Este livro traz reflexões a partir de ideias e teorias produzidas e difundidas pelo Núcleo de Estudos de Direitos Alternativo (Neda) e pelo Núcleo de Estudos da Tutela Penal e Educação em Direitos Humanos (NETPDH), ligados à Faculdade de Ciências Humanas e Sociais da Unesp, em Franca. Ambos os grupos são reconhecidos nos meios acadêmicos do Direito por desenvolverem uma visão crítica acerca de tutela penal, que seria permeada pela seletividade e desproporcionalidade, além de provocar estigmatização, reunindo, assim, traços marcantes do sistema penal brasileiro. De acordo com o prefácio do professor de Direito Penal e Criminologia da Unesp, Paulo César Corrêa Borges, o autor, Roberto Galvão Faleiros Junior, apresenta aqui reflexões da criminologia crítica que estabelecem uma compreensão conjuntural dos sistemas penais (particularmente o do Brasil).Tais reflexões indicam, segundo Borges, proposições concretas para a instrumentalização democrática do direito penal na América Latina, levando em conta os pressupostos materiais, históricos e dialéticos comprometidos com a formulação de concepções a partir das classes subalternas e marginalizadas, mas também com limitações referentes à compreensão dos direitos humanos

The relationship between humans and the world around is getting less symbiotic and harmonic, so as with the other animals we share the planet with, mostly about domination of plagues, domination for food, company, work or fun. This last both are responsible for the beginning of the Circus as we know, with the exhibition of wild animals and horses, and have been increased with clowns, acrobats, and jugglers, street artists, getting to be one unified show all around the world, which most of them don´t have animals. Following this tendency, the PL 7291/06 is on process on the plenary assembly to forbidden the animals inside Circus. In that matter, this work is a Phenomenological perspective of the phenomenon Circus’s animals sited beyond the animal rights activists perspective. The Ideographic and Nomotetic analysis of the activist’s speech realize that is no discordance between then. All the speeches agrees that the animal must be out of the circus, and most of them agrees about the cruelty involving the animal´s domination, about that ONGs should be the better destination for this animals, and they shows lack of knowledge about the Brazilian Circus, with or without animals, their traditions and characteristics, so as the lack of knowledge about de ecology and biology of the animals involved.

Marine turtles are reptiles that occur on the Brazilian coast and can travel very large distances between feeding and nesting grounds. Five species found in Brazil are threatened. The consumption of turtle meat and eggs is an ancient habit in many coastal communities around the world. The main causes that threaten these species are the increase in fishing and the drastic changes in the environment. The presence of turtles near the beaches and their accidental capture were reported by fishermen in the region of Cananéia, where this work was developed. This study was also made based in interviews of fishermen that living in the area and the follow up of their fishing activities. This methodology made possible to identify the turtles in the area, the behavior of the fishermen with these animals and the relation between non-commercial fishing and turtles. The fishing traps area has a direct relation with the capture of turtles. The higher incidence of turtle capture is usually next to islands, rocky coasts, low lands and bay entrances, which are areas where the most common species of the region (Chelonia mydas) normally look for food. The fishermen opinions about the critical situation of these species and their conservation has also been studied. Several programs in Environmental Education for the communities of the region have been recommended

The main objective of this study was elaborating a diagnosis of technical conditions of Legal Reserves situation on the rural properties in Botucatu. In addition, considering the characteristics of fauna and flora and the economic aspects of these areas, it was presented alternatives to encourage the correct implantation and the effective preservation of the Legal Reserves. Because these areas contribute to the maintenance of local biodiversity and to availability of environmental services essential for all living creatures. In this study it was observed the presence of native vegetation in 13% of the rural properties’ areas in Botucatu, it is therefore necessary the recovery (reforestation) of 7% of all the rural properties’ areas, to be achieved the 20% of native vegetation (minimum area to be preserved as Legal Reserve, as disposed in Federal Law nº 12.651/12) on rural properties. A viable and significant alternative for recovery these areas, reinforced by the new forestry law, is the practice of sustainable management, that must be carried in harmony with conventional farming practices existing in the remaining areas of rural properties

The progressive growth of the population and the increase of sewage generated has demanded of society and public policies that, besides the collection network deployment is carried out the treatment and proper disposal of treated sewage in all brazilian municipalities. The aim of this study was to monitor and evaluate the work of implementation of a Sewage Treatment Plant (STP) in Guaratinguetá city of São Paulo state, to identify the compliance with legal requirements and the NBR 12,209/2011. The construction of this ETE met all the requirements of NBR 12209/2011 and benefited a large portion of population with the sewage treatment. Based on the results of this assessment it was concluded that the construction of a STP is relatively simple, differing only on the legal requirements related to the location, area for the construction and materials used in the work. The knowledge generated in this study will assist the public policies in the implementation of STPs in municipalities that do not yet have this basic sanitation

Historically the evolution of the occupation of ararense territory was due to the expansion of agricultural activities. Such activities were intensified with the transformations engendered by the Green Revolution, increasing the exploitation, the area occupied by agriculture and the deforestation and consequent environmental degradation. Therefore the current reality of rural areas in Araras/SP has shown that part of agricultural practices made it does not guarantee the effectiveness of environmental legislation and the sustainability of farms. Considering the recently implemented environmental policies, such as Law nº 12.651 / 2012, better known as New Forest Code and Decree nº 8.235 / 2014 establishing a period of one year to rural property registered with the Rural Environmental Registry (CAR), as tools targeting to reduce environmental degradation and contribute to building a sustainable rural development. This work aims to analyze the dynamics of the rural municipality of Araras on the environmental situation in some rural properties and actions to be taken by the owners to the full compliance of its properties before the environmental public policy

En el año 2003 Brasil incorporó a su Estrategia Nacional ¨Fome Zero¨ el Programa Cisternas, iniciativa que comenzó a nivel local y cuyo objetivo es garantizar el acceso a agua para el consumo humano por medio de la construcción de un millón de cisternas rurales en todo el semiárido brasileño. Las cisternas de captación de agua de lluvia son una tecnología social de bajo coste y alto valor técnico, cultural y ambiental, destinada a garantizar agua de calidad a la población rural de baja renta y a mitigar los efectos que sobre ella tienen las sequias recurrentes y prolongadas que afectan al semiárido. Como parte del Programa Cisternas, la ONG brasileña “Instituto Ambiental Brasil Sustentável” (IABS) está apoyando el proyecto Cisternas Escolares, cuyo objetivo es construir cisternas de 52.000 litros de captación de agua de lluvia en 110 escuelas rurales del semiárido alagoano, y capacitar a las comunidades escolares para su correcta gestión. Este Trabajo Fin de Máster consiste en la evaluación de los efectos que dicho proyecto está teniendo sobre las condiciones de vida de las comunidades escolares rurales beneficiarias, aspirando a aportar información sobre los potenciales beneficios sociales de este tipo de actuaciones y a incrementar dichos beneficios proporcionando recomendaciones prácticas. De esta forma se pretende dar respuesta a la necesidad de conocimiento y mejora de los efectos que los proyectos de cisternas de captación de agua de lluvia tienen sobre sus beneficiarios, pero también a la demanda que está surgiendo desde la agenda del desarrollo, de evaluaciones de impacto más prácticas que sirvan para mejorar los proyectos que evalúan. La metodología propuesta en este trabajo adopta un enfoque mixto orientado a combinar el rigor de los datos cuantitativos, con el análisis de la cadena de efectos del proyecto y las percepciones de los beneficiarios. Dicha metodología consta de cuatro partes diferenciadas: i) la elaboración de la línea de base del proyecto; ii) un análisis causa – efecto cualitativo del proyecto, incluyendo las percepciones de los beneficiarios; iii) una evaluación de impacto que no pudo llevarse a cabo debido a retrasos en la ejecución del proyecto que desplomaron el potencial estadístico; y iv) un estudio de caso múltiple, realizado como alternativa a la evaluación de impacto, orientado a identificar diferencias entre las escuelas que reciben una cisternas y las que no. Los resultados de esta evaluación de efectos muestran que el proyecto Cisternas Escolares tiene potencial para producir mejoras en la salud, el funcionamiento, la autonomía, los usos del agua, la preocupación de las comunidades escolares y los conflictos con los vecinos de las escuelas beneficiarias. Dicho potencial es variable en cada una de las escuelas y depende de múltiples factores, los cuales son identificados y analizados en este trabajo. Fruto de este trabajo son también una serie de recomendaciones orientadas a que el proyecto Cisternas Escolares consiga alcanzar su máximo potencial en todas las escuelas beneficiarias. Estas recomendaciones pretenden mejorar las capacitaciones del proyecto y los consejos gestores del agua de las escuelas, así como incluir nuevas actividades relevantes en el proyecto, como la creación de espacios de participación para los actores y la involucración de las alcaldías y las secretarías de educación.
