Lei Maria da Penha: da convivência com as práticas do sistema de justiça no submédio do Vale do São Francisco

The inequalities that mark the women’s lives in societies around the world have been the subject of intense discussion by the feminist movement, with developments in questioning about possibilities of full citizenship. In this scenario the Brazilian feminist movement has achieved steadily, in recent decades, an effort to participate in the formulation of the public policy agenda, as well as the realization of demands to institutionalize the legal parameters as regulations for the issue of violence against women. On the grounds of social justice, many discourses are made with a focus on reframing the institutional role of the state in the areas of constitutional law and criminal law. Considering these discourses, proposals were reformulated and the action of the state was resized, what ended in the enactment of Law 11,340 / 2006 (Maria da Penha Law), with a great impact on the Brazilian criminal justice system. Taking this perspective as its starting point, this research is focused on understanding the struggles for access to the legal field regarding the implementation of the Maria da Penha Law. This qualitative and quantitative research analyses the way the social practices and social representations which involve activists of the feminist movement and operators from the justice system are established in Juazeiro/ BA and Petrolina/PE before the institutional reshuffles of the state. As a result, it was revealed that, despite inconsistencies in the performance of the criminal justice system, the positioning of feminist activism is grounded on the assumption.

Posicionamento estratégico de destinos: uma análise através da percepção dos operadores de Turismo da cidade de São Paulo sobre o destino Natal, Brasil

El turismo constituye una actividad propulsora de mejorías económicas y sociales en incontables lugares alrededor del mundo, y la ciudad de Natal se posiciona como uno de los principales destinos turísticos del Nordeste brasileño. De ese modo, el objetivo del presente estudio consistió en analizar el posicionamiento estratégico del destino Natal por medio de la percepción de los operadores de turismo de la ciudad de São Paulo, principal mercado emisor de turistas del país. El estudio de carácter descriptivo-exploratorio utilizó un abordaje cualitativo y tuvo, como universo de investigación, operadoras de turismo de la capital paulista que comercializan el destino Natal. En la colecta de datos, se utilizaron la investigación bibliográfica y el estudio de campo, siendo este último efetivado por medio de un guión de entrevista semiestruturado. Ya la técnica utilizada para el análisis de los datos fue el análisis de contenido, iniciada mediante selección del material recolectado y concluida con el proceso de categorización. Cuanto a los resultados del estudio, se percibió que el paulistano que viaja al destino Natal tiene un perfil demográfico que sugiere a la práctica del turismo sustentable, está a la busca del turismo de sol y playa, y valora las bellezas naturales del lugar. Los operadores de turismo entrevistados evaluaron, positivamente, la ciudad de Natal, y destacaron los siguientes atributos del destino: playas, bellezas naturales, hostelería, receptividad de los autóctonas, gastronomía, de entre otros. Además, los respondentes demostraron tener un fuerte encariño al destino. En lo que se refiere a los aspectos negativos, prevaleció la observancia de la ineficacia de los gobiernos locales, donde el deterioro de la malla aérea y la incipiente promoción del destino fueron apuntados como los dos principales gargalos. Al analizar la competencia, se identificó que Fortaleza, Porto de Galinhas y Maceió son los tres principales concurrentes de Natal, siendo el destino pernambucano lo que presenta mejor evaluación. Por fin, se observó que no existe una diferenciación relevante en el destino Natal.

Os operadores argumentativos como estratégia linguística e discursiva da argumentação na sentença judicial

We studied in this dissertation the argumentation in the court judgment, which goal was to identify, describe and explain the running of argumentative operators in the argumentative orientation of text and discourse built through the text of the judgment. We support our research in the constructs adopted for the ATD – (Textual Analysis of the Discourses) - Adam (2011), in the studies about the Aristotle’s Rhetoric (1959) and Perelman and Olbrechts-Tyteca (1996) and other works such as of the Alves (2005), Capez (2008), Charaudeau (2012), Keller and Bastos (2015), Koch (2009; 2011), Rodrigues, Silva Neto and Passeggi (2010), Trubilhano and Henriques (2013). In a methodological way, we made use of deductive-inductive method, because we analyzed the argumentation in an "unknown" text - particular case - based on a theory already known (about language, text and argumentation). About the nature and objectives, our search was characterized as qualitatively and as an explanatory and descriptive investigation, with technical procedures of documental collection of Bibliographic Search. As corpus, we use a court judgment of character condemnatory, issued on September 10, 2014 and taken from the online site of the Federal Court of Rio Grande do Norte (JFRN). The results revealed that the argumentative operators exercised decisive roles in the organization of argumentative strategies of the text and the speech , guiding the announcer to the Desired conclusion by the enunciator. It was also possible to conclude that the use of argumentative operators allowed syllogistic constructions in the form of presentation of the arguments and in the construction of argumentation. In addition, operators like "but", "until", "already", "although" etc. helped to identify in the data's analysis the point of view (PoV) of the enunciator, the expectation break about the previous enunciate and / or the value scale given to the argument. Finally, with the use of argumentative operators the enunciator introduced arguments able to demonstrate/justify a thesis and refute an opposing thesis towards a conclusion sought by the own enunciator.
