Passados 29 anos da vigncia da lei 6.404/1976, necessria uma anlise crtica do modelo no-definitivo sobre grupos societrios, principalmente porque se constata que as maiores empresas com atividades no brasil organizam-se na forma de grupos econmicos. O objetivo deste estudo retomar os pressupostos da legislao grupal brasileira, compar-la com as estruturas empresariais nacionais atualmente existentes e, tendo em vista os resultados, indicar primeiras consideraes para se repensar o direito societrio a partir da realidade dos grupos.

Dispensa de licitao como meio para se atingir a proposta mai s vantajosa para a Administrao em face da obrigatoriedade de licitao exigida pelo Tribunal de Contas da Unio.

O trabalho se presta a identificar semelhanas entre o instituto da Repercusso Geral, nos recursos extraordinrios interpostos perante o Supremo Tribunal Federal, e do Recurso Repetitivo, nos recursos especiais interpostos perante o Superior Tribunal de Justia. Com isso, realizada uma tentativa de busca jurisprudencial at o fim de 2009, no obtendo xito na busca dos julgados em Direito Tributrio, para identificar uma possvel contradio entre o entendimento dos fundamentos dos filtros recursais entre as Cortes Superiores. Por fim, h uma anlise crtica sobre as possveis interferncias do julgamento do STJ nos julgamentos do STF, procurando compreender o papel do Supremo, bem como as possveis conseqncias das decises do STF nos contribuintes e suas formas de defesa possveis, caso venha ocorrer a hiptese formulada no trabalho.

O princpio bsico da educao fomentar o desenvolvimento pleno dos indivduos no sentido de se tornarem cidados livres, responsveis e autnomos, capazes de julgarem com esprito crtico e criativo o seu meio social. O presente estudo visou compreender como se pode integrar uma dimenso social e poltica no ensino da matemtica. Pretendeu-se reconhecer que aberturas e impedimentos existiam no sistema educativo portugus a uma educao matemtica crtica (EMC), que mudanas ocorriam na forma de os alunos fazerem matemtica e, ainda, se estes valorizavam ou estavam preparados para este tipo de atividades. O estudo foi do tipo qualitativo e tomou como mtodo a observao participante. Recorreu-se a um conjunto de notcias acerca do preo dos combustveis, de forma a possibilitar anlises crticas desta temtica, por parte dos alunos, ligadas a um conjunto de competncias transversais e de contedos especficos do programa da disciplina de matemtica. Foi observado que, para realizarem a anlise crtica das situaes, os alunos tomaram por referncia duas dimenses, a da matemtica e/ou a do seu senso comum. Mostraram interesse e motivao no estudo do modelo dos preos dos combustveis e valorizaram o papel da matemtica na compreenso/anlise desse modelo. Os resultados sugeriram que, para alm do conhecimento matemtico e do senso comum dos alunos, a capacidade crtica assume-se como um fator relevante na profundidade da anlise produzida. Os alunos reconheceram o papel potenciador da EMC na compreenso e aprendizagem de conceitos matemticos, o que, por sua vez, torna as aprendizagens mais significativas.

A educao uma prxis social presente em diferentes lugares e instantes da vida em sociedade. A Educao Matemtica pretende contribuir para o total desenvolvimento de conhecimentos e de competncias nos indivduos de forma a torn-los cidados crticos, responsveis e autnomos, capazes de participarem livre e ativamente na sociedade. Este estudo teve por objetivo compreender como que a Educao Matemtica Crtica contribui para formar alunos participativos, crticos e responsveis, capazes de analisar, perceber e desmistificar algumas situaes do nosso quotidiano, por exemplo promoes e publicidades, presentes na nossa sociedade. Sendo este problema definido de forma global, surge a necessidade de o fracionar em duas questes: 1) como pode a Educao Matemtica Crtica contribuir para o empowerment1 dos alunos com a matemtica?; 2) como pode a Educao Matemtica Crtica contribuir para que os alunos desenvolvam competncias matemticas e sociais que lhes permita analisar, perceber e desmistificar situaes do dia a dia? 1 A noo de empowerment est discutida no captulo II deste trabalho. Para analisar/discutir estas questes, escolheu-se uma metodologia de investigao de natureza qualitativa, em que a principal agente de recolha de dados foi a investigadora e que a mesma foi feita no ambiente natural de sala de aula. Adotou-se, ainda como mtodo, a observao participante. importante referir que os documentos de anlise so constitudos pelos trabalhos escritos dos alunos, onde importou mais o processo que propriamente o resultado final. A tarefa apresentada aos alunos teve por base um panfleto publicitrio sobre promoes de uma rede de hipermercados, de maneira a promover uma anlise crtica, por parte dos alunos, desta situao aliada a vrias competncias transversais e de contedos como a proporcionalidade direta: percentagens e regra de trs simples, prprios do programa da disciplina de matemtica. Da observao feita, verificou-se que os alunos, ao analisarem criticamente a situao proposta, enveredaram por duas perspetivas: numa primeira fase sobre o que dizia o seu entendimento (senso comum) e, aps debate em grande grupo, tendo em conta a matemtica. Os resultados do estudo mostraram que possvel desenvolver uma prtica pedaggica que valorize os aspetos da Educao Matemtica Crtica, isto , permite iv aprofundar os saberes matemticos e ampliar o esprito crtico nos alunos permitindo-lhes participar livre e ativamente na sociedade de que fazem parte.

Objetiva-se analisar a prtica do enfermeiro em sala de vacina, mediante o modelo de vigilncia sade como referncia. Trata-se da anlise crtica reflexiva realizada atravs de observao, durante as prticas como docentes, em Unidades Bsicas de Sade. Percebeu-se que o enfermeiro responsvel pela sala de vacinao desenvolve pouca atividade fixa especfica, indo sala para resolver algumas dificuldades ou na ausncia de funcionrios. O perfil epidemiolgico e o modelo de vigilncia sade so pouco usados, sinalizado pelo comportamento indiferente dos usurios. As atividades de vacinao devem ser desenvolvidas por uma equipe de enfermagem com participao do enfermeiro, a fim de oferecer um servio de qualidade e atender a demanda individual e coletiva

submeter a teoria do dficit de autocuidado de Orem a uma reflexo crtica. Metodologia: estudo terico sobre os aspectos Importncia e Aplicabilidade contidos no Modelo de Anlise Crtica de Chinn e Kramer para anlise crtica da teoria do dficit de autocuidado. Desenvolvido no perodo de outubro a dezembro de 2008. Resultados: o posicionamento da teoria do dficit de autocuidado est essencialmente relacionado filosofia da enfermagem e demonstra potencial para influenciar aes de enfermagem, em especial relativas educao para o autocuidado em pacientes portadores de cardiopatia isqumica. Concluses: a enfermagem, mediante a teoria do dficit de autocuidado, pode oferecer condies mais saudveis e de maior autonomia ao indivduo portador de cardiopatia isqumica

The research Ceclia Meireles and the Pedagogical Lyric in Children My Love (1924) consists in a critical analysis, a cultural and historical approach to the pedagogical intentionalities and to the social and educational functionalities expressed in the childish literary work of the poetess and educator Ceclia Meireles (1901-1964), in Brazil, during the first decades of XX century. The author s conceptions of the literary art, the philosophical and educational foundations, the Christian and liberal ideologies and values pertinent to her work for children and the relations between her texts and the ideals of the Brazilian intellectuals to effect changes in the every day life based on the child formation and on the teaching feminization process were examined in the work. This paper shows a content analysis with the intention of offering signification to the work Children My Love (1924) according to the investigation of specific categories: child, motherhood and schooling; through the exploration of synonymous and bipolar key-words found in Ceclia s documents: child/adult, teacher/mother; school/home, ignorance/intelligence. The research intends to understand how the author articulates, in her informal pedagogical action in Children s Literature, science, literary and Christian faith knowledge, in order to expand her social and educational ideal concentrated in children, guided by the maternal hand and aimed at constructing a New Man, New Civilization and a New Social Order

This study deals with Sociology teacher identity issues. This is done considering daily routines of Sociology grade school teachers in the city of Picos in the state of Piau-Brazil. Thus, the research aims to acknowledge the manner the inter-relations between the teacher s know-how and the process of construction of the professional identity of these teachers occur. It is seen that the discipline of Sociology in this context brings out processes related to inclusion and exclusion once the subject of Sociology is distinguished as unstable in relation to other disciplines. However, in June 2008, the law included the Sociology as a discipline 11,684 mandatory on all high school series.The theoretical and methodological procedures of this research were based on an ethnographic qualitative nature research and enabled a documental analysis. In order to collect data, a semi-structured questionnaire was applied in collective and individual in four state schools in the city of Picos in Piau. The analysis of the information was based in content analysis from the proposals made by Bardin (1997), and Franco (2008). The information was then organized in knowledge matrixes that allowed the identification of themes divided into two thematic axes: teacher education: the search for sense making in experience and the exercise of teaching as well as the Sociology grade school teacher s daily routine. The research enables the understanding of the senses the subjects have on their own activity since the work deals with concrete situations and experiences in the scholar context. These senses are considered relevant in order to enable a comprehension of the inter-relations that are established between the know-how and the construction of the identity on behalf of these teachers. Almost all of the interviewed subjects did not have a degree in Social Sciences and came from other backgrounds especially ones related to Education. Sociology teachers investigated almost in its entirety, do not have specific training in the social sciences, becoming teachers of Sociology by lack of school and to complete the work load. But, in spite of the difficulties experienced in the practice of the discipline all are in favour of its inclusion in high school. They have a clear vision, that through the work of the theoretical content of the discipline with the daily life of the students by using teaching strategies that add value to the relationship of knowledge that are prepared in society at large, to Sociology provides a critical analysis of the reality in which they are inserted

This study examines the determinations of the structural crisis of capital in the democratic control effected on the councils of rights and policies. Therefore the research aimed to apprehend and analyze the conjunctural and structural determinations and cyclical changes that incide on democratic control established by the Federal Constitution of 1988. The specific objectives turned to: (1) identify and analyze the theoretical and political fundamentals of democratic control in the production of social service in ENPESS 2010, in the productions of CFESS and the journal social services and society, (2) apprehend and analyze the possibilities, limits, contradictions and social direction of democratic control in contemporaneity and (3) identify and analyze the major political forces that constitute support and opposition to the exercise of democratic control. To approximate to the intended objectives the way theoretical and methodological covered was based in a perspective of totality that allows the apprehension of the object of study in their contradictory dimensions of universality, particularity and singularity. The results enabled to develop critical analysis of theoretical production of the Brazilian social service on the subject, having as snip studies of the journals social service and society; works of ENPESS 2010 and CFESS positioning. It was found, so in analysis undertaken, the spaces of democratic control suffer inflections of capital that shape their practices and social direction. In theoretical productions chosen, identified the prevalence of democratic control studied under an endogenous perspective to participatory canals, with incipient connections to the structural/conjunctural determinations of a historical period of crisis and seeks to restore the hegemony of capital. The positioning of the CFESS tends to recognition of democratic control in its contradictory dynamics recognizing the limits imposed by the sociability of the capital at the present time

Mozambique holds a potential for tourism development, especially for nature tourism, due to the existence of conservation areas around the country. The Maputo Special Reserve (MES) is considered as one of the most important conservation area and has benefited from investment in order to incruse the development of tourism in the region. Currently the number of visitors to MES has grown substantially with the intention to develop recreational activities related to ecotourism. Now the challenge lies in the way of optimizing opportunities for tourism development in order to achieve economic benefitis reduction the lead to poverty, without degrading the environment. Ecotourism face the demands and environmental discussions has been assumed as an alternative to the tourist market focused on protected areas, as it is believed that this segment is able to reconcile tourism development and simultaneously improve the conservation of the natural environment and still ensure the recovery of local communities and promoting their welfare. This study aims to analyze, from the perception of the local community, social and environmental contribution of ecotourism in Maputo Special Reserve, Mozambique. The research sought to investigate the relationship between ecotourism development in the region and generate benefits for the socio-environmental communities for residents. To achieve the objective, was chosen a critical analysis about the generation of socio-environmental benefits versus ecotourism in which we opted for a qualitative and quantitative approach seeking to establish the degree of agreement and disagreement about the benefits generated by ecotourism through interviews with community members

Este trabalho analisa um conjunto de notcias publicadas pelo The New York Times , verso on-line, que aborda a presena do presidente do Brasil, Luiz Incio Lula da Silva, no Frum Social Mundial em Porto Alegre, Brasil, e no Frum Econmico Mundial em Davos, Sua, em janeiro de 2003. Baseando-se no referencial terico-metodolgico da Anlise Crtica do Discurso - Bell e Garrett (1998), Fairclough (1995 e 2001) e Fowler (1991) -, investigam-se as estratgias discursivas utilizadas pelo jornal para referir-se ao presidente brasileiro participando de dois eventos de repercusso internacional, que representam plos ideolgicos opostos.

Among planning instruments used by manager instances of Brazilian Health System it pointed the Health Municipal Plan (PMS) that should be built collectively showing political intentions, directresses, priorities, objectives, goals framework, estimative of resources and need costs to get the goals of the health sector. The aim of this work was to analyze the plans in relation to attendance of legal requirements which manage the Brazilian Health System, its constitution and showing of essential items. The study included three municipalities form So Paulo State. It was used the documental analysis as research technique. Near all plans showed an analysis of situation with detailed descriptions of general situation of municipality, and only one of them realized critical analysis of their epidemiological data; the financial income applied on health was decrypted by only one municipality. About programming, all municipalities described the main problems and its solutions. Although they had goals framework, the question about cost estimative to get the goals was not approached. Any municipality showed an annual review, being one of them delayed over than two years. It was observed no participation of Municipal Health Council on elaboration and review of plans. It was concluded that there was a deficiency in the plans analyzed. It's necessary to execute continuing education with managers in relation to importance of systematic elaboration of plans and to incentive the promotion of active participation of Municipal Health Council promotion of aiming to became true the social control of health actions.
