Un kleptomane, pris d’impulsions irrésistibles, peut-il être responsable pénalement de ses actes ? Voilà la question à l’origine de cette recherche. Les troubles du contrôle des impulsions sont des troubles mentaux caractérisés par l’impossibilité de résister à une impulsion. Comment peut-on concilier ceux-ci avec le droit pénal canadien sachant que la responsabilité criminelle repose sur le postulat voulant que seul un acte volontaire justifie une déclaration de culpabilité ? Afin d’avoir une étude exhaustive sur le sujet, nous avons choisi trois troubles du contrôle des impulsions, soit la kleptomanie, la pyromanie et le jeu pathologique. Cette sélection permet d’étudier à la fois l’imputabilité criminelle et l’imposition d’une sentence en droit pénal canadien. Cette étude propose un retour aux principes fondamentaux de la responsabilité criminelle et l’analyse du droit pénal canadien afin de démontrer que certains troubles du contrôle des impulsions (kleptomanie et pyromanie) entraînent chez le sujet atteint une incapacité criminelle, le rendant non criminellement responsable au sens de l’article 16 du Code criminel. Au surplus, cette recherche porte sur les principes entourant l’imposition d’une sentence en droit pénal canadien et étudie l’impact de ces maladies mentales au point de vue de la peine. Cette analyse démontre que les caractéristiques diagnostiques des troubles du contrôle des impulsions sont utilisées afin d’alourdir la peine imposée aux contrevenants. Nous considérons que celles-ci ne devraient pas être employées comme facteurs aggravants (particulièrement en matière de jeu pathologique), mais devraient plutôt être utilisées afin d’imposer une peine plus appropriée pour remédier à la problématique entraînant la commission des délits.

El Derecho Penal Internacional es una rama bastante reciente del Derecho Internacional Público. En ese orden de ideas, el Derecho Penal Internacional le debe mucho a otras especialidades del Derecho Internacional, como lo son el Derecho de los Derechos Humanos y el Derecho Internacional Humanitario, puesto que si bien estas dos especialidades pueden y deben separarse del Derecho Penal Internacional, ciertos crímenes involucran tanto infracciones a las normas de DIH como a las de Derechos Humanos. En consecuencia, han dotado al Derecho Penal Internacional de parte de su contenido y por tanto podríamos considerarlas –guardadas las proporciones- como ancestros evolutivos de la especialidad, materia de esta monografía.

In Colombia, the definitions of crimes are found in the special part of the Criminal Code. They are set out as though the only way of to commit them was by being the author of the punishable conduct there described. Nevertheless, in the general part of the Criminal Code, we find other forms of criminal responsibility for the conduct described in the special part. Complicity is one of those ways. Although complicity is established in the Criminal Code, it does not appear as a criminal definition and, as such it is ignored or, worse, applied incorrectly. For those reasons, this article tries to reflect upon the validity of complicity. Accordingly, this article analyzes: what is complicity, what is the difference between complicity and co-authorship and how would complicity work in some practical cases related to socio-economic crimes, in which it has being overlooked or, has been used incorrectly. The article concludes that complicity is still valid, and that the correct application of complicity materializes the ideal of justice.

La presente investigación diagnóstica busca analizar el papel de las sanciones implementadas por el Sistema de Responsabilidad Penal para Adolescentes (SRPA) a la luz de la justicia restaurativa. A partir de la revisión bibliográfica sobre justicia restaurativa y su relación con la justicia juvenil, lo establecido en el Código de Infancia y Adolescencia (ley 1098 de 2006) y el CONPES 3629 que plantea las disposiciones de política del Sistema de Responsabilidad Penal para Adolescentes, y finalmente, del trabajo de campo realizado con adolescentes privados de la libertad, más una entrevista realizada a un experto, se describe y explica que tanto las sanciones se acercan al paradigma de la justicia restaurativa, la cual se fija en dicho código como una de las finalidades del sistema alternativo para adolescentes. Finalmente, se hacen algunas recomendaciones para la solución de las fallas encontradas en este aspecto del SRPA.

O debate a respeito da maioridade penal no Congresso Nacional vai além da discussão da Proposta de Emenda Constitucional nº 171 de 1993, uma vez que a conjuntura social e política, somada ao contexto deliberativo da proposta na Câmara dos Deputados, reacendeu o diálogo na sociedade. Diante disso, realiza-se um mapeamento da discussão da maioridade penal para se saber a extensão da disputa no Congresso Nacional. Para tanto, foram coletados dados e informações disponibilizados pela Câmara dos Deputados e pelo Senado Federal, identificando-se as propostas de emenda constitucional e os projetos de lei que abordam a questão da diminuição da idade mínima para a responsabilização penal. Ademais, a partir dessa seleção de propostas e projetos legislativos foi possível identificar aspectos pertinentes acerca do debate, como o posicionamento dos parlamentares e dos partidos políticos, os argumentos trazidos por ambas as partes da discussão e os interesses que poderão ser atingidos pela redução da idade penal. Além disso, é feito um breve estudo relativo ao Estatuto da Criança e do Adolescente e à contextualização da criminalidade juvenil no Brasil, visando facilitar o dimensionamento da discussão que se desenvolve no Congresso a respeito da inimputabilidade penal das crianças e dos adolescentes garantidos pela Constituição Federal e pelo Estatuto da Criança e do Adolescente. Questões importantes, como a Doutrina da Proteção Integral e os fatores que explicam a criminalidade juvenil, são abrangidos para dar suporte ao mapeamento e à coerência do presente trabalho.

The environment, which fundamental importance has already been recognized in all the world, is an actual national and international discussion subject, whose interest grows for the society, and consequently to the Law, in order to prevent the natural resources to the present and future generations. The 1988 Brazilian Constitution, recognizing the importance of the environment, treated about it in many of its parts, even dedicating a specific chapter (Chapter V About Environment, inserted in Title VIII About Social Order). The brazilian constitutional text established to everyone the fundamental right of enjoying an equilibrated environment, obligating the State and all society to defend and preserve the environment to the present and future generations. The economic growing process, that predominated and still persist in the big majority of the countries, where is practiced the capitalist system, has in the enterprises (legal persons) one of its main actors. Many times, these enterprises, especially in the actual globalized world in where we live, where the gain of money is priorized, ends, at the moment they act, making damages to the environment. These damages are, many times, considered by the law. crimes against the environment. The 1988 Brazilian Constitution, according to the Modern Criminal Law, realizing that many crimes were being committed by the enterprises, established in article 225, §3rd, the criminal responsibility of the legal persons. Almost ten years after the 1988 Brazilian Constitution, was published the Law number 9.605/98, in which third article established the penal responsibility of the legal persons that practice crimes against the environment, without excluding the individual responsibility

The criminal responsibility of the media is analyzed when the criteria for production of news and events involving public safety are produced without considering the technical, legal and ethical practice of journalism in the media factors. Freedom of speech, expression of thought, necessary for professional qualifications and constitutional limits, reaching criminal constitutional principles and the possibilities of criminal liability for offenses practiced in the media are present as key factors legal dialogue in this work. The judgment of the Supreme Court on the unconstitutionality of Law nº. 5.250/67 called Media Law caused a gap in the national legal system, forcing the use of the criminal code to address issues that involve crimes produced in media professional performance. The presumption of innocence is ignored by the professional media during a police investigation where the information published does not respect, including constitutional guarantees: the right to privacy, honor and image. The right to information and the duty to inform media are worked in its constitutional aspect, considering that the same information should be produced is guided by the quality and guiding principles of truth. The constitutional concept of media is presented as information with the appropriate language of the news media, produced and disseminated through the vehicles of mass media, whether in print or digital platform. The presented model of the legal right to information is outlined from a constitutional hermeneutics, increasing the production of news as a result of the occupation of journalist in different news platforms, guaranteeing the quality of this prolific law. Under the Freedom of professional activity of the journalist, the constitutional limits are addressed in line with the reality of (non) regulation of their profession, considering the constitutional abuses committed in the exercise of that activity linked to communication fences. Jusphilosophic field reaches the limits of the duty of truth in journalism as a tool for spreading news, respect the audience and compatibility with the constitutional state. Using the conceptual and doctrinal aspects, this criminal offense is parsed from the journalistic practice and the publication of news involving public safety, with the hypothetical field consummation of that crime through the eventual intention. As a form of judgment against these crimes produced in honor media presents the court of the jury as a legitimate form of democratic decision

The neoconstitutionalism led to a process of ethical revaluation of the normative systems and the process of constitutionalization of the many fields of law. This study examines the consequences of this process in criminal law, so important a Law field for the protection of the most valuable assets by the society, including the fundamental guarantees, thus emphasizing the necessity of protection of the collective and individual rights, which are guided by the observance of the defendants individual rights in the course of criminal proceedings and the search for the best efficiency of penal protection, according to the corollaries of defense against the state (prohibition of the excess or Übermassverbot) and the provision of rights by the state (prohibition of insufficient protection or Untermassverbot). The offense of fuel adulteration is taken as an object of study, since it is a vital market to a nation dependent of people and good s movement for their living, driven by fossil and biofuels. Such a crime affects essential legal interests to the development of society, interests such as the environment, consumer relations and economic order, particularly the principle of free competition. This paper seeks to analyze the need of a greater efficiency of this particular criminal protection, once concluded the conduct harm and social fear as a consequence by it as growing, and therefore having its former crime type, engraved in Article 1 of Law No. 8.176/1991, rewritten in compliance with the criminal law s principle of legality. Thus, the reformation proposals and legislative creation involving this crime were observed, with emphasis on the bill No. 2498/2003, which keeps it as blank heterogeneous criminal norm, kind of penal normative whose constitutionality is raised, including the forethought of criminal responsibility in the perpetrating of the offense as culpable and subsequently increasing the applicable minimum penalty, as well as the inclusion of new activities in the typical nucleus

O branqueamento de vantagens – como por exemplo capitais -, é um crime que pode atingir um carácter mundial. Também o financiamento do terrorismo surge aqui com um papel importante. É muito importante punir a ilicitude do crime de branqueamento. Mas mais importante ainda é a prevenção do branqueamento de capitais. Neste sentido, o dever de formação é fundamental. E é um dever fundamental que é importante sobretudo no contexto de determinadas entidades. El presente trabajo de investigación tiene como objetivo analizar el papel del Centro Forjar Ciudad Bolívar en la reincidencia de actos delictivos de los adolescentes infractores, basado en la teoría de la justicia restaurativa que se busca generar desde el Sistema de Responsabilidad Penal para Adolescentes en Colombia. De esta manera, se pretende demostrar que, al ser una política pública para generar una justicia restaurativa, su implementación ha sido fundamental dentro de la localidad, para generar un proceso de reinserción social y acompañamiento para evitar la reincidencia de actos delictivos de estos adolescentes. Para lograr este objetivo se utilizará un análisis metodológico cualitativo, basándose en estudios de las fuentes primarias, trabajo de campo a partir de entrevistas realizadas en el Centro Forjar de Ciudad Bolívar, para entender el impacto de la política pública en la localidad.

Currently, Portugal assumes itself as a democratic rule of substantive law State, sustained by a legal system seeking the right balance between the guarantee of fundamental rights and freedoms constitutional foreseen in Portugal’s Fundamental Law and criminal persecution. The architecture of the penal code lies with, roughly speaking, a accusatory basic structure, “deliberately attached to one of the most remarkable achievements of the civilizational democratic progress, and by obedience to the constitutional commandment”, in balance with the official investigation principle, valid both for the purpose of prosecution and trial. Regarding the principle of non self-incrimination - nemo tenetur se ipsum accusare, briefly defined as the defendant’s right of not being obliged to contribute to the self-incrimination, it should be stressed that there isn’t an explicit consecration in the Portuguese Constitution, being commonly accepted in an implicit constitutional prediction and deriving from other constitutional rights and principles, first and foremost, the meaning and scope of the concept of democratic rule of Law State, embedded in the Fundamental Law, and in the guidelines of the constitutional principles of human person dignity, freedom of action and the presumption of innocence. In any case, about the (in) applicability of the principle of the prohibition of self-incrimination to the Criminal Police Bodies in the trial hearing in Court, and sharing an idea of Guedes Valente, the truth is that the exercise of criminal action must tread a transparent path and non-compliant with methods to obtain evidence that violate the law, the public order or in violation of democratic principles and loyalty (Guedes Valente, 2013, p. 484). Within the framework of the penal process relating to the trial, which is assumed as the true phase of the process, the witness represents a relevant figure for the administration of criminal justice, for the testimonial proof is, in the idea of Othmar Jauernig, the worst proof of evidence, but also being the most frequent (Jauernig, 1998, p. 289). As coadjutant of the Public Prosecutor and, in specific cases, the investigating judge, the Criminal Police Bodies are invested with high responsibility, being "the arms and eyes of Judicial Authorities in pursuing the criminal investigation..." which has as ultimate goal the fulfillment of the Law pursuing the defense of society" (Guedes Valente, 2013, p. 485). It is in this context and as a witness that, throughout operational career, the Criminal Police Bodies are required to be at the trial hearing and clarify the Court with its view about the facts relating to occurrences of criminal context, thus contributing very significantly and, in some cases, decisively for the proper administration of the portuguese criminal justice. With regards to the intervention of Criminal Police Bodies in the trial hearing in Court, it’s important that they pay attention to a set of standards concerning the preparation of the testimony, the very provision of the testimony and, also, to its conclusion. Be emphasized that these guidelines may become crucial for the quality of the police testimony at the trial hearing, thus leading to an improvement of the enforcement of justice system. In this vein, while preparing the testimony, the Criminal Police Bodies must present itself in court with proper clothing, to read before and carefully the case files, to debate the facts being judged with other Criminal Police Bodies and prepare potential questions. Later, while giving his testimony during the trial, the Criminal Police Bodies must, summing up, to take the oath in a convincing manner, to feel comfortable, to start well by convincingly answering the first question, keep an attitude of serenity, to adopt an attitude of collaboration, to avoid the reading of documents, to demonstrate deference and seriousness before the judicial operators, to use simple and objective language, to adopt a fluent speech, to use nonverbal language correctly, to avoid spontaneity responding only to what is asked, to report only the truth, to avoid hesitations and contradictions, to be impartial and to maintain eye contact with the judge. Finally, at the conclusion of the testimony, the Criminal Police Bodies should rise in a smooth manner, avoiding to show relief, resentment or satisfaction, leaving a credible and professional image and, without much formality, requesting the judge permission to leave the courtroom. As final note, it’s important to stress that "The intervention of the Police Criminal Bodies in the trial hearing in Court” encloses itself on a theme of crucial importance not only for members of the Police and Security Forces, who must welcome this subject with the utmost seriousness and professionalism, but also for the proper administration of the criminal justice system in Portugal.
