The present paper examines some of the tensions, problems and challenges associated with claims for equality of opportunity (the fairness argument). The introductory part identifies three separate forms of justification for public education, including the argument associated with equality of opportunity. Part II examines in detail two questions that reveal part of the anatomy of equality of opportunity: (1) what an opportunity is, and (2) when individuals’ opportunities are equal. This is followed by a presentation of the two basic principles of equality of opportunity: (1) the principle of non-discrimination, and (2) the “levelling the playing field” principle. The next part takes up the multiculturalist hypothesis advanced by minority groups for the accommodation and recognition of cultural diversity. This is followed by the identification of a set of claims comprising the “fairness argument”. The last section focuses on the “currency problem” associated with cultural diversity as a form of “unfair disadvantage”. Part V examines two of the major shortcomings associated with the multicultural conception of equality of opportunity, while the concluding part discusses some of the questions that must be answered by any conception of equal opportunities. Institutions of public memory are increasingly undertaking co-creative media initiatives in which community members create content with the support of institutional expertise and resources. This paper discusses one such initiative: the State Library of Queensland’s ‘Responses to the Apology’, which used a collaborative digital storytelling methodology to co-produce seven short videos capturing individual responses to Prime Minister Kevin Rudd’s 2008 ‘Apology to Australia’s Indigenous Peoples’. In examining this program, we are interested not only in the juxtaposition of ‘ordinary’ responses to an ‘official’ event, but also in how the production and display of these stories might also demonstrate a larger mediatisation of public memory.

This paper outlines some of the experiences of Indigenous women academics in higher education. The author offers these experiences, not to position Indigenous women academics as victims, but to expose the problematic nature of racism, systemic marginalisation, white race privilege and radicalised subjectivity played out within Australian higher education institutions. By utilising the experiences and examples she seeks to bring the theoretical into the everyday world of being Indigenous within academe. In analysing these examples, the author reveals the relationships between oppression, white race privilege, institutional privilege and the epistemology that maintains them. She argues that, in moving from a position of being silent to speaking about what she has witnessed and experienced, she is able to move from the position of object to subject and gain a form of liberated voice (hooks 1989: 9) for herself and other Indigenous women. She seeks to challenge the practices within universities that continue to subjugate Indigenous women academics.

Conferences addressing emerging commonalities in the information professions were being held as far back as the early 1980s. At that time, there appeared to be two differing thoughts on the future of the information professions: one that saw the increasing diversification, the other favouring the professions’ convergence. Nearly thirty-five years later, we are still discussing the various advantages and disadvantages that a convergence of the information professions and professionals may bring; yet there has been very little empirical evidence gathered to enable us to move forward in this discussion. This conceptual paper uses existing literature to argue that the convergence of galleries, libraries, archives and museums is not a new concept to these institutions, but that they have been linked – philosophically and intellectually at least - for millennia. The intention of this paper is not to articulate what should be included in a GLAM curriculum, or to identify the skills and knowledge required of an information professional in a converged environment, but rather to demonstrate that this research is needed in order to provide an evidence base from which these may be developed.

The imperative for Indigenous education in Australia is influenced by national political, social and economic discourses as Australian education systems continue to grapple with an agreed aspiration of full participation for Aboriginal and Torres Strait Islander students. Innovations within and policies guiding our education systems are often driven by agendas of reconciliation, equity, equality in participation and social justice. In this paper, we discuss key themes that emerged from a recent Australian Office for Learning and Teaching (OLT) research project which investigated ways in which preservice teachers from one Australian university embedded Indigenous knowledges (IK) on teaching practicum . Using a phenomenological approach, the case involved 25 preservice teacher and 23 practicum supervisor participants, over a 30 month investigation. Attention was directed to the nature of subjective (lived) experiences of participants in these pedagogical negotiations and thus preservice and supervising teacher voice was actively sought in naming and analysing these experiences. Findings revealed that change, knowledge, help and affirmation were key themes for shaping discourses around Indigenous knowledges and perspectives in the Australian curriculum and defined the nature of the pedagogical relationships between novice and experienced teachers. We focus particularly on the need for change and affirmation by preservice teachers and their teaching practicum supervisors as they developed their pedagogical relationships whilst embedding Indigenous knowledges in learning and teaching.

A tese propõe novos fundamentos para a abordagem da conjugalidade contemporânea, tendo como eixo de referência a superação da monogamia como princípio estruturante do estatuto jurídico da família. Alguns fios condutores perpassam a tese e norteiam o tratamento do tema: (i) o princípio jurídico da monogamia como mecanismo legitimador da dominação masculina; (ii) a preocupação com a construção de lugares de não-direito e de invisibilidade jurídica de determinadas pessoas, mormente, as concubinas, excluídas da condição de sujeito de direito; (iii) o concubinato, campo privilegiado de estudo, é referido e analisado como estatuto de exclusão; (iv) os fatores decisivos para a reconfiguração da conjugalidade contemporânea: a democracia, o pluralismo cultural e a laicização do Direito; (v) a perspectiva do Direito Civil constitucionalizado é tomada como referência para a problematização da questão central da tese, e os princípios constitucionais da dignidade humana, solidariedade, igualdade, liberdade e democracia prestam-se ao estabelecimento de um banco de provas a que é submetida a assertiva que constitui o enunciado da própria tese: a superação da monogamia como princípio estruturante do estatuto jurídico das famílias contemporâneas. O tratamento dado à matéria é necessariamente interdisciplinar, tendo-se mostrado indispensável a interlocução, ainda que pontual, com historiadores, antropólogos, e sociólogos e mesmo com autores das ciências naturais. O princípio da monogamia consolidado no Ocidente, por força do monopólio da regulação das relações familiares pelo Direito Canônico, especialmente, pelos decretos e cânones tridentinos, e transposto ao domínio jurídico do Estado, a partir das revoluções burguesas experimenta, na reconfiguração da conjugalidade contemporânea, efetivo arrefecimento. Fatores, como a superação da dominação masculina, a laicização do Estado e do Direito, a primazia alcançada pela autonomia privada no campo das situações subjetivas existenciais e coexistenciais, a consagração do princípio do pluralismo das entidades familiares, nítida expressão da democratização da intimidade, são indicados como razões decisivas para a superação da monogamia como princípio jurídico.

The author of the article attempts to present the situation of comparative studies as a field of research and a way of thinking about the contemporary world on the basis of the analyses presented in Comparative Literature at a Crossroads? in the monographic issue of “Comparative Studies” 2006. Much attention is paid to the phenomenon of the crisis of comparative studies connected with a noticeable reluctance towards great theoretical models shared by many researchers, the extensiveness of the topic area and resulting methodological problems but also the fact that comparatists abandon the studies of other languages. This results in a need of searching for a satisfactory definition of this field of study, its scope of research and applicable research methods. Among the specific issues raised in the article there is, e.g. the case of world literature seen in the context of the classical contradiction between cultural hegemony and cultural pluralism. Moreover, an interesting review of the picture of the Polish culture from the perspective of postcolonial theories and intracultural differences is presented.

This qualitative study explores practicing teachers' experiences of teaching in classrooms of diversity, that is, classrooms where students represent a variety of differences including race, culture, ethnicity, and class. More specifically, this study investigates the types of curricular and pedagogical practices teachers employ in their classrooms. This study attempts to make a contribution to the scholarship of critical pedagogy by drawing upon the works of critical pedagogues to make sense of participants' descriptions oftheir curricular and pedagogical practices. Four participants were involved in this study. Participants were elementary teachers in classrooms of difference in Ontario who contributed the primary sources of data by engaging in 2 individual interviews. Additional sources of data included a focus group meeting that 2 ofthe participants were able to attend, school board curriculum resource documents assisting teachers in teaching critically, as well as a research journal which the researcher kept throughout the study. The scholarship of critical pedagogy (Ellsworth, 1992; Giroux, 1993; McLaren, 1989) informs the analysis of participants' descriptions of their teaching experiences. Many of the participants did not engage in a practice of critical pedagogy. This study explores some of the challenges and possibilities of using critical pedagogy to create spaces in classrooms where teachers can build connections between the curriculum mandated by the government and the multiple identities and experiences that students bring into the classroom. This study concludes with a discussion on what teachers need to know to be able to begin creating equitable and educational experiences in classrooms of difference.

Devant le manque de ressources économiques et la pauvreté, les « OGM » apparaissent comme un outil visant à contribuer à la croissance économique et alimentaire, notamment dans les pays en voie de développement et sous-développés. Cependant, nous devons nous pencher sur un sujet tout aussi fondamental, à savoir la protection juridique, accordée par la législation tant nationale qu’internationale en lien avec les « connaissances traditionnelles » quand elles sont aux prises avec l’utilisation des OGM. Connaître cette interaction et évaluer ses effets sur la culture est un sujet d’une ampleur considérable à l’heure actuelle, principalement lorsque l’on considère les « savoirs locaux » comme des éléments fondamentaux pour la conservation de la « biodiversité » et le « développement durable ».

Dans un contexte de mondialisation, les frontières géographiques et politiques se font de plus en plus diffuses et donnent lieu à un mélange des cultures tant au niveau local qu'international. Ce pluralisme culturel observé dans la population se transpose dans les milieux de soins, amenant son lot d'enjeux et de défis pour la pratique et la formation infirmière. Le développement de la compétence culturelle chez les professionnels de la santé est considéré comme l'une des solutions favorisant la qualité et l'équité dans les soins en contexte de diversité culturelle. La compétence culturelle fait l'objet de nombreux articles scientifiques en sciences infirmières, mais bon nombre d'entre eux sont issus d'une perspective essentialiste. À notre connaissance, aucune étude ne permet de représenter la trajectoire de développement de cette compétence sur un continuum intégrant des apprentissages réalisés à la fois chez des étudiantes et des infirmières selon une perspective constructiviste. Cette étude vise donc à formuler une proposition théorique constructiviste du développement de la compétence culturelle infirmière. L'approche de théorisation ancrée de Corbin et Strauss (2008) a permis de documenter le processus de développement de la compétence culturelle chez des infirmières et des étudiantes dans un Centre de santé et de services sociaux desservant une population qui présente une grande diversité culturelle. Une stratégie d'échantillonnage intentionnel a permis de recruter des infirmières identifiées par leurs pairs comme étant expertes du domaine des soins en contexte de diversité culturelle, des infirmières se disant intéressées par une pratique culturellement compétente et des étudiantes en dernière année d'un programme de baccalauréat en sciences infirmières. Un total de 24 participantes, dont 13 infirmières et 11 étudiantes ont pris part à cette étude. Un questionnaire sociodémographique, des périodes d'observation participante et des entrevues semi-structurées ont servi d'outils de collecte des données. La catégorie centrale « apprendre à réunir les différentes réalités afin d'offrir des soins efficaces en contexte de diversité culturelle » a été construite à partir d'une analyse inductive des données. Cette catégorie centrale se divise en trois sous-catégories : « construire la relation avec l'autre », « sortir du cadre habituel de pratique » et « réinventer sa pratique dans l'action ». La proposition théorique formulée présente l'évolution concomitante de ces trois sous-catégories en trois niveaux de développement de la compétence culturelle infirmière : « s'ouvrir aux différentes réalités entourant la pratique en contexte de diversité culturelle », « mettre à l'épreuve sa pratique » et « réunir les différentes réalités de la pratique en contexte de diversité culturelle de façon intégrée ». La proposition théorique constructiviste est ancrée dans les données empiriques, circonscrit des étapes de développement interreliées et met en contexte les apprentissages du début du développement de la compétence culturelle à l'expertise. Les éléments contextuels précisés suggèrent l'ajout des dimensions sociales et politiques dans la définition du concept de compétence culturelle. Les deux principales contributions théoriques de cette étude soulignent que l'interaction entre l'infirmière et l'environnement de même que l'expérience clinique sont constitutifs du développement de cette compétence. Les retombées de cette recherche se situent non seulement en formation, mais aussi dans la pratique, la gestion et la recherche en sciences infirmières.

Le droit international véhicule des principes de droits des femmes dits universels. Pourtant, ces droits prennent un tout autre sens lorsque confrontés aux réalités locales. En Inde, le droit hindou entretient la notion de devoirs par opposition aux droits individuels. Ainsi, la femme est définie selon ses relations à la famille et au mariage plutôt que selon ses libertés sociales. Toute dérogation dans les devoirs de la femme envers sa famille ou son mari est une raison valable pour punir la délinquance et discipliner. Cette étude s’intéresse aux tensions entre les standards internationaux et locaux à partir de l’étude de la Protection of Women against Domestic Violence Act de 2005 (PWDVA). Cette loi se trouve au confluent de l’universalisme du droit international des droits humains et du pluralisme culturel en Inde. La PWDVA semble remettre en question le statut de la femme et de la famille dans la société. Les idéaux du droit peuvent-ils être adaptés aux diverses réalités nationales et locales? Comment les organisations non gouvernementales (ONG) s’inscrivent-elles dans la conjugaison du droit vivant et du droit international pour contrer la violence domestique? Cette recherche étudie le rôle des ONG dans l’adaptation et la traduction des normes internationales dans le contexte culturel et social indien. Une analyse approfondie de documents théoriques et juridiques, des observations participatives et des entrevues au sein d'une ONG à Mumbai en 2013 ont permis d’observer la transition des normes internationales vers le local. Un tel séjour de recherche fut possible à l’aide d'une méthodologie suivant le cadre théorique du féminisme postmoderne et de l’anthropologie juridique. L’analyse des résultats a mené à la conclusion que les ONG jouent un rôle de médiateur entre les normes appartenant au droit international, au droit national indien et au droit vivant. Celles-ci doivent interpréter les droits humains intégrés à la PWDVA en reconnaissant ce qui est idéaliste et ce qui est réaliste à la lumière des réalités locales, faisant ainsi l’équilibre entre le besoin de transformations des communautés et le respect des valeurs à préserver. Cette recherche offre donc une ouverture quant aux solutions possibles pour contrer les tensions entre droits des femmes et droits culturels dans un contexte de développement international.
