A partir do exame da formação e identificação da norma consuetudinária, consoante os pressupostos da teoria dos dois elementos, investiga-se a índole consuetudinária das intervenções humanitárias no contexto do Direito Internacional Contemporâneo, a fim de verificar se tais práticas estatais teriam se constituído em um costume internacional e, por conseguinte, se elas ampliaram o rol das exceções ao princípio da proibição do uso da força pelos Estados nas relações internacionais esculpido no artigo 2 (4) da Carta das Nações Unidas. Dada a polissemia existente para a expressão intervenção humanitária, esta pode ser compreendida como o recurso à força armada por um Estado, ou grupo de Estados, para além das suas fronteiras, conforme discricionariedade própria, ou seja, sem a autorização do CSNU, com o propósito de cessar práticas em largas escalas, persistentes e generalizadas, comissivas ou omissivas, de graves violações dos Direito Humanos e Internacional Humanitário. A partir da apuração dos elementos que conformam esse conceito estabelecido, do exame dos casos de ocorrência e das justificativas legais apresentadas pelos Estados interventores para essa prática interventiva, conjugado com a reação dos demais Estados à essa conduta, por uma considerável e persistente falta de expresso reconhecimento do caráter de direito para a intervenção humanitária, é possível afirmar que os Estados sucessivamente reafirmaram o reconhecimento do princípio da interdição do uso da força pelos Estados nas suas relações internacionais e, que nos quadros do Direito Internacional contemporâneo, a este tipo de intervenção não é um costume internacional porque carece de opinio iuris.

O comércio internacional vem desempenhando um papel cada vez mais vital no cenário da economia mundial. O fluxo de investimentos estrangeiros vem crescendo exponencialmente com potencial de gerar desenvolvimento econômico e oportunidades de lucro para os investidores. O crescimento da importância dessas duas disciplinas desafia as regras do Direito Internacional. Por um lado, o Direito Internacional dos Investimentos objeto de críticas em virtude da fragmentação normativa gerada pelo bilateralismo. Por outro lado, o Direito do Comércio Internacional consagrado através do multilateralismo da Organização Mundial do Comércio considerado, por muitos, como ultrapassado. As tentativas de regular em nível multilateral os investimentos estrangeiros restaram fracassadas e o existente sistema multilateral no comércio internacional rechaçado. Nessa dualidade entre investimentos estrangeiros e comércio internacional resta duvidoso o seu caráter de complementaridade. No entanto, a crescente e inegável interconexão entre investimentos estrangeiros e comércio internacional não somente representa um desenvolvimento para o panorama normativo de ambos, como também, contribui para o crescimento do padrão de tratamento, desenvolvimento econômico e trocas comerciais. Deixa de se tratar de uma relação entre duas disciplinas isoladas que, na verdade, são elementos complementares que devem ser desenvolvidos em conjunto para um crescimento econômico mais avançado e um desenvolvimento contributivo.

O direito internacional dos refugiados constitui um dos mais importantes mecanismos de proteção internacional do indivíduo, sendo objeto de Convenção com alto número de ratificações e de legislação nacional ainda mais protetiva. Não obstante o amplo acervo normativo disponível, desenvolvido para lidar com os desafios impostos pelos frequentes fluxos migracionais que marcaram a primeira metade do século XX, fenômenos recentes tornaram evidente a necessidade de revisão, ainda que parcial, de sua estrutura. Políticas de controle de fronteiras adotadas na Europa levaram ao incremento do fluxo de refugiados entre Estados do Sul. Paralelamente, a transferência de parte do controle para fora das águas territoriais europeias fenômeno observado também no sudeste asiático põe o direito internacional dos refugiados em confronto com a regulamentação do direito do mar. Enquanto isto, o Brasil, por não possuir histórico recente relevante de recebimento de migrantes, enfrenta grande dificuldade para garantir até mesmo o reconhecimento da condição de refugiado. Neste contexto, é imprescindível o enfrentamento de tais problemas, compatibilizando o instituto do refúgio com as necessidades das primeiras décadas do século XXI.

Względy społeczne są silnie chronione w prawie Unii Europejskiej i Stanów Zjednoczonych. Ważnym elementem wskazanych systemów prawnych jest również prawo antymonopolowe, którego cel, najogólniej rzecz ujmując, stanowi zapewnienie właściwego funkcjonowania rynku. Kwestie socjalne nie mieszczą się w optyce prawa antymonopolowego. Może to prowadzić do powstania bardzo skomplikowanej sytuacji między prawem antymonopolowym a unormowaniami służącymi ochronie względów socjalnych. Istnieją obszary, na których te dwa zespoły norm są komplementarne, ale zauważyć należy również, że na pewnych płaszczyznach cele prawa pracy są odmienne, a nawet przeciwstawne wobec zadań stawianych przed prawem antymonopolowym. Sferę, w której powstanie konfliktów jest najbardziej prawdopodobne stanowią układy zbiorowe pracy. Zgodnie z unijnym i amerykańskim orzecznictwem prawo antymonopolowe nie może być wykorzystywane do uniemożliwienia osiągnięcia celów socjalnych chronionych przez prawo. Istnieją jednak przypadki, w których stosownie prawa antymonopolowego do układów zbiorowych pracy jest możliwe.

This thesis examines the tension between patent rights and the right to health and it recognizes patent rights on pharmaceutical products as one of the factors responsible for the problem of lack of access to affordable medicines in developing countries. The thesis contends that, in order to preserve their patent policy space and secure access to affordable medicines for their citizens, developing countries should incorporate a model of human rights into the design, implementation, interpretation, and enforcement of their national patent laws. The thesis provides a systematic analysis of court decisions from four key developing countries (Brazil, India, Kenya, and South Africa) and it assesses how the national courts in these countries resolve the tension between patent rights and the right to health. Essentially, this thesis demonstrates how a model of human rights can be incorporated into the adjudication of disputes involving patent rights in national courts. Focusing specifically on Brazil, the thesis equally demonstrates how policy makers and law makers at the national level can incorporate a model of human rights into the design or amendment of their national patent law. This thesis also contributes to the ongoing debate in the field of business and human rights with regard to the mechanisms that can be used to hold corporate actors accountable for their human rights responsibilities. This thesis recognizes that, while states bear the primary responsibility to respect, protect, and fulfil the right to health, corporate actors such as pharmaceutical companies also have a baseline responsibility to respect the right to health. This thesis therefore contends that pharmaceutical companies that own patent rights on pharmaceutical products can be held accountable for their right to health responsibilities at the national level through the incorporation of a model of civic participation into a country’s patent law system.

A key challenge in promoting decent work worldwide is how to improve the position of both firms and workers in value chains and global production networks driven by lead firms. This article develops a framework for analysing the linkages between the economic upgrading of firms and the social upgrading of workers. Drawing on studies which indicate that firm upgrading does not necessarily lead to improvements for workers, with a particular focus on the Moroccan garment industry, it outlines different trajectories and scenarios to provide a better understanding of the relationship between economic and social upgrading. This article fi rst summarizes the structural reforms of pensions (total or partial privatization) in Latin America and Central and Eastern Europe, identifying their advantages and disadvantages, and does the same with the international process of re-reforms of pensions with a greater role of the state. Second, chooses Chile as a case study, as a world pioneer in both types of reforms; describes their characteristics and effects on social welfare of the structural reform of 1981 and the re-reform of 2008. Such effects are evaluated based on ten basic principles of social security from the International Labour Offi ce (ILO): 1) social dialogue to approve the reforms, 2) universal coverage of the population, 3) equal treatment of insured persons, 4) social solidarity, 5) gender equity, 6) suffi ciency of benefi ts, 7) effi ciency and reasonable administrative cost, 8) social participation in the management of the system, 9) role of the state and supervision, and 10) fi nancial sustainability. Third, it summarizes the advantages and disadvantages-challenges of the re-reform and informs on the current debate for further reforms.

The paper presents a dynamic study of the Spanish labour market which tries to determine if it matches the characteristics of transitional labour markets from a fl exicurity approach. Employment trajectories of Spanish workers during the years 2007-2010 are studied using the Continuous Sample of Working Lives. This period covers the end of the expansion of the Spanish economy and the beginning of the current employment crisis. From the combination of the chosen topic, the approach, and the database used, this is a novel perspective in our country. The article shows evidence of the evolution of the employment and unemployment spells, the Spanish labour market turnover degree, and the diffi culties of some groups for carrying out transition between employment and unemployment. The results obtained show a labour market in which a) transitions have come to a halt, and b) there is high job insecurity.

China has been the world’s fastest growing economy in the past 30 years with its enterprises rapidly emerging and becoming leading players globally. In particular, the progressive integration into the international system has been spurred by China’s entry into the global trading regime of the World Trade Organization (WTO) in 2001. The 'go global' policy has been facilitating the rapidly growing engagement on the African continent of Chinese multinational companies (MNCs). As a promising tri-polar global economic entity, its growth of relations with Africa has been both unprecedented and impressive. As the Sino-Africa economic and business partnership surges forward, the matter of corporate social responsibility (CSR) is increasingly becoming an imperative ingredient for any successful business. It is noteworthy that responsible corporate citizens should take account of the impact of their investment on both economic and social arenas. However, it still remains uncertain what role Chinese MNCs have been playing in the continent’s sustainable development.
A Sino-Congo deal seems a positive way forward, accelerating the Democratic Republic of Congo’s (hereinafter referred to as Congo) regional economy, depressed due to years of war. Meanwhile, the escalating investment into Congo has raised controversies for its no-attachment policy, with increasing pressure imposed on China’s MNCs to take CSR more seriously. Particular concerns are focused on the multinationals’ inadequate environmental and human rights protection. The recent massive infrastructure investment is arguably perceived as a different interpretation of CSR, which has aroused a hot debate about whether China is heading for status as a responsible stakeholder in the international community. It is conducive to clarifying the paradoxical issue by addressing whether China’s recent approaches have the potential to facilitate CSR initiatives or hinder them in the long run.

This article aims to consider the role for a critical criminology outside the national dimension, highlighting its continuities with studies in the critical tradition which have suggested the need to address State criminality and criminogenic structures more in general, but also suggesting a critique of international criminal law as a governmentality project.It reconstructs the genealogy of the international criminal justice system, following on from Schmitt and other well known authors, but it focuses in specific on its paradoxes, contradictions and ambiguities rather than its purely political effect. The authors argue that critical criminologists should engage with the international dimension of crime and control and approach this venture of a international criminal justice system as the possibility of “telling the truth” about State atrocities without missing on using strategically the category of human rights and law to bring to the fore minoritarian interests which are
usually denied by power discourses and economic forces.
