Le présent travail s’interroge quant au niveau de protection offert par la structure actuelle du droit international à l’ensemble de la population LGBT en vertu des normes juridiques de non-discrimination. Il questionne par le fait même la nécessité de créer une convention internationale spécifique contre la discrimination faite en fonction de l’orientation sexuelle au sein du système onusien des droits de la personne. Afin de le déterminer, une analyse bipartite est proposée. L’évolution de la notion d’orientation sexuelle au sein du droit international de 1975 à aujourd’hui expose dans un premier temps l’applicabilité de la norme de non-discrimination à l’ensemble de la population, et ce, malgré la polarisation de la communauté internationale sur la question. Par la suite, la jurisprudence du Comité des droits de l’homme en matière d’orientation sexuelle illustre la mise sur pied d’un régime de protection des minorités sexuelles modulé par les tractations politiques présentes sur la scène internationale. Ce mémoire conclut que la protection de la population LGBT ne nécessite pas la création une convention internationale contre la discrimination faite en fonction de l’orientation sexuelle, mais plutôt l’imposition d’une garantie universellement applicable de la norme juridique de non-discrimination à tous les droits fondamentaux reconnus par le système des traités des Nations Unies.

By the turn of the twenty-first century, UNDP had embraced a new form of funding based on ‘cost-sharing’, with this source accounting for 51 per cent of the organisation’s total expenditure worldwide in 2000. Unlike the traditional donor - recipient relationship so common with development projects, the new cost-sharing modality has created a situation whereby UNDP local offices become ‘subcontractors’ and agencies of the recipient countries become ‘clients’. This paper explores this transition in the context of Brazil, focusing on how the new modality may have compromised UNDP’s ability to promote Sustainable Human Development, as established in its mandate. The great enthusiasm for this modality within the UN system and its potential application to other developing countries increase the importance of a systematic assessment of its impact and developmental consequences.

Objective: Transnational food, beverage and restaurant companies, and their corporate foundations, may be potential collaborators to help address complex public health nutrition challenges. While UN system guidelines are available for private-sector engagement, non-governmental organizations (NGO) have limited guidelines to navigate diverse opportunities and challenges presented by partnering with these companies through public–private partnerships (PPP) to address the global double burden of malnutrition.

Design: We conducted a search of electronic databases, UN system websites and grey literature to identify resources about partnerships used to address the global double burden of malnutrition. A narrative summary provides a synthesis of the interdisciplinary literature identified.

Results: We describe partnership opportunities, benefits and challenges; and tools and approaches to help NGO engage with the private sector to address global public health nutrition challenges. PPP benefits include: raising the visibility of nutrition and health on policy agendas; mobilizing funds and advocating for research; strengthening food-system processes and delivery systems; facilitating technology transfer; and expanding access to medications, vaccines, healthy food and beverage products, and nutrition assistance during humanitarian crises. PPP challenges include: balancing private commercial interests with public health interests; managing conflicts of interest; ensuring that co-branded activities support healthy products and healthy eating environments; complying with ethical codes of conduct; assessing partnership compatibility; and evaluating partnership outcomes.

Conclusions: NGO should adopt a systematic and transparent approach using available tools and processes to maximize benefits and minimize risks of partnering with transnational food, beverage and restaurant companies to effectively target the global double burden of malnutrition.
