Analisa a Questão de Ordem (QO) 411/09, respondida por Michel Temer, então Presidente da Câmara dos Deputados, que alterou o entendimento a respeito do sobrestamento da pauta na Câmara. A opção pela análise de uma questão de ordem justifica-se pelo entendimento de que se trata de um dos instrumentos regimentais mais legítimos e definidores do processo legislativo, pois tem o potencial de orientar os caminhos de uma proposição e criar jurisprudência legislativa, podendo até mesmo definir os rumos da atividade parlamentar, como é o caso da QO 411/09. O estudo pretende, a partir da abordagem teórica e metodológica da vertente francesa da análise do discurso, desvelar as relações de poder no plano das formações discursivas e suas respectivas formações ideológicas no interior do Legislativo vis-à-vis o Executivo, com ênfase no poder de agenda e no equilíbrio entre os Poderes da República. Para tanto, propõe-se analisar pronunciamentos proferidos em Plenário por ocasião da supracitada Questão de Ordem, tendo como referência o discurso político como cena teatral indicado por Charaudeau, de forma a tentar fornecer novos elementos interpretativos aos dilemas institucionais e às escolhas políticas dos atores envolvidos nesse debate. Conclui-se que as estratégias discursivas empregadas pelos atores políticos evidenciaram o processo de significação, circulação e entrecruzamento dos saberes a respeito da relação institucional entre os Poderes. A análise do discurso contribuiu para a compreensão do contexto social da produção discursiva da QO e da alteração do sobrestamento da pauta, além de reiterar a ideia de que a formação discursiva está intimamente relacionada à prática institucional das relações de poder dentro e fora da Câmara dos Deputados. Os embates dos pronunciamentos evidenciam esta premissa. Além disso, a análise da QO foi capaz de revelar a força política e retórica dos pronunciamentos em Plenário no sentido de modificar e, sobretudo, legitimar o entendimento sobre o trancamento da pauta. Ao utilizar a análise do discurso, tendo como pano de fundo o processo legislativo, direito constitucional e a ciência política, pretendeu-se dar novo enfoque à temática do sobrestamento da pauta e, dessa forma, tentar fornecer novos elementos interpretativos aos dilemas institucionais e às escolhas políticas dos atores envolvidos nesse contexto.

Single-species management objectives may not be consistent within mixed fisheries. They may lead species to unsafe situations, promote discarding of over-quota and/or misreporting of catches. We provide an algorithm for characterising bio-economic reference points for a mixed fishery as the steady-state solution of a dynamic optimal management problem. The optimisation problem takes into account: i) that species are fishing simultaneously in unselective fishing operations and ii)intertemporal discounting and fleet costs to relate reference points to discounted economic profits along optimal trajectories. We illustrate how the algorithm can be implemented by applying it to the European Northern Stock of Hake (Merluccius merluccius), where fleets also capture Northern megrim (Lepidorhombus whiffiagonis) and Northern anglerfish (Lophius piscatorius and Lophius budegassa). We find that optimal mixed management leads to a target reference point that is quite similar to the 2/3 of the Fmsy single-species (hake) target. Mixed management is superior to singlespecies management because it leads the fishery to higher discounted profits with higher long-term SSB for all species. We calculate that the losses due to the use of the Fmsy single-species (hake) target in this mixed fishery account for 11.4% of total discounted profits.

In stock assessments, recruitment is typically modeled as a function of females only. For protogynous stocks, however, disproportionate fishing on males increases the possibility of reduced fertilization rates. To incorporate the importance of males in protogynous stocks, assessment models have been used to predict recruitment not just from female spawning biomass (Sf), but also from that of males (Sm) or both sexes (Sb). We conducted a simulation study to evaluate the ability of these three measures to estimate biological reference points used in fishery management. Of the three, Sf provides best estimates if the potential for decreased fertilization is weak, whereas Sm is best only if the potential is very strong. In general, Sb estimates the true reference points most closely, which indicates that if the potential for decreased fertilization is moderate or unknown, Sb should be used in assessments of protogynous stocks. Moreover, for a broad range of scenarios, relative errors from Sf and Sb occur in opposite directions, indicating that estimates from these measures could be used to bound uncertainty.

Analisa como as Escolas do Legislativo, que têm a finalidade precípua de formar, treinar e capacitar os profissionais que atuam nas Casas Legislativas, passaram a ter função difusora da educação política. Conclui-se que o fortalecimento do Poder Legislativo, a melhoria da sua imagem institucional, a manutenção da democracia e o aumento da participação popular nestes processos são consequências possíveis do funcionamento das Escolas do Legislativo.

Investiga as Comissões Parlamentares do Congresso brasileiro sob um aspecto normativo-institucional, mas também empírico tendo em vista que há uma abordagem sobre a efetiva quantidade de comissões e de seus membros. A análise aborda, portanto, as comissões parlamentares brasileiras, sob aspectos relacionados ao tipo de comissões, seu funcionamento e características, mecanismos legislativos, tempo de duração, forma de recrutamento, número de membros, profissionalização, dando especial relevo para as Comissões Permanentes da Câmara dos Deputados. Verificou-se que o crescimento da quantidade de comissões ao longo do tempo, aliado a outros fatores, como o grau de institucionalização na Constituição de 1988 e a quantidade de Comissões presentes atualmente no processo legislativo do Congresso Nacional, revelam que o sistema de Comissões cumpre um papel importante no processo legislativo, tanto como espaço de deliberação, como aprimoramento técnico do trabalho legislativo.

ENGLISH: Most of the catches of yellowfin and skipjack tuna from the Eastern Pacific Ocean are made by vessels fishing with poles and lines and live bait. From 1931 to 1954, these baitboats, on the average, accounted for over three-fourths of the total annual California landings of yellowfin and skipjack (Shimada and Schaefer, 1956). With the substantial increase in recent years in the production of the tropical tunas, there have been greater demands for live bait. This increased need for larger amounts of baitfishes has given rise to important questions relating to the manner in which these populations may be most wisely used. The Inter-American Tropical Tuna Commission has been concerned with various aspects of this problem since its establishment in 1950. This report presents some of the results obtained from the Commission's studies of the baitfishes important to the fishery for yellowfin and skipjack tuna. It traces briefly the origin and development of the bait fishery, describes its operations, extent, and yield, and discusses some aspects of the effects of exploitation upon the Eastern Pacific baitfish populations, particularly of the anchoveta (Cetengaulis mysticetus). SPANISH: Los barcos que emplean cañas y cuerdas y carnada viva, son los que realizan la mayor parte de la pesca de atún aleta amarilla y barrilete en el Océano Pacifíco Oriental. De 1931 a 1954 estos barcos han desembarcado, en promedio, más de las tres cuartas partes de las pescas anuales de ambas especies (Shimada y Schaefer, 1956). Con el aumento sustancial en dicha producción en los últimos años, ha habido una mayor demanda por carnada viva. Esta creciente necesidad de obtener cantidades mayores de pecescebo, ha originado importantes cuestiones relativas a la mejor forma en que estas poblaciones pueden ser utilizadas. A la Comisión Interamericana del Atún Tropical le ha tocado ocuparse de varios aspectos de este problema, desde que fué establecida en el año 1950. Este informe ofrece algunos de los resultados obtenidos a través de los estudios de la Comisión sobre los peces-cebo importantes para la pesquería de atún aleta amarilla y barrilete; señala brevemente el origen y desarrollo de la pesquería de carnada; describe sus operaciones, extensión y rendimiento, y trata algunos aspectos de los efectos de la explotación sobre las poblaciones de dichos peces en el Pacifíco Oriental, particularmente de la anchoveta (Cetengraulis mysticetus). ENGLISH: Growth and mortality data for Cetengraulis mysticetus, Anchoa naso, Engraulis mordax, E. ring ens, E. anchoita, E. encraslcbolus, E. japonicus, and E. australis were assembled and compared. Estimates of the coefficients of natural mortality, M, of E. anchoita and Ancboa naso were made from the maximum age of the former and from data for the other species. The relative yields per recruit at different fishing mortality rates and lengths at entry into the fishery were calculated for each species, using what are considered to be the best estimates and other likely values of K, a constant of growth, and M. The maximum yields per recruit are theoretically obtainable at very high fishing mortality rates, except when the length at entry is low relative to the asymptotic length. K and M may be positively related to the temperature and to each other, and if such is the case at higher temperatures greater fishing effort would be needed to attain the maximum yield per recruit. The applicability of the yield-per-recruit approach to the data is discussed, and suggestions for further research are made. SPANISH: Se reunieron y compararon los datos sobre el crecimiento y mortalidad correspondientes a Cetengraulis mysticetus, Anchoa naso, Engraulis mordax, E. ringens, E. anchoíta, E. encrasicbolus, E. japonicus y E. australls. Los estimativos de los coeficientes de la mortalidad natural, M, de E. anchoita y Anchoa naso se obtuvieron según la edad máxima de E. anchoita y según los datos de las otras especies. Se calculó para cada especie el rendimiento relativo por recluta a diferentes tasas de mortalidad por la pesca y a diferentes longitudes de entrada a la pesquería, empleándose lo que se considera que son los mejores estimativos y otros valores probables de K, una constante de crecímíento, y M. El rendimiento máximo por recluta se obtiene teóricamente a tasas muy altas de la mortalidad por la pesca con excepción de cuando la longitud a la entrada es baja en relación a la longitud asintótica. K y M pueden estar relacionadas positivamente a la temperatura y mutuamente, y si este es el caso a temperaturas más altas se necesitará un esfuerzo superior de pesca para obtener el rendimiento máximo por recluta. La aplicabilidad del enfoque a los datos rendimiento-por-recluta es discutido y se hacen sugerencias para otras investigaciones. (PDF contains 66 pages.)

We conduct experiments to investigate the effects of different majority requirements on bargaining outcomes in small and large groups. In particular, we use a Baron-Ferejohn protocol and investigate the effects of decision rules on delay (number of bargaining rounds needed to reach agreement) and measures of "fairness" (inclusiveness of coalitions, equality of the distribution within a coalition). We find that larger groups and unanimity rule are associated with significantly larger decision making costs in the sense that first round proposals more often fail, leading to more costly delay. The higher rate of failure under unanimity rule and in large groups is a combination of three facts: (1) in these conditions, a larger number of individuals must agree, (2) an important fraction of individuals reject offers below the equal share, and (3) proposers demand more (relative to the equal share) in large groups.
