This project is the result of a four months internship at the “Julgado de Paz de Lisboa” between September and December of 2014. The internship was a necessary requirement for completing the Master’s degree in Law. In the first section we describe all the work developed during the internship and expose the main topic of the thesis. The second section describes the structure of the “Julgados de Paz” as well as its competences and its procedures. We also highlight the main differences between the “Julgados de Paz” and the “Tribunais Judiciais”. In the third section we describe the figure of the lawyer taking a historical perspective as well the most relevant principles for the topic of the thesis. The fourth section analyses the present legislation both at the “Julgados de Paz” as well as the “Tribunais Judiciais” it what respects mandatories of the requirement of a lawyer. In the final section we present our conclusions and our proposals for solving the existing anomalies that arise from the present regime.

This report is the outcome of an internship that took place in Centro de Arbitragem Comercial da Câmara de Comércio e Indústria Portuguesa and its completion is an essential part of the path towards obtaining the Master’s Degree in Faculdade de Direito da Universidade Nova de Lisboa. This report has been structured in two stages – firstly, the presentation of the Centro de Arbitragem Comercial, focusing on its field of expertise, organic structure, principles and advantages. Then, the description of the activities developed within the Secretariat over the several stages of the arbitration procedure – since the reception of the arbitration requirement in institutional proceedings, terms of reference in ad hoc procedures, through the monitoring of the arbitral tribunal sessions (preliminary hearings, submission of evidence and final allegations) and the notification of the arbitration award. The second stage of this report is related to the description of the functions and powers of the President of Centro de Arbitragem Comercial. Firstly, it defines those powers by analyzing the statutes and rules of proceedings of the Centro de Arbitragem, drawing comparisons between the above mention and the rules of proceedings of others arbitral institutional centres, some of them are international references. The report assesses and describes the presidential powers, such as: configuration and composition of the arbitral tribunal (including arbitrator’s replacements, excuses and refusals); deadline extensions; determination of procedural rules and decision-making on any procedural incidents which arise before the constitution of the arbitral tribunal; definition of arbitration costs and fees; joinder of parties and consolidation of proceedings admission; and appointment of an emergency arbitrator. Lastly, this report analyzes some decisions delivered by the President in the respective institutional procedures which took place in the Centre.

O presente Relatório tem como objetivo expor o trabalho desenvolvido durante o estágio, no âmbito da componente não letiva do mestrado em Ciências da Educação, realizado ao abrigo de um protocolo entre a Faculdade de Ciências Socais e Humanas (FCSH) da Universidade Nova de Lisboa (UNL) e a Escola Profissional Gustave Eiffel (EPGE), sob orientação científica do Professor Doutor Luís Manuel Bernardo da FCSH e orientação prática pela Mestre Maria Goreti Freitas, da EPGE. O estágio teve a duração de três meses, com um total de 400 horas. Deste modo, serão descritas as práticas de estágio, sustentadas nos conhecimentos adquiridos nas componentes letivas do mestrado em Ciências da Educação. O relatório está estruturado em três capítulos, finalizando com uma reflexão sobre a produtividade do estágio para a nossa aprendizagem. No primeiro capítulo, pretende-se justificar a escolha da temática deste relatório, procedendo-se à caracterização da secretaria e da escola, fundamentada através de uma revisão de literatura, bem como por algumas entrevistas realizadas durante o estágio. Neste capítulo dá-se importância ao facto deste estágio ter permitido uma interação com toda a comunidade educativa, nas suas respetivas diferenças, em diferentes níveis e situações. No segundo capítulo, efetuou-se a uma contextualização acerca das plataformas de gestão educativas bem como a sua importância para a gestão da comunidade educativa. Evidenciou-se em particular o papel das plataformas de gestão na educação, enquanto elo de ligação entre a secretaria e toda a comunidade educativa. No terceiro capítulo levou-se a cabo a descrição das principais atividades desenvolvidas durante o estágio curricular. Por fim, apresenta-se a uma reflexão crítica sobre o processo de estágio. Todo o trabalho remete para documentos anexos, os quais comprovam a documentação complementar. Alguns destes documentos foram elaborados de forma original, designadamente as entrevistas realizadas no decurso do estágio.

O presente relatório resultou do estágio efetuado na DGPC, no âmbito da componente não-letiva do Mestrado em Arqueologia. O seu propósito centrou-se no Inventário e Georreferenciação das manifestações funerárias rupestres medievais, enquadradas na região do Centro de Portugal. Este trabalho possibilitou a atualização e introdução de inúmeras ocorrências, respeitantes a sepulturas e necrópoles escavadas na rocha, na base de dados da DGPC – o Endovélico. A concretização deste objetivo assentou essencialmente na consulta de bibliografia especializada, assim como de relatórios técnico-científicos. Ao constar do Endovélico, a informação inserida afigura-se como um contributo para o conhecimento e divulgação deste tipo de património medieval, auxiliando, inevitavelmente, no que concerne à sua salvaguarda e proteção. O processamento e sistematização da vasta informação inventariada e georreferenciada possibilitou o desenvolvimento de uma análise, na perspetiva das sepulturas escavadas na rocha como fenómeno funerário alto-medieval. Esta permitiu a criação de uma imagem, ainda que incompleta, dos tipos de agrupamentos existentes e da relação entre as sepulturas e as zonas envolventes, com lugar numa parte do território de Viseu.

Temple Grandin was born in Boston, Massachusetts on August 29,1947 to Richard Grandin and Eustacia Cutler. She was diagnosed with autism at age 2. She suffered from delayed speech development and did not begin to speak until the age of 4. Temple’s mother defied the doctors and kept her out of institutions. Temple was given speech therapy as well as an intensive education. Her high school science teacher and her aunt on a ranch in Arizona inspired Temple to continue her studies and pursue a career as a scientist and livestock equipment designer.She graduated from Hampshire Country School (a boarding school for gifted children) in Ridge, New Hampshire in 1966, and earned a bachelor’s degree in psychology from Franklin Pierce College in 1970. In 1975, she received a master’s degree in animal science from Arizona State University and then a doctoral degree in animal science from the University of Illinois in 1989. She is currently a professor at Colorado State University. Dr. Grandin is one of the world’s leaders in the design of livestock handling facilities. She has done extensive work in design of handling facilities for animals and has developed animal welfare guidelines for the meat industries. Dr. Grandin is a past member of the board of directors of the Autism Society of America. She lectures to parents and teachers throughout the U.S. on her experiences with autism. She makes the case that the world needs people on the autism spectrum: visual thinkers, pattern thinkers and verbal thinkers. Some of Temple Grandin’s books include: Animals Make Us Human, Animals in Translation, The Way I See It, The Autistic Brain, and Different…Not Less. In 2010, a movie entitled “Temple Grandin” starring Clare Danes was released. The movie was based on Grandin’s own writings. Temple Grandin is an expert on animal behavior, a bestselling author, and an autism activist. In 2010, she was listed in the “Heroes” category in the “Time” list of the world’s 100 most influential people. She has received numerous awards including an honorary doctorate from McGill, the University of Illinois and Duke University. Cette étude a été réalisée dans le cadre d’une maîtrise en Aménagement. Elle s’efforce à démontrer que l’étape d’un projet que l’on appelle problématisation, c’est-à-dire l’étape de construction des problèmes à être résolus, permet de s’assurer que les actions entreprises soient en cohérence et en pertinence avec le contexte du projet. Nous constatons désormais que nous ne pouvons plus nous contenter d’évaluer les projets sur la seule base de son efficience, c’est-à-dire la concordance de ses résultats avec les objectifs prévus. Dans ces circonstances, nous émettons l’hypothèse que la problématisation fait appel à des compétences particulières et généralement peu utilisées par rapport à d’autres étapes de la réalisation d’un projet. À cet égard, nous avons réalisé un travail de recherche exploratoire sur ce thème en ayant comme objectif d’obtenir une compréhension des compétences mobilisées lors de la problématisation en situation de projet en général et d’identifier plus spécifiquement ces compétences dans une situation de projet en particulier, celle des projets de coopération internationale. Pour y arriver, nous avons procédé à la construction d’un référentiel d’emploi et d’activités pour en déduire un référentiel de compétences de la problématisation. Pour ce faire, nous avons réalisé une étude de cas sur les projets de stage de coopération internationale. L’utilisation de la technique de l’« instruction au sosie » et d’une rechercheintervention nous ont permis de dégager les principaux résultats suivant: la problématisation fait appel à des compétences particulières de gestion de l’information et de médiation. Les compétences générales de problématisation que les responsables des stages dans les organisations de coopération internationale v doivent maîtriser sont : être capable de générer les disponibilités de projets à partir de données primaires et secondaires; être capable de faire des choix et de justifier ces choix en fonction de l’analyse des données; être capable de présenter des informations écrites claires, respectueuses des idées des partenaires en fonction du langage de projet utilisé par le public auquel s’adresse la proposition; être capable d’utiliser les commentaires des évaluateurs pour améliorer un projet et être capable de mener à terme un projet. La contribution principale de ce travail de recherche réside dans la proposition d’un outil précieux pour le recrutement et la sélection, l’évaluation du rendement, la formation et le perfectionnement des acteurs de la problématisation.
