Resulta muy complicado iniciar una demanda o acción por discriminación en el ámbito laboral, debido principalmente a que dicha conducta se encuentra generalmente encubierta, además porque es el empleador el que tiene en su poder los medios de prueba. Por tales motivos, es de vital importancia mejorar los mecanismos de prueba en demandas o acciones por discriminación en material laboral, para así garantizar efectivamente el derecho a la igualdad de trato que se encuentra contemplado en la Constitución de la República del Ecuador y en instrumentos internacionales suscritos por nuestro país.

La identidad sexual y de género como el cuerpo son espacios de poder y diferencia donde se evidencia la precariedad del sistema político económico heterosexual ‘blanco occidental’ y su impositivo sistema de sexo-género. Mediante un trabajo etnográfico la investigación indagó y analizó la situación actual de las travestis encarceladas en el Centro de rehabilitación para Varones Nº 1, vinculándolo con la estructura macro social circundante a la que pertenece y el ex-penal está inserto activamente. El estudio da cuenta de la actualidad enmarcada entre junio 2005 y enero 2007. Hace referencia a hechos sociopolíticos e históricos que visibilizan y evidencian dentro del contexto nacional la situación de la violencia socio cultural, física-psico afectiva, como las circunstancias de marginalización y discriminación que se ejerce sobre las travestis; así como la persistente violación a sus derechos fundamentales como consecuencia de su identidad sexual y de género abyecta; por parte de otros agentes sociales.

Inclusive practice is well embedded across society and has developed over time. However, although policy and public view have moved forward, the way organisations address the agenda for inclusion often represents a superficial interpretation of this concept. Qualitative data were gathered using new ethnography to explore the experiences of a library-based reading group for visually impaired readers. The voices of the individuals shed light on the individual and collective experience of reading. These insights challenge the traditional views of distinct provision that are designed to address targets for inclusion of individuals with disabilities. We argue for a clearer focus on the unintentional consequences of practice in the name of inclusion that leave individuals feeling marginalised. This paper suggests the alternative focus on social justice as offering a discourse that focuses on society and away from the individual.

Recalling information involves the process of discriminating between relevant and irrelevant information stored in memory. Not infrequently, the relevant information needs to be selected from amongst a series of related possibilities. This is likely to be particularly problematic when the irrelevant possibilities are not only temporally or contextually appropriate but also overlap semantically with the target or targets. Here, we investigate the extent to which purely perceptual features which discriminate between irrelevant and target material can be used to overcome the negative impact of contextual and semantic relatedness. Adopting a distraction paradigm, it is demonstrated that when distracters are interleaved with targets presented either visually (Experiment 1) or auditorily (Experiment 2), a within-modality semantic distraction effect occurs; semantically-related distracters impact upon recall more than unrelated distracters. In the semantically-related condition, the number of intrusions in recall is reduced whilst the number of correctly recalled targets is simultaneously increased by the presence of perceptual cues to relevance (color features in Experiment 1 or speaker’s gender in Experiment 2). However, as demonstrated in Experiment 3, even presenting semantically-related distracters in a language and a sensory modality (spoken Welsh) distinct from that of the targets (visual English) is insufficient to eliminate false recalls completely, or to restore correct recall to levels seen with unrelated distracters . Together, the study shows how semantic and non-semantic discriminability shape patterns of both erroneous and correct recall.

Elite Education: a strategy for recognition? A study on anti-discrimination strategies among law-students of Middle Eastern background While research show that individuals of foreign background are being discriminated against and stigmatized in Sweden, an increasing number of them still choose higher education and also show a tendency towards choosing an elite education. In this article, I examine if there is a link between experiences of discrimination and the choice of elite education. The study is based upon semi-structured interviews with five female and five male law students of Middle Eastern background. The findings show that discrimination, either against the students or their parents, has led to a high study motivation where the choice of elite education can be understood as an anti-discrimination strategy. Other anti-discrimination strategies are to resist a victim mentality and to destigmatize by challenging stereotypes. These anti-discrimination strategies can be understood as strategies for recognition, that is, striving for equality by being ascribed a positive status.

Opposition and Support: A Study of Swedish Muslim Congregations Anti-Islamic attitudes are deeply rooted in Western Europe, and Muslims have, especially in the post-September 11 context, experienced discrimination and demonization. But how do anti-Islamic attitudes affect practicing Muslims and their congregations? The aim of this study, the first of its kind in Europe, is to present a statistically representative view of how Muslim congregations in Sweden experienced the reactions from the surrounding community. The results of the survey carried out show that according to the representatives of the local congregations (n=105) half of the congregations have experienced opposition from the local community and in 40 percent of the congregations criminal offences have been committed against active Muslims or their places of worship.  This opposition is closely connected with two types of situations: either international occurrences (i.e. terrorist bombings in, for example, London, Madrid) or local events that have emphasized the presence of Islam in the public sphere. A multivariate analysis of the results of the study shows that the strongest opposition has taken place in small municipalities with a large proportion of immigrants. However, opposition does not preclude support. On the contrary, opposition appears to have a mobilizing effect on those who support the right of Muslims to exercise freedom of religion. However, neither opposition nor support are the key factors affecting whether congregations see themselves as established in the local community. The degree of anchorage depends on the demographic composition of the congregation and on the degree of contact that the members have with the surrounding community.

Racism in Brazil has some specificities when compared to other countries, for, differently from, for instance, South Africa and the United States, Brazilian Constitutions, ever since the Independence (1822), have never distinguished the citizens according to race or color. Furthermore, since the mid-1900s, Afro-Brazilian cultural manifestations, such as, for example, samba and capoeira, started to be valued as a part of our “national identity”. These specificities make race relations in Brazilian society a much more complex issue. This paper is focused on selected parts of interviews that deal with the nature of racial discrimination in Brazil, extracted from interviews with leaders of the black movement produced within the scope of the project “The History of Black Movement in Brazil: organization of a collection of Oral History Interviews”, developed by CPDOC, Getulio Vargas Foundation (Rio de Janeiro). These “histories within history”, as told by our interviewees, may be transformed into images that will be able to condense a given reality, thus allowing us to evaluate the gains obtained by oral history methodology.
