This article looks at the negotiations between Switzerland and Germany on air traffic regulation with the help of negotiation analysis tools. A number of factors pre-eminent in the literature on negotiation processes and outcomes are presented and critically assessed. In particular arguments of “power”, which are often insufficiently explored in analysing interstate cooperation, are brought back into the picture. The article argues that structural power best explains the negotiation results while domestic politics and information asymmetries both account for non-ratification of the treaty. Institutionalist arguments on the constraining effects of international norms and institutions as well as explanations focusing on negotiation skills are of minor importance. Moreover, the nature of the Swiss intra-governmental setting at the federal level did not encourage the Swiss negotiators to exploit all means during the different stages of the bargaining process. The article concludes by illuminating a number of policy observations in the broader context of Swiss foreign relations and indicating avenues for further research

State-building is currently considered to be an indispensable process in overcoming state fragility: a condition characterized by frequent armed conflicts as well as chronic poverty. In this process, both the capacity and the legitimacy of the state are supposed to be enhanced; such balanced development of capacity and legitimacy has also been demanded in security sector reform (SSR), which is regarded as being a crucial part of post-conflict state-building. To enhance legitimacy, the importance of democratic governance is stressed in both state-building and SSR in post-conflict countries. In reality, however, the balanced enhancement of capacity and legitimacy has rarely been realized. In particular, legitimacy enhancement tends to stagnate in countries in which one of multiple warring parties takes a strong grip on state power. This paper tries to understand why such unbalanced development of state-building and SSR has been observed in post-conflict countries, through a case study of Rwanda. Analyses of two policy initiatives in the security sector - Gacaca transitional justice and disarmament, demobilization, and reintegration (DDR) - indicate that although these programs achieved goals set by the government, their contribution to the normative objectives promoted by the international community was quite debatable. It can be understood that this is because the country has subordinated SSR to its state-building process. After the military victory of the former rebels, the Rwandan Patriotic Front (RPF), the ruling elite prioritized the establishment of political stability over the introduction of international norms such as democratic governance and the rule of law. SSR was implemented only to the extent that it contributed to, and did not threaten, Rwanda's RPF-led state-building.

Este trabajo presenta un estudio de campo sobre confort térmico basado en la concepción adaptativa, para la determinación de las temperaturas y rangos de confort térmico de sujetos habituados a espacios enfriados mecánicamente en viviendas con aire acondicionado (AA) en el clima cálido y húmedo de la ciudad de Maracaibo (Venezuela) y las consecuentes implicaciones energéticas que tiene la satisfacción de esa demanda de confortabilidad en el sector residencial de la ciudad. Para la estimación de la temperatura de confort (Tc) y el rango de temperaturas de confort se aplican diferentes metodologías de análisis estadístico, las cuales son comparadas con las respectivas calculadas con el índice PMV; se analizan también otros aspectos asociados a la confortabilidad térmica, tales como las respuestas en las diferentes escalas de valoración de la confortabilidad, las preferencias, experiencias y expectativas térmicas de los sujetos. Las implicaciones energéticas se determinan en base al consumo de la energía eléctrica residencial debido exclusivamente a la variación de la Tc, entre la obtenida inicialmente en espacios naturalmente ventilados (NV) en Maracaibo (Bravo y Gonzalez 2001a) y la determinada ahora en espacios con AA. Para ello, se utiliza una metodología que es el resultado de la modificación parcial de la propuesta por Yamtraipat et al (2006). Entre los resultados y conclusiones derivadas de este estudio se encuentra que el 57 % de las personas prefieren las mismas condiciones confortables experimentadas en los ambientes con AA y solamente un 30 % prefieren experimentar ambientes ligeramente fríos y ligeramente calientes. Mientras tanto, las estimaciones de la Tc, y el respectivo rango, varían de acuerdo a la metodología empleada. Con la convencional metodología adaptativa, la Tc se estima en 25 °C en un amplio rango de 6 °C, entre 22 °C y 28 °C; mientras que con la metodología denominada “método de los promedios de los intervalos de las sensaciones térmicas” (Gómez-Azpeitia et al, 2007), la misma Tc se estima en 24 °C, en un rango estrecho de 22,5 °C a 25,5 °C y en un rango ampliado de 21 °C a 27 °C (amplitud 6 °C), donde se encuentran las tres cuartas partes de las personas del estudio. Ambas Tc son muy próximas a la temperatura operativa optima de 24,5 °C (rango de 23 °C a 26 °C) establecida por las normas internacionales ISO 7730:1994 y ASHRAE 55:1992 para el verano en climas templados. Sin embargo, la Tc estimada con los valores de PMV resulta ser superior en 1 °C y 2 °C a la Tc estimada con la metodología adaptativa (25 °C) y con el metodo de los promedios de los intervalos (24 °C), respectivamente. Con la metodología aplicada y la muestra del estudio se estima que de haberse registrado una Tbsint igual o próxima a 28 C (equivalente a la Tc en espacios NV en Maracaibo) en todos los espacios medidos (con Tbsint entre 19 C y 29 C), el ahorro total de la energía anual seria de 1.648,1 GWh en un ano respecto al consumo de AA en el año 2007 (2.522,3 GWh en un ano), mientras que el ahorro de energía asumiendo Tbsint de 24 C y de 25 C, resultan en 651,9 GWh en un ano y 425,7 GWh en un ano, respectivamente. Esto significa respectivos consumos adiciones de energía eléctrica equivalentes al 60,4 % y 74,2 %. Finalmente, los hábitos o conductas adoptadas por las personas de este estudio, sumado a las predominantes manifestaciones de confortabilidad en ambientes enfriados mecánicamente, redundan en mayores adaptaciones a condiciones de frio y exigencias de temperaturas de confort más bajas, con su consecuente consumo energético para proveerlas. ABSTRACT This investigation presents a study on thermal comfort following the adaptive approach for the determination of the thermal comfort temperatures and ranges of subjects accustomed to mechanically refrigerated spaces in dwellings with air conditioning (AA) systems in the hot and humid weather of the city of Maracaibo (Venezuela) and the ensuing energy use implications it has on the satisfaction of such demand of comfortability in the residential sector of the city. For the estimation of the comfort temperature (Tc) and the range of comfort temperatures different statistical analysis methodologies were used, which are then compared to the respective values calculated with the PMV index, also discusses other aspects related with thermal comfortability were analyzed, such as the responses on the different scales of perception of thermal comfortability, preferences, experiences and expectations of the analyzed subjects. The energetic implications are determined through the residential energy consumption related exclusively with the variation of the Tc between the originally calculated for naturally ventilated (NV) spaces in Maracaibo (Bravo y Gonzalez 2001a) and the one calculated on the present study with AA. For this, a new methodology was developed by partially modifying the Yamtraipat et al (2006) proposal. Among the results and conclusions of this study are that 57 % of the studied subjects prefer the same comfortable conditions experienced on AA environments and only a 30 % prefer to experience slightly cooler or warmer environments. Also, estimations of the Tc and its respective range vary according to the used methodology. With the conventional adaptive methodology, the Tc is estimated in 25 °C with a wide range of 6 °C, between 22 °C and 28 °C, while using the “thermal sensation intervals averages method” (Gomez-Azpeitia et al, 2007) the Tc is estimated in 24 °C on a narrow range between 22.5 °C and 25.5 °C and a widened range of 21 °C to 27 °C (6 °C in amplitude), a range where . of the studied subjects are located. Both Tc are very close to the optimum operation temperature of 24.5 °C (with a range between 23 °C and 26 °C) established on the ISO 7730:1994 and ASHRAE 55:1992 international norms for the summer on warm climates. However, the estimated Tc with the PMV indexes results to be 1 °C and 2 °C above the Tc estimated with the adaptive methodology (25 °C) and the thermal sensation intervals averages method (24 °C), respectively. With the applied methodology and this study sample, its estimated that if a Tbsint equal or close to 28 °C (equivalent to the Tc in NV spaces in Maracaibo) was registered in all measured spaces (with Tbsint between 19 °C and 29 °C) the total yearly energy savings would be of 1.648,1 GWh in a year with respect to the AA consumption in the year 2007 (2.522.3 GWh in a year), while the energy savings assuming a Tbinst of 24 °C and 25 °C result in 651.9 GWh and 425.7 Gwh in a year, respectively. This means that the respective additional electrical energy consumption amount to 60.4 % and 74.2 %, respectively. Finally, the habits or behaviors adopted by the subjects analyzed on this study, added to the predominant manifestations of comfortability in mechanically refrigerated environments result in greater adaptations to colder conditions and lower thermal comfort temperature demands, with the consequential increase in power consumption to meet them.

This research provides an institutional explanation of the practices of external intervention in the Arab state system from the fall of the Ottoman Empire in 1922 to the Arab Spring. My explanation consists of two institutional variables: sovereignty and inter-state borders. I examine the changes in regional and international norms of sovereignty and their impact on the practices of external intervention in the Arab state system. I also examine the impact of the level of institutionalization of inter-state borders in the Arab World on the practices of external intervention. I argue that changes in regional and international norms of sovereignty and changes in the level of institutionalization of inter-state borders have constituted the significant variation over time in both the frequency and type of external intervention in the Arab state system from 1922 to the present. My institutional explanation and findings seriously challenge the traditional accounts of sovereignty and intervention in the Arab World, including the cultural perspectives that emphasize the conflict between sovereignty, Arabism, and Islam, the constructivist accounts that emphasize the regional norm of pan-Arabism, the comparative politics explanations that focus on the domestic material power of the Arab state, the post-colonial perspectives that emphasize the artificiality of the Arab state, and the realist accounts that focus on great powers and the regional distribution of power in the Middle East. This research also contributes to International Relations Theory. I construct a new analytical framework to study the relations between sovereignty, borders, and intervention, combining theoretical elements from the fields of Role Theory, Social Constructivism, and Institutionalization. Methodologically, this research includes both quantitative and qualitative analysis. I conduct content analysis of official documents of Arab states and the Arab League, Arabic press documents, and Arab political thought. I also utilize quantitative data sets on international intervention.

From the Introduction. The EU has seen a renewed interest in strengthening its common energy policy and promoting energy security. The greatest trigger has been Russia’s unpredictable, aggressive behaviour in Ukraine in the past year. Lack of trust in a long-standing economic partner and concerns about relying on a trade partner that does not adhere to international norms have left their mark.

El artículo se centra en la actividad internacional del Partido Comunista de España (PCE) desde las secuelas de la represión de la Primavera de Praga hasta 1977. Fue un período caracterizado por el principio del declive definitivo del movimiento comunista internacional. El análisis abarca múltiples cuestiones. Examina las crecientes críticas del PCE hacia el modelo soviético, y sus repercusiones en las relaciones entre el partido liderado por Santiago Carrillo y el movimiento comunista. Además, el artículo explora el intento del PCE de promover un nuevo tipo de internacionalismo en Europa occidental, auspiciando una renovada colaboración entre comunistas y socialistas y aprovechando las condiciones brindadas por la distensión. En este contexto tuvo lugar el surgimiento del eurocomunismo, que el ensayo analiza ilustrando los factores internos y externos que determinaron su crisis en la segunda mitad de los setenta.

Todos os seres humanos, independentemente da sua fase no ciclo vital ou qualquer tipo de condição, são seres plenos de direitos e merecem ser tratados com dignidade e respeito. Os jovens, por se encontrarem numa etapa inicial do desenvolvimento humano, requerem atenção e assistência especiais. A presença de crianças e jovens envolvidos no sistema de justiça é cada vez mais frequente e devido à sua idade precoce, inúmeras leis e documentos foram desenvolvidos para proteger os menores, com o objetivo de fornecer uma justiça adaptada à sua maturidade cognitiva e emocional em todas as fases do processo judicial (antes, durante e após). Quando estas questões são referentes a jovens na qualidade de ofensores, tomam particular pertinência, devido à possibilidade do seu direito de defesa ficar comprometido. Uma vez que, em Portugal, a literatura existente acerca de como o sistema de justiça interage com os jovens em conflito com a Lei é escassa, o presente estudo é revestido de particular pertinência. Assim, esta investigação visa apresentar um estudo quantitativo que pretende compreender a perceção que os jovens em conflito com a Lei têm da terminologia legal e dos procedimentos judiciais. A recolha de dados realizou-se baseada no método de inquérito suportado pela técnica de questionário fechado. Elaborou-se um instrumento constituído por 69 questões dicotómicas, com um tempo de realização estimado de 15 minutos. Para a realização da investigação foram obtidas as autorizações necessárias (i.e. Comissão de Ética da Universidade Fernando Pessoa e Direção Geral de Reinserção e Serviços Prisionais) e os respetivos consentimentos informados dos participantes. Os resultados revelam que, em geral, os jovens inquiridos têm um relativo bom conhecimento da terminologia legal e dos procedimentos judiciais que ocorreram durante o processo tutelar de que foram alvo. Verificou-se uma diferença de conhecimento/experiência significativa entre os Centros Educativos do Porto e da Guarda, sendo que os jovens do Porto revelarem maiores conhecimentos que os jovens da Guarda. Apesar dos jovens apresentarem conhecimento acerca do sistema, existem determinadas lacunas às quais se deve atentar. Assim, depreende-se que o sistema jurídico português possa estar a empenhar-se de forma a cumprir as normas e legislações nacionais e internacionais e garantir o bem-estar e esclarecimento do jovem em conflito com a lei. Contudo, reconhece-se que é da responsabilidade dos intervenientes judiciais com contacto direto com a criança (e.g. advogado, juiz) esta função, pelo que os lapsos identificados devem ser colmatados de forma a garantir que o jovem seja (como é) um cidadão pleno de direitos e dignidade quando contacta com o sistema jurídico.

ResumenEste trabajo pretende ser un instrumento de reflexión sobre el rol histórico de la autoridad en el aula. El supuesto es que los períodos autoritarios han dejado huellas en las cosmologías docentes y por ello el autoritarismo se resiste a partir. Esto último impide enfatizar en actitudes y acciones didácticas de tipo cooperativo; invisibilizando derechos fundamentales, principalmente aquellos referidos en la infancia y adolescencia. Se hace hincapié en la participación democrática de docentes y estudiantes, enfatizando en la exaltación de un tipo de socialización enmarcada en la participación democrática desde la escuela, que pueda aportar hábitos trasladables a otros ámbitos sociales, contribuyendo a formar actitudes deliberativas, necesarias para participar activamente. El marco utilizado es, en el caso de las teorías del aprendizaje y como soporte metodológico, el principio de Zona de Desarrollo Próximo (Vigotsky) y el supuesto de aprendizaje práctico/participativo (Rogoff), además de brindar algunas concepciones sobre filosofía política en educación (Gutman).Respecto al marco normativo, se presta atención al cuerpo jurídico internacional sobre derechos humanos poniendo énfasis en la esfera de la educación, las recientes leyes argentinas de educación (2006) y de protección de la infancia y la adolescencia (2006). AbstractThis work aims to be an instrument of reflection on the historical role of authority in the classroom. The assumption is that authoritarian periods have left footprints in the cosmologies of teacher, hence authoritarianisms resists to leave. This prevents the emphasis on didactic cooperative attitudes and actions, thus subduing fundamental rights, mainly those referred to infancy and adolescence. The teachers´ and students´ democratic participation is emphasized, remarking the exaltation of a kind of socialization framed by the democratic participation from the school, which can bring habits transferable to other social areas, facilitating the development of the deliberative attitudes needed to participate actively. The theoretical framework is, in the case of learning theories and as a methodological support, the principle of Near Area Development (Vigotsky) and as the second argument, we use the assumption of learning by doing/participatory (Rogoff). In the first case, a task that is done with help today will be autonomously tomorrow. For the latter, it means participatory activities in order to achieve habits that may relocate to other social environments. In the case of Guttmann, it is looking for framing issues of political theory of education, mainly those related to the new skills a twenty-first century citizenship must acquire. Regarding the regulatory framework, attention is paid to international norms on human rights with emphasis on education, recent Argentinean education laws (2006) and new laws on childhood and adolescence protection (2006). Purpose: Businesses cannot rely on their customers to always do the right thing. To help researchers and service providers better understand the dark (and light) side of customer behavior, this study aims to aggregate and investigate perceptions of consumer ethics from young consumers on five continents. The study seeks to present a profile of consumer behavioral norms, how ethical inclinations have evolved over time, and country differences. ---------- Design/methodology/approach: Data were collected from ten countries across five continents between 1997 and 2007. A self-administered questionnaire containing 14 consumer scenarios asked respondents to rate acceptability of questionable consumer actions. ---------- Findings: Overall, consumers found four of the 14 questionable consumer actions acceptable. Illegal activities were mostly viewed as unethical, while some legal actions that were against company policy were viewed less harshly. Differences across continents emerged, with Europeans being the least critical, while Asians and Africans shared duties as most critical of consumer actions. Over time, consumers have become less tolerant of questionable behaviors. ---------- Practical implications: Service providers should use the findings of this study to better understand the service customer. Knowing what customers in general believe is ethical or unethical can help service designers focus on the aspects of the technology or design most vulnerable to customer deviance. ---------- Multinationals already know they must adapt their business practices to the market in which they are operating, but they must also adapt their expectations as to the behavior of the corresponding consumer base. Originality/value: This investigation into consumer ethics helps businesses understand what their customer base believes is the right thing in their role as customer. This is a large-scale study of consumer ethics including 3,739 respondents on five continents offering an evolving view of the ethical inclinations of young consumers.
