In this relatively short book, David Clark sets out to fill what he perceives to be a gap in the presently available writing on Australian public law by achieving two distinct objectives. The first is to remedy 'one of the oddest limitations of current public law writing in Australia' by detailing the history and operation of the state and territory constitutions as well as their philosophical underpinnings. The other is to explore certain areas of federal public law, such as the laws applicable to the constitution and operation of the Commonwealth Parliament and non-judicial bodies such as the Ombudsman, which are often not dealt with in leading constitutional and administrative law texts. It is acknowledged by the author that attempting to cover such a wide range of topics is a 'high-wire act'. Fortunately, apart from one slight stumble, Clark manages to keep his balance and has produced a useful précis of a number of the institutions and concepts that are fundamental to the orderly functioning of Australian society.

La governance del settore alimentare si fonda su una struttura multilivello, ove poteri locali, nazionali, sovranazionali e globali interagiscono. In tale assetto, ogni regolatore è chiamato a proteggere interessi diversi tra loro, tra cui l'ambiente, la salute umana, il benessere animale e la libera concorrenza. La regolazione del settore alimentare, inoltre, impone la considerazione di aspetti etici e culturali, dotati di una forte matrice territoriale. In questo sistema, i valori che entrano in gioco non sono egualmente rappresentati, ma quelli considerati "minori" sono sovente sovrastati dalle esigenze di protezione di un unico interesse: la libera concorrenza su scala globale. Ne deriva che la regolazione del settore alimentare necessita di un nuovo equilibrio. Questo può richiedere sia l'adozione di nuove regole - soprattutto a livello sovranazionale - sia un'interpretazione maggiormente inclusiva dei principi e delle regole già esistenti da parte delle Corti. Tuttavia, risulta maggiormente urgente e di immediata efficacia permettere ai soggetti interessati, siano essi privati o pubblici, di partecipare alla formulazione delle politiche e delle decisioni inerenti il settore alimentare. La partecipazione procedurale è in grado di soddisfare esigenze differenti e talvolta opposte, pertanto essa è regolata dal legislatore a seconda dello scopo finale prefissato. Principalmente, essa è vista come una applicazione diretta dei principi di democrazia e trasparenza; tuttavia, il suo reale impatto sul risultato finale delle decisioni pubbliche può scostarsi considerevolemente da tale paradigma. Lo scopo di tale lavoro è analizzare i diversi modelli partecipativi implementati nei vari livelli di governo, al fine di determinarne il reale impatto sui soggetti interessati e sul bilanciamento degli interessi in gioco. La conclusione dimostra un certo livello di perplessità per ciò che riguarda l'assetto di tali garanzie nella regolazione del settore alimentare, dove lo sviluppo del concetto di democrazia partecipativa e di bilancio tra gli interessi rilevanti è ancora acerbo.

This paper is a constructivist attempt to understand a global political space where states as actors (the traditional domain of international relations theory and international law) are joined by international organizations, firms, NGOs, and others. Today we know that many supposedly private or international orders (meaning sources of order other than the central institutions of the territorial state) are engaged in the regulation of large domains of collective life in a world where the sources of power are multiple, sovereignties are overlapping, and anarchy is meaningless. The paper begins with an attempt, discussed in the first section, to sort out what the rule of law might mean in the context of the WTO, where we soon see that it can only be understood by also considering the meaning of Administrative Law. Much of the debate about rule of law depends on positivist and centralist theories of “law,” whose inadequacy for my purposes leads, in the second section, to a discussion of legal pluralism and implicit law in legal theory. These approaches offer an alternative theoretical framework that respects the role of the state while not seeing it as the only source of normativity. The third section looks directly at WTO law and dispute settlement. I tr y to show that the sources and interpretations of law in the WTO and the trading system cannot be reduced to the Dispute Settlement Body. I conclude in the fourth section with some suggestions on how a WTO rule of law could be understood as democratic.

El derecho internacional, como el derecho administrativo de cada Estado, se encuentra vinculado a la finalidad universal del derecho. No obstante, la influencia de la comunidad internacional en los asuntos jurídicos de los Estados está generando, con el auge de la globalización, mecanismos o instrumentos que de forma no impositiva pero sí persuasiva, vienen delimitando las competencias estatales. Estos instrumentos ejercen la función de ordenar los ámbitos de validez de dichas competencias jurídicas y administrativas internas, a través de formas declaratorias de carácter internacional, mediante normas jurídicas blandas denominadas soft law. El amplio y variado uso del soft law en temas como los derechos humanos y el medio ambiente plantea una dificultad para la teoría tradicional de fuentes, inspirada en la voluntad de los Estados, los cuales se constituyen a partir de su soberanía estatal (hard law). Esto sugiere una dicotomía jurídica, en donde el soft law se contrasta con las reglas legales que definen obligaciones específicas de hard law, es decir, “son normas o principios más abiertos o generales en su contenido y significado, comprendiéndose como suaves. En tal caso, el Soft Law plantea una apertura a la internacionalización y democratización del derecho administrativo. La creciente adopción de instrumentos de soft law de influencia internacional o global permite la participación de actores no estatales, tales como las organizaciones no gubernamentales (ONG), y de carácter civil en la construcción de políticas e instrumentos que en ocasiones adquieren más legitimidad que las leyes creadas para atender tales asuntos.

The following report reflects a five-month internship in the Department of Legal Affairs of the Portuguese Ministry of Foreign Affairs, from 4 August to 30 December 2014. This report mainly had as a basis the knowledge from the Administrative Law, Procedural Administrative Law, Labour Law, Special Labour Law and Social Law classes. Thus, it was possible to experience procedural administrative phases, such as the hierarchical appeal, the impugnation of public tender, witness hearing, among others. Apart from these, it was possible to collaborate on the elaboration of a Handbook of Good Practices of Administrative Law and to receive training on Public Procurement.
