En el foro se ha discutido ampliamente respecto de la naturaleza jurídica del “Swiss Challenge”, que constituye una figura poco conocida y que muchas veces, incluyendo los organismos de control han considerado que se asimila a una contratación directa, incluso llegando a manifestarse que es una figura no prevista en el Derecho Público Ecuatoriano, y atentatoria de los principios de la contratación administrativa. Con este antecedente, amable lector, surge la necesidad de proceder al análisis del procedimiento “Swiss Challenge”, a fin de determinar si es un procedimiento que cumple con los principios de la contratación administrativa, si se encuentra previsto en la legislación ecuatoriana; así como, evidenciar el tratamiento que se ha dado de este procedimiento en los casos emblemáticos en que se ha desarrollado en el Ecuador. Por esta razón, abordaremos en el primer capítulo del presente trabajo de investigación, los conceptos fundamentales y las diferentes etapas del procedimiento “Swiss Challenge”; así como, su relación con los principios de la contratación administrativa; llegando al análisis del cumplimiento de cada uno; y, de manera especial, respecto de los principios de igualdad, oposición o libre concurrencia y transparencia. Avanzando en el análisis es importante verificar cual ha sido la aplicación que se ha dado en la administración pública ecuatoriana de este procedimiento, para lo cual, nos adentraremos en el análisis de los dos casos emblemáticos de “Swiss Challenge” en la república del Ecuador; esto es, revisaremos los concernientes a la concesión para la construcción, administración y mantenimiento del Nuevo Aeropuerto Internacional de Quito –NAIQ-; así como, el financiamiento y la construcción del proyecto hidroeléctrico Toachi- Pilatón. Asimismo, evidenciaremos si es que el desarrollo del procedimiento “Swiss Challenge” en estos dos proyectos, atendieron a los principios de la contratación administrativa, identificando las dificultades que se hubieren producido en los mismos; aspectos que, determinarán el cumplimiento formal y material de dichos axiomas y su correcta aplicación. Finalmente, realizaremos un análisis de las normas del ordenamiento jurídico ecuatoriano, con especial atención en el cambio de modelo en la gestión de los sectores estratégicos por parte de la Constitución del 2008; lo que nos permitirá desentrañar si el “Swiss Challenge” es un figura prevista en el Ordenamiento Jurídico Ecuatoriano.

Existen conductas netamente sexuales, en las que la red ha llegado a convertirse en un fin o un medio para que ciertos individuos busquen y logren satisfacción sexual a través del chantaje sexual a menores de edad, delito conocido en la normativa penal anglosajona como “grooming” o “child grooming”, conducta que actualmente en el COIP se encuentra tipificada en su Art.- 173; siendo entonces que a través del presente trabajo pretendemos, en base a la teoría el derecho penal mínimo consagrado en el Art 195 de nuestra Constitución, analizar si el tipo penal incluido en el COIP referente al grooming, o como se lo ha denominado, delito de “Contacto con finalidad sexual con menores de dieciocho años por medios electrónicos”, cumple o no con aquella conducta considerada como tal por la doctrina y las legislaciones extranjeras; y especialmente establecer, conforme a los axiomas de Ferrajoli, si existe efectivamente la necesidad y la lesividad como para tipificar esta conducta a través de un tipo penal autónomo o si bien pueden estos actos encontrar su verbo rector y características especiales en otros tipos penales ya existentes en la legislación sustantiva penal, pues es claro que el Derecho Penal, para legitimar su existencia en un Estado Constitucional de Derechos y Justicia, debe limitar el ejercicio del poder punitivo del Estado.

Increasing evidence demonstrates that beta-amyloid (Ab) is toxic to synapses, resulting in the progressive dismantling of neuronal circuits. Counteract the synaptotoxic effects of Ab could be particularly relevant for providing effective treatments for Alzheimer’s disease (AD). Curcumin was recently reported to improve learning and memory in animal models of AD. Little is currently known about the specific mechanisms by which Ab affects neuronal excitability and curcumin ameliorates synaptic transmission in the hippocampus. Organotypic hippocampal slice cultures exposed to Ab1–42 were used to study the neuroprotective effects of curcumin through a spectral analysis of multi-electrode array (MEA) recordings of spontaneous neuronal activity. Curcumin counteracted both deleterious effects of Ab; the initial synaptic dysfunction and the later neuronal death. The analysis of MEA recordings of spontaneous neuronal activity showed an attenuation of signal propagation induced by Ab before cell death and curcumin-induced alterations to local field potential (LFP) phase coherence. Curcumin-mediated attenuation of Ab-induced synaptic dysfunction involved regulation of synaptic proteins, namely phospho-CaMKII and phosphosynapsin I. Taken together, our results expand the neuroprotective role of curcumin to a synaptic level. The identification of these mechanisms underlying the effects of curcumin may lead to new targets for future therapies for AD.

Monolayers of neurons and glia have been employed for decades as tools for the study of cellular physiology and as the basis for a variety of standard toxicological assays. A variety of three dimensional (3D) culture techniques have been developed with the aim to produce cultures that recapitulate desirable features of intact. In this study, we investigated the effect of preparing primary mouse mixed neuron and glial cultures in the inert 3D scaffold, Alvetex. Using planar multielectrode arrays, we compared the spontaneous bioelectrical activity exhibited by neuroglial networks grown in the scaffold with that seen in the same cells prepared as conventional monolayer cultures. Two dimensional (monolayer; 2D) cultures exhibited a significantly higher spike firing rate than that seen in 3D cultures although no difference was seen in total signal power (<50 Hz) while pharmacological responsiveness of each culture type to antagonism of GABAAR, NMDAR and AMPAR was highly comparable. Interestingly, correlation of burst events, spike firing and total signal power (<50 Hz) revealed that local field potential events were associated with action potential driven bursts as was the case for 2D cultures. Moreover, glial morphology was more physiologically normal in 3D cultures. These results show that 3D culture in inert scaffolds represents a more physiologically normal preparation which has advantages for physiological, pharmacological, toxicological and drug development studies, particularly given the extensive use of such preparations in high throughput and high content systems.

We present measurements of the charge balance function, from the charged particles, for diverse pseudorapidity and transverse momentum ranges in Au + Au collisions at root S(NN) = 200 GeV using the STAR detector at RHIC. We observe that the balance function is boost-invariant within the pseudorapidity coverage vertical bar-1.3, 1.3 vertical bar. The balance function properly scaled by the width of the observed pseudorapidity window does not depend on the position or size of the pseudorapidity window. This scaling property also holds for particles in different transverse momentum ranges. In addition, we find that the width of the balance function decreases monotonically with increasing transverse momentum for all centrality classes. (c) 2010 Elsevier B.V. All rights reserved.

Nuclear collisions recreate conditions in the universe microseconds after the Big Bang. Only a very small fraction of the emitted fragments are light nuclei, but these states are of fundamental interest. We report the observation of antihypertritons-comprising an antiproton, an antineutron, and an antilambda hyperon-produced by colliding gold nuclei at high energy. Our analysis yields 70 +/- 17 antihypertritons (3/Lambda(H) over bar) and 157 +/- 30 hypertritons ((3)(Lambda)H). The measured yields of (3)(Lambda)H (3/Lambda(H) over bar) and (3)He ((3)(He) over bar) are similar, suggesting an equilibrium in coordinate and momentum space populations of up, down, and strange quarks and antiquarks, unlike the pattern observed at lower collision energies. The production and properties of antinuclei, and of nuclei containing strange quarks, have implications spanning nuclear and particle physics, astrophysics, and cosmology.

We present results on the system size dependence of high transverse momentum di-hadron correlations at root s(NN) = 200 GeV as measured by STAR at RHIC. Measurements in d + Au, Cu + Cu and Au + Au collisions reveal similar jet-like near-side correlation yields (correlations at small angular separation Delta phi similar to 0, Delta eta similar to 0) for all systems and centralities. Previous measurements have shown Chat the away-side (Delta phi similar to pi) yield is suppressed in heavy-ion collisions. We present measurements of the away-side Suppression as a function of transverse momentum and centrality in Cu + Cu and Au + Au collisions. The suppression is found to be similar in Cu + Cu and An + An collisions at a similar number of participants. The results are compared to theoretical calculations based on the patron quenching model and the modified fragmentation model. The observed differences between data and theory indicate that the correlated yields presented here will further constrain dynamic energy loss models and provide information about the dynamic density profile in heavy-ion collisions. We present the multiplicity and pseudorapidity distributions of photons produced in Au + Au and Cu + Cu collisions at root(s)NN = 62.4 and 200 GeV. The photons are measured in the region -3.7 < eta < -2.3 using the photon Multiplicity detector in the STAR experiment at RHIC. The number of photons produced per average number of participating nucleon pairs increases with the beam energy and is independent of (lie collision centrality. For collisions with similar average numbers of participating nucleons the photon multiplicities are observed to be similar for An + Au and Cu + Cu collisions at a given beam energy. The ratios of the number of charged particles to photons in the measured pseudorapidity range are found to be 1.4 +/- 0.1 and 1.2 +/- 0.1 for root(s)NN = 62.4 and 200 GeV, respectively. The energy dependence of this ratio could reflect varying contributions from baryons to charged particles, while mesons are the dominant contributors to photon production in the given kinematic region. The photon pseudorapidity distributions normalized by average number of participating nucleon pairs, when plotted as a function of eta-Y(beam), are found to follow a longitudinal scaling independent of centrality and colliding ion species at both beam energies. High-energy nuclear collisions create an energy density similar to that of the Universe microseconds after the Big Bang(1); in both cases, matter and antimatter are formed with comparable abundance. However, the relatively short-lived expansion in nuclear collisions allows antimatter to decouple quickly from matter, and avoid annihilation. Thus, a high-energy accelerator of heavy nuclei provides an efficient means of producing and studying antimatter. The antimatter helium-4 nucleus ((4)(He) over bar), also known as the anti-alpha ((alpha) over bar), consists of two antiprotons and two antineutrons (baryon number B = -4). It has not been observed previously, although the alpha-particle was identified a century ago by Rutherford and is present in cosmic radiation at the ten per cent level(2). Antimatter nuclei with B -1 have been observed only as rare products of interactions at particle accelerators, where the rate of antinucleus production in high-energy collisions decreases by a factor of about 1,000 with each additional antinucleon(3-5). Here we report the observation of (4)<(He) over bar, the heaviest observed antinucleus to date. In total, 18 (4)(He) over bar counts were detected at the STAR experiment at the Relativistic Heavy Ion Collider (RHIC; ref. 6) in 10(9) recorded gold-on-gold (Au+Au) collisions at centre-of-mass energies of 200 GeV and 62 GeV per nucleon-nucleon pair. The yield is consistent with expectations from thermodynamic(7) and coalescent nucleosynthesis(8) models, providing an indication of the production rate of even heavier antimatter nuclei and a benchmark for possible future observations of (4)(He) over bar in cosmic radiation.

We study the beam-energy and system-size dependence of phi meson production (using the hadronic decay mode phi -> K(+) K(-)) by comparing the new results from Cu + Cu collisions and previously reported Au + Au collisions at root s(NN) = 62.4 and 200 GeV measured in the STAR experiment at RHIC. Data presented in this Letter are from mid-rapidity (vertical bar y vertical bar < 0.5) for 0.4 < p(T) < 5 GeV/c. At a given beam energy, the transverse momentum distributions for phi mesons are observed to be similar in yield and shape for Cu + Cu and Au + Au colliding systems with similar average numbers of participating nucleons. The phi meson yields in nucleus-nucleus collisions, normalized by the average number of participating nucleons, are found to be enhanced relative to those from p + p collisions. The enhancement for phi mesons lies between strange hadrons having net strangeness = 1 (K(-) and <(A)over bar>) and net strangeness = 2 (Xi). The enhancement for phi mesons is observed to be higher at root s(NN) = 200 GeV compared to 62.4 GeV. These observations for the produced phi(s (s) over bar) mesons clearly suggest that, at these collision energies, the source of enhancement of strange hadrons is related to the formation of a dense partonic medium in high energy nucleus-nucleus collisions and cannot be alone due to canonical suppression of their production in smaller systems. Os algoritmos baseados no paradigma Simulated Annealing e suas variações são atualmente usados de forma ampla na resolução de problemas de otimização de larga escala. Esta popularidade é resultado da estrutura extremamente simples e aparentemente universal dos algoritmos, da aplicabilidade geral e da habilidade de fornecer soluções bastante próximas da ótima. No início da década de 80, Kirkpatrick e outros apresentaram uma proposta de utilização dos conceitos de annealing (resfriamento lento e controlado de sólidos) em otimização combinatória. Esta proposta considera a forte analogia entre o processo físico de annealing e a resolução de problemas grandes de otimização combinatória. Simulated Annealing (SA) é um denominação genérica para os algoritmos desenvolvidos com base nesta proposta. Estes algoritmos combinam técnicas de busca local e de randomização. O objetivo do presente trabalho é proporcionar um entendimento das características do Simulated Annealing e facilitar o desenvolvimento de algoritmos com estas características. Assim, é apresentado como Simulated Annealing e suas variações estão sendo utilizados na resolução de problemas de otimização combinatória, proposta uma formalização através de um método de desenvolvimento de algoritmos e analisados aspectos de complexidade. O método de desenvolvimento especifica um programa abstrato para um algoritmo Simulated Annealing seqüencial, identifica funções e predicados que constituem os procedimentos deste programa abstrato e estabelece axiomas que permitem a visualização das propriedades que estes procedimentos devem satisfazer. A complexidade do Simulated Annealing é analisada a partir do programa abstrato desenvolvido e de seus principais procedimentos, permitindo o estabelecimento de uma equação genérica para a complexidade. Esta equação genérica é aplicável aos algoritmos desenvolvidos com base no método proposto. Uma prova de correção é apresentada para o programa abstrato e um código exemplo é analisado com relação aos axiomas estabelecidos. O estabelecimento de axiomas tem como propósito definir uma semântica para o algoritmo, o que permite a um desenvolvedor analisar a correção do código especificado para um algoritmo levando em consideração estes axiomas. O trabalho foi realizado a partir de um estudo introdutório de otimização combinatória, de técnicas de resolução de problemas, de um levantamento histórico do uso do Simulated Annealing, das variações em torno do modelo e de embasamentos matemáticos documentados. Isto permitiu identificar as características essenciais dos algoritmos baseados no paradigma, analisar os aspectos relacionados com estas características, como as diferentes formas de realizar uma prescrição de resfriamento e percorrer um espaço de soluções, e construir a fundamentação teórica genérica proposta.
