Isotope screening is a simple test for determining the photosynthetic pathway used by plants. The scope of this work was to classify the photosynthetic type of some herbs and medicinal plants through studies of the carbon isotope composition (δ13C). Also, we propose the use of carbon isotope composition as a tool to control the quality of herbs and medicinal plants. For studies of δ13C, δ 13C‰ = [R (sample)/R (standard) - 1] × 10-3, dry leaves powdered in cryogenic mill were analyzed in a mass spectrometer coupled with an elemental analyzer for determining the ratio R = 13CO2/12CO2. In investigation of δ13C of 55 species, 23 botanical families, and 44 species possessed a C3 photosynthetic type. Six species found among the botanical families Euphorbiaceae and Poaceae were C4 plants, and 5 species found among the botanical families Agavaceae, Euphorbiaceae, and Liliaceae possessed CAM-type photosynthesis. Carbon isotope composition of plants can be used as quality control of herbs and medicinal plants, allowing the identification of frauds or contaminations. Also, the information about the photosynthetic type found for these plants can help in introducing and cultivating exotic and wild herbs and medicinal plants.

It is not frequent for a National Regulation Authority (NRA) to bring an action against the Commission decision and, cynically speaking, case Prezes Urzędu Komunikacji Elektronicznej2 v Commission3 shows that the avoidance of a sweeping retaliation may be one of the reasons for it. The General Court followed the Commission‟s argument that, notwithstanding the peculiarities of the employment conditions of the Polish Regulator‟s legal counsel giving it virtually full independence, as well as the fact that the Polish law itself does not differentiate between in-house counsel and third party attorneys, the claim should be rejected on the grounds of inadmissibility. The GC based its judgment on Art 19 of the Statute of the Court of Justice4, which requires that, with the exception of the Member States' Governments and the EU Institutions, parties to the dispute must be represented by a lawyer. In so doing, the Court explicitly referred to the infamous Akzo Nobel Chemicals and Akcros Chemicals v Commission5 and EREF v Commission6. Most importantly, the Court stated that the lawyers representing Prezes Urzędu Komunikacji Elektronicznej (UKE) are bound to enjoy a degree of independence inferior to that of lawyers who are not linked to their clients by an employment contract7.

Taking as its point of departure the lapse of the 1662 Licensing Act in 1695, this book examines the lead up to the passage of the Statute of Anne 1710 and charts the movement of copyright law throughout the eighteenth century, culminating in the House of Lords decision in Donaldson v Becket (1774). The established reading of copyright's development throughout this period, from the 1710 Act to the pronouncement in Donaldson, is that it was transformed from a publisher's right to an author's right; that is, legislation initially designed to regulate the marketplace of the bookseller and publisher evolved into an instrument that functioned to recognise the proprietary inevitability of an author's intellectual labour. The historical narrative which unfolds within this book presents a challenge to that accepted orthodoxy. The traditional analysis of the development of copyright in eighteenth-century Britain is revealed to exhibit the character of long-standing myth, and the centrality of the modern proprietary author as the raison d'etre of the modern copyright regime is displaced.

Defoe sets out various public interest arguments concerning the encouragement of learning, industry and the arts, in support of his case for the introduction of copyright legislation. The commentary describes part of the background to the passing of the Statute of Anne 1710 (uk_1710), in particular: the various unsuccessful attempts to reintroduce an alternative to the Licensing Act 1662 (uk_1662); Defoe's public writing on the need for, and social value of, copyright protection; and the influence of his writings in providing the Company of Stationers with a new rhetorical strategy with which to lobby parliament and secure the passing of the Statute of Anne.

Legislation conferring the exclusive right of printing and publishing certain lectures for the same term of protection provided by the existing copyright legislation (see: Statute of Anne, uk_1710; Copyright Act, uk_1814). This was the first occasion on which the legislature extended copyright protection to works in the oral form. The legislation is of interest in terms of the distinction it draws between lectures delivered within the 'public' and the 'private' spheres (lectures delivered at a University, for example, are not protected), in terms of articulating the nature of the relationship between a speaker and his audience, and in specifically clarifying that newspapers are similarly prohibited from reporting protected lectures. The commentary explores the background to the passing of the Act, and in particular the role which Henry Brougham played in proposing and securing the same.

The principle of autonomy underpins legal regulation of advance directives that refuse life-sustaining medical treatment. The primacy of autonomy in this domain is recognised expressly in the case law, through judicial pronouncement, and implicitly in most Australian jurisdictions, through enactment into statute of the right to make an advance directive. This article seeks to justify autonomy as an appropriate principle for regulating advance directives and relies on three arguments: the necessity of autonomy in a liberal democracy; the primacy of autonomy in medical ethics discourse; and the uncontested importance of autonomy in the law on contemporaneous refusal of medical treatment. This article also responds to key criticisms that autonomy is not an appropriate organising principle to underpin legal regulation of advance directives.

Recent failures of large corporations worldwide has led corporate governance and strategic management scholars to call for increased board involvement in decision-making (Tricker, 2009) that has paralleled regulators’ requests for higher monitoring and punishments in the case of frauds and misbehaviors (Coffee, 2005)

Problems with charity law jurisprudence persist. The difficulties arose in the 20th century and are fundamental to the way the doctrine is presently theorised. They grew out of the approach taken in Pemsel’s Case to the categorisation of the ‘spirit and intendment’ of the Preamble to the Statute of Charitable Uses. Recent statutory reforms, such as the Charities Act 2006 (Eng&W), have compounded the underlying problems rather than resolving them. This paper aims to stimulate thinking about a new foundation for charity jurisprudence – while the approach may seem radical, the paper argues that these new foundations can be discerned underlying the current jurisprudence. The difficulties can be overcome by rediscovering the underlying jurisprudence which is disregarded in the current approach to categorisation. Giving voice, in contemporary language, to that foundational jurisprudence, this paper provides a way out of the current problems. It also provides an alternative way of conceptualising the doctrine of charitable purpose to guide reform.

The Birth of the Minority State Church Development of the legal relationship between the state of Finland and the Finnish Orthodox Church 1917 1922 Mika Nokelainen, University of Helsinki, Finland. The present research seeks to explain how the legal relationship developed between the state of Finland and the Orthodox Church of Finland. The main focus is on three statutes: 1) the Statute of the Orthodox Church in Finland as stated by Prime Minister J. K. Paasikivi s cabinet in November 1918, 2) The Republican Constitution of July 1919 and 3) The Freedom of Religion Act of 1923. This study examines how different political goals influenced the three statutes mentioned above. Another important factor that is taken into account is the attitude of the Lutheran Church of Finland, the church of the national majority, towards the Orthodox minority and its judicial position in the country. Finland became independent in December 1917, in the aftermath of the November Revolution in Russia. The Orthodox Church already had hundreds of years of history in Finland. In the 19th century, several statutes by emperors of Russia had made the Orthodox Church an official state church of Finland. Due to the long history of the Orthodox Church in Finland, Prime Minister Paasikivi s cabinet made the decision to support the church in the spring of 1918. Furthermore, the cabinet s goal to occupy East Karelia increased its willingness to support the church. The Finnish-national Orthodox Church was needed to educate the East-Karelians. A new statute on the Orthodox Church in Finland came into force in November 1918, reorganising the administration, economy and legal relationship between the church and state in Finland. With this statue, the cabinet gained some authority over the church. Sections of this statute made possible, for example, the cabinet s interference in the internal affairs of the church. The Republican Constitution of 1919 included the principle of freedom of religion. The state, which previously had been Lutheran, now became non-denominational. However, the Republican Constitution explicitly mentioned the Lutheran as well as the Orthodox Church, which indirectly confirmed the position of the Orthodox Church as the second state church of Finland. This position was finally confirmed by the Freedom of Religion Act in 1923. In general, the Lutheran Church of Finland did not resist the judicial position of the Orthodox Church. However, some Lutherans regarded the Orthodox Church with suspicion because of its intimate connection with Russia.

Resumen: La prevención de enfermedades que fundan discapacidad es un tema central en las políticas de salud pública, y en la vida de las familias, dada la contribución de las mismas en la morbi-mortalidad perinatal. La implementación del diagnóstico prenatal genera, entonces, un dilema controversial. Por un lado, se interpreta que el diagnóstico temprano de la patología favorece el mejor desarrollo y adaptación del niño por nacer y sus familias, porque definen el estatuto moral del feto como inherente, por lo que deben recibir las mismas consideraciones morales que el niño ya nacido. Pero por otro, se asumen como medidas preventivas que disminuyen la prevalencia de enfermedades genéticas, al evitar el nacimiento de niños con estas patologías. El niño por nacer no es considerado como persona y la discapacidad se interpreta como un daño para el niño y su familia, y debe ser evitada. Tres conceptos se involucran en este conflicto: el de persona; el de discapacidad; y el de prevención de enfermedades. El objetivo del trabajo es realizar una reflexión acerca de la interpretación de estos conceptos en las diferentes visiones en bioética, que facilite una profundización de la compresión de los mismos y permita aplicar los avances tecnológicos de manera que respeten la condición humana.

Resumen: En el trabajo se aborda la vexata quaestio de la cientificidad de la ciencia jurídica, a la que se le impugna la pretensión de ser científica y, a la vez, práctica. Se estudian las impugnaciones realizadas en ese sentido por Claude Lévi-Strauss y Hans Albert, así como los intentos de algunos filósofos del derecho analíticos de superarla a través del análisis lógico del lenguaje jurídico. Se analizan después los cuestionamientos efectuados por algunos representantes de la filosofía hermenéutica, que critican los ensayos analíticos y proponen una concepción interpretativa de la ciencia jurídica. Luego de esta exposición, el A. evalúa las aportaciones analíticas y hermenéuticas, poniendo de relieve sus fortalezas y sus falencias a la hora de establecer el estatuto científico de la ciencia jurídica, para pasar finalmente a proponer una concepción de la ciencia del derecho heredera de la tradición de la filosofía práctica de cuño aristotélico. En este punto, el A. desarrolla —con base en el pensamiento de Tomás de Aquino— una concepción analógica del conocimiento científico y explica de qué modo es posible aplicarla a un saber acerca del derecho que resulte, a la vez, científico y práctico. Finalmente, desenvuelve la necesidad epistémica de una apertura del conocimiento de la ciencia jurídica a los primeros principios prácticos, que la vincula constitutivamente a la doctrina de la ley natural, así como al nivel máximamente determinado de la prudencia jurídica.

O instituto da gestão democrática da cidade ocupa lugar central nos debates e nas reflexões acerca do Direito da Cidade e do Estatuto da Cidade. Especificamente no que se refere ao conteúdo dessas reflexões, a gestão democrática alcança impressionante consenso, não sendo coisa fácil encontrar razões no sentido de negar a validade da construção de uma cidadania ativa para gestão dos negócios urbanos. Este trabalho quer entender, concretamente, a razão do citado consenso, ancorado em uma concepção crítica que tenta chamar atenção para aspectos do social que não costumam ser contemplados pela análise realizada entre os juristas que se dedicam ao tema. Neste sentido, questões como a da alienação do trabalho e sua relação com a alienação política e a situação real das cidades a partir da categoria de análise da FES (formação econômica e social) não devem ser ignoradas quando das discussões sobre as possibilidades de efetivação de atuação citadina ativa nas cidades brasileiras. Em tempo, é necessário, a partir das categorias destacadas, analisar criticamente os instrumentos do Estatuto da Cidade para que não se permitam maiores ilusões acerca do estado de coisas aqui discutido.

O objetivo desta dissertação foi estudar as várias interfaces e possíveis insuficiências no atendimento prestado aos adolescentes que vivem com HIV / AIDS. Assim, a área de pesquisa concentrou-se em algumas unidades de saúde da área do Rio de Janeiro - Programa municipal 2.2. O primeiro capítulo descreve um esboço histórico da formação do Estado moderno e as bases para a política social sustentável do Estado capitalista contemporâneo culminando com a análise da construção de um modelo de proteção social no Brasil, depois dos anos trinta. Desta forma, o Estado é visto como uma área atravessada por paradoxal interesses conflitantes e as políticas sociais, administradas no interior do estado, sendo fruto de processos históricos, econômicos e políticos. No segundo capítulo, os problemas da política de saúde no Brasil são discutidos, enfocando as orientações das políticas sobre a AIDS e a adolescência. Em primeiro lugar, os aspectos históricos sobre as políticas de AIDS são analisados e, em seguida, há uma investigação do conceito de adolescência e os princípios norteadores do Estatuto da Criança e do Adolescente e do Programa Saúde do Adolescente. No terceiro capítulo o material coletado na pesquisa por profissionais de saúde é analisado e relacionado com o estudo documental com a crítica das políticas destinadas. A conclusão mostra que, apesar de todo o progresso clínico e / ou farmacológico para o tratamento de pessoas vivendo com AIDS e na formulação de políticas públicas para garantir os direitos, os adolescentes precisam de espaços de boas-vindas nas relações sociais, onde nem a família, a religião, a escola e seus pares estão preparados para essa proximidade. Outra questão importante é a incapacidade dos profissionais de saúde para lidar com os vários aspectos da doença. Contas de contenção e abuso são comuns, revelando que as unidades de saúde nem sempre desenvolvem o seu potencial para cuidar.
