The European Court of Human Rights has begun to refer to the EU Charter of Fundamental Rights in order to support its reasoning for interpreting the European Convention on Human Rights in a particular way. But the EU Charter does not yet have any special status in that regard, being treated by the Court as on a par with numerous other documents of international law. The Court’s use of the Charter began in connection with arts 8 and 12 of the Convention (the right to a family life and the right to marry) but in subsequent years it has been extended to many other Articles of the Convention. It is in relation to art.6 (the right to a fair trial) that the Charter’s influence has been most noticeable so far, the Court having changed its position on two important aspects of Article 6 partly because of the wording of the EU Charter. But the influence on art.3 (in relation to the rights of asylum seekers), art.7 (in relation to retroactive penal laws), art.9 (in relation to the right to conscientious objection) and art.11 (in relation to rights of trades unions) has also been significant. The potential for the Charter to have greater influence on the Court’s jurisprudence in years to come remains considerable.

Through analysis and interpretation of transcribed taped conversations with two remarkable University teachers, Joel Shack and Harry Whittier, an articulation of perception and metaphor that exists in effective teaching, emerges as life giving or transformational. Creative insight and interpretation connect teaching to life. This work demonstrates how insightful conversations about teaching relate to poetic essence (Joel), energy (Harry), and healing (Ray), all aspects of a similar perceptual, creative and transformative process. Teachers shape education and excellent teaching inspires insofar as it is inspirited. Effective teaching is highly conscious and intentional. So much depends on how aware the teacher is, how the teacher sees what s/he is doing and how this doing/teaching is received. The effective teacher, attentive to how this energy works, can provoke positive change in consciousness both in the student, in education and in society. My study draws attention to the healing power of the teacher as he/she teaches and to the process of dialogue as teachers talk about what they do and don't do. For inherent in conversation and dialogue is the desire to affirm whole perceptions of existence. Dialogue and conversation is necessary to creating the kind of consciousness that will aid the reflective and conscientious teacher. The effective teacher attempts to effect change, to make things better. I call this transforming process, healing. And what creates this healing is the life, the attitude and approach of the teacher. The teacher's energy and consciousness, the teacher's perception of meaning, is the active but implicit ingredient in this transformative and healing process. These conversations are creative, theoretical, illuminating and even practical. It is my hope that the contents of these conversations will inspire potential teachers who can consider the vocation of teaching as a healing process that promises to generate positive growth in mind, body and spirit.

Human decision-making has consistently demonstrated deviation from "pure" rationality. Emotions are a primary driver of human actions and the current study investigates how perceived emotions and personality traits may affect decision-making during the Ultimatum Game (UG). We manipulated emotions by showing images with emotional connotation while participants decided how to split money with a second player. Event-related potentials (ERPs) from scalp electrodes were recorded during the whole decision-making process. We observed significant differences in the activity of central and frontal areas when participants offered money with respect to when they accepted or rejected an offer. We found that participants were more likely to offer a higher amount of money when making their decision in association with negative emotions. Furthermore, participants were more likely to accept offers when making their decision in association with positive emotions. Honest, conscientious, and introverted participants were more likely to accept offers. Our results suggest that factors others than a rational strategy may predict economic decision-making in the UG.

Les changements socioéconomiques des dernières décennies ont profondément transformé le rapport qu’entretient le Québec avec ses professionnels de la santé. En ouvrant le champ à l’accumulation privée du capital dans les années 1990, se met en place au sein de la fonction publique une philosophie politique issue du monde des affaires. Dès lors, le paradigme de la gouvernance investit les hôpitaux, où exerce 65 % de l’effectif infirmier québécois. Des chercheurs ont investigué les contraintes et torts subis par les infirmières consécutivement à la restructuration du système de santé, cependant, peu d’entre eux ont tenu compte des rapports de force et des structures de pouvoir dans lesquels s’enracine le vécu des infirmières. La présente étude a pour but d’explorer les expériences vécues d’infirmières soignantes politiquement engagées qui exercent en centre hospitalier (CH), de rendre compte de l’ordre social existant au sein de cette institution, de décrire la façon dont elles aimeraient idéalement exercer et de répertorier les idées qu’elles ont et les actions qu’elles mettent en place individuellement ou collectivement de façon à favoriser la transformation de l’ordre social et de l’exercice infirmier en CH. Épistémologiquement, notre étude qualitative s’inscrit dans cette idée que la réalité est complexe, mouvante et dépendante de la perception des personnes, proposant une orientation compréhensive et contextualisée de l’action humaine et du politique; c’est ainsi que le point de vue politique des infirmières participantes est pris en compte. L’articulation des expériences vécues, de l’idéal normatif et de l’action politique des participantes est explorée suivant une perspective postmoderniste, praxéologique et dialectique issue de la théorie critique qui réfléchit non seulement sur ce qui est, mais également sur ce qui est souhaitable; une réflexion qui sous certaines conditions s’ouvre sur l’action transformatrice. Les notions de pouvoir, de rapport de force, de résistance et d’émancipation influencent notre analyse. Au terme de cette étude, les résultats indiquent la présence d’une déprofessionnalisation graduelle en faveur d’une technicisation du soin infirmier et d’une dérive autoritaire grandissante au sein des CH s’arrimant au registre sémantique de l’économie de marché à partir des notions d’efficacité, de performance et d’optimisation. Les infirmières soignantes perçues comme des « automates performants » se voient exclues des processus décisionnels, ce qui les prive de leurs libertés de s’exprimer et de se faire critiques devant ce qui a été convenu par ceux qui occupent les hautes hiérarchies du pouvoir hospitalier et qui déterminent à leur place la façon dont s’articule l’exercice infirmier. Le pouvoir disciplinaire hospitalier, par l’entremise de technologies politiques comme la surveillance continue, les représailles et la peur, la technicisation du soin et le temps supplémentaire obligatoire, concourt à la subjectivation des infirmières soignantes, en minimisant l’importance de leur jugement clinique, en affaiblissant la solidarité collective et en mettant au pas l’organisation syndicale, ce qui détournent ces infirmières de la revendication de leurs droits et idéaux d’émancipation les ramenant à une position subalterne. Nos résultats indiquent que les actions politiques que les participantes souhaitent déployer au sein des CH visent l’humanisation des soins et l’autodétermination professionnelle. Toutefois, nombre des actions répertoriées avaient pour finalité fonctionnelle la protection et la survie des infirmières au sein d’un dispositif hospitalier déshumanisant. Certaines infirmières soignantes s’objectent en conscience, déploient des actions de non-coopération individuelles et collectives, font preuve d’actes de désobéissance civile ou souhaitent agir en ce sens pour établir un rapport de force nécessaire à la prise en compte de leurs revendications par une gouvernance hospitalière qui autrement ferait la sourde oreille. Le pouvoir exercé de façon hostile par la gouvernance hospitalière doit à notre avis être contrecarré par une force infirmière collective égale ou supérieure, sans quoi les politiques qui lui sont associées continueront de leur être imposées. Le renouvellement radical de la démocratie hospitalière apparaît comme la finalité centrale vers laquelle doivent s’articuler les actions infirmières collectives qui permettront l’établissement d’un nouveau rapport de force puisque c’est à partir de celle-ci que les infirmières soignantes pourront débattre de l’orientation que doit prendre l’exercice infirmier.

A medida que pasa el tiempo; la ciencia, el desarrollo tecnológico y la constante búsqueda de encontrar nuevas verdades, más fehacientes y que logren responder más asertivamente los diferentes cuestionamientos de la humanidad, han logrado redefinir las teorías y los axiomas que, en su momento, se tomaron como el dogma a seguir en diferentes disciplinas y cuestionamientos de la sociedad y la industria. La concepción tradicional que se tiene de la mente y el comportamiento del consumidor tenía vacios importantes en términos de aplicabilidad y generalización de sus teorías, pues pensar que la humanidad desarrolla sus decisiones de compra bajo análisis netamente racionales y apegados a estructuras temporales para manejar su dinero es un supuesto que no se emplea de manera general y concienzuda por el común. Antes que agentes 100% racionales, con un completo flujo de información y en un mercado perfecto bajo todos los preceptos económicos, somos personas de sentimientos y sentidos. Reaccionamos ante situaciones, estados de ánimo y estímulos, donde es nuestro cerebro quien recibe todo el contexto cognitivo que nos brinda el entorno y entonces actúa (y compra) de diferentes maneras. Es allí donde el Neuromarketing nace como un claro ejemplo de esa búsqueda por una nueva verdad. Una donde entender al consumidor no deje de lado su faceta más real; sus reacciones, pues son estas las que realmente definen qué le gusta o no y qué despierta en él un impulso lo suficientemente importante como para incidir en su decisión de compra. Es por ello que el Neuromarketing se ha adentrado a estudiar lo más profundo y verídico del consumidor, su cerebro. Alejándose de las técnicas tradicionales de investigación de mercados, donde el consumidor puede desvirtuar la información que percibe de un producto o una campaña publicitaría por diferentes razones sociales y psicológicas. El Neuromarketing se ha adentrado al estudio del consumidor y su cerebro mediante técnicas biométricas, en las cuales expone al consumidor al marketing y analiza sus reacciones cerebrales en términos de interés, adrenalina, memoria activa y sentimientos, apoyado por técnicas como el ¨eye tracking¨, donde las interacciones visuales del consumidor permiten identificar los puntos calientes y de interés en determinada pieza publicitaria. Pero el estudio, entendido por algunos como ¨invasivo¨ frente a las libertades en términos de privacidad y libertad de elección del consumidor deben ser responsablemente dirigidos y puestos bajo un contexto científico, donde el único fin sea el de generar nuevas hipótesis y teorías que permitan tener un mejor conocimiento del comportamiento del consumidor sin traspasar los límites del control del mismo. El Neuromarketing debate su existencia misma entre la creación de nuevas metodologías de acercamiento al pensamiento del consumidor, la efectividad de sus conocimiento dados a la industria y el yugo social que acarrea esta ciencia debido a la potencial coerción a los consumidores debido a sus hallazgos.

Conscientious objection is defined as the ability to depart from statutory mandates because of intimate convictions based on ethical or religious convictions. A discussion of this issue presents the conflict between the idea of a State concerned with the promotion of individual rights or the protection of general interests and an idea of law based on the maintenance of order and against a view of the law as a means to claim the protection of minimum conditions of the person. From this conflict is drawn the possibility to argue whether conscientious objection should be guaranteed as a fundamental right of freedom of conscience or as a statutory authority legislatively conferred upon persons. This paper sets out a discussion around the two views so as to develop a position that is more consistent with the context of social and constitutional law.

Entender la relevancia que adquiere el triunfo de Fernando Armindo Lugo Méndez en Paraguay implica realizar un repaso de la vida política de dicho país, para comprender el funcionamiento que el Partido Colorado –opositor al ex obispo en las elecciones del 2008– adquirió en los previos 61 años en el poder; 35 de los cuales conformaron una dictadura (liderada por Alfredo Stroessner).Realizando una breve caracterización de la historia política del Paraguay, comenzando con las Guerras Patrias, prosiguiendo con una descripción de los gobiernos colorados que presidieron entre 1947 y 2008, y profundizando el análisis de los años de transición a la democracia (iniciada en 1989), este artículo intentará dar una aproximación interpretativa sobre los factores que confluyeron para lograr el triunfo electoral del ex clérigo Fernando Lugo en el año 2008, quien derrocó al Partido Colorado (Asociación Nacional Republicana, ANR).Consiguientemente, se describirá la conformación de los poderes legislativos y judiciales, con la finalidad de observar continuidades y rupturas en estas instituciones durante la transición y en el gobierno actual.Finalmente, se hará un breve comentario referido a la actualidad del país, a dos años de haber consagrado como primer mandatario a un ex obispo.---The restoration of the democraticorder in Paraguay. Método: En el Complejo Calle 100 en Bogotá, en el periodo de Julio a Diciembre de 2013 se revisaron los Urocultivos positivos, de pacientes menores de 16 años con diagnóstico clínico de IVU, procedentes de la comunidad. Consultamos las historias clínicas para documentar antibiótico empírico dado y episodios previos de infección. Se describieron los gérmenes aislados y las resistencias antibióticas. Discusión: Las cefalosporinas de primera generación tienen tasas de resistencias superiores al 37%, similar a lo reportado en la literatura, y son usadas como primera línea; ésta conducta debe ser reevaluada. Los aminoglucósidos, la nitrofurantoína y la cefuroxima son alternativas terapéuticas recomendables. La prevalencia de E coli BLEE de origen comunitario genera preocupación, debe incitar a realizar manejo antibiótico dirigido y concienzudo.

Although the effects of personality traits on complaining behaviour emerged in the early 1980s, there is limited research in the service industry. The purpose of this study is to examine whether consumer personality traits influence intentions to complain and whether product price and product types moderate the relationship between personality traits and intentions to complain in the retail industry. The research model is tested by logistic regression analysis on two groups of consumers who report passive and active complaining intentions. The study reveals that conscientious consumers who are open to new experiences tend to have higher intentions to complain. Being extroverted does not have any influence on complaining behaviour. Whilst price levels (low/high) and product types (grocery, clothing and electronics) improve the predictive ability of the complaining behaviour, the interaction effects relating to the three personality traits are statistically insignificant. Theoretical and managerial implications of the study findings are discussed.

This thesis concerns the place of music in New South Wales schools from 1920 to 1956. The initial chapters explore issues related to the investigation and the methodology that has guided the research. To provide a foundation for the thesis as a whole, the investigation’s British antecedents are considered and the relevant literature is reviewed. Six broad themes are used as the organisational framework for this thesis: the major events that shaped schooling, the syllabus and recommended music resources, the rationales for the inclusion of music in schools, the place of school music broadcasts, music teaching practice in schools, and the provision of teacher training. Each theme forms the basis of one chapter, with the exception of one extensive theme which is discussed in two adjoining chapters.

This investigation concluded that from 1920 to 1956, the Department of Education’s fundamental aim for schooling was to develop the state’s children into good citizens. Music was valued for its ability to contribute to this aim.

During this period, the Department engaged in a policy of music transmissionism. Specifically, the Department sought to transmit the music values, knowledge and skills that it held in high regard to teachers who in turn were expected to transmit them to their students. The dominant culture and values that were transmitted were those of Britain and the British Empire—that is, music was used to transmit Britishness to children.

The investigation also concluded that during this period there was an expansion of music curriculum and pedagogy in New South Wales. However, in a oneway traffic of ideas between Britain and Australia, it was British music education practices that continued to influence the methods used in New South Wales schools.

In addition, this investigation concluded that there were past periods when New South Wales schools were very musical places—specifically, at the turn of the twentieth century, during the Second World War and during the immediate post-war years. The successes achieved in music during these times required the interplay of six factors: a Department of Education that valued music for the contribution it made to the development of children as good citizens; a Department of Education that provided strong leadership for music by employing a conscientious, inspirational music educator or educators whose sole responsibility was to champion and supervise music across the state; a Departmental expectation that music would be taught by generalist teachers who themselves had developed music expertise during their pre-service preparation or through professional development opportunities offered to them; the existence of a reward system to encourage teachers to increase their music discipline knowledge and skills; a music syllabus that was developmental and hence built on prior music knowledge and skills; and teachers who were able to deliver quality music programs to their students because they themselves were one element in a cycle of respect for music.

It describes his constitutional role and interventions in the Australian political process. It concludes that he was a conscientious King’s representative, with a deep interest in Australian political and social affairs and was accepted by members of both parties.

The aim of this study was to explore the relationship between consumer personality and brand personality as measured by constructs refl ecting The Big Five dimensions in the context of fashion products. The fi ndings of the study show that some dimensions of The Big Five constructs are signifi cantly related to preferences on particular dimensions of brand personality. It was found that consumers who exhibit a Conscientious personality demonstrate preferences towards ‘ Trusted ’ brands. In contrast, those who are Extrovert in nature are motivated by ‘ Sociable ’ brands. Findings related to gender reveal that male and female consumers differ in how they express their personality when it comes to brand personality. Male respondents who are dominant on the Neuroticism dimension prefer ‘ Trusted ’ brand, whereas ‘ Trusted ’ brand is preferred by females who are dominant on the Conscientiousness dimension. The results of this study will inform brand managers about how to tailor specifi c marketing strategies such that brand personalities communicated to consumers are congruent with their personalities.

The research contemplates the dilemma faced by small rural communities producers¿ in north-eastern Brazil maintaining last longing relationships. Due to difficult social conditions in distant regions, small producers utilize practices of commercial exclusivity to obtain sustainability. In the Lago do Junco community case, located in the state of Maranhão, the babaçu oil exports¿, the social environmental appeal guarantee the cluster participants sustainability and the representation of women in society. But social problems related to the lack of formal education e the absence of relationship with local aid organizations causes the non compliance with market demands, leading the cluster to a non-innovative trap. In the honey community case in Simplício Mendes, located in the state of Piauí, the closest relationship with the external aid agents increased the conversion of market demands in reality. The analysis reveal possibilities on obtaining economic sustainability for small producers thru the conscientious utilization of nature resources guaranteeing the harmony between the environmental preservation and the development of both activities, apiculture in Piauí and babaçu oil processing in Maranhão.

Desde à muito, os temas, capital social e comportamento de cidadania organizacional (CCO) têm sido extensivamente pesquisado e estudados nos EUA, no entanto estes têm recebido pouca relevância a nível de outros contextos internacionais. Se por um lado, a sua importância e inferência na performance dentro do contexto empresarial têm sido crescente, caracterizando a necessidade de um entendimento cada vez maior por parte das empresas, por outro, o investimento das corporações de grande porte, caminham cada vez mais em direção dos países com crescimento exponencial sustentado, como são o BRIC, o que cna uma necessidade fomentada de pesquisa nesta área de pesquisa para estas regiões. Este estudo pretendeu investigar, avaliar e mapear a influência do capital e do CCO na satisfação de vida e desempenho no trabalho do funcionário de nível superior, no contexto empresarial brasileiro e português, com o objetivo de identificar quais as diferenças existentes nestes duas realidade, devido ao investimento crescente do segundo para com o primeiro. Genericamente, encontramos clara influência das dimensões do CCO tanto para o desempenho no trabalho como para a satisfação de vida do trabalhador, assim como presença também marcada das duas dimensões do capital Social. Mais especificamente, foi entendido pelo nosso estudo que a realidade empresarial brasileira necessita que as empresas criem mecanismos que fomentem os laços entre colegas, a conscienciosidade, altruísmo e virtude cívica dos seus funcionários, pois assim aumentará o desempenho. Já para o contexto português, apenas a conscienciosidade e a virtude apresentaram significativa relação. Desta forma, conclui-se que para o investimento das empresas português no Brasil, estas precisam ter atenção à dimensão estrutural - relação com colegas - promovendo-a e à necessidade patente que os brasileiros têm de ajudar os seus colegas - comportamento altruísta - para aumentar o desempenho no trabalho. No que se refere a satisfação de vida, que se mostrou estreitamente relacionada com o desempenho, o brasileiro apenas precisa notar confiança nos colegas, senti-se altruísta e consciencioso, ao passo que o português necessita criar fortes laços com os colegas, mas não fomentar o comportamento altruístico. Desta forma as empresas investidoras apenas precisam ter atenção mais uma vez a necessidade de prestar ajuda especifica que o brasileiro sente, promovendo workshops com os próprios funcionários, por forma a estes passarem o seu conhecimento, monitorias, estágios, entre outros. Estes resultados demonstraram que cada continente, país (possuidor ou não da mesma língua) e/ou cultura comporta diferenças significativas no contexto empresarial, assim tornase difícil implementar técnicas e comportamentos internacionais e esperar que os resultados sejam exatamente iguais. Este estudo espera dar alguns instrumentos de comparação para que as empresas portuguesas entendam, a este nível, a realidade brasileira.

O reconhecimento pela Ciência de que os animais são seres sencientes e conscientes propiciou o surgimento das teorias morais que chamamos de direito animal, bem como o desenvolvimento de alternativas técnicas ao uso de animais, sobretudo na educação. Neste cenário, estudantes de biomédicas se recusam à realização de experimentação animal, baseados no direito à objeção de consciência protegido pela Constituição da República Federativa Brasileira de 1988, que, contudo, tem sido negado pelos tribunais. Este trabalho tem por objetivo, através do estudo de casos, apresentar que as premissas e os fundamentos em que se apoiam os tribunais para negar a objeção de consciência são questionáveis do ponto de vista jurídico, tendo em vista o sentido da objeção de consciência e hermenêutico, pela aplicação do princípio da força normativa da constituição e do princípio da proporcionalidade.
