As IPSS’s visam dar uma estrutura organizada ao dever ético de solidariedade e justiça – valores incalculáveis – entre os indivíduos. Não são administradas pelo Estado, nem por corpos autárquicos. E têm por objectivo, como informa a Segurança Social também, o apoio a crianças e jovens, o apoio à família, a protecção dos cidadãos na velhice e invalidez e nas situações de diminuição de meios de subsistência ou de capacidade para o trabalho, promoção e proteção da saúde designadamente por meio da prestação de cuidados de medicina preventiva, curativa e de reabilitação, educação e formação profissional dos cidadãos, resolução dos problemas habitacionais das populações.; Abstract: The IPSS's aim to give an organized structure to the ethical duty of solidarity and justice - incalculable values - between individuals. Are not run by the state or by municipal bodies. And aim, as reported by the Social Security also, support for children and youth, family support, the protection of citizens in old age, disability and decrease in situations of subsistence or capacity for work, promotion and health protection including through the provision of care preventive medicine, curative and rehabilitation, education and vocational training of citizens, solving the housing problems of the people.

As instituições particulares de solidariedade social (IPSS) são entidades constituídas por iniciativa de particulares e sem finalidade lucrativa com o propósito de dar expressão organizada ao dever moral de solidariedade e de justiça entre os indivíduos. Considerando as dificuldades económicas que Portugal atravessa estas instituições assumem um papel fundamental na sociedade de hoje, sendo o mesmo reconhecido por estado e clientes. O capital humano é o elemento central no que concerne aos ativos intangíveis e é formado pelas pessoas que integram a instituição. É essencial analisar a gestão dos recursos humanos das IPSS tendo em conta que estes, alinhados com a direção, são parte fulcral para a instituição atingir os objetivos a que se propõe. Com este estudo pretendemos analisar as práticas de gestão de recursos humanos aplicadas pelas IPSS e para o conseguir utilizamos um questionário diagnóstico, distribuído a uma amostra da população, e analisamos as práticas de uma IPSS através de um estudo de caso. O estudo mostrou que as IPSS aplicam maioritariamente a gestão administrativa de recursos humanos e que a regulamentação das instituições por parte da Segurança Social é um fator importante na tipologia de gestão aplicada. As conclusões baseiam-se na análise do estudo de caso e das respostas ao questionário, pelas IPSS da amostra, razão pela qual a generalização das conclusões deverá ser ponderada.

A composição musical é um tema de muito interesse para a computação evolucionária dentro da área da inteligência artificial. É uma área que tem sofrido vários desenvolvimentos ao longo dos últimos anos pois o interesse em que hajam computadores que façam obras musicais é deveras aliciante. Este trabalho tem por objectivo realizar mais um passo nesse sentido. Assim, foi desenvolvida uma aplicação informática que realiza composições musicais de dois géneros distintos: Músicas Infantis e Músicas Blues. A aplicação foi implementada com recurso aos Algoritmos Genéticos, que são os algoritmos evolucionários mais populares da área da computação evolucionária. O trabalho foi estruturado em duas fases de desenvolvimento. Na primeira fase, realizou-se um levantamento estatístico sobre as características específicas de cada um dos géneros musicais. Analisaram-se quinze músicas de cada género musical, com o intuito de se chegar a uma proporção do uso que cada nota tem em cada um dos casos. Na segunda fase, desenvolveu-se o software que compõe as músicas com implementação de um algoritmo genético. Além disso, foi também desenvolvida uma interface gráfica que permite ao utilizador a escolha do género musical que pretende compor. O algoritmo genético começa por gerar uma população inicial de potenciais soluções de acordo com a escolha do utilizador, realizando, de seguida, o ciclo que caracteriza o algoritmo genético. A população inicial é constituída por soluções que seguem as regras que foram implementadas de acordo com os dados recolhidos ao longo da primeira fase. Foi também implementada uma interface de avaliação, através da qual, o utilizador pode ouvir cada uma das músicas para posterior avaliação em termos de fitness. O estado de evolução do algoritmo é apresentado, numa segunda interface, a qual facilita a clareza e justiça na avaliação ao longo de todo o processo. Esta última apresenta informação sobre a média das fitness da geração anterior e actual, sendo assim possível ter uma noção da evolução do algoritmo, no sentido de se obterem resultados satisfatórios no que diz respeito às composições musicais.

This essay presents the European Arrest Warrant and its relationship with the principle of double criminality, which was abolished in 2002 with the new Framework Decision (FD). This instrument was essential to implement the principle of mutual recognition and strengthen the police and judicial cooperation in criminal matters in the newly created space of freedom, security and justice. It was urgent to create mechanisms to combat cross-border crime, that alone States have struggled to counter. An analysis of the FD No 2002/584/JHA is made. The execution of warrants and the non-mandatory and optional grounds of refusal are studied in detail. As it is the implementation issue. The role of mutual recognition in practice is studied as well. The procedure is to introduce the principle of double criminality, to explain the concept and its abolition, warning for the consequences derived from them, related to the principle of legality and fundamental rights. The analysis of the European Arrest Warrant in practice in Portugal and in comparison with other Member States allows the measurement of the consequences from the abolition of dual criminality and the position of States on this measure. With the abolition of double criminality, the cooperation in judicial and criminal matters departs from what was intended by the European Council of Tampere. And without cooperation, fundamental rights of citizens are unprotected, so the states have to adopt measures to remedy the "failures" of the European Law.

The causes of children rights and youth rights have been the focus of our attention. The ideals of freedom and justice accompany us in our daily lives and, as such, this thesis aims to study the questions of major importance in the field of children and youth protection in Portugal which deserve deep and serious reflection. We shall start with a brief theoretical framework of the evolution of the rights of children and youth in Portugal, defining some concepts. This will be followed by an analysis of all relevant Portuguese legislation, which will set out its fields of application, measures, objectives and underlying principles. There are multiple reasons to raise awareness to the importance of the topics that will be treated and to the necessity and urgency of thinking about an effective promotion and protection of children and youth in Portugal. In an increasingly globalized society, the crime appears as a reality that crosses borders. Globalization has potentiated the emergence of new forms of crime, which have been the subject of more interventional, particularly in terms of political, judicial and police authorities as well as civil society approaches. The media allow rapid expansion of criminal methodologies, which aggregate to the ease of movement of itinerant criminal groups, increases the opportunities for the continuation of the practice of criminal offenses, threatening, increasingly, the tranquility and safety of populations. Criminal organizations are characterized by their complexity, thus contributing to the difficulty in combat, by police and judicial authorities, forcing rapid adaptation to new political and criminal reality, particularly at the level of institutional cooperation, national and international, as exemplified by the creation of the "European Area of Freedom, Security and Justice" and new agencies in the field of police cooperation. It was intended with this paper to answer the central question: Is it possible to define a concept of Itinerant Crime in the European regulatory framework (Police and Judiciary)? To fulfill this aim, we performed the characterization of the concept of itinerant crime including itinerant criminal group, we analyzed the work that is being done by the authorities, police and judiciary, in order to contain the phenomenon. Finally, we studied type of existing cooperation at European level between the Member States and the authorities with responsibilities in this area. At the end, we conclude that efforts are being made towards the enhancement of operational, police and judicial cooperation, between the competent authorities of the European Union by combating this phenomenon. Define, and also proposed, a unique concept of Itinerant Crime, in order to be included in the legal standards, in order to facilitate research, in particular to better fit the itinerant crime and assist the prosecution of offenders.

The work of this thesis would like to investigate two particular questions about the care of underage: on the one hand, the maltreatment, and the mother's desire on the other hand. About the first, this proposal try to underscore the elaborate irregularity and disparity related to this phenomenon and his historical evolution. The objective's thesis propose to underline that the abuse crosses the crisis of educational dimension inside and outside the family. We are talking about a type of crisi that places at the origin of a specific clinic and that it is about the maltreatment designated, at the same time, to cope with the educational void and with the ill-treated under age's hardships. The so-called clinic of the maltreatment horns, therefore, with the purpose to join and to set in order the normative and educational aspects. However, the prescriptive requirement is intended to measure against the same one crisis in a paradoxical way; the laws and the juveniles court must make up for the lack absence of the rules that characterized the maltreatment, getting around to use the typical reference that traditionally were been at the base of the educational way's construction. The same crimes on underage often found in the father the responsibility. The requirements and the therapeutic needs has utilized the theoretical construct of the trauma as the key line of clinical practice. On the one hand, the trauma was been paired controversially to the psychoanalytical concepts as the notion of the phantom, in the same manner that the objective truth is been opposed to the notion of the imagination and fantasy; on the other hand, the trauma was gotten to be the mark and the characteristic that defined the individual identity of the mistreated persons, regardless of the person's clinical structure or, generally, regardless of the their individual position. Both the normative demand and therapeutic converge on the idealization of the imaginary figure that is able to supply to every type of maltreatment: the mother. This position is connected on theoretical construct well-established in the mythology, that associated the mother figure to a natural dimension; this is related to the second point at issue: the mother's desire. The awareness of the mother figure in natural and idealized terms describes accusingly and negatively the trauma, without seeing the difference between trauma that helps to give a structure to the individual position from the trauma solely devastating. The mother's mythology, therefore, is in an evident antagonism with the female figure and woman's sexuality. In these way the maltreatment's clinic suggests that a woman is able to be a mother only when she doesn't appreciate the rule of female. This situation preclusives a comparison with own sexuality and gives to the women a complex of castration. The clinic cases reported highlight as these difficulties are the expression of the familiarity's heredity that wasn't been sufficiently elaborated. This condition (into the relation between mother and his child) turn the infant in the incapacity to symbolized and it doesn't help him to accede to the positive trauma, to the language and to the edipic rule; this is the reason why the child toils difficulties to approach to own personality and to orient himself in the relation with his body, with the body of the adults and the same age children.

El projecte de recerca “Església, poder i societat als comtats catalans d'origen carolingi (877-1010)” contempla l'estudi de l'Església catalana del segle X en tots els seus vessants: com a estructura formada per diferents institucions (seus episcopals, cenobis, parròquies i esglésies-oratoris); com a conjunt de persones (clergues i laics que participen de diferent manera i amb diferent implicació dels afers eclesiàstics); en relació al poder polític-administratiu dels comtats catalans (comtes, vescomtes, senyors i altres delegats del poder i la justícia); com en relació amb els aspectes socioeconòmics i d'ordenació territorial (la gran massa de camperols, l'acaparament de terres per part dels grans propietaris, l'articulació d'un sistema de rendes, els vincles entre persones de diferents rangs, la compartimentació d'un espai creixent). Observem, doncs, que l'Església catalana altmedieval resta present en tots els àmbits de la vida i que el seu estudi permet, de retruc, un coneixement més profund i rigorós de la societat. Tot això, contextualitzat durant el segle X, a cavall entre dos períodes ben estudiats i que en ocasions l'han ennuvolat. El segle X és un període privilegiat per a l'estudi d'un bon nombre de dinàmiques polítiques, socials, econòmiques i culturals que demostren que aquesta centúria tenia una personalitat pròpia i que la posen en rellevància respecte als temps anteriors i posteriors. La historiografia tradicional altmedieval catalana tendeix a buscar l'origen dels canvis socials, institucionals i polítics, de la Catalunya medieval, en dos moments concrets: el món carolingi o els anys immediatament posteriors al canvi de mil•lenni. No obstant això, l'augment de fonts històriques, el millor coneixement dels conceptes i de les institucions i l'apropament a la història mitjançant nous enfocaments i paradigmes, permet visualitzar el segle X com a moment de continuació, però també de naixement de situacions prou importants com per a no ser negligides.

The restriction fragment length polymorphism of the 195 bp repeated DNA sequence of Trypanosoma cruzi was analyzed among 23 T. cruzi stocks giving a reliable picture of the whole phylogenetic variability of the species. The profiles observed with the enzymes Hinf I and Hae III were linked together and supported the existence of two groups. Group 1 shows a 195 bp repeated unit (Hinf I) and high molecular weight DNA (Hae III), while group 2 presents a ladder profile for each enzyme, which is a characteristic of tandemly repeated DNA. The two groups, respectively, clustered stocks pertaining to the two principal lineages evidenced by isoenzyme and RAPD markers. The congruence among these three independent genomic markers corroborates the existence of two real phylogenetic lineages in T. cruzi. The specific monomorphic profiles for each major phylogenetic lineage suggest the existence of ancient sexuality and cryptic biological speciation.

El treball de recerca té per objecte l’estudi dels avantatges que podria oferir la implantació de l’anomenada "justícia de proximitat" a Catalunya tot considerant, en especial, la seva virtualitat com a mecanisme de prevenció de la criminalitat a les grans ciutats. Aquest model de justícia presenta molts paral·lelismes, quant als seus objectius i finalitats, però també en relació amb alguns aspectes concrets de la seva configuració, amb la denominada mediació comunitària. Per això es presta especial consideració, per una banda, al pojecte de Llei orgànica de modificació de la Llei orgànica 6/1985, d’1 de juliol, del Poder Judicial, en matèria de justícia de proximitat i Consells de justícia, i , per altra banda a l’Avantprojecte de Llei de Mediació familiar i comunitària a Catalunya. Aquestes propostes de reforma legislativa són analitzades a la llum de les principals aportacions de la sociologia, la criminologia i la ciencia política en matèria de garantia de la seguretat ciudadana. També s’han pres en consideració diversos models de dret comparat. Els resultats de la recerca han posat de manifest que la garantia de la seguretat ciudadana s’ha d’articular a través de mecanismes basats en els principis de subsidiarietat, cooperació i participació, en la corresponsabilització de la societat i en la introducció d’instruments d’autoregulació normalitzats. Tenint en compte aquests resultats i les necessitats de reforma de l’organització jurisdiccional, es presenta en aquest treball un model de justícia de proximitat que s’articula principalment com un model de justícia de barri, que s’hauria de compatibilitzar amb la mediació comunitària, però que inclou també de forma paral•lela un sistema de justícia de les petites reclamacions.

Background: The literature shows how gender mandates contribute to differences in exposure and vulnerability to certain health risk factors. This paper presents the results of a study developed in the south of Spain, where research aimed at understanding men from a gender perspective is still limited. Objective: The aim of this paper is to explore the lay perceptions and meanings ascribed to the idea of masculinity, identifying ways in which gender displays are related to health. Design: The study is based on a mixed-methods data collection strategy typical of qualitative research. We performed a qualitative content analysis focused on manifest and latent content. Results: Our analysis showed that the relationship between masculinity and health was mainly defined with regard to behavioural explanations with an evident performative meaning. With regard to issues such as driving, the use of recreational drugs, aggressive behaviour, sexuality, and body image, important connections were established between manhood acts and health outcomes. Different ways of understanding and performing the male identity also emerged from the results. The findings revealed the implications of these aspects in the processes of change in the identity codes of men and women. Conclusions: The study provides insights into how the category ‘man’ is highly dependent on collective practices and performative acts. Consideration of how males perform manhood acts might be required in guidance on the development of programmes and policies aimed at addressing gender inequalities in health in a particular local context.
