obrigatoriedade seria condição forte nesse sentido. O direito de acesso ao ensino médio foi muito restrito no período inicial de constituição do Estado Brasileiro, apresentando uma maior abrangência a partir do segundo período republicano e chegando quase que à total afirmação nos dias de hoje. A delimitação atual do direito contempla o dever do Estado na efetiva proteção do acesso ao ensino médio, assim como o caráter prospectivo dos deveres implícitos na sua universalização, obrigatoriedade e gratuidade.

New emerging international dynamics introduce a global poly-axiological polycentric disorder which undermines the tradition of a unique global legal order in international law. Modern Era was characterized by Western European civilizational model – from which human rights is a byproduct. This consensus had its legitimacy tested by XXst century’s scenario – and the ‘BRICS factor/actor’ is a symptom of this reality. Its empowerment in world politics lead to the rise of distinct groups of States/civilizations provided with different legal, political, economic and social traditions – promoting an unexpected uprise of otherness in international legal order and inviting it to a complete and unforeseeable reframing process. Beyond Washington or Brussels Consensus, other custom-originated discourses (Brasília, Moscow, New Delhi, Peking or Cape Town Consensus, among other unfolded possibilities) will probably henceforth attempt shaping international law in present global legal disorder.

O objetivo desta pesquisa é compreender como os atores públicos que participaram, direta ou indiretamente, da Operação Centro Legal de 2012, qualificaram, em seu discurso, o uso de crack e a região conhecida por “cracolândia”, em São Paulo, notadamente a Polícia Militar do Estado de São Paulo. O problema de pesquisa consiste na compreensão das diferentes falas que os atores tem em torno do uso de crack e da cracolândia de São Paulo, levando em consideração um quadro teórico que se foca no estudo do estigma, do desvio e do conhecimento enquanto instrumento de poder. A conclusão é que o estigma e o conhecimento de um determinado ramo do campo da psiquiatria foram elementos muito importantes e influentes na construção da imagem verbalizada pelos atores pesquisados com respeito ao uso do crack e à “cracolândia”.

This paper aims to verify the main contributions and adjustments that the paper “Towards a Legal Theory of Finance” from Katharina Pistor may bring to the role of the Brazilian National Bank for Economic and Social Development (BNDES) in the Brazilian development financing. In order to do so, I work with two questions in this paper: (i) such theory presents elements which allow analyzing the role of the BNDES and from there, if it is required, adjustments can be made in the governance of the BNDES? and (ii) there are academics and scholars that, together with the theory, also contribute with the improvement of the BNDES role in the development of Brazil?

Almost a full century separates Lewis’ Alice in Wonderland (1865) and the second, lengthier and more elaborate edition of Hans Kelsen’s Pure Theory of Law (1960; first edition published in 1934). And yet, it is possible to argue that the former anticipates and critically addresses many of the philosophical assumptions that underlie and are elemental to the argument of the latter. Both texts, with the illuminating differences that arise from their disparate genre, have as one of their key themes norms and their functioning. Wonderland, as Alice soon finds out, is a world beset by rules of all kinds: from the etiquette rituals of the mad tea-party to the changing setting for the cricket game to the procedural insanity of the trial with which the novel ends. Pure Theory of Law, as Kelsen emphatically stresses, has the grundnorm as the cornerstone upon which the whole theoretical edifice rests2. This paper discusses some of the assumptions underlying Kelsen’s argument as an instance of the modern worldview which Lewis satirically scrutinizes. The first section (Sleepy and stupid) discusses Lewis critique of the idea that, to correctly apprehend an object (in the case of Kelsen’s study, law), one has to free it from its alien elements. The second section (Do bats eat cats?) discusses the notion of systemic coherence and its impact on modern ways of thinking about truth, law and society. The third section (Off with their heads!) explores the connections between readings of systems as neutral entities and the perpetuation of political power. The fourth and final section (Important, Unimportant) explains the sense in which a “critical anticipation” is both possible and useful to discuss the philosophical assumptions structuring some positivist arguments. It also discusses the reasons for choosing to focus on Kelsen’s work, rather than on that of Lewis’ contemporary, John Austin, whose The Province of Jurisprudence Determined (published in 1832) remains influential in legal debates today.

Este é o relatório final acerca do desembolso do Programa ABC e que compõe, entre outras, as atividades do segundo ano de trabalho do Observatório do Plano ABC. Seu principal objetivo é analisar quantitativa e qualitativamente o desempenho – contratação – da principal linha de crédito para o financiamento da agricultura de baixa emissão de carbono no Brasil, o Programa ABC. O relatório apresenta as atualizações referentes à parcela da safra 2014/15 (de julho de 2014 a fevereiro de 2015), trazendo, também, uma análise focada nos recursos contratados via BNDES e nas finalidades de investimento às quais se destinam. Além disso, é apresentado um estudo de caso realizado no estado do Pará, e é discutido, também, o potencial de contribuição ao alcance das metas de redução de emissões pela região da Amazônia Legal.

This paper employs mechanism design to study the effects of imperfect legal enforcement on optimal scale of projects, borrowing interest rates and the probability of default. The analysis departs from an environment that combines asymmetric information about cash flows and limited commitment by borrowers. Incentive for repayment comes from the possibility of liquidation of projects by a court, but courts are costly and may fail to liquidate. The value of liquidated assets can be used as collateral: it is transferred to the lender when courts liquidate. Examples reveal that costly use of courts may be optimal, which contrasts with results from most limited commitment models, where punishments are just threats, never applied in optimal arrangements. I show that when voluntary liquidation is allowed, both asymmetric information and uncertainty about courts are necessary conditions for legal punishments ever to be applied. Numerical solutions for several parametric specifications are presented, allowing for heterogeneity on initial wealth and variability of project returns. In all such solutions, wealthier individuals borrow with lower interest rates and run higher scale enterprises, which is consistent with stylized facts. The reliability of courts has a consistently positive effect on the scale of projects. However its effect on interest rates is subtler and depends essentially on the degree of curvature of the production function. Numerical results also show that the possibility of collateral seizing allows comovements of the interest rates and the probability of repayment.

This paper discusses the growing attention that, over the last decades, has been given to the administrative procedure in Administrative Law, as it also highlights the procedures which are in tune with the new trappings of this legal field. It focuses on the sanctioning competence of regulatory agencies, notably what concerns the procedural guide that conditions its exercise. It aims at gathering varied elements, many times dispersed over the legal system, so it is possible to list, with a satisfactory degree of detail, the procedural constitutional guidelines which are indispensable to the sanctioning of private entities through punitive action by regulatory agencies. It highlights the due legal process clause, for the abundance of the protective set there is around it, as a guiding constitutional principle for the application of sanctions by regulatory agencies. It examines the repercussion of the constitutional principle of the due legal process on Administrative Law, focusing on the most relevant principles on which the first unfolds itself. It analyzes, in light of the due legal process principle, the sanctioning administrative procedure developed in regulatory agencies. In conclusion, it is asserted that there is no room, in the Brazilian legal system as a whole, for sanctions to be applied summarily; that there reigns, in our system, an absolute presumption, dictated by the Constitution, that only through regular procedures can the best and fairest decision, concerning cases in which the rights of private parties could be affected, be taken by the public administration; that, respecting the principle of the right to a fair hearing, it is indispensable that there be motivation of a decision that imposes a sanction; that there should be, in homage to the principle of full defense and for the need to preserve the autonomy of the regulatory party, an appeal court in every agency; that the principles listed in the federal law No. 9.784/1999 should be mandatorily monitored by the agencies, for this is the only alternative consistent with the Constitution

The dental documentation or handbook is a collection of documents produced by the professional with diagnostic and therapeutical purpose where the inherent information to the buccal and general health of patients are registered. The register and proper filling of these documents, taking care of the ethical and legal requirements, provide to the dentist the possibility to contribute with justice in cases of human identification and makes of these documents an essential element of evidence in the ethical processes, administrative, civil and criminal against the dentists. Ahead of this fact, understanding such requirements and the importance of the dentist to register himself adequately, this research verified the knowledge of Natal (RN) City s dentists with relation to the elaboration of the dental handbook, investigating the concepts and the importance attributed to the handbook, identifying the documents more used and filed by these professionals, besides inquiring the legal value of filed documents and the filling time of these ones. The sample was constituted by 124 dentists, who had answered a questionnaire, after having been randomly selected ITom a list of professionals subscribed in the Dentistry Local Council/RN Section. The analysis of the results showed that majority of the participant citÍzens (52,3%) confers to the dental documentation the clinical importance, followed by the legal and forensic-dentistry importance; 59,3% of the searched professionals do not distinguish satisfactorily or they do not observe differences between the dental handbook and the clinical filing card, the X-rays, the dental certificates, the prescriptions, the directions and the receipts; between the documents of common use to clínical and specialist ones, the contract of rendering of services and term of ITee and cleared up consent are the documents less used by the professionals. It was still verified, that only 13,1% of the sample register the signature of the patients in the clinical filing card, making it more credibility to be presented in judgement. In the same way, copies of dental certificates and prescriptions evaluated and signed by the patients are filed respectively by only 13,5% and 9,4% ofthe searched professionals and 50% ofthe sample, keep these documents filed for an indeterminate period of time, that is, these professionals have the guard of the handbook and they do not intend to disdain it, although 85,5% of the sample does not recognize the real proprietor of the handbook. It is concluded that a great part of the dentists is unaware about the importance of the dental documentation, and neglect its elaboration, leaving themselves exposed to several kinds of penalties foreseen in the legislation

This paper presents the Ergonomic Work Analysis method in a Brazilian Dentist's office. Through the study, the constraints and the strategies in avoiding them were identified. It was found that dentists hardly use the position most indicated by the International Organization for Standardization (ISO) and the Federation Dentaire Internacionale (FDI) for both the patient and the dentist, which is respectively supine and 9 o'clock, due to the limited space and layout. Five types of treatments performed by the professional have been studied. The frequency and duration of actions in these treatments were accounted for and the standard positions adopted were identified. The AET was found to be a very suitable method to grasp the dentist's activity and build a point of view of the profession, which is characterized as: stressful, perfectionist and restrictive. Time management is presented as an important strategy to control the tension arising from performing the treatments.

The use of implant-supported prosthesis to replace missing teeth became a predictable treatment. Although high success rate has been reported, implant treatment is suitable to complications, failures, and limitations such as peri-implant bone loss after implant loading. Stress evaluation on the bone-abutment-implant interface has been carried out to develop new designs of prosthetic platform and to understand the stress distribution in this interface. Several types of prosthetic platforms are available such as external and internal hexagon, Morse cone connection, and the concept of platform switching. Therefore, this study aimed to critically describe the different options of prosthetic platforms in implant dentistry, by discussing their biomechanical concepts, clinical use, and advantages and disadvantages. It was observed that all types of prosthetic platforms provided high success rate of the implant treatment by following a strict criteria of indication and limitation. In conclusion, a reverse planning of implant treatment is strongly indicated to reduce implant overload, and the use of advanced surgical-prosthetic techniques is required to obtain a long-term success of oral rehabilitations.

Traumatic tooth injuries involve function and aesthetics and cause damage that range from minimal enamel loss to complex fractures involving the pulp tissue and even loss of the tooth crown. Technical knowledge and clinical experience are essential to establish an accurate diagnosis and provide a rational treatment. The purpose of this study was to evaluate the knowledge of Restorative Dentistry specialists about the management of crown and crown-root fractures based on treatment plans proposed by these professionals for these cases. A descriptive questionnaire was mailed to 245 Restorative Dentistry specialists with questions referring to their professional profile and the treatment plans they would propose for the management of crown and crow-root fractures resulting from dental trauma. One hundred and fifty-four questionnaires were returned properly filled. The data were subjected to descriptive statistics and the chi-square test was used to determine the frequency and the level of the significance among the variables. The analysis of data showed that in spite of having a specialist title, all interviewees had great difficulty in planning the treatments. As much as 42.8% of the participants were unable to treat all types of dental trauma. Complicated and uncomplicated crown-root fractures posed the greatest difficulties for the dentists to establish adequate treatment plans because these fractures require multidisciplinary knowledge and approach for a correct case planning and prognosis.

The application of engineering knowledge in dentistry has helped the understanding of biomechanics aspects related to osseointegrated implants. Several techniques have been used to evaluate the biomechanical load oil implants comprising the use of photoelastic stress analysis, finite element stress analysis, and strain-gauge analysis. Therefore, the purpose of this Study was to describe engineering methods used in dentistry to evaluate the biomechanical behavior of osseointegrated implants. Photoelasticity provides good qualitative information oil the overall location and concentration of stresses but produces limited quantitative information. The method serves as ail important tool for determining the critical stress points in a material and is often used for determining stress concentration factors in irregular geometries. The application of strain-gauge method oil dental implants is based oil the use of electrical resistance strain gauges and its associated equipment and provides both in vitro and vivo measurements strains under static and dynamic loads. However, strain-gauge method provides only the data regarding strain at the gauge. Finite element analysis can Simulate stress using a computer-created model to calculate stress, strain, and displacement. Such analysis has the advantage of allowing several conditions to be changed easily and allows measurement of stress distribution around implants at optional points that are difficult to examine clinically All the 3 methodologies call be useful to evaluate biomechanical implant behavior close to the clinical condition but the researcher should have enough knowledge in model fabrication (experimental delineation) and results analysis.
