Experience gained from numerous projects conducted by the U.S. Environmental Protection Agency's (EPA) Environmental Monitoring Systems Laboratory in Las Vegas, Nevada has provided insight to functional issues of mapping, monitoring, and modeling of wetland habitats. Three case studies in poster form describe these issues pertinent to managing wetland resources as mandated under Federal laws. A multiphase project was initiated by the EPA Alaska operations office to provide detailed wetland mapping of arctic plant communities in an area under petroleum development pressure. Existing classification systems did not meet EPA needs. Therefore a Habitat Classification System (HCS) derived from aerial photography was compiled. In conjunction with this photointerpretive keys were developed. These products enable EPA personnel to map large inaccessible areas of the arctic coastal plain and evaluate the sensitivity of various wetland habitats relative to petroleum development needs.

O presente trabalho tem por objetivo analisar o julgamento colegiado dos recursos nos Tribunais de segunda instância, à luz das razões teóricas subjacentes à colegialidade e das garantias fundamentais do processo. Após a exposição das finalidades com que, em abstrato, a lei processual institui um órgão judicial colegiado para o julgamento dos recursos (i) reforço da cognição judicial, (ii) garantia de independência dos julgadores e (iii) contenção do arbítrio individual , é feita a análise pormenorizada das sucessivas etapas de que se compõe o procedimento recursal ordinário da apelação, conforme a disciplina prevista nas leis federais e em disposições regimentais, como a distribuição dos recursos, o papel do relator, a figura do revisor, a pauta da sessão de julgamento, o regime da sustentação oral, a mecânica da deliberação colegiada, a atividade de redação do acórdão e a intimação das partes quanto ao teor da decisão, a fim de identificar os pontos em que o regime formal do julgamento dos recursos termina por revelar um descompasso com as premissas por que deveria se guiar. Em todo o trabalho, o marco teórico utilizado deita raízes na concepção democrática do direito processual civil, fundada na máxima eficácia das garantias fundamentais do processo previstas na Constituição Federal de 1988.

Propõe-se estudo teórico com o objetivo de examinar a extensão e os limites da proteção jurídica concedida aos nascituros no ordenamento jurídico brasileiro. Há décadas a doutrina nacional se debruça acerca da exegese mais adequada do art. 4 do Código Civil de 1916, que, atualmente, corresponde ao art. 2 do Código Civil, com pequenas modificações textuais, mas sem alterar substancialmente o dispositivo. O Código Civil aparentemente optou pela atribuição da personalidade civil somente após o nascimento com vida, assegurando, contudo, os direitos do nascituro desde a concepção. O próprio Código Civil prevê expressamente direitos ao nascituro, como o direito a se beneficiar de doação e herança, o direito ao reconhecimento de paternidade e o direito à curatela. Nas últimas décadas outras leis infraconstitucionais reforçaram a proteção do nascituro, para resguardar direitos próprios do nascituro, entre eles o direito à assistência pré-natal, o direito à saúde e à integridade física e o direito aos alimentos. Não obstante, é costumeira a consciência de que o reconhecimento desses direitos pressupõe a concessão da personalidade civil desde a concepção, visto que a titularidade deles dependeria do gozo pleno da personalidade. Embora, pelo perfil do interesse, não haja óbice ao reconhecimento de situações patrimoniais, existenciais e dúplices, que podem ser titularizadas pelo nascituro, a preocupação do legislador nacional sempre se centrou nos aspectos patrimoniais. Diante da existência de situações jurídicas subjetivas merecedoras de proteção por parte do ordenamento jurídico titularizáveis pelos nascituros, pretende-se identificar e revelar os direitos extrapatrimoniais do ente por nascer como merecedores de tutela no direito brasileiro. Mediante pesquisa bibliográfica, observada a metodologia do direito civil constitucional, serão examinados os conceitos de nascituro, bem como as teorias existentes sobre os direitos que lhe são assegurados, com vista à possibilidade de proteção de seus direitos existenciais

The National Marine Fisheries Service (NMFS) is dedicated to the stewardship of living marine resources (LMR’s). This is accomplished through science-based conservation and management, and the promotion of healthy ecosystems. As a steward, NMFS has an obligation to conserve, protect, and manage these resources in a way that ensures their continuation as functioning components of healthy marine ecosystems, affords economic opportunities, and enhances the quality of life for the American public. In addition to its responsibilities within the U.S. Exclusive Economic Zone (EEZ), NMFS plays a supportive and advisory role in the management of LMR’s in the coastal areas under state jurisdiction and provides scientific and policy leadership in the international arena. NMFS also implements international measures for the conservation and management of LMR’s, as appropriate.NMFS receives its stewardship responsibilities under a number of Federal laws. These include the Nation’s primary fisheries law, the Magnuson Fishery Conservation and Management Act. This law was first passed in 1976, later reauthorized as the Magnuson-Stevens Fishery Conservation and Management Act in 1996, and reauthorized again on 12 January 2007 as the Magnuson-Stevens Fishery Conservation and Management Reauthorization Act (MSRA). The MSRA mandates strong action to conserve and manage fishery resources and requires NMFS to end overfishing by 2010 in all U.S. commercial and recreational fisheries, rebuild all overfished stocks, and conserve essential fish habitat.

The National Marine Fisheries Service (NMFS) Northeast Fisheries Science Center (NEFSC) Fisheries Sampling Branch (FSB) collects, maintains, and distributes data for scientific and management purposes in the northwest Atlantic Ocean. FSB manages three separate but related observer programs: the Northeast Fisheries Observer Program (NEFOP), the Industry Funded Scallop (IFS) Observer Program, and the At Sea Monitoring (ASM) Program. For the purposes of this manual, “observers” refers to any observer/monitor working for the FSB. In 2011, FSB trained and deployed over 200 observers, provided coverage on a variety of fisheries, and completed over 15,000 sea days. Observed trips are required under many of the region's fishery management plans, and for some fisheries by other federal laws and authorities such as Amendment 16 and Framework 44, Magnuson-Stevens Fishery Conservation and Management Act, Marine Mammal Protection Act, the Endangered Species Act, the and the Sustainable Fisheries Act. The purpose of this guide is to provide FSB observers, as well as end users of NEFSC Observer Program data, with a detailed description of each data field collected. In addition to this manual, the NEFSC Observer Program Biological Sampling and Catch Estimation Manual provides summaries and tables intended to enable observers to quickly determine the correct sampling protocols and methods while at sea. This manual represents a revision of the data forms, collection procedures, and protocols described in the 1996 NEFSC Observer Program Manual. This work is funded based on the uneasiness with the concept of State as a public machine for development. Of State as a public machine to deliberate valid practices for valid methods and to limit valid subjects in valid spaces. In midst of this specific context, this work dedicates itself to investigate the following research problem: the mistaken recognition of the blind subject in public spaces of representation. For this reason, it was addressed the following question: how the blind subject is recognized in public spaces of representation? To answer the question, it was necessary to contextualize how the blind subject is being recognized in various public spaces of representation. In the international scope, the human rights debate held between the National States was analyzed (BRAND, 2005; KOERNER, 2002; UN, 2006). In the national arena, constitutional rights, federal laws, public policies and institutions representing the blind subject were examined (CABRAL, 2008; SARAVIA, 2006). Finally, in a local context, the fundaments of the concept of citizen for the subject recognition were investigated (AGAMBEN, 2002; RORTY, 1999, DELEUZE AND GUATTARI, 1996). The methodology included reports of national and international representatives in the Lusophone Countries Meeting for Dissemination and Implementation of the Convention on the Rights of Persons with Disabilities and, mainly, interviews with blind subjects. The data was processed by content analysis and was discussed based on the following categories: representation spaces; representation modes; representation amplitude; representation premises. The results show, regarding such spaces of representation, the growing importance of thinking the rights of persons with disabilities ¿ group in which belongs the blind subject ¿ as of the international and national scenario. However, the blind subjects announced alternative local spaces for representation: church, internet, radio, etc. Regarding the representation modes, the role of law and standards has been advocated specially in the human rights field. The importance of the cooperation between the States and the civil society to ensure, in practice, the rights achieved was also emphasized. But other forms of representation, directly linked to each interviewee¿ history, was important. Regarding the representation amplitude, there were arguments in defense of a conception of human dignity and freedom to all inhabitants of the globe. The lusophone event highlighted the concern of the cultural peculiarities of those involved in the meeting. The blind interviewees argued for citizenship as construction of instruments for freedom and autonomy, but recognized that this is not a clear desire between the blind people in general, and even less in society as a whole. With respect to the representation premises, the fundaments for the recognition of the blind subject were based on the primacy of reason at the expense of personal experimentation. Experimentation that serves as the foundation of a new form of recognition of the blind subject in public spaces of representation, one more interested in singularities, impenetrable by reason, unmovable to another, and which are irreducible to each subject. The final considerations suggest that if the State has a reason to be, this is not another than to offer instruments to manifest as many as the existential possibilities of the subject. This is the concept of State for development.

O objetivo principal deste trabalho é estudar a influência do governo eletrônico na democracia. Por ser um tema que permite diversas abordagens, escolheu-se focar o estudo na avaliação da transparência administrativa e disponibilidade de informações públicas em websites governamentais. A análise empírica avaliou a prestação de contas públicas de todas as capitais estaduais brasileiras, em cumprimento às leis federais de Contas Públicas e de Responsabilidade Fiscal. Para isso, criou-se um roteiro de avaliação de websites governamentais que permitisse a avaliação dos principais indicadores relacionados à transparência administrativa. Os resultados obtidos da pesquisa apresentam evidências dos principais condicionantes da transparência, permitindo relacioná-los com as indicações da literatura sobre o tema. Como resultado final, pretende-se contribuir para a maior compreensão de um dos componentes fundamentais da democracia representativa: a transparência dos atos públicos, colaborando para ampliar o conhecimento sobre os possíveis impactos do governo eletrônico na sociedade moderna.

Discrimination, in its best form, is a hard concept to fathom as an employee or ordinary citizen. In the workplace, there are times when discrimination is necessary due to extenuating circumstances that revolve around the form or act of discrimination. It could be conveyed to save a life or avoid future conflict. However, it must be clearly stated as a written law that the act is lawful. When unlawful discrimination occurs, it stages an entirely different tone, as it is mainly conducted out of malice, hatred, greed, control, or ignorance. Over the last few decades, discrimination has existed in the workplace, although Federal laws mandate that it does not occur. It does not exist in just one geographical area or is country specific, but covers a wide spectrum, linking countries together from their points of view to creating rifts amongst those who are affected and those who are not, not only from a business perspective, but social humanistic relationships as well. This thesis will use quantitative and qualitative data to support discrimination of sexual harassment, race or color, and gender issues, as well as personal experiences, and how it has and will continue to impact businesses if the acts do not cease, permanently. Leadership, from the Presidents and Heads of Countries, Chief Executive Officers (CEOs), managers, lowest-ranking supervisor, and employees should make it their personal goal to ensure these issues do not continue or arise in their perspective areas of responsibilities. When employees understand that they are valued, will be taken seriously when reporting acts of discrimination, and that some form of action will be taken, performance and productivity will escalate, and morale will increase in the workplace, resulting in higher productivity and subsequently higher profit margins for the company.

Since the emergence of the first demands for actions that were intended to give greater attention to culture in Brazil, came the first discussions which concerned the way the Brazilian government could have a positive influence in encouraging the culture, as is its interaction with the actors interested and involved with the cause. During the military dictatorship, there were programs which relied on the direct participation of the State to ensure that right, from the viewpoint of its support and implementation of public resources in developing the "cultural product" to be brought to society in its various forms of expression - all this, funded by the government. It is an example of "EMBRAFILMES" and "Projeto Seis e Meia", continued until the present day in some regions of the country, though maintained by entities not directly connected with the administration or the government. However, it was from the period of democratization and the end of the dictatorship that the Brazilian government began to look at the different culture, under its guarantee to the society. Came the first incentive laws, led by "Lei Sarney" Nº 7.505/86, which was culture as a segment which could receive foreign assistance in order to assist the government in fulfilling its public duty. After Collor era and the end of the embargo through the encouragement of culture incentive laws, consolidated the incentive model proposed in advance of Culture "Lei Sarney" and the federal laws, state and local regimentares as close to this action. This applies to the Rouanet Law (Lei Rouanet), Câmara Cascudo Law (Lei Câmara Cascudo) and Djalma Maranhão Cultural Incentive Law (Lei de Incentivo à Cultura Djalma Maranhão), existing in Natal and Rio Grande do Norte. Since then, business entities could help groups and cultural organizations to keep their work from the political sponsorship under control and regiment through the Brazilian state in the form of their Cultural Incentive Law. This framework has contributed to the strengthening of NGOs and with the consolidation of these institutions as the linchpin of Republican guaranteeing the right to access to culture, but corporate social responsibility was the one who took off in the segment treated here, through the actions of Responsibility Cultural enterprises arising from the Cultural Organizations. Therefore, in the face of this discourse, this study ascertains the process of encouraging the Culture in Rio Grande do Norte from the Deviant Case Analysis at the Casa da Ribeira, the main Cultural Organization that operates, focused action in Natal in order to assess the relationships established between the same entity and the institutions which are entitled to maintain the process of encouraging treated in this study - Enterprise, from the viewpoint of corporate sponsorship and Cultural Responsibility and State in the form of the Laws Incentive Funds and Public Culture Incentive

Este estudo tem como objetivo central analisar o trabalho docente nos cursos de graduação a distância, tomando como exemplo o curso de Licenciatura em Matemática a distância da Universidade Federal do Pará, no contexto da política de expansão da educação superior por meio da modalidade a distância. O estudo se utiliza de documentos oficiais que versam sobre a política de expansão da educação superior por meio da educação à distância, de legislações federais e documentos relativos à política de expansão da modalidade a distância na Universidade Federal do Pará, assim como de entrevistas com os antigos e atuais coordenadores do curso em análise. Parte-se da premissa de que a atual forma de organização da produção capitalista demanda trabalhadores com a formação mínima - educação básica - e que, para isso, é necessário ampliar as matriculas na educação superior para garantir a universalização da educação básica. As orientações de organismos coletivos do capital, tais como, o Banco Mundial e a Organização das Nações Unidas para a Educação, a Ciência e a Cultura, no que conceme à política de expansão da educação superior, salientam o uso das novas tecnologias de informação e comunicação como ferramenta útil para o desenvolvimento de cursos na modalidade a distância, caracterizando estes, dessa forma, como mais eficientes que os cursos presenciais, por serem menos onerosos, flexíveis em relação ao tempo e espaço e de ampla difusão. Nesse contexto, a expansão da educação superior, no Brasil, ocorre por meio da educação à distância, com destaque para as instituições privadas. Verificou-se que um dos atores centrais na educação superior é o trabalhador docente, que, nas últimas duas décadas, vivencia a ampliação da precarização e da intensificação do trabalho. O estudo indica amplo desenvolvimento dos cursos de graduação na modalidade a distância, com índices superiores aos observados na educação presencial, tanto nas instituições públicas quanto privadas. No que conceme ao trabalho docente na modalidade a distância, os estudos apontam para a potencialização da precarização e da intensificação deste trabalho, que, apesar disso, não impede que essa modalidade de ensino se mantenha em ascensão. No caso do curso em análise, verificou-se a presença de elementos particulares da precarização e da intensificação do trabalho docente, tais como aumento da carga horária de trabalho sem aumento da remuneração, acúmulo de atividades pelos docentes, ausência de política de formação específica para os docentes do curso a distância, pouca produção, por estes docentes, de materiais didáticos específicos dos cursos a distância.
