In BHP Coal Pty Ltd v K Orenstein & Koppel AG (No 2) [2009] QSC 64 McMurdo J considered the circumstances in which the ordinary rule under r 681 of the Uniform Civil Procedure Rules 1999 (Qld) (UCPR) that costs should follow the event should be departed from in favour of a party who was unsuccessful overall, but who succeeded on particular questions. When the court is satisfied that a departure from the usual order under r 681 of the UCPR is justified, it appears increasingly willing to exercise the power in r 684(2) to declare what percentage of costs was applicable to a particular issue

In Hogan v Ellery [2009] QDC 154 McGill DCJ considered two applications for leave to deliver interrogatories under r 229 of the Uniform Civil Procedure Rules 1999 (Qld) (UCPR). The judgment provides useful analysis of the circumstances in which a plaintiff may obtain leave to deliver interrogatories to a defendant in defamation proceedings, and also to a non-party before action.

Trial by jury in civil proceedings : “convenience” and the philosophy of the UCPR

In Syddall v National Mutual Life Association of Australasia Limited [2008] QSC 101 Daubney J ordered the action be tried without a jury. His judgment considered the circumstances in which a trial involves any technical, scientific or other issue that can not be “conveniently” considered and resolved by a jury as provided in r 474 of the Uniform Civil Procedure Rules 1999 (Qld)

UCPR r243 - notice of non-party disclosure - obligation to state allegation to which documents sought are directly relevant

In Deppro Pty Ltd v Hannah [2008] QSC 193 one of the matters considered by the court related to the requirement in r 243 of the Uniform Civil Procedure Rules 1999 (Qld) that a notice of non-party disclosure must “state the allegation in issue in the pleadings about which the document sought is directly relevant.”The approach adopted by the issuing party in this case of asserting that documents sought by a notice of non-party disclosure are relevant to allegations in numbered paragraphs in pleadings, and serving copies of the pleadings with the notice, is not uncommon in practice. This decision makes it clear that this practice is fraught with danger. In circumstances where it is not apparent that the non-party has been fully apprised of the relevant issues the decision suggests an applicant for non-party disclosure who has not complied with the requirements of s 243 might be required to issue a fresh, fully compliant notice, and to suffer associated costs consequences.

The decision of Durward SC DCJ in OSM Group Pty Ltd v Holden [2013] QDC 151 involves a useful consideration of the requirements relating to the pleading of denials and non-admissions under the Uniform Civil Procedure Rules 1999 (Qld) (UCPR). In Mitchell Contractors Pty Ltd v Townsville-Thuringowa Water Supply Joint Board [2004] QSC 329, Douglas J considered the issue of broad significance for litigation practitioners of whether draft expert reports fall within the description in r212(2) of the Uniform Civil Procedure Rules 1999 (Qld) of documents "consisting of a statement or report of an expert" and are therefore not privileged from disclosure.

A 330-360 GHz spectral survey of G 34.3+0.15 .1. Data and physical analysis

A 330--360 GHz spectral survey of the hot molecular core associated with the 'cometary' ultracompact HII region G 34.3+/-0.15 observed with the James Clerk Maxwell Telescope has detected 338 spectral lines from at least 35 distinct chemical species plus 19 isotopomers. 70 lines remain unidentified. Chemical abundance and rotation temperature have been determined by rotation diagram analysis for 12 species, and lower limits to abundance found for 38 others.

Análisis de los elementos de Soft Power presentes en la política exterior alemana de cooperación para el desarrollo (2002-2009)R ALEMANA DE COOPERACIÓN PARA EL DESARROLLO (2002-2009)

A lo largo de la historia el Sistema Internacional se ha configurado a partir de los diferentes polos de poder y de diversas formas de interacción entre actores. Una de estas formas es la cooperación internacional, la cual abre el espacio a nuevos asuntos dentro de la agenda internacional y permite profundizar la colaboración en determinados temas de interés de los actores. Esta forma de relacionamiento puede ser entendida como una herramienta de Soft Power definiéndose éste como un elemento que permite a los Estados influenciar dentro del sistema internacional por medio de acciones no bélicas y que facilita el acercamiento de los países desarrollados con los países en vías de desarrollo para moldear el sistema internacional. Siguiendo esta idea, el Estado Alemán ha implementado el uso del Soft Power dentro de su política exterior buscando generar beneficios tanto a Alemania como para los Estados receptores de cooperación. Alemania ha redefinido sus prioridades: ajustar y reorganizar sus estrategias de cooperación para optimizar recursos, teniendo en cuenta la historia alemana y los cambios estructurales que las dos guerras mundiales generaron en la perspectiva de su política exterior. La fuerte y firme estructura política, económica y social ha permitido que este sea el único país de la Unión Europea que no ha sufrido directamente la crisis económica y por lo tanto ha logrado seguir aportando parte de su PIB a la cooperación internacional. Esto ha generado un diálogo político entre diferentes países, el cual permite el acercamiento con los gobiernos de turno en cada Estado para la creación de políticas encaminadas al desarrollo y al mejoramiento de la calidad de vida de los ciudadanos.

La evaluación implica la recogida sistemática de información para cualificar la toma de decisiones. Una de las tareas principales consiste en tomar la decisión acerca de qué información es necesaria y cómo se puede recoger puesto que la toma de decisiones basada en información rigurosa supera con creces la que se realiza sin esa información. Una de las evaluaciones empleadas en el mundo empresarial y extrapolable al ámbito de la dirección escolar es la evaluación 360 grados, consistente en la recolección de información de ámbitos que rodean al sujeto evaluado: las percepciones del superior inmediato, de los colegas con los que trabaja, y de los usuarios del servicio. Esta evaluación proporciona, mediante la comparación de percepciones, un resumen de los puntos fuertes y las áreas de mejora. Para concluir se incluyen varias herramientas y cuestionarios que permiten implementar un proceso de la evaluación 360 grados.

Search for R-parity violating supersymmetry via the LL(E)over-bar couplings lambda(121), lambda(122) or lambda(133) in p(p)over-bar collisions at root s=1.96 TeV

A search for gaugino pair production with a trilepton signature in the framework of R-parity violating supersymmetry via the couplings; lambda(121), lambda(122), or lambda(133) is presented. The data, corresponding to an integrated luminosity of L approximate to 360 pb(-1), were collected from April 2002 to August 2004 with the D0 detector at the Fermilab Tevatron Collider, at a center-of-mass energy of root s = 1.96 TeV. This analysis considers final states with three charged leptons with the flavor combinations eel, mu mu l, and ee tau (l = e or mu). No evidence for supersymmetry is found and limits at the 95% confidence level are set on the gaugino pair production cross section and lower bounds on the masses of the lightest neutralino and chargino are derived in two supersymmetric models. The r-matrix of the Alday-Arutyunov-Frolov model

We investigate the classical integrability of the Alday-Arutyunov-Frolov model, and show that the Lax connection can be reduced to a simpler 2 x 2 representation. Based on this result, we calculate the algebra between the L-operators and find that it has a highly non-ultralocal form. We then employ and make a suitable generalization of the regularization technique proposed by Mail let for a simpler class of non-ultralocal models, and find the corresponding r- and s-matrices. We also make a connection between the operator-regularization method proposed earlier for the quantum case, and the Mail let's symmetric limit regularization prescription used for non-ultralocal algebras in the classical theory.

Applying the National Institute for Clinical Excellence criteria to patients treated with the Genous (TM) Bio-engineered R stent (TM): a sub-study of the e-HEALING (Healthy Endothelial Accelerated Lining Inhibits Neointimal Growth) worldwide registry

The National Institute for Clinical Excellence (NICE) guidelines recommend the use of bare-metal stents (BMS) in non-complex lesions with a low risk of restenosis (diameter a parts per thousand yen3 mm and lesion length a parts per thousand currency sign15 mm) and the use of drug-eluting stents (DES) in more complex lesions with a high risk of restenosis (diameter < 3.0 mm or lesion length > 15 mm). However, the guidelines were created based on studies evaluating BMS and DES only. We performed an analysis of patients undergoing non-urgent percutaneous coronary intervention with the novel endothelial cell capturing stent (ECS). The ECS is coated with CD34(+) antibodies that attract circulating endothelial progenitor cells to the stent surface, thereby accelerating the endothelialization of the stented area. We analyzed all patients enrolled in the worldwide e-HEALING registry that met the NICE criteria for either low-risk or high-risk lesions and were treated with a parts per thousand yen1 ECS. The main study outcome was target vessel failure (TVF) at 12-month follow-up, defined as the composite of cardiac death or MI and target vessel revascularization (TVR). A total of 4,241 patients were assessed in the current analysis. At 12-month follow-up, TVF occurred in 7.0% of the patients with low-risk lesions and in 8.8% of the patients with high-risk lesions (p = 0.045). When evaluating the diabetic patients versus the non-diabetic patients per risk group, no significant differences were found in TVF, MI or TVR in either risk group. The ECS shows good clinical outcomes in lesions carrying either a high or a low risk of restenosis according to the NICE guidelines with comparable rates of cardiac death, myocardial infarction, and stent thrombosis. The TVF rate with ECS was slightly higher in patients with high-risk lesions, driven by higher clinically driven TLR. The risk of restenosis with ECS in patients carrying high-risk lesions needs to be carefully considered relative to other risks associated with DES. Furthermore, the presence of diabetes mellitus did not influence the incidence of TVF in either risk group.

gems: An R Package for Simulating from Disease Progression Models

Mathematical models of disease progression predict disease outcomes and are useful epidemiological tools for planners and evaluators of health interventions. The R package gems is a tool that simulates disease progression in patients and predicts the effect of different interventions on patient outcome. Disease progression is represented by a series of events (e.g., diagnosis, treatment and death), displayed in a directed acyclic graph. The vertices correspond to disease states and the directed edges represent events. The package gems allows simulations based on a generalized multistate model that can be described by a directed acyclic graph with continuous transition-specific hazard functions. The user can specify an arbitrary hazard function and its parameters. The model includes parameter uncertainty, does not need to be a Markov model, and may take the history of previous events into account. Applications are not limited to the medical field and extend to other areas where multistate simulation is of interest. We provide a technical explanation of the multistate models used by gems, explain the functions of gems and their arguments, and show a sample application.
