Jasmonates (JAs) trigger an important transcriptional reprogramming of plant cells to modulate both basal development and stress responses. In spite of the importance of transcriptional regulation, only one transcription factor (TF), the Arabidopsis thaliana basic helix-loop-helix MYC2, has been described so far as a direct target of JAZ repressors. By means of yeast two-hybrid screening and tandem affinity purification strategies, we identified two previously unknown targets of JAZ repressors, the TFs MYC3 and MYC4, phylogenetically closely related to MYC2. We show that MYC3 and MYC4 interact in vitro and in vivo with JAZ repressors and also form homo- and heterodimers with MYC2 and among themselves. They both are nuclear proteins that bind DNA with sequence specificity similar to that of MYC2. Loss-of-function mutations in any of these two TFs impair full responsiveness to JA and enhance the JA insensitivity of myc2 mutants. Moreover, the triple mutant myc2 myc3 myc4 is as impaired as coi1-1 in the activation of several, but not all, JA-mediated responses such as the defense against bacterial pathogens and insect herbivory. Our results show that MYC3 and MYC4 are activators of JA-regulated programs that act additively with MYC2 to regulate specifically different subsets of the JA-dependent transcriptional response.

Des del punt de vista històric, la doctrina científica explica el naixement i posterior desenvolupament del testament hològraf d’una forma inequívoca i sense que existeixin plantejaments teòrics distants ni contradictoris. També respecte a la seva introducció en el dret civil de Catalunya, hem de constatar que la doctrina dels autors no presenta diferències significatives en el seu plantejament i desenvolupament teòric i legal. Assentat lo anterior, podem resumir que el testament hològraf neix en el Dret romà sota la forma de testament “parentum inter liberos” , la qual s’introdueix en el Dret català. Arrel del moviment compilador i amb la publicació del Codi civil , s’inicia la regulació del testament hològraf segons els postulats del Dret consuetudinari francès recollit en el “Code civil”. El Tribunal Suprem va estimà aplicables a Catalunya els articles 688 y següents del Codi civil. En la Compilació del dret civil de Catalunya de 21 de juliol de 1960 es van recollir les dues formes de testament hològraf: La general del Codi civil, i l’especial del testament “parentum inter liberos”, que no estava sotmesa a termini per la seva protocol•lització. S’ha de reconèixer que aquest forma especial de testament hològraf era vista amb recel por la doctrina científica catalana; Borrell y Soler va arribar a mantenir que segons el principi de “inclussio unius exclusio alterius”, el testament “parentum inter liberos” no podia aplicar-se en altres supòsits diferents dels previstos. El Codi de Successions de Catalunya aprovat per la Llei 40/1991, de 30 de desembre, regula definitivament el testament hològraf en els seus articles 120 i 121, suprimint la especialitat testamentaria del “parentum inter liberos”, por raons de seguretat jurídica i facilitant el procediment judicial de protocol•lització . Per això, podem dir, que el testament hològraf es consagra a Catalunya segons les pautes del Codi civil (i a través del Dret comparat) . Finalment, esdevé la publicació de la Llei 10/2008, de 10 de juliol, del llibre IV del Codi civil de Catalunya, relatiu a les successions (entrada en vigor: 1-1-2009), en el que es regula el testament hològraf en els seus tres articles: 421-17 (requisits de valides), 421-18 (adveració) y 421-19 (caducitat del testament). El testament hològraf, en dret civil català, és un tipus de testament que no requereix cap solemnitat, si bé els seus requisits són indispensables i la absència de qualsevol d’ells el converteix en un testament nul. Per altre banda, és un testament que acostuma a donar peu a molts problemes, ja que al no precisar d’assessorament notarial o de qualsevol altre classe, pot obviar-ne qualsevol dels requisits establerts en el Codi Civil de Cataluña (llibre IV), no només a la seva forma, sinó també al seu contingut, amb la nul•litat conseqüent. Per altre banda, al no fer-se menció a la capacitat del testador, pot donar-se la situació en que els hereus l’impugnin al qüestionar la seva capacitat per atorgar el testament. En primer lloc, per poder atorgar un testament d’aquesta índole és indispensable ser major d’edat o menor emancipat (en el C.c.Cat.) exigint la Llei que el testament hagi estat escrit pel propi testador i del seu puny i lletra, i a més a més d’haver estat firmat amb expressió de la data i el lloc en que s’ha atorgat. La falta de qualsevol d’aquests requisits convertiria el testament hològraf en nul. Igualment seria nul si el mateix contingués “paraules ratllades, esmenades, afegides o entre línies” que no haguessin estat salvades pel propi testador mitjançant la seva firma. És a dir, que serà precís que el testador faci constar amb la seva firma al marge la seva conformitat amb cada una de les paraules ratllades o modificacions que realitzi en el text. És evident que el que es pretén evitar és que el testament pugui ser modificat per tercers una vegada atorgat. Como es pot comprovar, aquest tipus de testament és molt simple d’atorgar i no requereix cap tipus de formalitat més enllà d’atendre els requisits ja exposats. Ara bé, el problema arriba a l’hora de donar valides a aquets testament una vegada el testador ha mort, ja que el testament ha de ser protocol•litzat davant de Notari, si bé anteriorment el testament ha d’estar validat davant del Jutge de Primera Instància de l’últim domicili del testador. El document firmat pel finat haurà de ser presentat davant el citat Jutge en el termini de quatre anys des de que s’hagi produït la mort i haurà de ser presentat per qui l’hagi tingut dipositat o per qualsevol interessat, ja sigui hereu, legatari, marmessor o por qui ostenti qualsevol altre interès. És important ressenyar que el testament hològraf no és vàlid si no l’adversa el Jutge en el termini ressenyat. El testament hològraf és considerat por la majoria d’autors la forma més senzilla de testament i pel que hem pogut veure, aquesta opinió és del tot correcta. Aquesta senzilles suposa a la vegada potencials avantatges como la del secret del seu contingut, i greus inconvenients, que s’han pogut analitzar a través de la jurisprudència. La inseguretat de la capacitat del testador per testar, la possible mala interpretació de la voluntat del mateix o la omissió de formalitats són només alguns dels riscs que corre el que es disposa a expressar la seva última voluntat sense la presència d’un Notari que l’assessoris. Existeix un altre risc, potser el més evident, que és el de la custòdia del document ja que, si és dipositat en males mans, aquest podria no arribar mai a les d’un Jutge per la seva interpretació.

Synaptic-vesicle exocytosis is mediated by the vesicular Ca(2+) sensor synaptotagmin-1. Synaptotagmin-1 interacts with the SNARE protein syntaxin-1A and acidic phospholipids such as phosphatidylinositol 4,5-bisphosphate (PIP2). However, it is unclear how these interactions contribute to triggering membrane fusion. Using PC12 cells from Rattus norvegicus and artificial supported bilayers, we show that synaptotagmin-1 interacts with the polybasic linker region of syntaxin-1A independent of Ca(2+) through PIP2. This interaction allows both Ca(2+)-binding sites of synaptotagmin-1 to bind to phosphatidylserine in the vesicle membrane upon Ca(2+) triggering. We determined the crystal structure of the C2B domain of synaptotagmin-1 bound to phosphoserine, allowing development of a high-resolution model of synaptotagmin bridging two different membranes. Our results suggest that PIP2 clusters organized by syntaxin-1 act as molecular beacons for vesicle docking, with the subsequent Ca(2+) influx bringing the vesicle membrane close enough for membrane fusion.

The study of wave propagation at sonic frequency in soil leads to elasticity parameter determination. These parameters are compatible to those measured simultaneously by static loading. The acquisition of in situ elasticity parameter combined with laboratory description of the elastoplastic behaviour can lead to in situ elastoplastic curves. - L'étude de la propagation des ondes acoustiques permet la détermination des paramètres d'élasticité dans les sols. Ces paramètres sont cohérents avec des mesures statiques simultanées. L'acquisition des paramètres d'élasticité in situ associée à une description du comportement élasto-plastique mesuré en laboratoire permet d'obtenir des courbes d'élastoplasticité in situ.

What allows an armed group in a civil war to prevent desertion? This paper addresses this question with a focus on control in the rearguard. Most past studies focus on motivations for desertion. They explain desertion in terms of where soldiers stand in relation to the macro themes of the war, or in terms of an inability to provide positive incentives to overcome the collective action problem. However, since individuals decide whether and how to participate in civil wars for multiple reasons, responding to a variety of local conditions in an environment of threat and violence, a focus only on macro-level motivations is incomplete. The opportunities side of the ledger deserves more attention. I therefore turn my attention to how control by an armed group eliminates soldiers’ opportunities to desert. In particular, I consider the control that an armed group maintains over soldiers’ hometowns, treating geographic terrain as an important exogenous indicator of the ease of control. Rough terrain at home affords soldiers and their families and friends advantages in ease of hiding, the difficulty of using force, and local knowledge. Based on an original dataset of soldiers from Santander Province in the Spanish Civil War, gathered from archival sources, I find statistical evidence that the rougher the terrain in a soldier’s home municipality, the more likely he is to desert. I find complementary qualitative evidence indicating that soldiers from rough-terrain communities took active advantage of their greater opportunities for evasion. This finding has important implications for the way observers interpret different soldiers’ decisions to desert or remain fighting, for the prospect that structural factors may shape the cohesion of armed groups, and for the possibility that local knowledge may be a double-edged sword, making soldiers simultaneously good at fighting and good at deserting.

El treball que es presenta té per a objecte l’anàlisi de les principals disposicions de caràcter processal que s’incorporen al Projecte de llei del Llibre II del Codi Civil de Catalunya. S’hi desenvolupa el règim jurídic que s’hi proposa però també s’ha tractat d’identificar les possibles llacunes existents, així com les contradiccions o defectes. Amb la finalitat de contribuir a millorar la qualitat del Projecte s’han elaborat una sèrie d’esmenes que recullen les propostes realitzades en el treball.

Es proposa que el legislador català reguli, de manera uniforme, el dret de desistiment al Llibre VI CCCat. Pot fer-ho, en el seu cas, fent ús o considerant els models de regulació uniforme que s´està proposant en el context de la revisió de l´acquis comunitari. És aquesta mateixa regulació comunitària la que avala una configuració del dret a desistir com a causa extintiva del contracte, amb eficàcia retroactiva o ex tunc, i, per tant, com a mecanisme que es projecte sobre un contracte perfeccionat, fins i tot consumat. Ara bé, aquesta configuració no hauria de privar al legislador català de l´oportunitat de considerar altres possibilitats: així, la d´articular la facultat de penediment en fase pre-contractual. Serien més d´una les tècniques que faciliten la reflexió abans de l´atorgament del contracte, en comptes de permetre-la després. Convertida en mecanisme post-contractual, haurà d´anar acompanyada de les disposicions que estableixin el règim del contracte mentre no transcorre el termini per a desistir, les conseqüències de l´eventual pèrdua de la cosa entretant no caduqui el dret, les condicions i requisits d´exercici de la facultat i la liquidació de la situació possessòria, en el seu cas. Els comentaris i suggerències que es proposen a l´estudi es formulen a propòsit dels preceptes que, relatius al desistiment, s´incorporaren als Treballs preparatoris del Llibre Sisè del Codi civil de Catalunya (document de 23.04.04)

Thank you Chairman I would like to extend a warm welcome to our keynote speakers, David Byrne of the European Commission, Derek Yach from the World Health Organisation, and Paul Quinn representing Congressman Marty Meehan who sends his apologies. When we include the speakers who will address later sessions, this is, undoubtedly, one of the strongest teams that have been assembled on tobacco control in Europe. The very strength of the team underlines what I see as a shift – a very necessary shift – in the way we perceive the tobacco issue. For the last twenty years, we have lived out a paradox. It isn´t a social side issue. I make no apology for the bluntness of what I´m saying, and will come back, a little later, to the radicalism I believe we need to bring – nationally – to this issue. For starters, though, I want to lay it on the line that what we´re talking about is an epidemic as deadly as any suffered by human kind throughout the centuries. Slower than some of those epidemics in its lethal action, perhaps. But an epidemic, nonetheless. According to the World Health Organisation tobacco accounted for just over 3 million annual deaths in 1990, rising to 4.023 million annual deaths in 1998. The numbers of deaths due to tobacco will rise to 8.4 million in 2020 and reach roughly 10 million annually by 2030. This is quite simply ghastly. Tobacco kills. It kills in many different ways. It kills increasing numbers of women. It does its damage directly and indirectly. For children, much of the damage comes from smoking by adults where children live, study, play and work. The very least we should be able to offer every child is breathable air. Air that doesn´t do them damage. We´re now seeing a global public health response to the tobacco epidemic. The Tobacco Free Initiative launched by the World Health Organisation was matched by significant tobacco control initiatives throughout the world. During this conference we will hear about the experiences our speakers had in driving these initiatives. This Tobacco Free Initiative poses unique challenges to our legal frameworks at both national and international levels; in particular it raises challenges about the legal context in which tobacco products are traded and asks questions about the impact of commercial speech especially on children, and the extent of the limitations that should be imposed on it. Politicians, supported by economists and lawyers as well as the medical profession, must continue to explore and develop this context to find innovative ways to wrap public health considerations around the trade in tobacco products – very tightly. We also have the right to demand a totally new paradigm from the tobacco industry. Bluntly, the tobacco industry plays the PR game at its cynical worst. The industry sells its products without regard to the harm these products cause. At the same time, to gain social acceptance, it gives donations, endowments and patronage to high profile events and people. Not good enough. This model of behaviour is no longer acceptable in a modern society. We need one where the industry integrates social responsibility and accountability into its day-to-day activities. We have waited for this change in behaviour from the tobacco industry for many decades. Unfortunately the documents disclosed during litigation in the USA and from other sources make very depressing reading; it is clear from them that any trust society placed in the tobacco industry in the past to address the health problems associated with its products was misplaced. This industry appears to lack the necessary leadership to guide it towards just and responsible action. Instead, it chooses evasion, deception and at times illegal activity to protect its profits at any price and to avoid its responsibilities to society and its customers. It has engaged in elaborate ´spin´ to generate political tolerance, scientific uncertainty and public acceptance of its products. Legislators must act now. I see no reason why the global community should continue to wait. Effective legal controls must be laid on this errant industry. We should also keep these controls under review at regular intervals and if they are failing to achieve the desired outcomes we should be prepared to amend them. In Ireland, as Minister for Health and Children, I launched a comprehensive tobacco control policy entitled “Towards a Tobacco Free Society“. OTT?Excessive?Unrealistic? On the contrary – I believe it to be imperative and inevitable. I honestly hold that, given the range of fatal diseases caused by tobacco use we have little alternative but to pursue the clear objective of creating a tobacco free society. Aiming at a tobacco free society means ensuring public and political opinion are properly informed. It requires help to be given to smokers to break the addiction. It demands that people are protected against environmental tobacco smoke and children are protected from any inducement to experiment with this product. Over the past year we have implemented a number of measures which will support these objectives; we have established an independent Office of Tobacco Control, we have introduced free nicotine replacement therapy for low-income earners, we have extended our existing prohibitions on tobacco advertising to the print media with some minor derogations for international publications. We have raised the legal age at which a person can be sold tobacco products to eighteen years. We have invested substantially more funds in health promotion activities and we have mounted sustained information campaigns. We have engaged in sponsorship arrangements, which are new and innovative for public bodies. I have provided health boards with additional resources to let them mount a sustained inspection and enforcement service. Health boards will engage new Directors of Tobacco Control responsible for coordinating each health board´s response and for liasing with the Tobacco Control Agency I set up earlier this year. Most recently, I have published a comprehensive Bill – The Public Health (Tobacco) Bill, 2001. This Bill will, among other things, end all forms of product display and in-store advertising and will require all retailers to register with the new Tobacco Control Agency. Ten packs of cigarettes will be banned and transparent and independent testing procedures of tobacco products will be introduced. Enforcement officers will be given all the necessary powers to ensure there is full compliance with the law. On smoking in public places we will extend the existing areas covered and it is proposed that I, as Minister for Health and Children, will have the powers to introduce further prohibitions in public places such as pubs and the work place. I will also provide for the establishment of a Tobacco Free Council to advise and assist on an ongoing basis. I believe the measures already introduced and those additional ones proposed in the Bill have widespread community support. In fact, you´re going to hear a detailed presentation from the MRBI which will amply illustrate the extent of this support. The great thing is that the support comes from smokers and non-smokers alike. Bottom line, Ladies and Gentlemen, is that we are at a watershed. As a society (if you´ll allow me to play with a popular phrase) we´ve realised it´s time to ´wake up and smell the cigarettes.´ Smell them. See them for what they are. And get real about destroying their hold on our people. The MRBI survey makes it clear that the single strongest weapon we have when it comes to preventing the habit among young people is price. Simple as that. Price. Up to now, the fear of inflation has been a real impediment to increasing taxes on tobacco. It sounds a serious, logical argument. Until you take it out and look at it a little more closely. Weigh it, as it were, in two hands. I believe – and I believe this with a great passion – that we must take cigarettes out of the equation we use when awarding wage increases. I am calling on IBEC and ICTU, on employers and trade unions alike, to move away from any kind of tolerance of a trade that is killing our citizens. At one point in industrial history, cigarettes were a staple of the workingman´s life. So it was legitimate to include them in the ´basket´ of goods that goes to make up the Consumer Price Index. It isn´t legitimate to include them any more. Today, I´m saying that society collectively must take the step to remove cigarettes from the basket of normality, from the list of elements which constitute necessary consumer spending. I´m saying: “We can no longer delude ourselves. We must exclude cigarettes from the considerations we address in central wage bargaining. We must price cigarettes out of the reach of the children those cigarettes will kill.” Right now, in the monthly Central Statistics Office reports on consumer spending, the figures include cigarettes. But – right down at the bottom of the page – there´s another figure. Calculated without including cigarettes. I believe that if we continue to use the first figure as our constant measure, it will be an indictment of us as legislators, as advocates for working people, as public health professionals. If, on the other hand, we move to the use of the second figure, we will be sending out a message of startling clarity to the nation. We will be saying “We don´t count an addictive, killer drug as part of normal consumer spending.” Taking cigarettes out of the basket used to determine the Consumer Price Index will take away the inflation argument. It will not be easy, in its implications for the social partners. But it is morally inescapable. We must do it. Because it will help us stop the killer that is tobacco. If we can do it, we will give so much extra strength to health educators and the new Tobacco Control Association. This new organisation of young people who already have branches in over fifteen counties, is represented here today. The young adults who make up its membership are well placed to advise children of the dangers of tobacco addiction in a way that older generations cannot. It would strengthen their hand if cigarettes move – in price terms – out of the easy reach of our children Finally, I would like to commend so many public health advocates who have shown professional and indeed personal courage in their commitment to this critical public health issue down through the years. We need you to continue to challenge and confront this grave public health problem and to repudiate the questionable science of the tobacco industry. The Research Institute for a Tobacco Free Society represents a new and dynamic form of partnership between government and civil society. It will provide an effective platform to engage and mobilise the many different professional and academic skills necessary to guide and challenge us. I wish the conference every success.
