O presente estudo tem por objetivo oferecer uma contribuição inicial para a revitalização do direito eleitoral, por meio da releitura de seus institutos, regras, princípios e lógica estruturante à luz do sistema constitucional da liberdade de expressão. Seu ponto de partida é a constatação de que o direito eleitoral brasileiro não confere à liberdade de expressão a sua devida dimensão de peso. No contexto das campanhas, as liberdades de expressão, informação e imprensa têm sido demasiadamente sacrificadas. O arcabouço teórico do direito eleitoral, ao invés de se estruturar em torno da necessidade de garantir um debate públicodesinibido, robusto e aberto, parece organizar-se exatamente no sentido oposto, buscando limitar o fluxo e a contraposição de informações, ideias e opiniões. O trabalho identifica duas causas principais deste cenário. Em primeiro lugar, e de modo geral, isso se dá porque a cultura da liberdade de expressão não criou raízes no país. Em segundo lugar, e mais especificamente, porque a dogmática do direito eleitoral padece de grave subdesenvolvimento teórico, que se reflete em três principais deficiências: (i) na inexistência de identificação e sistematização consistente dos princípios substantivos norteadores do direito eleitoral e seus respectivos conteúdos, (i) na construção da disciplina sob fundamentos teóricos inconsistentes e contraditórios como o ideal democrático, e (iii) na regulação excessiva, assistemática e casuísta, instituída à margem do sistema de direitos fundamentais. Para a superação dessas deficiências, propõe-se, em primeiro lugar, um marco teórico para a liberdade de expressão, capaz de fornecer o instrumental necessário para a regulação eleitoral.Em seguida, apresenta-se um panorama do tratamento atual da liberdade de expressão no direito eleitoral, procedendo-se à filtragem de grande parte da regulação das campanhas eleitorais à luz do sistema constitucional da liberdade de expressão, incluindo o regramento da propaganda política, o acesso aos meios de comunicação durante o pleito, e as regras de financiamento de campanha.

Model-based approaches to handle additive and convolutional noise have been extensively investigated and used. However, the application of these schemes to handling reverberant noise has received less attention. This paper examines the extension of two standard additive/convolutional noise approaches to handling reverberant noise. The first is an extension of vector Taylor series (VTS) compensation, reverberant VTS, where a mismatch function including reverberant noise is used. The second scheme modifies constrained MLLR to allow a wide-span of frames to be taken into account and projected into the required dimensionality. To allow additive noise to be handled, both these schemes are combined with standard VTS. The approaches are evaluated and compared on two tasks, MC-WSJ-AV, and a reverberant simulated version of AURORA-4. © 2011 IEEE.

This article aims to propose a chronological subdivision in the history of African communication. African communication today is one of the most important axes for implementing development strategies, sustaining education, health, and schooling programmes, and so on. However, many of these programmes fail due to a lack of or ineffective communication between international organisations, local elite and lay people. The reasons for this situation must be found in Africa’s history of communication, which has undergone radical transformations in its different phases. Using the functionalist analysis drawn up by Jakobson, this article proposes a new chronological subdivision of Africa’s history of communication, reflecting on the current contradictions in contemporary communication in Africa.

This paper discusses whether or not Strasbourg organs have created principled criteria governing the use of the doctrine within the context of free speech and public morals. The first part of the paper gives an overview of the doctrine and further examines how the doctrine has evolved within the European context. Part II focuses on the rationale behind the doctrine and discusses the legitimacy of the doctrine in light of its application to various forms of free speech. Part III covers one of the most problematic applications of the doctrine in matters concerning public morality, where Contracting States have a wide margin of appreciation. This part will discuss whether or not the “lack of European consensus” criterion is an elusive concept that might create a risk of abuse in the application of the doctrine. The paper concludes that while margin of appreciation today serves as a flexible instrument between the local necessities and the universal application of human rights, the imprecise and contradictory points might lead to its potential abuse that might endanger its future existence.

À l’image des théories de la bande dessinée imprimée, la BD numérique est elle aussi accaparée par les analyses formalistes, dont la plus connue, celle de Scott McCloud, est critiquable, car elle réduit le média à un langage. Or, les mutations provoquées par la remédiation numérique ne sont pas uniquement formelles : l’expérience du lecteur, de l’auteur, et le rapport qu’ils entretiennent ensemble sont modifiés. Ce nouveau rapport influence le contenu des œuvres : on ne raconte pas la même chose dans le livre que sur Internet. L’autobiographie en BD, courant qui a explosé dans l’édition indépendante des années 1990, puis a été largement repris par les blogueurs, permet d’observer les différences de contenus et d’approches véhiculées par le livre et le numérique. Le dispositif du blogue propose un outil de liberté d’expression et de réflexion, mais les paramètres de son exécution (immédiateté, interactivité, désir de popularité, etc.) peuvent détourner cet objectif. Ainsi, beaucoup d’auteurs de blogues n’ont pas produit une autobiographie singulière, mais ont reproduit un courant de pensée existant (en exposant une libido fortement orientée vers la consommation) ainsi qu’un genre codifié, au sein duquel les autobiographies deviennent uniformes. Pour qualifier leurs blogues, on ne peut pas vraiment parler d’autobiographies, car ils ne mettent pas en scène un passé rétrospectif. Il s’agirait davantage de journaux intimes dont l’intimité est communiquée (ou publicisée) plutôt qu’expérimentée. Ce à quoi ces blogues ressemblent finalement le plus, c’est à une sorte de télé-réalité, une « bédé-réalité ».

"L’auteur présente une analyse générale de l’évolution historique et des développements récents du régime des droits d’auteur au Canada. Avec le développement des nouvelles technologies de l’information, et plus spécifiquement de l’Internet, le régime canadien des droits d’auteur nécessiterait d’importantes réformes. L’auteur déplore toutefois les modifications récentes issues de la loi C-60. En effet, selon lui, ces changements ne correspondent pas au régime international proposé par l’Organisation Mondiale de Propriété Intellectuelle. En fait, ceux-ci cadrent beaucoup plus avec la perspective américaine de protection limitative des droits d’auteur. Michael Geist trace d’abord l’historique du développement du régime de protection des droits d’auteur au Canada. Il souligne notamment les modifications législatives importantes de la fin des années 1980 et 1990 qui visaient à renforcer les règles de reconnaissance et de protection des droits que les auteurs canadiens possèdent sur leurs œuvres. Parallèlement, à ces modifications législatives, la Cour Suprême du Canada s’est aussi prononcée sur la question des droits d’auteur en interprétant limitativement la portée de ce régime, facilitant ainsi l’accès des œuvres artistiques au domaine public. L’auteur souligne les divergences et les contradictions entre la conception législative et celle jurisprudentielle de la fonction du régime canadien des droits d’auteur. Le législateur canadien a récemment proposé une nouvelle modification du régime de droits d’auteurs qui consisterait en l’extension des délais obligatoire avant qu’une œuvre couverte par le régime ne soit incluse dans le domaine public. Michael Geist s’oppose à une telle modification et soutient qu’elle entraînerait de nombreuses conséquences négatives pour les auteurs et les artistes canadiens. En effet, cette modification limiterait l’accès des auteurs aux oeuvres antérieures, elle entraverait les opportunités et les capacités commerciales des œuvres canadiennes et restreindrait les domaines de recherche académique. L’auteur aborde par la suite la problématique reliée aux ""Mesures de Protection Techniques"" et à la législation qui les encadre. En analysant les problèmes causés par ces mesures aux États-Unis, il présente leurs effets nuisibles pour les domaines fondamentaux de la liberté de parole et de la recherche académique. Les réformes possibles du régime canadien des droits d’auteur se situent dans une perspective plus ouverte du régime de protection et de promotion des œuvres canadiennes. Ces réformes auraient l’avantage de promouvoir et de protéger les œuvres canadiennes tout en évitant les problèmes causés par les mesures trop limitatives. À ce sujet, l’auteur propose l’établissement d’une bibliothèque digitale nationale, l’abrogation des droits d’auteur de la couronne et un nouveau régime permettant l’utilisation du matériel radiodiffusé de la Société Radio-Canada."

This study analyses the role of the Press Council as a champion and guard of free speech. It discusses the extent to which the Council succeeded in achieving its statutory objective of preserving the freedom of the press and maintaining and improving the standards of newspapers and news agencies. It also examines the inherent and in-built weaknesses of the Council and suggests ways and means for restructuring and enlarging its functions.

This thesis entitled “The right to freedom of information in india”.In a democracy, the citizens being the persons to choose their own governors, the right to know from the Government is a pre-condition for a properly evaluated election. Freedom of speech and expression, one of the repositories of self~government, forms the basis for the right to know in a wider scale. The functions which the free speech rights serve in a society also emphasize the need for more openness in the functioning of a democracy.Maintanance of law and order and investigation of crimes are highly important in a country like India, where no risk may be taken on account of the public‘s right to know. The Indian situations relating terrorist activities, riots based on language, region, religion and caste are important in this respect. The right to know of the citizens may be regulated in the interests of secrecy required in these areas.On the basis of the conclusions reached in this study, a draft Bill has been proposed for the passing of an Access to Public Documents Act. This Bill is appended to this Thesis.

Abstract Introduction: This seminar is on the topic of "GamerGate", an international movement, ostensibly about "ethics in video game journalism" but which has become inextricably linked with extreme forms of online misogyny, rape and death threats towards women in the industry. It is of relevance to all Web science researchers, because it raises many issues of free speech, online governance, trolling and (not least) the representation of women in the tech industry. Our guest speaker (Mark Bernstein) is known for his criticism of the movement, and his work was featured in an article in the Guardian last week. He is a longtime collaborator in the field of hypertext and online media research, who co-orgainsed our annual international Web Science conference two years ago. Based in Boston, US, he will be speaking to us via Skype on Wednesday morning, to give us some background on the Gamergate phenomenon and to explain the recent developments regarding Wikipedia.

En general, las formas de interacción entre los seres humanos que están mediadas por referentes tales como: las costumbres, las tradiciones, la educación, la política y la ética, se preservan a través de la institucionalización. Lo que implica la creación de normas reguladoras de las acciones humanas mediante códigos de ética y deontológicos. En el ámbito médico aparecen procedimientos como el consentimiento informado, cuyo fin es garantizar que se respete al paciente el derecho a conocer la realidad de su situación médica y a tomar decisiones acerca de procedimientos que se deben realizar. El desarrollo de este texto busca reconocer en el consentimiento informado una forma de institucionalización de la autonomía. Ahora bien, según esto la pregunta que orientará este documento es ¿cuál es la naturaleza de esa autonomía que institucionaliza la práctica del consentimiento informado?

Strategic lawsuits against public participation (SLAPPs) brought against the environmental movement in the UK since the 1990s are examined. SLAPPs, a form of Green backlash, have been mobilised across a wide range of policy areas that have seen vigorous campaigning and protest by the movement, including roads, GMOs and, more recently, climate change. SLAPPs are typically regarded as a threat, designed to close down democratic free speech and protest. However, in the UK, there are some notable cases where the environmental movement has been able to use agency to convert what may appear as a legal threat into a positive legal or media opportunity.

This investigation shall focus upon the issue of legalized abortion. I believe the complex controversy surrounding the issue of abortion, demonstrates more clearly than any other single contemporary issue the social, political, moral and religious forces working for change in a post-Reagan America. I shall examine in depth the theology, writings, strategies and activities of those Americans who seek to express themselves and their beliefs in religious, or religiously supported interest groups. The current debate surrounding abortion legislation lends itself to several forms of analysis: religious, political, sociological, etc. I will write from the perspective of a student of religion. I shall focus more upon the religious, moral and theological conviction-s of the abortion activists than upon their constitutional right to free speech or assembly. I shall give more attention to denominational structures and church/state relations than to the structuring of representative districts and democratic theory.
