This book analyses the structure, form and language of a selected number of international and national legal instruments and reviews how an illustrative range of international and national judicial institutions have responded to the issues before them and the processes of legal reasoning engaged by them in reaching their decisions. This involves a very detailed discussion of these primary sources of international and national environmental law with a view to determining their jurisprudential architecture and the processes of reasoning expected of those responsible for implementing these architectural arrangements. This book is concerned not with the effectiveness or the quality of an environmental legal system but only with its jurisprudential characteristics and their associated processes of legal reasoning.

This thesis is a comparative investigation of the methodology applied to human skin temperature measurement. The findings of this thesis suggest that clinical and significant differences exist between conductive and infrared devices which are commonly employed in the assessment of human skin temperature. These significant differences could potentially influence the interpretation of results, diagnosis and therefore treatment outcomes for health, clinical and exercise science applications.

Information is encoded in neural circuits using both graded and action potentials, converting between them within single neurons and successive processing layers. This conversion is accompanied by information loss and a drop in energy efficiency. We investigate the biophysical causes of this loss of information and efficiency by comparing spiking neuron models, containing stochastic voltage-gated Na+ and K+ channels, with generator potential and graded potential models lacking voltage-gated Na+ channels. We identify three causes of information loss in the generator potential that are the by-product of action potential generation: (1) the voltage-gated Na+ channels necessary for action potential generation increase intrinsic noise and (2) introduce non-linearities, and (3) the finite duration of the action potential creates a `footprint' in the generator potential that obscures incoming signals. These three processes reduce information rates by similar to 50% in generator potentials, to similar to 3 times that of spike trains. Both generator potentials and graded potentials consume almost an order of magnitude less energy per second than spike trains. Because of the lower information rates of generator potentials they are substantially less energy efficient than graded potentials. However, both are an order of magnitude more efficient than spike trains due to the higher energy costs and low information content of spikes, emphasizing that there is a two-fold cost of converting analogue to digital; information loss and cost inflation.

This study aims to reconstruct the history of shore whaling in the southeastern United States, emphasizing statistics on the catch of right whales, Eubalaena glacialis, the preferred targets. The earliest record of whaling in North Carolina is of a proposed voyage from New York in 1667. Early settlers on the Outer Banks utilized whale strandings by trying out the blubber of carcasses that came ashore, and some whale oil was exported from the 1660s onward. New England whalemen whaled along the North Carolina coast during the 1720s, and possibly earlier. As some of the whalemen from the northern colonies moved to Nortb Carolina, a shore-based whale fishery developed. This activity apparently continued without interruption until the War of Independence in 1776, and continued or was reestablished after the war. The methods and techniques of the North Carolina shore whalers changed slowly: as late as the 1890s they used a drogue at the end of the harpoon line and refrained from staying fast to the harpooned whale, they seldom employed harpoon guns, and then only during the waning years of the fishery. The whaling season extended from late December to May, most successfully between February and May. Whalers believed they were intercepting whales migrating north along the coast. Although some whaling occurred as far north as Cape Hatteras, it centered on the outer coasts of Core, Shackleford, and Bogue banks, particularly near Cape Lookout. The capture of whales other than right whales was a rare event. The number of boat crews probably remained fairly stable during much of the 19th century, with some increase in effort in the late 1870s and early 1880s when numbers of boat crews reached 12 to 18. Then by the late 1880s and 1890s only about 6 crews were active. North Carolina whaling had become desultory by the early 1900s, and ended completely in 1917. Judging by export and tax records, some ocean-going vessels made good catches off this coast in about 1715-30, including an estimated 13 whales in 1719, 15 in one year during the early 1720s, 5-6 in a three-year period of the mid to late 1720s, 8 by one ship's crew in 1727, 17 by one group of whalers in 1728-29, and 8-9 by two boats working from Ocracoke prior to 1730. It is impossible to know how representative these fragmentary records are for the period as a whole. The Carolina coast declined in importance as a cruising ground for pelagic whalers by the 1740s or 1750s. Thereafter, shore whaling probably accounted for most of the (poorly documented) catch. Lifetime catches by individual whalemen on Shackleford Banks suggest that the average annual catch was at least one to two whales during 1830·80, perhaps about four during the late 1870s and early 1880s, and declining to about one by the late 1880s. Data are insufficient to estimate the hunting loss rate in the Outer Banks whale fishery. North Carolina is the only state south of New Jersey known to have had a long and well established shore whaling industry. Some whaling took place in Chesapeake Bay and along the coast of Virginia during the late 17th and early 18th centuries, but it is poorly documented. Most of the rigbt whales taken off South Carolina, Georgia, and northern Florida during the 19th century were killed by pelagic whalers. Florida is the only southeastern state with evidence of an aboriginal (pre-contact) whale fishery. Right whale calves may have been among the aboriginal whalers' principal targets. Using track detectors we have measured sputtering yields induced by MeV light ions incident on a uranium containing glass, UO2 and UF4. No deviation from the behavior predicted by the Sigmund theory was detected in the glass or the UO2. The same was true for UF4 bombarded with 4He at 1 MeV and with 16O and 20Ne at 100 keV. In contrast to this, 4.75 MeV 19F(+2) sputters uranium from UF4 with a yield of 5.6 ± 1.0, which is about 3 orders of magnitude larger than expected from the Sigmund theory. The energy dependence of the yield indicates that it is generated by electronic rather than nuclear stopping processes. The yield depends on the charge state of the incident fluorine but not on the target temperature. We have also measured the energy spectrum of the uranium sputtered from the UF4. Ion explosions, thermal spikes, chemical rearrangement and induced desorption are considered as possible explanations for the anomalous yields.

Cette thèse commence comme une simple question en réponse au modèle du « parfait flâneur » que Baudelaire a élaboré dans Le peintre de la vie moderne (1853): un flâneur peut-il être imparfait? Je suggère trois interprétations possibles du mot « imparfait ». Il permet d’abord de sortir le flâneur du strict contexte du Paris du dix-neuvième siècle et permet des traductions imparfaites de personnages dans d’autres contextes. Ensuite, le flâneur déambule dans la dimension « imparfaite » de l’imagination fictionnelle – une dimension comparable à l’image anamorphique du crâne dans la peinture Les ambassadeurs de Holbein. Enfin, il réfère à l’imparfait conjugué, « l’imparfait flâneur » peut rappeler le personnage antihéroïque de l’humain dont l’existence est banale et inachevée, comme la phrase « il y avait ». Ces trois visions contribuent à la réinterprétation du flâneur dans le contexte de la fin du vingtième siècle. Mon hypothèse est que l’expérience urbaine du flâneur et la flânerie ne sont possibles que si l’on admet être imparfait(e), qu’on accepte ses imperfections et qu’elles ne nous surprennent pas. Quatre études de romans contemporains et de leurs villes respectives forment les principaux chapitres. Le premier étudie Montréal dans City of forgetting de Robert Majzels. J’examine les façons par lesquelles les personnages itinérants peuvent être considérés comme occupant (ou en échec d’occupation) du Montréal contemporain alors qu’ils sont eux-mêmes délogés. Quant au deuxième chapitre, il se concentre sur le Bombay de Rohinton Mistry dans A fine balance. Mon étude portera ici sur la question de l’hospitalité en relation à l’hébergement et au « dé-hébergement » des étrangers dans la ville. Le troisième chapitre nous amène à Hong-Kong avec la série Feituzhen de XiXi. Dans celle-ci, j’estime que la méthode spéciale de la marelle apparait comme une forme unique de flânerie imparfaite. Le quatrième chapitre étudie Istanbul à travers The black book d’Orhan Pamuk. Inspiré par les notions de « commencement » d’Edward Saïd, mon argumentaire est construit à partir de l’interrogation suivante : comment et quand commence une narration? En lieu de conclusion, j’ai imaginé une conversation entre l’auteur de cette thèse et les personnages de flâneurs imparfaits présents dans les différents chapitres.
