This socio-legal thesis has explored the factors responsible for explaining whether and how redress mechanisms control bureaucratic decision-making. The research considered the three principal institutions of administrative justice: courts, tribunals, and ombudsman schemes. The field setting was the local authority education area and the thesis examined bureaucratic decision-making about admissions to school, home-to-school transport, and Special Educational Needs (SEN). The thesis adopted a qualitative approach, using interviews and documentary research, within a multiple embedded case study design. The intellectual foundations of the research were inter-disciplinary, cutting across law, socio-legal studies, public administration, organization studies, and social policy. The thesis drew on these scholarly fields to explore the nature of bureaucratic decision-making, the extent to which it can be controlled and the way that learning occurs in bureaucracies and, finally, the extent to which redress mechanisms might exercise control. The concept of control was studied across all its dimensions – in relation both to ex post control in specific cases and the more challenging notion of ex ante or structuring control. The aim of the thesis was not to measure the prevalence of bureaucratic control by redress mechanisms, but to understand the factors that might explain its presence or absence in a particular area. The findings of the research have allowed for a number of analytical refinements and extensions to be made to existing theoretical and empirical understandings. 14 factors, along with 87 supporting propositions, have been set out with the aim of making empirically derived suggestions which can be followed up in future research. In terms of the thesis’ contribution to existing knowledge, its comparative focus and its emphasis on the broad notion of control offered the potential for new insights to be developed. Overall, the thesis claims to have made three contributions to the conceptual framework for understanding the exercise of control by redress mechanisms: it emphasizes the importance of ‘feedback’ in relation to the nature of the cases referred to redress mechanisms; it calls attention to the structure of bureaucratic decision-making as well as its normative character; and it discusses how the operational modes of redress mechanisms relate to their control functions.

UCON is an emerging access control framework that lacks an administration model. In this paper we define the problem of administration and propose a novel administrative model. At the core of this model is the concept of attribute, which is also the central component of UCON. In our model, attributes are created by the assertions of subjects, which ascribe properties/rights to other subjects or objects. Through such a treatment of attributes, administration capabilities can be delegated from one subject to another and as a consequence UCON is improved in three aspects. First, immutable attributes that are currently considered as external to the model can be incorporated and thereby treated as mutable at- tributes. Second, the current arbitrary categorisation of users (as modifiers of attributes), to system and administrator can be removed. Attributes and objects are only modifiable by those who possess administration capability over them. Third, the delegation of administration over objects and properties that is not currently expressible in UCON is made possible.

The ultimate goal of an access control system is to allocate each user the precise level of access they need to complete their job - no more and no less. This proves to be challenging in an organisational setting. On one hand employees need enough access to the organisation’s resources in order to perform their jobs and on the other hand more access will bring about an increasing risk of misuse - either intentionally, where an employee uses the access for personal benefit, or unintentionally, through carelessness or being socially engineered to give access to an adversary. This thesis investigates issues of existing approaches to access control in allocating optimal level of access to users and proposes solutions in the form of new access control models. These issues are most evident when uncertainty surrounding users’ access needs, incentive to misuse and accountability are considered, hence the title of the thesis. We first analyse access control in environments where the administrator is unable to identify the users who may need access to resources. To resolve this uncertainty an administrative model with delegation support is proposed. Further, a detailed technical enforcement mechanism is introduced to ensure delegated resources cannot be misused. Then we explicitly consider that users are self-interested and capable of misusing resources if they choose to. We propose a novel game theoretic access control model to reason about and influence the factors that may affect users’ incentive to misuse. Next we study access control in environments where neither users’ access needs can be predicted nor they can be held accountable for misuse. It is shown that by allocating budget to users, a virtual currency through which they can pay for the resources they deem necessary, the need for a precise pre-allocation of permissions can be relaxed. The budget also imposes an upper-bound on users’ ability to misuse. A generalised budget allocation function is proposed and it is shown that given the context information the optimal level of budget for users can always be numerically determined. Finally, Role Based Access Control (RBAC) model is analysed under the explicit assumption of administrators’ uncertainty about self-interested users’ access needs and their incentives to misuse. A novel Budget-oriented Role Based Access Control (B-RBAC) model is proposed. The new model introduces the notion of users’ behaviour into RBAC and provides means to influence users’ incentives. It is shown how RBAC policy can be used to individualise the cost of access to resources and also to determine users’ budget. The implementation overheads of B-RBAC is examined and several low-cost sub-models are proposed.

The United States and Japanese counterpart panels on aquaculture were formed in 1969 under the United States-Japan Cooperative Program in Natural Resources (UJNR). The panels currently include specialists drawn from the federal departments most concerned with aquaculture. Charged with exploring and developing bilateral cooperation, the panels have focused their efforts on exchanging information related to aquaculture which could be of benefit to both countries. The UJNR was begun during the Third Cabinet-Level Meeting of the Joint United States-Japan Committee on Trade and Economic Affairs in January 1964, In addition to aquaculture, current subjects in the program include desalination of seawater, toxic microorganisms, air pollution, energy, forage crops, national park management, mycoplasmosis, wind and seismic effects, protein resources, forestry, and several joint panels and committees in marine resources research, development, and utilization. Accomplishments include increased communication and cooperation among technical specialists; exchanges of information, data, and research findings; annual meetings of the panels, a policy-coordinative body; administrative staff meetings; exchanges of equipment, materials, and samples; several major technical conferences; and beneficial effects on international relations. BACKGROUND: After investing significant amounts of time and money in conducting formal risk assessments, such as root cause analysis (RCA) or failure mode and effects analysis (FMEA), healthcare workers are left to their own devices in generating high-quality risk control options. They often experience difficulty in doing so, and tend toward an overreliance on administrative controls (the weakest category in the hierarchy of risk controls). This has important implications for patient safety and the cost effectiveness of risk management operations. This paper describes a before and after pilot study of the Generating Options for Active Risk Control (GO-ARC) technique, a novel tool to improve the quality of the risk control options generation process. OUTCOME MEASURES: The quantity, quality (using the three-tiered hierarchy of risk controls), variety, and novelty of risk controls generated. RESULTS: Use of the GO-ARC technique was associated with improvement on all measures. CONCLUSIONS: While this pilot study has some notable limitations, it appears that the GO-ARC technique improved the risk control options generation process. Further research is needed to confirm this finding. It is also important to note that improved risk control options are a necessary, but not sufficient, step toward the implementation of more robust risk controls.

Do public organizations with similar tasks or structures differ across states with respect to their autonomy and control? If so, why? By comparing the autonomy, control and internal management of state agencies, this book shows how New Public Management doctrines actually work in three small European states with different politico-administrative regimes. Using a unique set of similar survey data on 226 state agencies in Norway, Ireland and Flanders, this study explains differences in agency autonomy, control and management by referring to international isomorphic pressures, state-specific politico-administrative regimes and characteristics of agencies. Therefore, organization theory and neo-institutional schools are used to formulate four competing theoretical perspectives and hypotheses are tested through simple and advanced statistical techniques. By comparing practices between states and between types of agencies, this study substantially enhances scientific knowledge about why public organizations are granted autonomy, why they are controlled in specific ways, and how autonomy affects internal management.

For this case examples have been chosen ranging from administrative or minor (criminal) offences to increasingly serious offences and offenders. In this way it can be comparatively demonstrated how the criminal justice systems studied handle specific cases and whether they do so in a similar or different way.

Ce mémoire revient sur la première tutelle de la Ville de Montréal, imposée par le gouvernement provincial de 1918 à 1921. Pour l’occasion, le Lieutenant-gouverneur du Québec nomme cinq administrateurs afin de gérer les affaires courantes de la municipalité. Peu connu des historiens et du public, cet événement suscite des changements profonds dans les structures politiques et administratives de la Ville qui laissent des empreintes dans la vie quotidienne actuelle des Montréalais. Puisqu’ils ne sont pas redevables devant la population, les commissaires mettent en œuvre plusieurs réformes souvent impopulaires qui permettent de rétablir l’équilibre budgétaire de la Ville. Au passage, ils tentent de moderniser l’administration municipale dont le fonctionnement est jusque-là incompatible avec les réalités d’une population grandissante et d’un espace urbain accru par les nombreuses annexions. Notre étude souligne les réformes implantées par la Commission administrative au niveau de la fiscalité, de l’organisation des services municipaux et des politiques d'urbanisme. Elles s’inspirent de réformes mises en œuvre dans plusieurs villes nord-américaines de grande taille. Durant leur mandat, les nouveaux administrateurs cherchent à imposer un modèle d’administration s’inspirant de grandes entreprises privées et réussissent à réduire de manière substantielle le déficit de la Ville. Enfin, une attention particulière est accordée à la fin du mandat de la Commission administrative et au régime administratif qui lui fait suite.

En continuité avec les ouvrages récents (Veyne 1981, MacMullen 1988 et Kelly 2004) qui tentent de relativiser les effets néfastes de la corruption lors du Bas-Empire, ce travail étudie le suffragium, le processus de nomination des fonctionnaires de bureaux, afin d'évaluer comment les acteurs sociaux du IVe siècle considéraient ce phénomène. Ce système, organisé d'une telle façon que les hauts fonctionnaires devaient fournir des lettres de recommandation aux candidats postulant à des postes au sein de la fonction publique, serait devenu complètement corrompu durant le IVe siècle et les lettres de recommandation auraient commencé à être systématiquement vendues. Pourtant, les lois de Constantin, Constance et Julien ne fournissent aucune preuve tangible que le suffragium était dans tous le cas vénal à cette époque. Bien au contraire, les empereurs ajoutaient la plupart de temps des épithètes au terme suffragium pour spécifier qu'il parle du suffragium vénal. Généralement, les empereurs sont présentés comme farouchement opposés au suffragium et à toutes les tractations qui y sont attachées. Loin d'être aussi hostiles envers les « pratiques corrompues », les empereurs de la dynastie constantinienne firent preuve d'un certain pragmatisme en voyant qu'ils ne pouvaient contrôler toutes les nominations de ceux qui voulaient entrer dans la fonction publique et que ce n'était pas nécessairement à leur avantage de le faire. Les empereurs se concentrèrent plutôt sur les restrictions entourant les promotions afin de faire en sorte que les personnes qui avaient de réels pouvoirs soient celles qui avaient démontré leurs qualités tout au long de leurs années de service. Bien qu'ils n'aient pas concrètement légiféré sur les critères d'embauche des candidats, cela ne veut pas dire que n'importe qui pouvait obtenir un poste. À travers l'étude des lettres de Libanios et de Symmaque, ce travail démontre que les hauts fonctionnaires ne fournissaient pas de lettres à quiconque le demandait, puisque leur réputation pouvait être entachée par le fait d'avoir recommandé un mauvais candidat à un de leurs amis. Les hauts fonctionnaires qui recevaient les recommandations pouvaient également soumettre les candidats à des examens afin d'être certains de la qualité de l'individu. Ce système officieux de contrôle des candidats vint pallier, en partie, les déficits de la législation impériale. Conjointement, la loi et les usages permirent à l'administration de fonctionner en lui fournissant des candidats qui répondaient aux critères de l'époque.

Con esta investigación se busca fortalecer las relaciones entre el government y la citizenship reflejándose en una transformación de la cultura institucional a partir de la cual se hiciera posible que la sociedad civil y el gobierno confluyeran en el propósito de mejorar la governance mediante las recomendaciones de la ciudadanía y la vigilancia y fiscalización que realizan las entidades de control. Riohacha, capital del departamento de la guajira es el principal objeto de este proyecto, pues llama la atención que es una de las ciudades más antiguas de Colombia, fundada en 1545 y se encuentra en un menor grado de desarrollo frente a todas las capitales de la región Caribe. De esta forma el control social es un instrumento clave y debe ser un derecho y un deber del ciudadano y ser ejercido de manera constante y transparente a través de figuras como las Citizens" watch. así se podría tener un control a la actividad administrativa y promover una mayor transparencia y eficiencia en el cumplimiento de los planes de desarrollo en el municipio de Riohacha.

La monografía presenta la auto-organización sociopolítica como la mejor manera de lograr patrones organizados en los sistemas sociales humanos, dada su naturaleza compleja y la imposibilidad de las tareas computacionales de los regímenes políticos clásico, debido a que operan con control jerárquico, el cual ha demostrado no ser óptimo en la producción de orden en los sistemas sociales humanos. En la monografía se extrapola la teoría de la auto-organización en los sistemas biológicos a las dinámicas sociopolíticas humanas, buscando maneras óptimas de organizarlas, y se afirma que redes complejas anárquicas son la estructura emergente de la auto-organización sociopolítica.

Este trabajo pretende de una manera tanto teórica como práctica, estudiar la relación que pueda existir entre la interculturalidad y el Management Control System, para ello se realiza una revisión bibliográfica de los trabajos empíricos y teóricos desarrollados hasta el momento sobre el tema. Se comienza con la revisión de los diferentes conceptos que puedan hacer alusión a la interculturalidad, y los MCS (o contemple variables cercanas en relación a este), se delimita el tema y se procede a su clasificación hasta llegar a la estructuración de la definición de los constructos que integren los conceptos de interculturalidad y MCS. De igual manera, se operacionalizan las variables para poder generar un análisis practico utilizando estadística cuantitativa. Finalmente presentamos los resultados que demuestran el grado de importancia percibido por encuestados de filiales localizadas en diferentes países de Latino América de la empresa Agrocampo S.A.S, con el fin de presentar conclusiones que integren los dos temas de análisis.

Las organizaciones en la actualidad deben encontrar diferentes maneras de sobrevivir en un tiempo de rápida transformación. Uno de los mecanismos usados por las empresas para adaptarse a los cambios organizacionales son los sistemas de control de gestión, que a su vez permiten a las organizaciones hacer un seguimiento a sus procesos, para que la adaptabilidad sea efectiva. Otra variable importante para la adaptación es el aprendizaje organizacional siendo el proceso mediante el cual las organizaciones se adaptan a los cambios del entorno, tanto interno como externo de la compañía. Dado lo anterior, este proyecto se basa en la extracción de documentación soporte valido, que permita explorar las interacciones entre estos dos campos, los sistemas de control de gestión y el aprendizaje organizacional, además, analizar el impacto de estas interacciones en la perdurabilidad organizacional.

Estudio que explora la manera en que se construye el archivo colonial a través de mecanismos jurídico-administrativos, dedicados a ejercer el control sobre las poblaciones subordinadas y el mantenimiento del poder colonial. El paso del testimonio oral, de los indígenas, al documento escrito, característico de la cultura letrada española, representó un desafío cultural. Paulatinamente, los indígenas aprendieron a usar el documento escrito y a emprender litigios judiciales. El control burocrático de la monarquía española dependió centralmente del uso y archivo de la documentación escrita y del papel que jugaron los letrados.

El texto analiza la forma en que la Constitución vigente regula la estructura, atribuciones y funcionamiento de los organismos de control y propone la forma en la que el tema debe ser tratado en una nueva Constitución. Para ello, se considera necesario tomar en cuenta la naturaleza de cada institución, lo que implica quitar a la Procuraduría General del Estado el carácter de órgano de control, y establecer un sistema de control fuerte concentrado en una única institución y no, como ocurre actualmente, disperso en varias entidades. La eliminación de la Comisión de Control Cívico de la Corrupción se muestra por ello como necesaria y, para contribuir a la independencia de la Contraloría General del Estado, poner especial atención en el período de funciones del Contralor, a fin de que éste no coincida con los períodos presidenciales. La utilización de las nuevas tecnologías para informar a la ciudadanía y permitir su participación en el control de la gestión pública es, también, indispensable.
