The WTO established two rules concerning the international protection of the TRIPs - trade related intellectual property rights, which includes patents and copyrights. One of these rules is the non-discrimination, which has shown to be efficiency-enhancing in the context of trade tariff reductions. The other is the national-treatment commitment rule. We develop in this paper a simple framework to show that the extended version of this rule - which is nowadays being imposed to members - brings out a loss of economic efficiency and a reduction in the levels of protection of intellectual property rights worldwide. As a consequence, it tends to reduce the investments on Research and Development throughout the world. This exactly contradicts the objectives of the Agreement.

This paper is part of the Brazilian branch of the BISA Copyright Review, a research project focused on the intersection of copyright and public interest in Brazil, India and South Africa, funded by the Ford Foundation. The Brazilian contribution is based on interviews with some of the key actors involved with the process of copyright reform initiated by the Brazilian Ministry of Culture in 2007, and provides a thorough picture of the Brazilian copyright policy scenario as of 2008.

Media Piracy in Emerging Economies is the first independent, large-scale study of music, film and software piracy in the developing world, with a focus on Brazil, India, Russia, South Africa, Mexico and Bolivia. Based on three years of work by some thirty-five researchers, the study tells two overarching stories: one tracing the explosive growth of piracy as digital technologies became cheap and ubiquitous around the world, and another following the growth of industry lobbies that have reshaped laws and law enforcement around copyright protection. The report argues that enforcement efforts have largely failed, and that the problem of piracy is better addressed as a failure of affordable access to media in legal markets.

O sistema de patentes pode ser considerado um instrumento de regulação da inovação. Alguns autores que estudam o sistema de patentes pela ótica da análise econômica do direito indicam que as chamadas “corridas por patentes” – quando diferentes indivíduos ou empresas, de forma independente, buscam desenvolver e patentear uma solução para determinado problema técnico – configurariam uma ineficiência do sistema de patentes. Isso porque, de acordo com esses autores, somente o primeiro a concluir o desenvolvimento de uma nova solução técnica e requerer proteção junto aos órgãos competentes é que poderia obter uma patente e explorar a invenção, de maneira que os outros competidores teriam simplesmente desperdiçado recursos escassos com suas pesquisas. O objetivo dessa dissertação é verificar se tais análises estão corretas, ou seja, se as “corridas por patentes” de fato constituem uma ineficiência do sistema de patentes, em especial à luz da legislação pertinente ao tema, da lógica atinente ao processo de inovação, da teoria dos jogos e dos benefícios eventualmente gerados para a sociedade pela pesquisa e desenvolvimento de novas soluções técnicas.

O presente artigo pretende analisar os compromissos assumidos pela Rússia quando de sua acessão à Organização Mundial de Comércio (OMC), a fim de averiguar os impactos que esses podem trazer ao sistema multilateral de comércio. A Rússia era a última grande economia que estava ausente da OMC e, para que sua acessão fosse aceita pelos membros da organização, submeteu-se a uma série de obrigações que concediam aos demais membros maior acesso ao mercado russo e visavam assegurar que o país conformaria seu sistema econômico às regras do sistema multilateral. Assim, foram estabelecidas obrigações em temas relacionados ao setor de petróleo e gás, à participação do Estado na economia, aos programas de subsídio e à observância das regras de propriedade intelectual. A partir da análise de tais compromissos, em conjunto a uma comparação com a acessão da China à OMC, em 2001, serão identificadas as principais características da economia russa que poderão ensejar desafios à sua plena participação no sistema multilateral

This dissertation uses an empirical gravity equation approach to study the relationship between nonreciprocal trade agreements (NRTAs) and members’ trade flows. Estimations relate bilateral imports to trade policy variables using a very comprehensive dataset with over fifty years of data. Results show that meager average trade effects exist only if members are excluded from the world trading system or if they are very poor. As trade flows between NRTA members are already rising before their creation, results also suggest a strong endogeneity concerning their formation. Moreover, estimations show that uncertainty and discretion tend to critically hinder NRTA’s performance. On the other hand, reciprocal trade agreements show the opposite pattern regardless of members’ income status.Encouraging developing countries’ openness to trade through reciprocal liberalization emerges consequently as a possible policy implication.

The topical corneal application of antimitotic mitomycin-C (MMC) during refractive surgery is still characterized by a lack of standardization and considerable empirism. For this reason the creation of a system capable of reliable drug delivery represents a beneficial innovation for patients submitted to these procedures. Objective: Elaborate a new MMC delivery system during the transoperatory period of photorefractive keratectomy (PRK) followed by patent application. Methods: The project consists of an in vitro experimental study to create an MMC (0.02%) release system. The drug was impregnated in sterile Whatman® 41 paper filter discs with a diameter of 8 mm. After drying, the discs were applied to antibiogram plates seeded with Staphylococcus epidermidis (American Type Culture Collection ATCC 12228), followed by the addition of a drop of sterile water. At the end of 1 minute, the discs were removed and the plates incubated for 48 hours at 35oC. Mean drop volume in the collyrium flasks was measured using analytical balance weighing. The inhibition halo (mm) was correlated with the MMC impregnated into the disc. After completion of the invention design a patent application was lodged at the National Institute of Industrial Property. Results: The correspondence between MMC-produced inhibition halos indicated that a dose of 16μg was ideal for impregnating into the discs. The mean drop volume obtained from the collyrium flasks was 37.7 μL. A minute after the application of one drop of balanced saline solution, the system released an adequate concentration for PRK surgery. Conclusion: A new MMC delivery system was created for transoperatory application in photorefractive keratectomy (PRK). Publication of the patent application (number PI 0704739-8) gives the authors exclusive intellectual property rights. Purpose - The purpose of this paper is to analyze the international strengthening of copyright law in developing countries and the active involvement of the international library community in the movement against it.Design/methodology/approach - The paper describes the overprotection of intellectual property rights through international and bilateral treaties, the reaction against such through the proposal of a WIPO development agenda, and the contribution of the international library organizations to the debates and discussions in the WIPO arena.Findings - The initiative for a development agenda for WIPO has proven much more successful than many had imagined, even its promoters. The most relevant proposals made by the international library community were included in the final list of approved recommendations.Originality/value - The paper raises awareness of the relationship between copyright and access to knowledge and, in consequence, the need for library organizations to exert influence in such legislation.
