In the United States, there has been fierce debate over state, federal and international efforts to engage in genetically modified food labelling (GM food labelling). A grassroots coalition of consumers, environmentalists, organic farmers, and the food movement has pushed for law reform in respect of GM food labelling. The Just Label It campaign has encouraged United States consumers to send comments to the United States Food and Drug Administration to label genetically modified foods. This Chapter explores the various justifications made in respect of genetically modified food labelling. There has been a considerable effort to portray the issue of GM food labelling as one of consumer rights as part of ‘the right to know’. There has been a significant battle amongst farmers over GM food labelling – with organic farmers and biotechnology companies, fighting for precedence. There has also been a significant discussion about the use of GM food labelling as a form of environmental legislation. The prescriptions in GM food labelling regulations may serve to promote eco-labelling, and deter greenwashing. There has been a significant debate over whether GM food labelling may serve to regulate corporations – particularly from the food, agriculture, and biotechnology industries. There are significant issues about the interaction between intellectual property laws – particularly in respect of trade mark law and consumer protection – and regulatory proposals focused upon biotechnology. There has been a lack of international harmonization in respect of GM food labelling. As such, there has been a major use of comparative arguments about regulator models in respect of food labelling. There has also been a discussion about international law, particularly with the emergence of sweeping regional trade proposals, such as the Trans-Pacific Partnership, and the Trans-Atlantic Trade and Investment Partnership. This Chapter considers the United States debates over genetically modified food labelling – at state, federal, and international levels. The battles often involved the use of citizen-initiated referenda. The policy conflicts have been policy-centric disputes – pitting organic farmers, consumers, and environmentalists against the food industry and biotechnology industry. Such battles have raised questions about consumer rights, public health, freedom of speech, and corporate rights. The disputes highlighted larger issues about lobbying, fund-raising, and political influence. The role of money in United States has been a prominent concern of Lawrence Lessig in his recent academic and policy work with the group, Rootstrikers. Part 1 considers the debate in California over Proposition 37. Part 2 explores other key state initiatives in respect of GM food labelling. Part 3 examines the Federal debate in the United States over GM food labelling. In Moral Rights and Their Application in Australia, Maree Sainsbury offers a summary of the new moral rights regime established in Australia in 2000. It is a decent guide and handbook to moral rights for legal practitioners, the authors of copyright work, and the users of copyright material. As the author notes: "The Australian moral rights legislation impacts on the rights and obligations of many people in diverse circumstances, from the creator of a highly unique work of art to the designer of a web site incorporating factual information or graphics which someone else has created. Any person creating or dealing with copyright material should be aware of the moral rights implications. This book provides a detailed analysis of the moral rights legislation, while stressing the fundamental provisions. It also provides some useful practical guidance for those who are affected, both in general terms and with respect to the more specific situations outlined above." Maree Sainsbury provides an enjoyable account of the history and nature of moral rights. She charts the romantic, Continental origins of moral rights, and explains their translation to countries, such as Australia and the United States.

Worldwide, no fewer than 50 million people a year are now fleeing dangerous and often life threatening situations in their countries of origin (UNHCR, 2014c). As one part of this movement, thousands risk journeys through dangerous waters hoping to obtain asylum in Australia. However, Australian Government policies adopted since 2013 aim to ensure that no asylum seeker nor any of the 3,500 detainees held in offshore detention centres will ever be settled on the mainland. To this has now been added a declaration that none of the recent refugees or 6200 asylum seekers waiting in Indonesia in centres run by the United Nations High Commissioner for Refugees (UNHCR) will gain entry (Whyte, 2014a). These immigration policies differ dramatically from those adopted in earlier decades that produced the country’s decidedly multicultural identity. This article reviews these changing perspectives of Australian governments and communities within the context of international obligations and expectations; the experiences of those directly involved in border policing practices and in detention centres; and the attitudes of national media. Relations and conflicts among the interests of the different parties are discussed and the scope for less punitive responses to the plight of asylum seekers is examined. The authors then focus on alternative processes to better address the interests and objectives of legitimately interested parties by processes which successively examine, optimise and reconcile the concerns of each. In so doing, they aim to demonstrate that such methods of sequential problem solving can respond effectively to the multiple concerns of the many significant stakeholders involved in increasingly significant global issues, whereas recourse to such single-goal, top-down programs as are expressed in the government’s current determination to “Stop the boats” at all costs are unlikely to prove sustainable.

[Excerpt] The Convention on the Rights of the Child (CRC) was one of the first international instruments to which the Republic of Uzbekistan acceded, and with parliamentary ratification on 9 December 1992, the Republic of Uzbekistan entered into a commitment to observe all the provisions of the CRC and to shoulder its responsibility before the international community. As a result various legislative, administrative and other steps have been taken by the government of the Republic of Uzbekistan with a view to bringing the State policy and legislation on children to be in line with the provisions as enshrined in the Convention on the Rights of the Child. The Constitution incorporates the fundamental provisions of the Universal Declaration of Human Rights. At the current stage in the restructuring of the country’s social and economic development, solid foundations have been laid for the conduct of significant democratic reforms based on a recognition of the innate worth of the individual (including the child) and of the unconditional respect of his or her rights and freedoms. Until recently, the State acted as the main guarantor of the provision of all social services, however the process of the transition (political/economic) to a market economy has entailed the development of new economic relations with a reduction in the allocation of state resources for the provision of social services to children. The efforts of the government made so far to bring the state policy and legislation on the child to be in line with the provisions enshrined in the convention on the rights of the child are commendable; never the less, the implementations of all these policies and laws into practice needs a lot to desire as there are a number of ongoing child rights violations. The National Report has fundamentally overlooked a number of child rights privileges enshrined in the CRC that have not yet been realised, or those rights that have been eroded since the independence. These shortcomings need to be noted for consideration so that the state steps up its efforts to enact new laws and/or to enforce the existing rules and regulations required for the protection and implementation of these child rights, and to improve the overall situation for children in the Republic of Uzbekistan.

Territoriality is a central issue in indigenous peoples struggles. The territorial struggles involve struggles over the control of natural resources and over political participation and representation, but also over the perception of territorial rights and the symbolic representation of the territory. These struggles are carried through both in material and symbolic ways through recurring to different discourses and representations that provide legitimation for the territorial claims of the group. The study is located in the Northern Autonomous Atlantic Region of Nicaragua. The study concerns the territorial strategies, conceptions and practices of the indigenous people and other actors. Territorial conflicts exist between the autonomous region and the central government of Nicaragua, between mestizo settlers and indigenous people, between different indigenous groups, and between these and development agents such as conservation projects. The study focuses on how territorial discourses and representations are used to legitimate territorial control. Environmental, historical and cartographical discourses are the most important discourses recurred to. The influence of discourses and representations on the territorial practices and policies of the different actors, the links between the local struggles and global processes, and the broader structural factors impacting on the territorial struggles are also analysed. Among the structural factors are the problems related to land tenure and management and the use of natural resources, the advance of the agricultural frontier, the institutional weaknesses of the central and regional governments and the legislative processes. The territorial discourses are both recurred to in a strategic way and also grounded in local ideals and practices. The discourses have produced real effects for example in legislation, land tenure systems, political representation and environmental practices. Although the use of discourses and representations are an important power tool in territorial struggles, territorial control cannot be effectively accomplished merely through representing territorial claims in a legitimate way or through reforming legislation, as the conflicts are also largely a result of structural factors affecting the region. The fieldwork was carried out during a total of twelve months between 2000 and 2002. The research methods used were semi-structured interviews, participant observation and participatory research methods. A broad range of literary sources were also used to collect data. The study is located within the field of critical political geography with a discursive political ecology approach. It can be called a critical realist approach to the discursive analysis of indigenous territoriality.

As an election looms in Australia, the tax debate continues unabated. Self-interest abounds. When we remove self-interest, we are often reduced to standard design principles for a taxation system. Lost in this discussion is the fundamental purpose of tax, which is to finance government expenditure. Most would argue that tax revenue should be sufficient to meet basic economic and social needs of the community. But how does a community determine what these basic economic and social needs should be? One way is by using a human rights framework. This can provide guidance for both developing and developed countries considering tax reform.

The purpose of this paper is to present exergy charts for carbon dioxide (CO2) based on the new fundamental equation of state and the results of a thermodynamic analysis of conventional and trans-critical vapour compression refrigeration cycles using the data thereof. The calculation scheme is anchored on the Mathematica platform. There exist upper and lower bounds for the high cycle pressure for a given set of evaporating and pre-throttling temperatures. The maximum possible exergetic efficiency for each case was determined. Empirical correlations for exergetic efficiency and COP, valid in the range of temperatures studied here, are obtained. Let F and G be two bounded operators on two Hilbert spaces. Let their numerical radii be no greater than one. This note investigates when there is a Gamma-contraction (S, P) such that F is the fundamental operator of (S, P) and G is the fundamental operator of (S*, P*). Theorem 1 puts a necessary condition on F and G for them to be the fundamental operators of (S, P) and (S*, P*) respectively. Theorem 2 shows that this necessary condition is also sufficient provided we restrict our attention to a certain special case. The general case is investigated in Theorem 3. Some of the results obtained for Gamma-contractions are then applied to tetrablock contractions to figure out when two pairs (F1, F2) and (G(1), G(2)) acting on two Hilbert spaces can be fundamental operators of a tetrablock contraction (A, B, P) and its adjoint (A*, B*, P*) respectively. O conceito atual de um comportamento socialmente habilidoso deve incluir capacidade de o indivíduo obter satisfação pessoal e, ao mesmo tempo, de desenvolver e manter relacionamentos mutuamente benéficos e sustentadores. No âmbito da educação, identifica-se uma crescente preocupação de pais, diretores de escolas e professores com o desenvolvimento interpessoal dos alunos, com o propósito de reduzir conflitos, aumentar a qualidade das relações entre os alunos e facilitar a aprendizagem. Neste sentido, é necessário que o professor se dedique a desenvolver as próprias habilidades interpessoais para que seja capaz de facilitar o desenvolvimento social e intelectual do aluno. Diante dessas constatações, torna-se relevante identificar que habilidades sociais do professor estão mais relacionadas com o seu desempenho social em sala de aula. Tais constatações fundamentaram esse estudo que avaliou os níveis de habilidades sociais de professores, assim como o desempenho social destes em sala de aula. Participaram da pesquisa oito professoras e dois professores do Ensino Fundamental II (do 6 ao 9 Ano), do Instituto Nossa Senhora Auxiliadora, no Rio de Janeiro. Suas idades variavam entre 24 e 50 anos. Participaram também 198 adolescentes, 100 do sexo masculino e 98 do sexo feminino. Suas idades variavam entre 11 e 15 anos. O desempenho social dos professores em sala de aula foi avaliado pelos próprios professores e pelos alunos, através do Questionário do Desempenho Social do Professor (QDSP). Os professores também responderam ao Inventário de Habilidades Sociais (IHS) e ao Inventário de Empatia (IE). Os resultados das medidas de auto-relato apontaram níveis de assertividade e de empatia acima da média na maioria dos professores dessa amostra, especialmente nos fatores relacionados a: auto-afirmação com risco; conversação e desenvoltura social; auto-exposição a desconhecidos e a situações novas; autocontrole da agressividade; tomada de perspectiva; flexibilidade; altruísmo e sensibilidade afetiva. As medidas de desempenho social dos professores foram satisfatórias, tanto a partir da perspectiva do professor quanto dos alunos. Entretanto, a auto-avaliação dos professores mostraram-se mais favoráveis do que a avaliação feita pelos alunos. Além disso, com base na avaliação dos alunos, apenas quatro professores apresentaram desempenho social assertivo e empático de forma equilibrada. Tais resultados indicam a necessidade de se desenvolver programas de treinamento em habilidades sociais educativas.

Os discursos políticos educacionais acerca da institucionalização da instrução elementar em Minas Gerais atravessaram todo o século XIX, apontando também como uma preocupação republicana, ora pelo discurso de impraticabilidade e ferimento aos direitos civis, ora pela defesa de seu caráter estatal e da argumentação de função civilizatória e disciplinar da população. Nesse sentido, pensar a compulsoriedade do ensino demanda uma compreensão da sua função social, o conhecimento dos agentes envolvidos e de seus interesses sobre tal medida de governo. De acordo com os defensores da obrigatoriedade do ensino no século XIX e início do XX, o intuito da educação seria formar cidadãos civilizados e instruídos. Tal perspectiva estava relacionada a um projeto de sociedade e de nação brasileira, para o qual era imprescindível formar, desde a infância, um povo disciplinado, um povo bem governado. O nosso objetivo foi analisar o tema da obrigatoriedade do ensino a partir do conceito foucaultiano de governamentalidade. Problematizando a ideia de que universalizar o acesso à educação representava apenas uma iniciativa de garantia de direitos, a hipótese que defendemos consiste na ideia de que o ensino obrigatório pode ter sido perspectivado enquanto uma estratégia de governo dos outros, de controle dos sujeitos. Partindo desse pressuposto, como efeito esperado, seria possível obter sujeito com outras atitudes, as atitudes derivadas da coação promovida pela escola. Ao legitimar a escola, o dispositivo da obrigatoriedade funcionaria como estratégia e produziria positividades. Por meio da escola e de seu caráter compulsório, tratava-se de atingir e gerir a população dos pequenos, de modo a equipá-la com os códigos mínimos do mundo civilizado, com os efeitos disciplinares correlatos.Para tanto, analisamos a legislação de Minas Gerais, impressos mineiros (Correio de Minas, Jornal do Commercio, Minas Livre, O Granbery) e a bibliografia acerca da obrigatoriedade da instrução primária, a fim de identificar traços do debate no Império e na passagem para a República, os quais foram problematizados à luz daquele conceito. A partir dessa discussão, concluímos que a obrigatoriedade do ensino é mais bem compreendida se analisada em outro registro que não seja meramente jurídico. Tal inferência aponta para a ampliação do quadro analítico acerca dessa política compulsória e dos interesses de Estado em torno dela.

Em 1988, a Assembleia Constituinte, no rastro do processo de redemocratização do país, finalmente apontava para a transformação das políticas sociais no Brasil, cujo resultado foi lavrado na Carta Magna. A partir desse momento, os brasileiros obtiveram o direito de cidadania como estatuto fundamental de nacionalidade, e o direito à saúde como princípio de cidadania. Neste sentido, o setor saúde foi pioneiro nas práticas das políticas sociais no Brasil. A adoção de seus princípios doutrinários e operacionais por lei destacando-se aqui a integralidade significou a afirmação do direito à saúde como caminho de supressão da estrutura fragmentada de organização dos serviços de saúde no Brasil. Integralidade emerge como eixo de organização da defesa do direito à saúde, a partir das propostas de mudanças das práticas no cotidiano dos serviços. O objetivo deste estudo foi analisar as relações existentes entre os usuários do Sistema Único de Saúde (SUS), a partir dos Conselhos de Saúde, e o Ministério Público (MP) desenvolvida no município de Porto Alegre, no estado do Rio Grande do Sul, no que concerne à utilização de dispositivos institucionais e jurídico legais no cumprimento do direito à saúde. O foco deste estudo esteve voltado para a experiência desenvolvida entre os anos de 2000 e 2004, no município de Porto Alegre. Historicamente, os Conselhos de Saúde naquele estado têm desempenhado papel de destaque na formulação e acompanhamento das políticas públicas de saúde. O avanço desses conselhos permitiu-lhes desenvolver novas estratégias na luta pela garantia do direito à saúde, e o MP vem sendo importante parceiro nessa disputa. Nesse cenário, pudemos observar a utilização, cada vez mais freqüente, do princípio da integralidade como recurso legal na discussão encaminhada pelos usuários junto ao MP, no intuito de garantir o direito à saúde. O princípio da integralidade tem sido utilizado como proposta de transformação da própria lógica da gestão de oferta de serviços. O MP tem propiciado uma interlocução cada vez maior entre a gestão dos serviços e os conselhos de saúde, a fim de encontrar melhores saídas para os principais problemas de saúde do município. Esse espaço de diálogo criado pelo MP constitui avanço substancial na compreensão das formas de solução de conflitos, fundando um novo campo de práticas de aprimoramento do Estado democrático. A atuação conjunta do MP com os Conselhos de Saúde tem levado a instituir novas formas e mecanismos de negociação e pactuação entre as diferentes esferas dos poderes públicos e sua relação com a sociedade, no que diz respeito à institucionalização de uma gramática civil de direito à saúde.

O presente trabalho tem por objetivo estudar as principais questões relacionadas à efetivação pelo Poder Judiciário do direito social a saúde. Serão analisados na primeira parte do trabalho os direitos sociais fundamentais e o mínimo existencial, no qual se inclui o direito à saúde, abordando-se a importância dada pela Constituição Federal a tal direito e sua regulamentação infraconstitucional, com destaque para a organização do Estado e as fontes de recursos. Após se demonstrar a importância do direito à saúde como direito social fundamental, será estudada na segunda parte do trabalho a escassez de recursos para o atendimento de todas as necessidades da população, abordando-se o conceito de reserva do possível e a relevância das leis orçamentárias para o alcance as prioridades sociais. Por fim, será demonstrada a legitimidade e necessidade de ingerência do Poder Judiciário na concretização do direito à saúde, destacando-se as posições doutrinárias e decisões judiciais que buscam alcançar o equilíbrio entre o atendimento de tal direito fundamental, o reconhecimento da limitação de recursos e a valorização do orçamento público.

An atrium is a central feature of many modern naturally ventilated building designs. The atrium fills with warm air from the adjoining storeys: this air may be further warmed by direct solar heating in the atrium, and the deep warm layer enhances the flow. In this paper we focus on the degree of flow enhancement achieved by an atrium which is itself 'ventilated' directly, by a low-level connection to the exterior. A theoretical model is developed to predict the steady stack-driven displacement flow and thermal stratification in the building, due to heat gains in the storey and solar gains in the atrium, and compared with the results of laboratory experiments. Direct ventilation of the atrium is detrimental to the ventilation of the storey and the best design is identified as a compromise that provides adequate ventilation of both spaces. We identify extremes of design for which an atrium provides no significant enhancement of the flow, and show that an atrium only enhances the flow in the storey if its upper opening is of an intermediate size, and its lower opening is sufficiently small. © 2003 Elsevier Science Ltd. The problem of refugees is a phenomenon characteristic of contemporary international relations. It can take an individual form (as a result of individual persecutions of a racial, religious, national or political character) or the form of mass relocations, especially in the face of military conflicts or general breaching of human rights. The purpose of this paper is to present the refugee question as an international global problem that may appear in any region of the world, impacting the situation of states and societies, that is perceived as both a threat and a fundamental challenge for the entire international community.

The central research question that this thesis addresses is whether there is a significant gap between fishery stakeholder values and the principles and policy goals implicit in an Ecosystem Approach to Fisheries Management (EAFM). The implications of such a gap for fisheries governance are explored. Furthermore an assessment is made of what may be practically achievable in the implementation of an EAFM in fisheries in general and in a case study fishery in particular. The research was mainly focused on a particular case study, the Celtic Sea Herring fishery and its management committee, the Celtic Sea Herring Management Advisory Committee (CSHMAC). The Celtic Sea Herring fishery exhibits many aspects of an EAFM and the fish stock has successfully recovered to healthy levels in the past 5 years. However there are increasing levels of governance related conflict within the fishery which threaten the future sustainability of the stock. Previous research on EAFM governance has tended to focus either on higher levels of EAFM governance or on individual behaviour but very little research has attempted to link the two spheres or explore the relationship between them. Two main themes within this study aimed to address this gap. The first was what role governance could play in facilitating EAFM implementation. The second theme concerned the degree of convergence between high-level EAFM goals and stakeholder values. The first method applied was governance benchmarking to analyse systemic risks to EAFM implementation. This found that there are no real EU or national level policies which provide stakeholders or managers with clear targets for EAFM implementation. The second method applied was the use of cognitive mapping to explore stakeholders understandings of the main ecological, economic and institutional driving forces in the Celtic Sea Herring fishery. The main finding from this was that a long-term outlook can and has been incentivised through a combination of policy drivers and participatory management. However the fundamental principle of EAFM, accounting for ecosystem linkages rather than target stocks was not reflected in stakeholders cognitive maps. This was confirmed in a prioritisation of stakeholders management priorities using Analytic Hierarchy Process which found that the overriding concern is for protection of target stock status but that wider ecosystem health was not a priority for most management participants. The conclusion reached is that moving to sustainable fisheries may be a more complex process than envisioned in much of the literature and may consist of two phases. The first phase is a transition to a long-term but still target stock focused approach. This achievable transition is mainly a strategic change, which can be incentivised by policies and supported by stakeholders. In the Celtic Sea Herring fishery, and an increasing number of global and European fisheries, such transitions have contributed to successful stock recoveries. The second phase however, implementation of an ecosystem approach, may present a greater challenge in terms of governability, as this research highlights some fundamental conflicts between stakeholder perceptions and values and those inherent in an EAFM. This phase may involve the setting aside of fish for non-valued ecosystem elements and will require either a pronounced mind-set and value change or some strong top-down policy incentives in order to succeed. Fisheries governance frameworks will need to carefully explore the most effective balance between such endogenous and exogenous solutions. This finding of low prioritisation of wider ecosystem elements has implications for rights based management within an ecosystem approach, regardless of whether those rights are individual or collective.
