Background: This paper explores and analyses the experiences of school-age street children. It specifically addresses the relationship of the street children who live on the streets of Sao Paulo (a large Brazilian metropolis), in relation to their experiences, with the policemen. Methods: The paper is a secondary analysis of date previously collected in 1999. The data were collected through individual semi-structured interviews, with 14 school-age children frequenting two city public refuges, with their legal guardians` consent. The text from transcribed interviews was organized according to the validity norms of `thematic analysis`, a technique of contents analysis method. The decomposing and reconstructing process of that analysis gave rise to thematic categories (among which `the police category`) that represented the reconstruction of the difficulties faced by the children in their development. Results and discussion: The children portrayed the police as an enemy, a fearful figure and one of the most agonizing street experiences. Rarely did the police have a positive image to them. According to the children, police violence occurs in three forms: through systematic police persecution in an effort to remove the children from the streets against their will; actions that had the deliberate intent to humiliate them with verbal or physical aggression; and through alleged sexual abuse, revealed by the children in a veiled manner. The authority that is supposedly intended to protect them is portrayed as one of the most feared social agents. Conclusion: The reported hostile behaviour of the policemen shows the state of vulnerability of those children living on the street. This situation must be focused like a health problem because it causes injury to development of children. Nurses can help them through organizing assistance to children in situation of personal and social risk in the school nursing and health institution.

Systems of distributed artificial intelligence can be powerful tools in a wide variety of practical applications. Its most surprising characteristic, the emergent behavior, is also the most answerable for the difficulty in. projecting these systems. This work proposes a tool capable to beget individual strategies for the elements of a multi-agent system and thereof providing to the group means on obtaining wanted results, working in a coordinated and cooperative manner as well. As an application example, a problem was taken as a basis where a predators` group must catch a prey in a three-dimensional continuous ambient. A synthesis of system strategies was implemented of which internal mechanism involves the integration between simulators by Particle Swarm Optimization algorithm (PSO), a Swarm Intelligence technique. The system had been tested in several simulation settings and it was capable to synthesize automatically successful hunting strategies, substantiating that the developed tool can provide, as long as it works with well-elaborated patterns, satisfactory solutions for problems of complex nature, of difficult resolution starting from analytical approaches. Currently, Portugal assumes itself as a democratic rule of substantive law State, sustained by a legal system seeking the right balance between the guarantee of fundamental rights and freedoms constitutional foreseen in Portugal’s Fundamental Law and criminal persecution. The architecture of the penal code lies with, roughly speaking, a accusatory basic structure, “deliberately attached to one of the most remarkable achievements of the civilizational democratic progress, and by obedience to the constitutional commandment”, in balance with the official investigation principle, valid both for the purpose of prosecution and trial. Regarding the principle of non self-incrimination - nemo tenetur se ipsum accusare, briefly defined as the defendant’s right of not being obliged to contribute to the self-incrimination, it should be stressed that there isn’t an explicit consecration in the Portuguese Constitution, being commonly accepted in an implicit constitutional prediction and deriving from other constitutional rights and principles, first and foremost, the meaning and scope of the concept of democratic rule of Law State, embedded in the Fundamental Law, and in the guidelines of the constitutional principles of human person dignity, freedom of action and the presumption of innocence. In any case, about the (in) applicability of the principle of the prohibition of self-incrimination to the Criminal Police Bodies in the trial hearing in Court, and sharing an idea of Guedes Valente, the truth is that the exercise of criminal action must tread a transparent path and non-compliant with methods to obtain evidence that violate the law, the public order or in violation of democratic principles and loyalty (Guedes Valente, 2013, p. 484). Within the framework of the penal process relating to the trial, which is assumed as the true phase of the process, the witness represents a relevant figure for the administration of criminal justice, for the testimonial proof is, in the idea of Othmar Jauernig, the worst proof of evidence, but also being the most frequent (Jauernig, 1998, p. 289). As coadjutant of the Public Prosecutor and, in specific cases, the investigating judge, the Criminal Police Bodies are invested with high responsibility, being "the arms and eyes of Judicial Authorities in pursuing the criminal investigation..." which has as ultimate goal the fulfillment of the Law pursuing the defense of society" (Guedes Valente, 2013, p. 485). It is in this context and as a witness that, throughout operational career, the Criminal Police Bodies are required to be at the trial hearing and clarify the Court with its view about the facts relating to occurrences of criminal context, thus contributing very significantly and, in some cases, decisively for the proper administration of the portuguese criminal justice. With regards to the intervention of Criminal Police Bodies in the trial hearing in Court, it’s important that they pay attention to a set of standards concerning the preparation of the testimony, the very provision of the testimony and, also, to its conclusion. Be emphasized that these guidelines may become crucial for the quality of the police testimony at the trial hearing, thus leading to an improvement of the enforcement of justice system. In this vein, while preparing the testimony, the Criminal Police Bodies must present itself in court with proper clothing, to read before and carefully the case files, to debate the facts being judged with other Criminal Police Bodies and prepare potential questions. Later, while giving his testimony during the trial, the Criminal Police Bodies must, summing up, to take the oath in a convincing manner, to feel comfortable, to start well by convincingly answering the first question, keep an attitude of serenity, to adopt an attitude of collaboration, to avoid the reading of documents, to demonstrate deference and seriousness before the judicial operators, to use simple and objective language, to adopt a fluent speech, to use nonverbal language correctly, to avoid spontaneity responding only to what is asked, to report only the truth, to avoid hesitations and contradictions, to be impartial and to maintain eye contact with the judge. Finally, at the conclusion of the testimony, the Criminal Police Bodies should rise in a smooth manner, avoiding to show relief, resentment or satisfaction, leaving a credible and professional image and, without much formality, requesting the judge permission to leave the courtroom. As final note, it’s important to stress that "The intervention of the Police Criminal Bodies in the trial hearing in Court” encloses itself on a theme of crucial importance not only for members of the Police and Security Forces, who must welcome this subject with the utmost seriousness and professionalism, but also for the proper administration of the criminal justice system in Portugal.

This text aims at showing the history of indigenous peoples’ mobilization in Colombia, the effects that it has brought about on Colombian democracy and political system, and the state’s reactions to their claims and actions. It will show how they have moved from class-based claims to a politics where identity claims have been central in their agenda and part of their strategies to negotiate with the state. It will also show the existing constitutional and legal framework that recognizes the rights of indigenous peoples, despite the context of persecution, murder, and forced displacement.

El estudio hasta el momento de la relación entre positivismo criminológico e ideario anarquista de entre siglos (XIX-XX), ha evidenciado la trascendencia del estudio de aquellos dos pensamiento en esa etapa histórica. El desarrollo de la Criminología como ciencia, así como del verdadero núcleo teórico y práctico del anarquismo español, se encuentra en aquel momento histórico de cambio de siglo. La construcción del tipo criminal anarquista, la política criminal desarrollada al efecto, así como las críticas, propuesta y posturas acerca de la cuestión criminal por parte de los anarquistas, revelan un auge discursivo y científico de ambas partes que estaban discutiendo sobre temas verdaderamente de fondo: aquellos sobre la naturaleza, el progreso y la forma de sociedad y Estado. Más allá de las disputas con aquellos autores de la Scuola Italiana, los anarquistas españoles, avivaron un interés decisivo en otro tipo de teorías como el darwinismo o el neomalthusianismo. Más allá del vehemente rechazo a la cárcel y al sistema estatal y capitalista en su conjunto, el desarrollo y utilización en propio sentido de la Ciencia, se fundamentó como herramienta política básica para el pensamiento anarquista. Por su parte, esa misma Ciencia positiva, era el comodín “objetivo” que se usaba de herramienta para una criminalización y persecución política de numerosas disidencias. Desentrañar, por un lado, cómo se articuló cada uno de esos discursos y qué implicaciones y relaciones tuvo, y por otro, qué herencia pervive de aquellas construcciones en nuestro sistema penal y político, son los puntos centrales de esta Tesis.

Esta dissertação propõe estudar o papel que a casa desempenha na vida dos cabo-verdianos residentes em Portugal, particularmente na região de grande Lisboa, observando-os como um grupo étnico, isto é, como um conjunto de pessoas que tem por referência a sua origem, ou os seus antepassados próximos em Cabo Verde, ou noutras regiões para onde estes tenham emigrado assim como os imigrantes que já regressaram a Cabo Verde. Por “origem” entendese tanto a procedência geográfica de um lugar que ficou distante, quanto a vinculação a determinados referenciais culturais. A imigração em causa é da segunda metade do século XX, cujas motivações ora são de ordem económica (movidos pelo sistema fundiário que não permitia o acesso à terra para a maioria das populações das ilhas, pobreza extrema, etc.), ora de ordem natural (escassez e irregularidade das chuvas, com as consequentes secas prolongadas e fomes, dizimando pessoas e gados), ora de ordem política (perseguição política, fuga à prestação de serviços militares na Guiné, antes e após o 25 de Abril). Assim, será dado uma especial atenção ao papel que a casa, sobretudo a que foi deixada em Cabo Verde, desempenha nas relações de parentesco de pessoas que se encontram espalhadas por diversos países, bem como todo o processo que enrola a construção e a manutenção da mesma.

Although the adder (Vipera berus) has a large distribution area, this species is particularly threatened in Western Europe due to high habitat fragmentation and human persecution. We developed 13 new microsatellite markers in order to evaluate population structure and genetic diversity in the Swiss and French Jura Mountains, where the species is limited to only a few scattered populations. We found that V. berus exhibits a considerable genetic differentiation among populations (global F-ST = 0.269), even if these are not geographically isolated. Moreover, the genetic diversity within populations in the Jura Mountains and in the less perturbed Swiss Alps is significantly lower than in other French populations, possibly due to post-glacial recolonisation processes. Finally, in order to minimize losses of genetic diversities within isolated populations, suggestions for the conservation of this species in fragmented habitats are proposed.

Résumé: Les vipères du genre Vipera sont des serpents venimeux distribués dans la totalité du Paléarctique. Malgré cette répartition considérable, elles sont extrêmement menacées, leur déclin étant principalement dû à la destruction et à la fragmentation de leur habitat ainsi qu'à la persécution humaine. Afin d'apporter de nouveaux éléments dans le contexte de la protection de ce groupe de reptiles, nous avons utilisé durant ce travail de thèse différents marqueurs moléculaires pour étudier la structuration génétique à petite et à large échelle chez trois espèces appartenant au genre Vipera. La première étude, une phylogéographie moléculaire de la vipère ammodytes (Vipera ammodytes), a montré dans l'ensemble de l'aire de répartition une forte structuration génétique provenant d'isolements antérieures au Pléistocène. La présence d'un nombre important de clades dans le centre des Balkans suggère que cette région a fourni de nombreux refuges isolés durant les glaciations. Ces dernières ont également eu un impact considérable sur la diversité génétique au sein de la majorité des clades, suite à d'importants goulots d'étranglement durant le Pléistocène. L'étude de la phylogéographie de la vipère aspic (Vipera aspis) a montré une différenciation génétique entre les populations présentes de chaque côté des Alpes, mais également une forte structuration interne avec la mise en évidence d'un refuge en France. Cette étude est la première à établir clairement l'utilisation d'un refuge français pour un vertébré terrestre. La troisième partie de cette thèse a étudié la phylogéographie de la vipère péliade (Vipera berus), espèce cible de ce travail. En plus de la mise en évidence d'un groupe génétique inattendu (localisé dans le nord de l'Italie, le sud de l'Autriche, le nord de la Slovénie et l'extrême sud-est de la Suisse), la variabilité génétique au sein du groupe nordique (comprenant les animaux de l'entier de l'aire de répartition de l'espèce à l'exception des individus du groupe italien et les animaux provenant des Balkans) est suffisamment importante pour conclure à l'utilisation de refuges glaciaires nordiques durant les dernières glaciations, en complément des refuges habituellement décrits pour la majorité des espèces animales (soit les péninsules ibérique, italienne et balakanique). Ces résultats nous ont conduit à effectuer une étude morphologique (quatrième partie) comparant les vipères péliades du "clade italien" et du "clade nordique" décrits ci-dessus. Seules de petites différences morphologiques ont pu être mises en évidence, malgré une séparation de ces groupes estimée à plus d'un million d'années. Une étude à plus petite échelle, centrée sur le Massif jurassien et certaines populations alpines et françaises, a été entreprise afin d'estimer leur diversité génétique et d'évaluer la structuration génétique entre les populations à l'aide de marqueurs microsatellites (cinquième partie). Une importante structuration a été observée entre les populations distantes de plus de 3 kilomètres, la structuration entre les populations plus proches étant plus limitée. De plus, une diversité génétique plus faible dans les populations jurassiennes et alpines comparativement aux populations du massif central et de la côte atlantique a été constatée, probablement due à une perte de diversité génétique lors de la recolonisation post-glaciaire. La sixième étude s'est intéressée au succès reproducteur des mâles de vipères péliades en conditions naturelles. Une corrélation entre la taille des mâles et leur succès reproducteur a été relevée, les individus de plus grande taille ayant un succès reproducteur plus élevé. Le taux de multipaternité a aussi été investigué, démontrant que la proportion de pontes issues de plusieurs pères est élevée (69%) malgré la faible densité de vipères observée sur le site étudié. Finalement, aucun lien entre le nombre de pères au sein d'une ponte et la mortalité des jeunes à la naissance n'a pu être mis en évidence, contrastant avec des travaux précédents. En conclusion, l'observation de la structuration très marquée chez les vipères péliades devrait permettre d'affiner les méthodes de protection de l'espèce dans le massif jurassien. A plus large échelle, l'importante structuration génétique observée chez les vipères ammodytes, aspic et péliade résultant de l'utilisation de nombreux refuges glaciaires, complémentaires aux refuges habituellement utilisés par les espèces animales, démontre l'intérêt de l'analyse phylogéographique des reptiles pour la compréhension des phénomènes de colonisation et d' extinction des populations durant la fin du Tertiaire et le Quaternaire. La mise en évidence chez les différentes espèces de vipères étudiées de nombreux groupes génétiques distincts (ESUs) devrait conduire à des modifications de la taxonomie ainsi qu'au statut de protection de ces espèces. Abstract: The vipers of the genus Vipera are venomous snakes widespread throughout the Palaearctic regions. Despite a large distribution area, several species are extremely threatened, especially due to the destruction and fragmentation of their habitats, as well as by human persecution. In order to increase the knowledge on these species and to improve their protection, several molecular markers have been used to investigate the genetic structure on small and large scales, within three species of the genus Vipera. The first study, a molecular phylogeography of the nose-horned viper (Vipera ammodytes), showed a considerable structuring throughout the distribution area, due to isolation into refugia before the Pleistocene. A high number of clades in the centre of the Balkans suggests that this region harboured numerous isolated glacial refugia during the last glaciation. Moreover, low genetic diversity within several clades implies that most populations of nose-horned vipers have suffered bottlenecks during the Pleistocene. The study of the phylogeography of the asp viper (Vipera aspis) showed genetic differentiation between populations on each side of the Alps, as well as considerable internal genetic structure, suggesting the use of a glacial refugium in France. This study is the first to establish firmly the occurrence of a French refugia for a terrestrial vertebrate. The third part of this work involved a phylogeographic study of the adder (Vipera berus), the target species of this thesis. Three clades were revealed: a Balkan clade (corresponding to the subspecies V. b. sachalinensis), an unexpected Italian clade (limited to northern Italy, southern Austria, northern Slovenia and southeasternmost corner of Switzerland) and a Northern clade clade (including adders of the whole distribution area excepted animals from the Balkan and the Italian clades). The genetic variability within the Northern clade is sufficiently high to conclude that a northern glacial refugia during the last glaciation, in addition to those refugia already described for the main species (Iberian, Italian and Balkan peninsula). These results motivated a morphological study (part four) comparing the adders from the Italian and the Northern clades describe above. Only small morphological differences have been found, despite the split between these two clades have taken place more than 1 million years ago. A study on a local scale, focused on the Jura Mountains, on a few populations in the Alps and France was, performed to estimate the genetic diversity and the genetic structure between populations using microsatellite markers (part five). Considerable structure was observed between populations separated by more than 3 kilometres, whereas the structure between closer populations is less marked. Moreover, lower genetic diversity in the populations from Jura Mountains and Alps was noticed compared to populations from Massif Central of Atlantic coast. Such loss of genetic variation probably followed post-glacial recolonisation. The sixth study focused on the reproductive success of male adders in the wild. A positive correlation between body length and reproductive success was observed. Multiple paternity was also observed in most of clutches (69%) despite the low density of adders in the study area. Finally, no relationship was found between the number of fathers in a clutch and the survival of offspring at birth, contradicting previous studies. To conclude, the observation of a significant genetic structure in Vipera berus will enable recommendations to be made to improve protection of this species in the Jura Mountain. On a larger scale, the considerable genetic structure found within Vipera ammdoytes, V. aspis and V. berus, resulting from isolation in additional glacial refugia to those already described for other species, demonstrates the relevance of phylogeographic studies of reptiles to better understand the colonisation and disappearance during the last Tertiary and the Quaternary. The observation of several groups of evolutionary significant units (ESUs) within the three studied species might lead to a revision of the taxonomy, as well as their conservation status.

The objective of my thesis is to assess mechanisms of ecological community control in macroalgal communities in the Baltic Sea. In the top-down model, predatory fish feed on invertebrate mesograzers, releasing algae partly from grazing pressure. Such a reciprocal relationship is called trophic cascade. In the bottom-up model, nutrients increase biomass in the food chain. The nutrients are first assimilated by algae and, via food chain, increase also abundance of grazers and predators. Previous studies on oceanic shores have described these two regulative mechanisms in the grazer - alga link, but how they interact in the trophic cascades from fish to algae is still inadequately known. Because the top-down and bottom-up mechanisms are predicted to depend on environmental disturbances, such as wave stress and light, I have studied these models at two distinct water depths. There are five factorial field experiments behind the thesis, which were all conducted in the Finnish Archipelago Sea. In all the experiments, I studied macroalgal colonization - either density, filament length or biomass - on submerged colonization substrates. By excluding predatory fish and mesograzers from the algal communities, the studies compared the strength of the top-down control to natural algal communities. A part of the experimental units were, in addition, exposed to enriched nitrogen and phosphorus concentrations, which enabled testing of bottom-up control. These two models of community control were further investigated in shallow (<1 m) and deep (ca. 3 m) water. Moreover, the control mechanisms were also expected to depend on grazer species. Therefore different grazer species were enclosed into experimental units and their impacts on macroalgal communities were followed specifically. The community control in the Baltic rocky shores was found to follow theoretical predictions, which have not been confirmed by field studies before. Predatory fish limited grazing impact, which was seen as denser algal communities and longer algal filaments. Nutrient enrichment increased density and filament length of annual algae and, thus, changed the species composition of the algal community. The perennial alga Fucus vesiculosusA and the red alga Ceramium tenuicorne suffered from the increased nutrient availabilities. The enriched nutrient conditions led to denser grazer fauna, thereby causing strong top-down control over both the annual and perennial macroalgae. The strength of the top-down control seemed to depend on the density and diversity of grazers and predators as well as on the species composition of macroalgal assemblages. The nutrient enrichment led to, however, weaker limiting impact of predatory fish on grazer fauna, because fish stocks did not respond as quickly to enhanced resources in the environment as the invertebrate fauna. According to environmental stress model, environmental disturbances weaken the top-down control. For example, on a wave-exposed shore, wave stress causes more stress to animals close to the surface than deeper on the shore. Mesograzers were efficient consumers at both the depths, while predation by fish was weaker in shallow water. Thus, the results supported the environmental stress model, which predicts that environmental disturbance affects stronger the higher a species is in the food chain. This thesis assessed the mechanisms of community control in three-level food chains and did not take into account higher predators. Such predators in the Baltic Sea are, for example, cormorant, seals, white-tailed sea eagle, cod and salmon. All these predatory species were recently or are currently under intensive fishing, hunting and persecution, and their stocks have only recently increased in the region. Therefore, it is possible that future densities of top predators may yet alter the strengths of the controlling mechanisms in the Baltic littoral zone.

The present investigation looks into the attitudes toward death in Paul’s authentic letters, and puts them in relation to modern theories of psychological coping. Drawing on psychologically-oriented hermeneutic theory, and theories about psychological coping in particular, I argue that each case of psychological coping must be understood in its historical situation as strategies emanating from a specific person’s subjective appraisal (cf. Pargament, Lazarus and Folkman). Paul’s letters frequently refer to persecution and violent death. To aid in psychological coping is often integral to the purpose of the letters, which makes the perspective of psychological coping akin to their genre. In the course of a tentatively assumed chronological order of 1 Thessalonians, Galatians, 1 Corinthians, 2 Corinthians, Romans, Philippians, and Philemon, Paul moves from the perception of Jesus dying for the faithful to the understanding of dying with Jesus. His coping strategies concerning death are gradually transformed from conservative and deferring coping styles, to a more self-directing coping style, to collaborative and transformative coping styles, and finally to a new sense of deferring coping style in prison. The last case of deferring coping carries the traits of generosity and flexibility even in the face of death, which is in contrast to his previous letters. Through his correspondence, we see Paul’s attitude toward death transformed from denial to reaction, to processing, to acceptance (cf. Lindemann, Kübler-Ross, Bowlby, Parkes, among others). His strategies also shift in accordance with these understandings. Denial is accompanied by diversion, threat by aggression, processing by rumination, and acceptance by joy. The study shows the hermeneutic benefits of reading Paul’s letters as the rhetorically framed expressions of a person in a particular historical situation. The letters open small windows through which we can glimpse the coping process of a person of antiquity. In adopting the method of psychological exegesis, the study shows that the variety of attitudes toward death in Paul’s letters makes sense from the perspective of psychological coping. The psychological aspect of these letters is an underexamined richness that can extend into areas of contemporary individual and group identity, and from there to public policy and ethics.

Graffiti, Memory and Contested Space: Mnemonic Initiatives Following Periods of Trauma and/or Repression in Buenos Aires, Argentina This thesis concerns the popular articulation ofmemory following periods or incidents of trauma in Argentina. I am interested in how groups lay claim to various public spaces in the city and how they convert these spaces into mnemonic battlegrounds. In considering these spaces of trauma and places of memory, I am primarily interested in how graffiti writing (stencils, spray-paint, signatures, etchings, wall-paintings, murals and installations) is used to make these spaces transmit particular memories that impugn official versions of the past. This thesis draws on literatures focused on popular/public memory. Scholars argue that memory is socially constructed and thus actively contested. Marginal initiatives such as graffiti writing challenge the memory projects of the state as well as state projects that are perceived by citizens to be 'inadequate,' 'inappropriate,' and/or as promoting the erasure of memory. Many of these initiatives are a reaction to the proreconciliation and pro-oblivion strategies of previous governments. I outline that the history of silences and impunity, and a longstanding emphasis on reconciliation at the expense of truth and justice has created an environment of vulnerable memory in Argentina. Popular memory entrepreneurs react by aggressively articulating their memories in time and in space. As a result of this intense memory work, the built landscape in Buenos Aires is dotted with mnemonic initiatives that aim to contradict or subvert officially sanctioned memories. I also suggest that memory workers in Argentina persistently and carefially use the sites of trauma as well as key public spaces to ensure official as well as popular audiences . The data for this project was collected in five spaces in Buenos Aires, the Plaza de Mayo, Plaza Congreso, La Republica Cromanon nightclub, Avellaneda Train Station and El Olimpo, a former detention centre from the military dictatorship.
