Focusing on paid work that blurs traditional legal boundaries and the challenge this poses to traditional forms of labour regulation, this collection of original case studies illustrates the wide range of different forms of regulation designed to provide decent work. The original case studies cover a diversity of workers from across developed and developing countries, the formal and informal economies and public and private work spaces. Each deals with the failings of traditional labour law, and several explore the capacity of different forms of regulatory techniques, such as commercial law, corporate codes of conduct, or supply chain regulation, to protect workers.

This paper reports on a number of blended learning activities conducted in two subjects of a Master of Architecture degree at a major Australian university. The subjects were related to “professional practice” and as such represent a little researched area of architectural curriculum. The research provides some insight into the student perceptions of learning opportunity and engagement associated with on-line delivery modes. Students from these two subjects were surveyed for their perceptions about the opportunity for learning afforded by the on-line components, and also for their perceived level of engagement. Responses to these perceptions of traditional and on-line modes of delivery are compared and analysed for significant differences. While students were generally positive in response to the learning experiences, analysis of the results shows that students found the traditional modes to assist in their learning significantly more than on-line modes. Students were neutral regarding the opportunity for engagement that on-line modes provided. Analysis of the students’ gender, age and hours of paid work was also conducted to ascertain any relationship with attitudes to the flexibility of on-line delivery; no significant relationship was detected. This study has shown that students were generally resistant to on-line engagement opportunities and their ability to support learning.

Your money or your life? A qualitative follow-up study of the young unemployed from an actor perspective is a qualitative and longitudinal study following 36 unemployed young people in Helsinki over a span of ten years. The purpose of the study is to shed light on how a few young people view employment/unemployment and their lives and future, how they as unemployed perceive their encounters with society, and how society supports them. Four so-called key informants were followed at a finer level of empirical detail. They were chosen for the thematic interviews because of their different personalities, starting points and preferences. Although some differences were expected, what the results show is quite striking. The individual stories raise a number of questions about differences between young people, about society s view of the young unemployed, and about the principles behind the so-called activation policy and how society s support is distributed. The key informants descriptions underline that the group young unemployed does not consist of individuals who are alike but that life is complex, that paid work and unemployment can be perceived very differently, and that background and unofficial support can have consequences for self-perception and for ways of looking at the future, vocational choices, paid work and activation policy. Margaret S. Archer s theory of Morphogenesis and Barbara Cruikshank s theory of constructing democracies compose the study s theoretical framework. The key informants stories give a picture of a formal support system that, even though it puts part of the responsibility for unemployment on the individuals themselves, in the name of fairness and equality, treats them in an impersonal way, not giving their personal situation and wishes much weight. As a consequence, those who share the dominant values of society do well, while others who do not are faced with difficulties. The bigger the gap between society s and the individual s values, the bigger the risk to be met by little understanding and by penalties. And vice versa: Those who initially have the right values and know how to deal with authorities get heard and their opinions get accepted. The informants ask for a more personal encounter, which could improve both the atmosphere and the clients experiences of being heard. Still the risk of having a more individualistic system should be addressed, as a new system might generate new winners, but just as well give new losers. Finally, we have to ask if the so-called activation policy is looking for answers primarily to a macro-level problem on the micro-level. If it does not produce more jobs, its support for the unemployed will be insignificant. It is not enough to think about what to do at the grassroots level to make the system more functional and support job-seeking. If the current rate of unemployment endures, the quality of life of the unemployed should be addressed. A first step could be taken by placing less guilt on the unemployed. Instead of talking about activating the unemployed, discussion should be targeted at removing structural impediments to employment. If we want to have less polarisation between the those with paid work and those without, who often struggle with low incomes, we need to include the macro-level in the discussion. What does high unemployment mean in a work-based society, where the individual s self-perception and important social forms of support are linked to labour income? And what can be done at the macro-level to change this undesirable condition at the micro-level? Abstract: Although he is the most prolific writer of the Greek Anthology, Palladas’ life is almost unknown. But, in spite of the limited biographical data, his work has fortunately been preserved in the GA. Because of his literary creation, the old times rewarded him with the nickname Μετέωρος, high, since the literary merits of a hundred poems of his authorship was recognized (others are discussed by critics). A dozen of them contains invaluable information about the political, religious and social situation in Alexandria immediately after the victory of the bishop Theophilus, Cyril’s predecessor and uncle, during the conflict between Christians and Gentiles, each sector backed up by an Alexandrian population segment (cfr. 9.528, 10.82, 10.85) . Resigned at times, constantly demanding, Palladas complains about the decline of the belief professed by him due to the increasing penetration of the new faith. Therefore, four epigrams record the conversion of the temple of Tyche into a tavern (9.180-183) and 10.90 seems to attack the doctrine of the Resurrection. When religion and politics go hand-in-hand, when religious conspiracies link up with palace intrigues, consequences are predictable: a man called Doroteo denounced him for his negative response to the new dogma, which caused him the loss of his teacher paid work. His annoyance was even greater with further sufferings, chiefly economic, and he had to sell his books (9.171 and 9.175) among other desperate decisions Forewarned about his radical bitterness against Church, it is just to make clear that he is not fully acquiescent with ancient gods and heroes. Thus, in 5.257 he questions Zeus’ ars amandi, in 9.377 refutes Tantalus’ possibility of thirst and hunger in Hades and 9.773 mischievously points out that Eros has been changed into a pan. The work begins with the selection, personal translation and comprehensive analysis of twenty two epigrams. Through such philological aid, we attempt to verify the frictions and the main perceptible factors in his poetic creation to justify his worldview, according to the pagan sentiment widespread in that time before the twilight already overwhelming of its ailing traditions

[ES] Este artículo se centra en el estudio de las políticas familiares que se han implantado en los países de nuestro entorno europeo y sus consecuencias sobre las mujeres en términos de bienestar y de igualdad. La paulatina e irreversible incorporación de las mujeres al mercado de trabajo no solo ha modificado la estructura familiar sino que también ha puesto de manifiesto la estrecha relación entre el trabajo remunerado y el trabajo no remunerado, es decir, el trabajo doméstico y el trabajo de cuidados tanto de la infancia como de las personas dependientes. El objetivo que se persigue es examinar y comparar el grado de compromiso que tienen estos países tanto con el bienestar de la infancia como con la igualdad entre mujeres y hombres, a través de los instrumentos que permiten articular la vida familiar con la vida laboral fomentando la participación masculina en el trabajo de cuidados así como la participación femenina en el empleo remunerado.

Este trabajo analiza los avances logrados y las desigualdades existentes en el mercado laboral y en el trabajo no remunerado con respecto a las mujeres, con especial incidencia en la C.A. de Euskadi. En primer lugar, se reflexiona de forma general sobre las medidas promovidas desde distintos niveles: europeo, estatal y de la C.A. de Euskadi, y la evolución que ha ido experimentando la sociedad para fomentar la igualdad entre mujeres y hombres. En segundo lugar, se hace un recorrido a través de los análisis teóricos de la desigualdad. En tercer lugar, se analiza la situación laboral de las mujeres vascas en comparación con la de los hombres, con especial atención en el trabajo no remunerado, la actividad laboral, el paro y los salarios. Finalmente, quedan planteadas una serie de conclusiones a las que se llega tras realizar el análisis.

[ESP] El objetivo de este artículo es relacionar las características de la inserción laboral femenina con su grado de participación en el mercado laboral en los países de la Unión Europea a través de los datos proporcionados por Eurostat. Nos interesa conocer si una mayor participación laboral entre las mujeres va aparejada con un modelo laboral “femenino”, esto es, con empleos a tiempo parcial, temporales, de baja remuneración y en determinados sectores y ocupaciones. O si por el contrario, en los países en los cuales la tasa de empleo femenina es elevada y hay menor brecha con respecto a la de los hombres, el modelo de inserción laboral de mujeres y hombres es similar. La diversidad de los mercados de trabajo y también de las políticas públicas y de las estructuras productivas en un área tan amplia como al UE27, nos impide establecer modelos de inserción laboral femenina claros, aunque sí hemos podido apuntar rasgos comunes con respecto a las desigualdades de género entre países.

This book provides a systematic introduction in the German gender equality acts for public services, and also a section per section commentary for each individual act. It analyses the legal base, limits and scope of the so called women's quota, gender mainstreaming in public employment and public policy, provisions to allow conciliation of paid work and work in families and the position of women's equality officers. It compares and analyses 16 state acts and the federal equality act. The introductory chapter, written by Dagmar Schiek, also provides an analysis of the EU level and constitutional frame for this legislation. The combination of a systematic introduction and a section by section commentary ensures that this valuable handbook can be used by trained lawyers as well as by social scientists, taking into account the fact that many equality officers are not trained lawyers.

Abstract This research takes the lens of social reproduction as a starting point for an examination of the effects of recent social welfare reforms on the lives o.fsingle mothers. As the cumulative effects o.f diminishing state provided benefits take hold, tensions are heightened as single mothers internalize the insecurity of earning an income in 11 capitalist labour market, while trying to carry out all that is involved in social reproduction with inadequate means of survival. Through interviewing single mothers who are the recipients of mUltiple state provided benefits (social assistance, student loans, subsidized housing and subsidized childcare), this thesis illuminates the cOl1linued regulation of women in an effort to assure that social reproduction is occurring at the lowest cost possible. State provided benefits are set lip in such a way that it is near impossible for single mothers to make ends meet without entering the labour force or entering into co-residential relationships. This push towards the labour force and/or marriage via punitive welfare policies illuminates the devaluation of the labour that is done at home. Through interviewing 5 single mothers, I will demonstrate the extensive labour that goes into maintaining their households. In addition .J case managers are interviewed. The employees of social assistance, subsidized hOllsing, subsidized childcare and student loans, have much agency in deeming who is worthy of receiving benefits. The employees of these agencies have the ability to make these women's lives easier or more complicated by how the workers interpret the policy regulations. Social policies are of paramount importance in the quest for women's equality and thus have consequences for how women's daily lives are organized. The rules and regulations that govern the individual policies are complex and bureaucratic and have implications for the ways in which women must organize their lives in order to survive. The shifts in social policy have been guided by neo-liberal assumptions with a focus on individual responsibility and a market-modeled welfare state. The caring work that is involved in raising children to be productive in a capitalist society is ignored or devalued in current policies. The emphasis in each polic.:v is on getting women who receive benefits into the paid work force, with little facilitation or investment into the caring work these women do on a daily basis that in turn supports capitalism. Policies, such as social assistance, subsidized housing, subsidized childcare and student loans, are set up in such a way that ignores the reality of women's day-to-day lives and devalues the necessary work done at home. It takes an abundance of labour and strategizing for women to seek out necessary means of survival, labour that is amplified when a woman is dealing with mUltiple slate provided benefits.

Cette thèse examine la façon dont on interprète la santé et le bien-être des travailleuses célibataires et sans enfant au sein de deux types de récits : ceux provenant d’études publiées dans des périodiques (récits scientifiques) et ceux provenant d’entrevues qualitatives avec des membres de ce groupe (récits profanes). Sur le plan démographique, leur nombre est significatif; elles représentent 28% des employées canadiennes. Par contre, leur santé/bien-être est peu visible dans les écrits de recherche. Dans les sciences sociales, plusieurs études portent sur l’expérience parfois éprouvante d’être un adulte célibataire vivant dans une culture orientée sur le couple et la famille. Elles mettent l’accent sur le stigma associé à ce statut. Certains suggèrent même que les pratiques de recherche peuvent contribuer à la perpétuation de représentations négatives à l’égard des célibataires. En ayant un profil qui pourrait être symbolique d’une déviation vis-à-vis des attentes normatives entourant la vie de couple ou de famille, les travailleuses célibataires et sans enfant semblent un point de repère utile pour évaluer cette dernière possibilité. S’attarder autant aux récits scientifiques que profanes permettrait d’explorer les tensions et convergences entre eux. Suivant cet objectif, un échantillon de 32 articles scientifiques et de 22 retranscriptions d’entrevues ont été analysés selon une approche d’analyse de discours guidée par les concepts de répertoire interprétatif (une façon cohérente d’aborder un sujet donné) et de position du sujet (une identité mise en évidence par une façon de parler ou d’écrire). Trois articles ont émergé de cette recherche. Suite à une analyse des thèmes communs utilisés dans l’interprétation de la santé/du bien-être du groupe en question, un répertoire interprétatif surnommé la famille comme référence a été identifié. Ce répertoire expliquerait notamment la tendance observée d’expliquer leur santé/bien-être en référant aux états et aux charactéristiques d’être parent ou partenaire. Cette pratique peut avoir l’effet de voiler leur vie privée ou de la construire comme étant relativement appauvrie. L’article 2 examine comment les membres de ce groupe construisent leur propre bien-être. Il identifie la notion d’équilibre entre plusieurs sphères de vie et une identité de femme dynamique comme éléments centraux aux récits sur leur bien-être. Ces derniers vont à l’encontre de la perception des célibataires ou des personnes sans enfant comme ayant des vies moins épanouies ou enrichies et qui ne sont pas touchées par des questions de conciliation travail-vie personnelle. Le troisième article rassemble les deux types de récits autour des sujets de l’emploi et du statut de célibataire en lien avec le bien-être. Il met en évidence de nombreuses similarités et divergences, et théorise la fonction de ces diverses constructions. En conclusion, j’avance qu’une perspective plus critique face au statut de couple ou familial et de ses aspects normatifs pourrait offrir à la recherche en santé publique un point de réflexivité à développer davantage.

Cette étude porte sur la culture de travail des femmes qui ont été à l’emploi du grand magasin Dupuis Frères de Montréal entre 1920 et 1960. Nous nous intéressons aux particularités du travail salarié féminin dans le domaine de la vente au détail au Québec, mais aussi à la nature et à l’évolution de cette culture de travail de même qu’à ses liens avec les changements qui surviennent à l’époque dans la construction des nouvelles normes de la féminité respectable. D’une part, notre but est de montrer que pour les travailleuses de Dupuis, leur emploi leur permet de gagner leur vie certes, mais aussi de l’agrémenter, de se divertir au moyen de loisirs organisés par l’entreprise et de créer des liens entre elles. À travers la culture de travail qu’elles y développent, ces femmes se créent une identité particulière. Nous soulignons aussi que Dupuis Frères, dans un esprit paternaliste, encadre de près ses employées et exploite leur culture de travail afin de s’assurer de leur loyauté et de maintenir sa bonne réputation auprès de l’opinion publique. D’autre part, nous cherchons à prouver que même si la culture des femmes à l’emploi de Dupuis au cours de cette période est largement influencée par la domesticité et l’idéologie des sphères séparées, caractéristiques de la féminité « traditionnelle » dominante, elle intègre néanmoins de plus en plus, surtout à partir de la Deuxième Guerre mondiale, de nouvelles dimensions plus « modernes » de la féminité qui ne remplacent pas l’idéal de la mère-ménagère, mais qui viennent plutôt s’y greffer et qui rendent, du coup, leur identité féminine plus complexe.

Ce travail de mémoire porte sur le processus d’insertion sociale et économique des personnes vivant des problèmes de santé mentale. Le travail est devenu un important véhicule d’intégration sociale. En effet, on prétend que la pratique d’un métier serait pour les personnes souffrant de problèmes de santé un outil de rétablissement et de mieux-être, car elle permet de réduire les symptômes et l’incidence des hospitalisations. Le travail permet, également, d’augmenter les interactions sociales et de contribuer activement à la société. Il existe, toutefois, d’autres véhicules d’intégration qui semblent, sous certains angles, apporter les mêmes avantages. Les activités bénévoles améliorent la qualité de vie, favorisent les interactions sociales et donnent, à l’individu, l’occasion de contribuer à sa communauté. Par ailleurs, le retrait social peut être un moyen de s’éloigner des pressions sociales et de s’accorder une pause bénéfique. On soutient que les personnes ayant un problème de santé mentale qui ont une lecture positive de leur situation de marginalité tendent à être moins hospitalisées. S’appuyant sur une démarche qualitative, ce travail de recherche a tenté de cerner les perspectives, les questionnements et les perceptions des personnes ayant un trouble mental à l’égard d’un processus d’intégration socioprofessionnelle, de participation sociale et de retrait social. Des entrevues semi-dirigées ont été menées auprès de onze personnes, et grâce à ces entretiens, un portrait au regard de leurs parcours social et professionnel a pu être brossé. Les entretiens ont permis d’explorer l’impact des problèmes de santé mentale sur leur réalité et sur leur identité, leurs représentations du marché de l’emploi et les motifs qui justifient le choix de s’engager ou de renoncer à un processus d’intégration socioprofessionnelle. Les résultats de cette recherche ont permis d'identifier cinq facteurs qui peuvent influencer la décision des personnes qui sont le rapport à l'environnement social, l'identité, le rapport aux institutions de l'État, les discours de légitimation et les perspectives d'avenir. Les résultats démontrent que l'on ne peut isoler les notions de vulnérabilité, d'autonomie, de bien-être ou de stabilité dans une phase spécifique. La vulnérabilité, l'autonomie, le bien-être et la stabilité sont des états que l’on peut vivre en situation de retrait social, de participation sociale et d’intégration socioprofessionnelle. Selon les circonstances et l’état émotif, ils peuvent être des modes adaptés ou inadaptés.

Este estudio pretende desentrañar las razones que han pesado en el imaginario social a la hora de asignar los roles domésticos y de cuidado familiar exclusivamente a las mujeres, con la consecuencia de disminuir y, en algunos casos, casi anular sus oportunidades a la hora de acceder a un trabajo remunerado o de mejorar sus condiciones laborales. La propuesta frente a esta realidad es que el derecho actúe como equilibrador de las oportunidades de hombres y mujeres en el acceso al empleo y en el derecho al trabajo, lo que se logrará si se atacan las causas que generan esas desigualdades, entre ellas, unas de las más poderosas son las responsabilidades familiares y domésticas, que deben ser redistribuidas equitativamente entre hombres y mujeres, y donde el Estado debe intervenir facilitando espacios de cuidado y atención para niños/as y adultos mayores.

This paper considers how employment laws are being used in response to what we have termed ‘the eldercare/workplace conundrum’. It is well known that people are now living longer but health is still failing in a significant percentage of older people, meaning that many adults require care for longer, albeit to varying degrees and for varying amounts of time. Many of these individuals will receive care from relatives or close friends who are participating in the labour market: this is increasingly likely as adults are expected / wanting to remain in paid work for longer, often into their 60s and 70s. The requirements of elderly dependants can cause these workers huge difficulties and dilemmas as they attempt, across time, to accommodate the particular needs of the person for whom they wish to provide care, often a loved one, and meet the particular demands of their employment relationship. In this paper we consider why this is an area of social policy that warrants effective legal engagement and consider, drawing on various examples of legal responses in other countries that face similar conundrums, what might improve legal engagement in this area.
