Since their introduction in 2005, thousands of same-sex couples in the UK have had a civil partnership. However, many other couples have chosen not to have one. This qualitative study explores why some same-sex couples are choosing not to have a civil partnership. Seven semi-structured interviews were conducted with 12 people (five couples and two individuals) who identified as lesbian, gay or bisexual, and analysed using discourse analysis. Participants' accounts were characterised by ambivalence about civil partnership, and three main paradoxes were identified: the 'good but not good enough' paradox, the 'unwanted prize' paradox and the 'legal rights v. social oppression paradox. A major source of ambivalence was support for rights but resistance to assimilation into dominant heteronormative cultural frameworks. Participants negotiated this ambivalence in a variety of ways, including considering how to have a civil partnership that is different from 'marriage', and adopting a pragmatic position. The analysis highlights the importance of social recognition and support for a range of relationship forms and identities, as well as for an ongoing critical debate about civil partnerships and same-sex marriage. © The Author(s) 2011.

Accession to the EU has had ambiguous effects on civil society organizations (CSOs) in the East Central European countries. A general observation is that accession has not led to the systematic empowerment of CSOs in terms of growing influence on national policy making. This article investigates the determinants of successful CSO advocacy by looking at international development and humanitarian NGOs (NGDOs) in the Czech Republic and Hungary. Reforms in the past decade in the Czech Republic have created an international development policy largely in line with NGDO interests, while Hungary’s ministry of foreign affairs seems to have been unresponsive to reform demands from civil society. The article argues that there is clear evidence of NGDO influence in the Czech Republic on international development policy, which is because of the fact that Czech NGDOs have been able solve problems of collective actions, while the Hungarian NGDO sector remains fragmented. They also have relatively stronger capacities, can rely on greater public support and can thus present more legitimate demands towards their government.

The current research sought to clarify the diverging relationships between counterfactual thinking and hindsight bias observed in the literature thus far. In a non-legal context, Roese and Olson (1996) found a positive relationship between counterfactuals and hindsight bias, such that counterfactual mutations that undid the outcome also increased participants’ ratings of the outcome’s a priori likelihood. Further, they determined that this relationship is mediated by causal attributions about the counterfactually mutated antecedent event. Conversely, in the context of a civil lawsuit, Robbennolt and Sobus (1997) found that the relationship between counterfactual thinking and hindsight bias is negative. The current research sought to resolve the conflicting findings in the literature within a legal context. ^ In Experiment One, the manipulation of the normality of the defendant’s target behavior, designed to manipulate participants’ counterfactual thoughts about said behavior, did moderate the hindsight effect of outcome knowledge on mock jurors’ judgments of the foreseeability of that outcome as well as their negligence verdicts. Although I predicted that counterfactual thinking would increase, or exacerbate, the hindsight bias, as found by Roese and Olson (1996), my results provided some support for Robbenolt and Sobus’s (1997) finding that counterfactual thinking decreases the hindsight bias. Behavior normality did not moderate the hindsight effect of outcome knowledge in Experiment Two, nor did causal proximity in Experiment Three. ^ Additionally, my hypothesis that self-referencing may be an effective hindsight debiasing technique received little support across the three experiments. Although both the self-referencing instructions and self-report measure consistently decreased mock jurors’ likelihood of finding the defendant negligent, and self-referencing instructions decreased their foreseeability ratings in studies two and three, the self-referencing manipulation did not interact with outcome knowledge to moderate a hindsight bias effect on either foreseeability or negligence judgments. The consistent pattern of results across the three experiments, however, suggests that self-referencing may be an effective technique in reducing the likelihood of negligence verdicts.^

The use of structural health monitoring of civil structures is ever expanding and by assessing the dynamical condition of structures, informed maintenance management can be conducted at both individual and network levels. With the continued growth of information age technology, the potential arises for smart monitoring systems to be integrated with civil infrastructure to provide efficient information on the condition of a structure. The focus of this thesis is the integration of smart technology with civil infrastructure for the purposes of structural health monitoring. The technology considered in this regard are devices based on energy harvesting materials. While there has been considerable focus on the development and optimisation of such devices using steady state loading conditions, their applications for civil infrastructure are less known. Although research is still in initial stages, studies into the uses associated with such applications are very promising. Through the use of the dynamical response of structures to a variety of loading conditions, the energy harvesting outputs from such devices is established and the potential power output determined. Through a power variance output approach, damage detection of deteriorating structures using the energy harvesting devices is investigated. Further applications of the integration of energy harvesting devices with civil infrastructure investigated by this research includes the use of the power output as a indicator for control. Four approaches are undertaken to determine the potential applications arising from integrating smart technology with civil infrastructure, namely • Theoretical analysis to determine the applications of energy harvesting devices for vibration based health monitoring of civil infrastructure. • Laboratory experimentation to verify the performance of different energy harvesting configurations for civil infrastructure applications. • Scaled model testing as a method to experimentally validate the integration of the energy harvesting devices with civil infrastructure. • Full scale deployment of energy harvesting device with a bridge structure. These four approaches validate the application of energy harvesting technology with civil infrastructure from a theoretical, experimental and practical perspective.

The present work aims to develop the theme "The summary procedure and the reform of 2013". The purpose of its analysis serves the interest to understand the virtues and disadvantages of the changes introduced by Act n.º 20/2013 to our Code of Criminal Procedure, and the main focus of the present reflection is to further the impact of the measures taken by the legislator to the summary proceedings. The opening of the most serious crimes to summary procedure is a reform measure duly highlighted because it is a true innovation in the Portuguese penal system. Therefore, it urges to analyse not only the consequences of this measure, as well as if the objectives of its introduction in the summary procedure system are met. It should be noted that the legislator intends to promote speedy trial, and at the same time, ensure compliance with the Constitutional rights associated to the accused. At this point it is important to realize if there is a restriction of the accused essential guarantees. On the other hand, it should be noted that the typical characteristics of summary proceedings might have been invariably modified, due to the innovative aspect of the reform. That said, the changes might have fostered a mischaracterization of the typical format of the summary procedure, both in terms of the nature of the proceedings and in terms of its space and objectives within the penal system. Reflecting on the above will provide a deeper understanding of the volatile balance between the Portuguese governing prosecution efficiency and the Constitution, as well as the future of the criminal policy in Portugal.

Human rights are the basic rights of every individual against the state or any other public authority as a member of the human family irrespective of any other consideration. Thus every individual of the society has the inherent right to be treated with dignity in all situations including arrest and keeping in custody by the police. Rights of an individual in police custody are protected basically by the Indian Constitution and by various other laws like Code of Criminal Procedure, Evidence Act, Indian Penal Code and Protection of Human Rights Act. The term `custody' is defined neither in procedural nor in substantive laws. The word custody means protective care. The expression `police custody' as used in sec. 27 of Evidence Act does not necessarily mean formal arrest. In India with special reference to Kerala and evolution and development of the concept of human rights and various kinds of human rights violations in police custody in different stages of history. Human rights activists and various voluntary organisations reveals that there are so many factors contributing towards the causes of violations of human rights by police. Sociological causes like ambivalent outlook of the society with respect to the use of third degree methods by the police, economic causes like meager salary and inadequate living conditions, rampant corruption in police service, unnecessary political interference in the crime investigation, work load of police personnel without any time limit and periodic holidays, unnecessary pressure from superior police officers and the general public for speedy detection causing great mental strain to the investigating officers, defective system of recruitment and training, imperfect system of investigation and lack of public co-operation are some of the factors identified in the field survey towards the causes of violations of human rights in police custody.

Esta tesis producto del trabajo de investigación se planteo sobre las bases de un derecho administrativo interno creado para resolver los problemas suscitados al interior del Estado en consonancia con los postulados constitucionales, teniendo en cuenta el artículo 4° en que se establece la supremacía de la Constitución y los artículo 9°, 93, 94 y 224 al 227 que ordenan el desarrollo del derecho de integración en el marco de los países Latinoamericanos y del Caribe, por lo que surge la imperiosa necesidad de armonizar el derecho de la integración con el ordenamiento jurídico nacional y en especial con el derecho administrativo quien deberá recepcionar el mencionado ordenamiento supraestatal, alterando las tradicionales concepciones de las fuentes de este derecho interno. Por lo tanto, desde la perspectiva del derecho administrativo comprendido como un derecho legislado que regula las relaciones entre el Estado y los particulares en el que prevalece el “principio de legalidad” de los actos administrativos, se puede intuir que constituye un problema jurídico los impactos derivados de los tratados de integración, donde nos preguntamos sí las categorías de fuentes actuales del derecho administrativo son las adecuadas para abordar la recepción de estas disposiciones Por lo que al explorara las incidencias en el derecho administrativo con ocasión de la recepción del derecho de integración con particular énfasis en la Comunidad Andina, identificamos que uno de los rasgos más distintivos del ordenamiento jurídico andino, como el de otros esquemas de integración, proviene del discutido concepto de supranacionalidad. Dentro de la teoría jurídica contemporánea la comprensión de este término trae una novísima concepción que al mismo tiempo es respetuosa de la soberanía interna de los Estados miembros, la cual permite el surgimiento del nuevo ente común donde es posible la distribución de competencias en la reglamentación de ciertos ámbitos entre autoridades multilaterales y nacionales, conservando su propia autonomía. Este concepto ha permitido que en el ordenamiento comunitario andino, a semejanza de lo que acontece en el derecho interno de los Estados, exista un sistema de control de las normas jurídicas garantizado por una jurisdicción contenciosa-administrativa ejercida a través del Tribunal de Justicia de la Comunidad Andina. Lo que en definitiva incide en el derecho administrativo interno al encontramos frente a ordenamientos independientes, como lo son los del derecho de integración, en los que se producen, aplican y ejecutan normas según las reglas de juego adoptadas para ese efecto por los Estados miembros, que dependerán del marco del proceso de integración y su armonización con las normas internas. Es por ello, que en el resultado final de esta tesis se constata la aparición de nuevas fuentes de legalidad, donde ya no sólo se contemplará la ley y la jurisprudencia, ésta última posicionada con el devenir del tiempo debido a su pertinencia, como lo podemos contrastar con la expedición del Nuevo Código de Procedimiento Contencioso Administrativo (L. 1437/11) que aún no ha entrado en vigencia, en donde se resalta la importancia del Precedente Judicial a partir de las sentencias de unificación del Consejo de Estado. Pero más allá, de este nuevo reconocimiento legislativo, el sistema de fuentes establecido se verá alterado en su jerarquía con el derecho que nace con ocasión de los tratados de integración, lo que aún no se refleja en este nuevo Código, el cual no prevé la aplicación de las nuevas fuentes de legalidad.

Neste exercício são discutidas formas de empreender mudanças em políticas públicas, focando especialmente no estudo da política prisional brasileira. O que é central no debate proposto é a viabilidade da inserção de audiência a ser realizada imediatamente após a prisão de um indivíduo, a audiência de custódia, que possibilitará o encontro entre a pessoa presa e o juiz. O ator promotor da mudança, o Instituto de Defesa do Direito de Defesa – IDDD apregoa como resultado mecanismos de prevenção e combate à tortura e um efetivo controle judicial da detenção. Subsequente a esse argumento, o Instituto é enquadrado como figura influente no papel de grupo de pressão pela mudança na política pública prisional por meio da defesa da audiência de custódia.
