"La liberté de religion, souvent reconnue comme étant la « première liberté » dans de nombreuses traditions juridiques, reflète également les différentes conceptions de la place de l'individu et de la communauté dans la société. Cet article examinera la liberté de religion dans le contexte constitutionnel canadien. Nous avons choisi d'étudier la liberté de religion dans trois vagues successives : avant l'entrée en vigueur de la Déclaration canadienne des droits, sous la Déclaration canadienne des droits; et enfin, après l'entrée en vigueur de la Charte canadienne des droits et libertés. De plus, l'accommodement ainsi que de la proportionnalité de la liberté de religion d'un individu sera également traité. Ainsi que nous le démontrerons, la liberté de religion a engendré un repositionnement de l'individu face aux intérêts de la communauté ainsi qu'une réinterprétation des justifications menant à la sauvegarde de ces croyances."

À une époque où l'immigration internationale est de plus en plus difficile et sélective, le statut de réfugié constitue un bien public précieux qui permet à certains non-citoyens l'accès et l'appartenance au pays hôte. Reposant sur le jugement discrétionnaire du décideur, le statut de réfugié n’est accordé qu’aux demandeurs qui établissent une crainte bien fondée de persécution en cas de retour dans leur pays d'origine. Au Canada, le plus important tribunal administratif indépendant, la Commission de l'immigration et du statut de réfugié du Canada (CISR), est chargé d’entendre les demandeurs d'asile et de rendre des décisions de statut de réfugié. Cette thèse cherche à comprendre les disparités dans le taux d’octroi du statut de réfugié entre les décideurs de la CISR qui sont politiquement nommés. Au regard du manque de recherches empiriques sur la manière avec laquelle le Canada alloue les possibilités d’entrée et le statut juridique pour les non-citoyens, il était nécessaire de lever le voile sur le fonctionnement de l’administration sur cette question. En explorant la prise de décision relative aux réfugiés à partir d'une perspective de Street Level Bureaucracy Theory (SLBT) et une méthodologie ethnographique qui combine l'observation directe, les entretiens semi-structurés et l'analyse de documents, l'étude a d'abord cherché à comprendre si la variation dans le taux d’octroi du statut était le résultat de différences dans les pratiques et le raisonnement discrétionnaires du décideur et ensuite à retracer les facteurs organisationnels qui alimentent les différences. Dans la lignée des travaux de SLBT qui documentent la façon dont la situation de travail structure la discrétion et l’importance des perceptions individuelles dans la prise de décision, cette étude met en exergue les différences de fond parmi les décideurs concernant les routines de travail, la conception des demandeurs d’asile, et la meilleure façon de mener leur travail. L’analyse montre comment les décideurs appliquent différentes approches lors des audiences, allant de l’interrogatoire rigide à l’entrevue plus flexible. En dépit des contraintes organisationnelles qui pèsent sur les décideurs pour accroître la cohérence et l’efficacité, l’importance de l’évaluation de la crédibilité ainsi que l’invisibilité de l’espace de décision laissent suffisamment de marge pour l’exercice d’un pouvoir discrétionnaire. Même dans les environnements comme les tribunaux administratifs où la surabondance des règles limite fortement la discrétion, la prise de décision est loin d’être synonyme d’adhésion aux principes de neutralité et hiérarchie. La discrétion est plutôt imbriquée dans le contexte de routines d'interaction, de la situation de travail, de l’adhésion aux règles et du droit. Même dans les organisations qui institutionnalisent et uniformisent la formation et communiquent de façon claire leurs demandes aux décideurs, le caractère discrétionnaire de la décision est par la nature difficile, voire impossible, à contrôler et discipliner. Lorsqu'ils sont confrontés à l'ambiguïté des objectifs et aux exigences qui s’opposent à leur pouvoir discrétionnaire, les décideurs réinterprètent la définition de leur travail et banalisent leurs pratiques. Ils formulent une routine de rencontre qui est acceptable sur le plan organisationnel pour évaluer les demandeurs face à eux. Cette thèse montre comment les demandeurs, leurs témoignages et leurs preuves sont traités d’une manière inégale et comment ces traitements se répercutent sur la décision des réfugiés.

In this article, we consider the changing relationships between French ‘have-not’ movements (the unemployed, the homeless, undocumented persons) and the main organizations involved in the alter-globalization field from 1995 to 2005. We demonstrate how the building of the global space of protest in France was punctuated by two moments. The first corresponds to the gradual convergence of social actors around the issue of globalization, translated into a renewal of activists’ discourses, the development of multiple scales of mobilizations and a functional division of tasks among actors. The second moment corresponds more to the crystallization of divisions among them. These divisions are articulated around different conceptions of what the struggle's aims should be (a fight against liberalism or an alternative experiment) and differences regarding the sense of belonging to the global space of protest (transnational networks or national territory). The history of convergence placed the have-nots at the heart of alter-globalist mobilizations, whereas the history of divergence translated into a ‘decentering’ of the place of the have-nots within this space. Their progressive marginalization also reveals the transformations of struggles against globalization in France.
L’enseignement de la distinction entre le passé composé et l’imparfait en français langue seconde

La présente recherche vise à décrire et comprendre l’enseignement de la distinction entre le passé composé et l’imparfait à partir des connaissances et conceptions des enseignants ainsi qu’à partir de leur matériel didactique. La distinction aspectuelle, plus précisément celle qui concerne le perfectif et l’imperfectif, est une difficulté qui concerne plusieurs langues. La recherche antérieure s’est beaucoup intéressée à cette question, permettant de comprendre les raisons de cette difficulté qui se fonde sur l’hypothèse de l’aspect. À partir de cette hypothèse, les difficultés concernant la distinction entre le passé composé et l’imparfait s’éclaircissent, permettant d’ajuster les explications et la transposition didactique. Or, la recherche antérieure considère que les manuels didactiques fournissent aux apprenants et aux enseignants des explications qui ne permettent pas une réelle compréhension de la distinction entre le passé composé et l’imparfait. La présente recherche cherche à vérifier ces hypothèses. À partir d’entrevues réalisées auprès de neuf enseignants de français langue seconde, les résultats montrent qu’effectivement, les enseignants s’inspirent des manuels didactiques pour expliquer et transposer la distinction entre le passé composé et l’imparfait. De plus, à partir du matériel didactique fourni par les mêmes enseignants, les résultats montrent que malgré une connaissance de la difficulté d’emploi du passé composé et de l’imparfait, les exercices ne sont pas adaptés aux difficultés des étudiants. Enfin, la présente recherche démontre la prédominance de l’intrant typique par rapport à l’intrant atypique.

This thesis Entitled Internet Utilization and Academic Activities of Faculty Members in the Universities of kerala: an analytical study. Today, scientific research is throwing up new discoveries, inventions and vistas by the hour. We are witnessing a veritable knowledge explosion. It is important for members of university faculty members to keep abreast of it for giving up-t-date information to their students about the new development in the subject of their study. The internet is an invaluable tool for achieving it. Most of the universities have sufficient internet facility, but the accessibility to all the faculty members is not adequate. University Libraries also provides standard supplementary service in the internet area. This study indicates differential level of awareness and utilization of the internet services by the faculty members in the areas of teaching, research and publication. However the overall impression is that the awareness and utilization is inadequate. This point to the urgent need to devise programs and schemes to promote internet utilization among the faculty members. The suggestions indicate the key areas that deserve attention by policy makers and administrators. Thanks to the internet, every new development in every field of study is just a click away for faculty members, research scholars and students.

Stories of peoples’ struggles across the globe are testaments to their determination to resist exploitation and injustice, and to imagine and construct their own narratives of economic and political difference. These stories of emancipatory moments demonstrate that something radically different in terms of dominant socio-economic relations and mental conceptions of the world may arise out of and beyond capitalism. The Pursuit of Alternatives: Stories of Peoples’ Economic and Political Struggles Around the World presents a fresh and new perspective on how the ‘process of becoming’ alternatives might take place based on peoples’ lived experiences. The chapters here, by labour activists and academics, explore how various forms of peoples’ economic and political initiatives and struggles in six countries – Brazil, Canada, Colombia, Nigeria, the Philippines, and South Korea – might become ‘actually existing’ spaces and moments for the development of critical consciousness and transformative capacities which are both central in challenging the dominant social, economic and political relations. The stories in this book bring to light today’s language of peoples’ struggles; what inspires people to create their own emancipatory moments and spaces for transformative self-change. While this book does not aim to propose an alternative to capitalism per se, it makes a stimulating contribution to the continuing debate on what alternatives to capitalist relations and arrangements might look like by grounding these alternatives in the everyday lives and struggles of workers, women, aboriginal peoples, the unemployed, and the poor.

A review article of the The New England Journal of Medicine refers that almost a century ago, Abraham Flexner, a research scholar at the Carnegie Foundation for the Advancement of Teaching, undertook an assessment of medical education in 155 medical schools in operation in the United States and Canada. Flexner’s report emphasized the nonscientific approach of American medical schools to preparation for the profession, which contrasted with the university-based system of medical education in Germany. At the core of Flexner’s view was the notion that formal analytic reasoning, the kind of thinking integral to the natural sciences, should hold pride of place in the intellectual training of physicians. This idea was pioneered at Harvard University, the University of Michigan, and the University of Pennsylvania in the 1880s, but was most fully expressed in the educational program at Johns Hopkins University, which Flexner regarded as the ideal for medical education. This article offers a theoretical interpretation of the dispositions on land restitution contained in the famous “Victims’ Bill”, which was debated in the Colombian Congress during the year 2008. The bill included specific mechanisms aimed at guaranteeing the restitution of land to victims of the Colombian armed conflict. At the time, the bill was endorsed by all the main political actors in the country –notably the government and the elites that support it, on the one hand, and victims’ and human rights organizations and other opposition groups, on the other–. The fact that the restitution of land to victims of the Colombian armed conflict was being considered as a serious possibility by all political actors in the country seemed to indicate the existence of a consensus among actors whose positions are ordinarily opposed, on an issue that has traditionally led to high levels of polarization. This consensus is quite puzzling, because it seems to be at odds with the interests and/or the conceptions of justice advocated by these political actors, and because the restitution of land faces enormous difficulties both from a factual and a normative point of view, which indicates that it may not necessarily be the best alternative for dealing with the issue of land distribution in Colombia. This article offers an interpretation of said consensus, arguing that it is only an apparent consensus in which the actors are actually misrepresenting their interests and conceptions of justice, while at the same time adopting divergent strategies of implementation aimed at fulfilling their true interests. Nevertheless, the article concludes that the common adherence by all actors to the principle of restorative justice might bring about its actual realization, and thus produce an outcome that, in spite (and perhaps even because) of being unintended, might substantively contribute to solving the problem of unequal land distribution in Colombia. Even though the article focuses in some detail on the specificities of the 2008 Bill, it attempts to make a general argument about the state of the discussion on how to deal with the issue of land distribution in the country. Consequently, it may still be relevant today, especially considering that a new Bill on land restitution is currently being discussed in Congress, which includes the same restitution goals as the Victims’ Bill and many of its procedural and substantive details, and which therefore seems to reflect a similar consensus to the one analyzed in the article.

This article focuses on innate concepts: their definition, according to the linguistic work of Noam Chomsky, and the outline of a method for their study. As an introduction to the subject some academic conceptions of the concept acquisition are pointed out, and it is claimed that there is a lack of an empirical method for the study of innate concepts. Next, the article presents the definition that Chomsky has defended over time about such concepts. Finally, in a theoretical way, it presents the conditions for an empirical procedure for the study of innate concepts, called semantic analysis of corpus

Since 2003 the School of Medicine at the Universidad del Rosario in Bogotá, Colombia, offers to the students a program named Peer Tutors. The program’s objectives are: to generate a social interaction mechanism that favors knowledge construction side by side with advanced peers; to promote the development of ethical, moral and coexistence oriented values through an academic experience, and to generate a space to explore specific academic interests and teacher´s potential. This article presents the theoretic frame that supports the importance of social interaction in knowledge construction, as well as some indicators that allow a first appraisal of the program. Several achievements that account for the synergic value of an experience that not only fulfills the function of initiating a process of teaching formation and academic support, but that also builds a proactive attitude before learning, are highlighted.

The article shows the classroom like an workplace to move moral development, from the relationship between students and professors in the university atmosphere. It proposes elements to take to the practice the ethics education a transverse curriculum line. It assumes the ethics, from a plural perspective, founded on the knowledge and the human action. It joins the integral formation with the conceptions of education, curriculum, pedagogical models and methodologies of education. It proposes actions to demonstrate the commitment of the professor with the integral formation. Finally, concludes that the professor is agent of moral development and that in the classroom is constructed: identity, autonomy and responsibility, from open and plural relation between professors and students and between these and the knowledge.

El trasplante de órganos y/o tejidos es considerado como una opción terapéutica viable para el tratamiento tanto de enfermedades crónicas o en estadios terminales, como de afectaciones no vitales, pero que generen una disminución en la calidad de vida percibida por el paciente. Este procedimiento, de carácter multidimensional, está compuesto por 3 actores principales: el donante, el órgano/tejido, y el receptor. Si bien un porcentaje significativo de investigaciones y planes de intervención han girado en torno a la dimensión biológica del trasplante, y a la promoción de la donación; el interés por la experiencia psicosocial y la calidad de vida de los receptores en este proceso ha aumentado durante la última década. En relación con esto, la presente monografía se plantea como objetivo general la exploración de la experiencia y los significados construidos por los pacientes trasplantados, a través de una revisión sistemática de la literatura sobre esta temática. Para ello, se plantearon unos objetivos específicos derivados del general, se seleccionaron términos o palabras claves por cada uno de estos, y se realizó una búsqueda en 5 bases de datos para revistas indexadas: Ebsco Host (Academic Search; y Psychology and Behavioral Sciences Collection); Proquest; Pubmed; y Science Direct. A partir de los resultados, se establece que si bien la vivencia de los receptores ha comenzado a ser investigada, aún es necesaria una mayor exploración sobre la experiencia de estos pacientes; exploración que carecería de objetivo si no se hiciera a través de las narrativas o testimonios de los mismos receptores

RESUMO: Nesta dissertação apresenta-se um estudo de caso integrado que tem por objetivo analisar como a temática ambiental é desenvolvida nas séries finais do Ensino Fundamental II nas escolas públicas do Município de Itambé- Bahia. Esta investigação discorre a relação do homem - natureza, concepções de meio ambiente e sustentabilidade; retrata a educação ambiental no Ensino Fundamental e suas tendências pedagógicas. Este trabalho foi realizado no período de agosto a dezembro de 2010 em duas escolas localizadas na zona urbana do município de Itambé-BA. Os dados foram obtidos através de questionários aplicados a 180 alunos do 8º e 9º ano; entrevistas semiestruturadas com 20 professores, análise do Projeto Político Pedagógico e observação direta. Os resultados apontaram que há uma prática da Educação Ambiental voltada ao preservacionismo; a maioria dos educadores realiza a sua prática docente de forma individual, o que dificulta o desenvolvimento da EA. Inferimos que os professores necessitam de formação em educação ambiental, pautadas em uma visão crítica, percebendo o meio ambiente dentro de todas as suas dimensões e complexidades e que a Secretaria Municipal de Educação fortaleça o desenvolvimento dessa temática, a fim de executar ações voltadas ao cuidado com a natureza e a vida humana. ABSTRACT: This dissertation presents an integrated case study that aims to analyze how the environmental theme is developed in the final grades of primary education in public schools II of Itambé-Bahia. This research discusses the relationship of man - nature, conceptions of environment and sustainability; portrays environmental education in elementary education and its pedagogical trends. This work was carried out from August to December 2010 in two schools located in the urban area of Itambé-BA. Data were obtained through questionnaires given to 180 students of 8th and 9th grade, semi-structured interviews with 20 teachers, analysis of the Political Pedagogical Project and direct observation. The results showed that there is a practice of environmental education to conservatism, most educators place their teaching practice individually, which hinders the development of EA. We infer that teachers need training in environmental education, rooted in a critical view, seeing the environment in all its dimensions and complexities and that the City Department of Education strengthen the development of this theme in order to perform actions directed care with nature and human life.
