Child labour has a gender bias related to the dominant stereotypes regarding gender roles. While out-of-home paid work is carried out predominantly by boys, girls bear the greater burden in unpaid domestic tasks, whether in their own homes or the homes of others. Boys are more exposed to the risks of being out on the street and find it more difficult to combine work and education. For girls it may be easier to reconcile the spheres of work and education, but they suffer costs that remain hidden and that reinforce their disadvantages throughout the life cycle. On the one hand, they are marked by the assumption that the burden of the care economy is entirely their responsibility, which determines future labour prospects. Indeed, even when girls show greater educational achievement, their occupational options are more limited. On the other hand, girls are exposed to risk within the household, where overexploitation, maltreatment and abuse are as frequent as they are unpunished.

Cette thèse porte sur le recours à des mesures restrictives du commerce par le Canada comme moyen de lutte contre le travail dangereux des enfants, dans un contexte de mise en œuvre de la responsabilité internationale d’un État en cas de non respect de la Convention de l’Organisation internationale du travail nº 182 sur les pires formes de travail des enfants. Bien que la capacité d’imposer des telles mesures se rapportant à des situations de travail dangereux des enfants soit analysée, essentiellement, du point de vue du droit de l’Organisation internationale du commerce (OMC), cette étude reste circonscrite à l’application de la Convention OIT 182. De plus, cette thèse veut fournir une analyse prospective de nature spéculative portant sur l’opportunité de recourir à de telles mesures en discutant de leurs éventuelles conséquences sur les enfants qu’on vise à protéger par ce moyen. La première partie de la thèse s’intéresse à la légalité d’éventuelles sanctions commerciales imposées par le Canada afin d’amener un pays membre de l’OMC dont il importe des produits à respecter la Convention OIT 182. La légalité de ces sanctions est abordée tant du point de vue du régime général du GATT que de celui des exceptions générales. Du point de vue du régime général, l’analyse porte notamment sur l’article III de cet accord relatif au principe du traitement national. Une fois constatée leur illicéité à l’égard de l’article III du GATT, seul l’article XX de cet accord peut être invoqué pour permettre le recours à ces mesures. Nous nous attardons plus particulièrement aux exceptions de l’article XX relatives à la protection de la moralité publique et à celle de la protection de la vie et de la santé humaine. La thèse aborde les conditions auxquelles est assujetti le recours aux exceptions de l’article XX retenues comme pertinentes, notamment celles de la « nécessité » des mesures et du respect des compétences étatiques. En outre, cette étude analyse les conditions d’application des mesures restrictives du commerce découlant du préambule de l’article XX. En ce qui concerne l’exception relative à la moralité publique, cette notion est discutée dans un contexte national spécifique, soit celui du Canada. La seconde partie de la thèse s’intéresse à l’opportunité de recourir à des mesures commerciales restrictives et leurs conséquences éventuelles sur les enfants dont la protection est recherchée. La démarche, qui est éminemment prospective, prend la forme d’une étude de cas portant sur un secteur productif qui n’a jamais connu dans les faits des sanctions commerciales, soit la production floricole en Équateur. Il s’agit d’un secteur caractérisé par la présence d’enfants en situation de travail dangereux impliqués dans la production de biens destinés à l’exportation. Notre recherche est de type exploratoire. De ce fait, elle ne vise pas à formuler des conclusions fermes quant aux effets des sanctions, mais plutôt à déceler les effets potentiellement bénéfiques ou nuisibles que les mesures restrictives du commerce pourraient avoir sur les enfants exploités, ainsi qu’à évaluer la contribution des sanctions commerciales à la solution du problème.

BACKGROUND: The care and protection of the estimated 143,000,000 orphaned and abandoned children (OAC) worldwide is of great importance to global policy makers and child service providers in low and middle income countries (LMICs), yet little is known about rates of child labour among OAC, what child and caregiver characteristics predict child engagement in work and labour, or when such work infers with schooling. This study examines rates and correlates of child labour among OAC and associations of child labour with schooling in a cohort of OAC in 5 LMICs. METHODS: The Positive Outcomes for Orphans (POFO) study employed a two-stage random sampling survey methodology to identify 1480 single and double orphans and children abandoned by both parents ages 6-12 living in family settings in five LMICs: Cambodia, Ethiopia, India, Kenya, and Tanzania. Regression models examined child and caregiver associations with: any work versus no work; and with working <21, 21-27, and 28+ hours during the past week, and child labour (UNICEF definition). RESULTS: The majority of OAC (60.7%) engaged in work during the past week, and of those who worked, 17.8% (10.5% of the total sample) worked 28 or more hours. More than one-fifth (21.9%; 13% of the total sample) met UNICEF's child labour definition. Female OAC and those in good health had increased odds of working. OAC living in rural areas, lower household wealth and caregivers not earning an income were associated with increased child labour. Child labour, but not working fewer than 28 hours per week, was associated with decreased school attendance. CONCLUSIONS: One in seven OAC in this study were reported to be engaged in child labour. Policy makers and social service providers need to pay close attention to the demands being placed on female OAC, particularly in rural areas and poor households with limited income sources. Programs to promote OAC school attendance may need to focus on the needs of families as well as the OAC.

Attitudes, knowledge, and perceptions of an individual influence their behavior as well as culture of a society. The objective of the study was to understand the attitudes and knowledge of 584 Indian community members regarding child rights and their perceptions about whether selected child rights were secured in reality. Overall attitudes of vast majority (96 – 98%) of the participants towards child rights were found to be positive i.e., children should have rights in various respects except issue like right to meet others (Article 15 of CRC). Knowledge of majority of the participants about child rights related legislations was moderate and varied across the cities while participants were unanimous about poor lived experiences of child rights in reality. So far as attitude and perception are concerned about child rights, there was a significant difference in the distribution between cities (p<0.01). Overall, the Rights of Children to Free and Compulsory Education Act, 2009 had the highest awareness (91.3%, n=533), followed by the Child Labour (Prohibition and Regulation) Act, 1986 (89.7%, n=523) and the Prohibition of Child Marriage Act, 2006 (89.6%, n=523). Findings of the present study speak in favor of community awareness about child rights and penalties for violation of child rights.

Colombia suffers from one of the longest civil conflicts in the world, which is believed to have had several consequences on the country’s economic and development performance. This study uses measures of central government deterrence effort as instruments of conflict to estimate the impact of conflict on children’s time allocation to two different types of work: housework and work performed outside the household for poor families living in small municipalities in Colombia. I find that conflict significantly increases the amount of time children allocate to work. Both housework, for girls, and work outside the household, for boys, increase with Guerrilla attacks. However, the later effect is the opposite for Paramilitary attacks.

This study provides some preliminary insight in relation to the use of social audits by the global clothing and retail companies that source garment products from developing nations. In the era of globalisation, companies based in developed nations have transferred their production locations to many parts of the developing nations. At the same time, there are widespread global stakeholder concerns about the use of child labour, inadequate health and safety standards and poor working conditions at many of these production locations. Social audits appear to be a tool used by companies to monitor working conditions and to ensure that manufacturing takes place in a humane working environment. The study finds that companies use social auditing in order to maintain their legitimacy within the wider community.

Purpose – The purpose of this study is to explore senior managers’ perception and motivations of corporate social and environmental responsibility (CSER) reporting in the context of a developing country, Bangladesh. Design/methodology/approach – In-depth semi-structured interviews were conducted with 25 senior managers of companies listed on the Dhaka Stock Exchange. Publicly available annual reports of these companies were also analysed. Findings – The results indicate that senior managers perceive CSER reporting as a social obligation. The study finds that the managers focus mostly on child labour, human resources/rights, responsible products/services, health education, sports and community engagement activities as part of the social obligations. Interviewees identify a lack of a regulatory framework along with socio-cultural and religious factors as contributing to the low level of disclosures. These findings suggest that CSER reporting is not merely stakeholder-driven, but rather country-specific social and environmental issues play an important role in relation to CSER reporting practices. Research limitations/implications – This paper contributes to engagement-based studies by focussing on CSER reporting practices in developing countries and are useful for academics, practitioners and policymakers in understanding the reasons behind CSER reporting in developing countries. Originality/value – This paper addresses a literature “gap” in the empirical study of CSER reporting in a developing country, such as Bangladesh. This study fills a gap in the existing literature to understand managers’ motivations for CSER reporting in a developing country context. Managerial perceptions on CSER issues are largely unexplored in developing countries.

Resumen: El tema “trabajo infantil” es complejo de abordar debido a la falta de unicidad en su conceptualización y por la heterogeneidad y multiplicidad que lo caracteriza. No obstante, la diversidad de análisis (tanto descriptivos como estadísticos) en diferentes países sobre la cuestión, ha probado el gran avance en el sorteamiento de estas dificultades, como también brindado la base del diseño de planes de erradicación eficientes. Argentina ha sido una excepción a la regla. A pesar de la existencia de reportes e informes provenientes de organismos gubernamentales nacionales e internacionales se encuentra muy poco desarrollada la investigación basada en las herramientas econométricas. Por consiguiente, este análisis busca ampliar los conocimientos sobre el trabajo infantil en Argentina mediante la construcción de un modelo Logit binario que permita así examinar tanto la incidencia de los factores condicionantes más populares de la bibliografía internacional, así como la llamada “paradoja de la riqueza” planteada por Bhalotra y; por último la obtención de conclusiones sobre el impacto de las asistencias sociales en el trabajo infantil.

Cross-cultural variations in conceptions of childhood are discussed, particularly with regard to child abuse and child labour. Regardless of cultural background, a universal minimum standard of child rearing is required. The street child literature is reviewed, culminating in an analysis of Ethiopian street children. Theoretically this work is informed by victimology. Concepts shared by victimology and rational choice perspective are discussed, after Fattah (1993a). Victim surveys are described, highlighting their accuracy of crime estimates. Juvenile prostitution, runaways and rape are examined, particularly with regard to their relevance in Addis Ababa. Fifty five male and 135 female street children were interviewed. Interviews with boys focused on delinquency. An age-related pattern emerged, with younger boys less likely to drink, chew khat, steal or be sexually active. Interviews with street girls focused on the differences between girls living on the streets (girls of the street), girls working on the streets (girls on the street) and a sample of homebased girls. Girls of the street come to the street come to the streets for many reasons. Conflicts with a parent or guardian account for almost 50%. They are highly vulnerable to sexual assaults, particularly those 43% who have worked as prostitutes. Girls on the street experience considerably less victimisation. Urban poor girls live in socio-economic circumstances akin to girls on the street but enjoy almost universal protection from victimisation because they do not spend time on the streets. Unprotected by the stability which a family provides, girls of the street experience high victimisation levels. Such victimisation is often the result of reliance on types of work, such as prostitution, which brings the girls into contact with exploitative adults. Resistance to such victimisation is provided by a secure place to sleep, companions, and relatively safe types of work. Such protective factors are more readily available to family based children as compared to those living independently.

The Bolsa Família Program goal is to promote social development and poverty reduction, through the direct transfer of conditional cash, in association with other social programs. This study aims to analyze whether Bolsa Família had an association with children’s school attendance, which is one of the educational conditions of the program. Our main hypothesis is that children living in households receiving Bolsa Família had greater chances of attending school. Data from the Ministry of Social Development and Combating Famine indicated that children living in households with Bolsa Família had greater school enrolment levels. By using data from the 2010 Demographic Census, collected by the Brazilian Institute of Geography and Statistics (IBGE), some descriptive analyzes and binary logistic regression models were performed for different thresholds of household per capita income. These estimates were made by comparing children who lived in households receiving Bolsa Família to those children not receiving the program. We took into consideration characteristics about the household, mothers, and children. The results were clustered by the municipality of residence of the child. In all income thresholds, children benefi ting from Bolsa Família were more likely to be enrolled in school, compared to children not receiving the benefi t.

Dans cet article nous passons en revue les différentes théories économiques traitant du travail des enfants. Nous distinguons deux analyses différentes du travail des enfants. Une première analyse se référant à la pauvreté, étudie les impacts sur le bien-être du ménage d’une décision parentale de mettre les enfants au travail. De ce fait, la pauvreté est l’unique facteur explicatif du travail des enfants. Dans cette approche, le ménage arbitre entre offrir du loisir aux enfants ou les mettre au travail, en fonction du revenu parental. Dans la deuxième analyse, l’arbitrage ne s’opère plus en terme de loisir et travail mais en terme d’éducation et travail. Selon cette approche, le travail des enfants est facteur non seulement de la pauvreté mais aussi des imperfections du marché des capitaux. La décision parentale de mettre les enfants au travail a un impact sur le bien-être futur de ces enfants. Ces deux analyses montrent que le travail des enfants conduit à une situation de trappe à pauvreté.
