El propósito de este trabajo es demostrar el análisis de los movimientos islamistas en Egipto, en este caso la Hermandad Musulmana. Para esto nos enfocaremos en una primera parte a estudiar el origen de la Hermandad musulmana, debatiremos si existe una carta fundacional o un programa político, incluso analizaremos el intento de formalizar un programa político durante la presidencia de Hosni Mubarak y la Hermandad contemporánea. En la segunda parte, será primordial el estudio de la reforma política de 2007 en Egipto, estudiaremos la posición de la reforma desde el punto de vista del Partido Nacional Democrático (PND), de Hosni Mubarak, de la Hermandad Musulmana, de los partidos políticos de oposición y de la comunidad internacional. Finalmente abordaremos las estrategias políticas de la Hermandad Musulmana durante el gobierno de Hosni Mubarak, luego estudiaremos las estrategias políticas implementadas por el Presidente Mubarak y analizaremos las relaciones entre la Hermandad Musulmana y Hosni Mubarak durante la presidencia.

El siguiente trabajo tiene como objetivo el Estado del arte acerca de la discusión teórica de la repercusión de la unión monetaria en el principio de soberanía nacional, específicamente el caso de Gran Bretaña, ya que éste es el único país que expresa abiertamente su incertidumbre referente a algún tipo de amenaza a su soberanía. Se pretende precisar si existen criterios concluyentes, o por el contrario determinar si no hay claridad con respecto al futuro de Gran Bretaña como miembro de la unión monetaria.A partir de lo anterior, se plantean como sus propósitos particulares construir un marco conceptual acerca de la soberanía. Este estado del arte se inicia con citas de los principales autores de finales de siglo XVII y XVIII y finaliza con las posiciones conceptuales aportadas por los teóricos modernos motivados por el nacimiento de la Unión Europea como un nuevo orden político. Entre las que se citan: modelo centrico o intergubernamentalista, modelo de gobernabilidad multi-nivel, modelo neo-funcionalista y modelo federalista. Igualmente, el trabajo, busca desarrollar un marco conceptual sobre Unión Monetaria y su evolución hasta el logro de una unión fiscal europea en el periodo de 1950-2010, establecer las relaciones teóricas entre Soberanía del Estado y Unión Monetaria y por último realizar un análisis histórico hermenéutico de la Unión Europea y el caso del Reino Unido de acuerdo a las relaciones evidenciadas en los apartados teóricos entre soberanía del Estado y Unión Monetaria.

La historia de la tributación en Colombia en los últimos años se ha caracterizado por un sistema tributario ineficiente y poco equitativo. La reforma tributaria del año 2006, continua con la misma tendencia tributaria de años anteriores y además, crea una serie de beneficios y exenciones tributarias que están en contra de los principios constitucionales de Equidad, Progresividad y Eficiencia. Respecto al impuesto de renta, crea nuevas tarifas, descuentos y beneficios tributarios que generan un impuesto ineficiente en términos de control y de recaudo. Por otro lado, los beneficios dirigidos a sectores económicos en específico y a los contribuyentes más ricos del país, están en contra de un sistema tributario equitativo y progresivo. Finalmente, la extensión del impuesto al patrimonio, se considera como un impuesto ineficiente ya que es un impuesto transitorio que se ha vuelto permanente y costoso para el país. Se observa entonces, un carácter inequitativo, regresivo e ineficiente de la ley 1111 de 2006, soportado en la evidencia de los beneficios y descuentos tributarios otorgados a grandes capitales y la extensión del Impuesto al Patrimonio.

This article has the purpose to prove that the Customary International Law and the Conventional International Law are sources of Constitutional Law. First, it analyses the matter of the relations between International Law and National or Domestic law according with the theories dualism and monist and international decisions. Then, it studies the reception and the hierarchy of International Customary and Conventional Law to Domestic Law including Constitution. This matter has been studied according with several Constitutions and the international doctrine. Then, it considers the constitutional regulations about international law in the Constitution of the Republic of Colombia. The general conclusion is that International Law is incorporated in domestic law according with the Constitution of each country. But every state has the duty to carry out in good faith its obligations arising from treaties and other sources of International Law, and it may not invoke provisions in its Constitutions or its Laws as an excuse for failure to perform this duty. Accordingly, state practice and decided cases have established this provision, and the same rule is established in articles 27 and 46 of the Vienna Convention on Law of Treaties of 1969.

Right to Audience and Right to a Lawful Judge are presumed to be two of the most important guaranties for the rule of law. Both liberties are established in the Spanish Constitution of 1978 as “fundamental rights”, and they are included as a part of a most generic right: the right to due process of law. Along this text, I will try to show its content and significance, according to the sentences of the Spanish “Tribunal Constitucional”, passed through more than 25 years.

My aim in this paper is to propose a reflection on the position and the importance that the constitutional judge has in the legal systems of contemporary constitutionalism. The figure of the judge responsible of protecting the Constitution is a key institution, without which we cannot understand the laws of constitutional democracies, their current lines of development, and the guarantee of rights and freedoms that constitute the normative core of these systems. Moreover, the reflection on the exercise of the powers of the judge, its scope and its justification is an important part of contemporary legal discussion, still relevant, albeit not exclusively - in the field of legal philosophy. The object of attention of my reflection is the judge who has the power of judicial review, in a scheme of defense of the Constitution, regardless the specific ways of this defense.

En este artículo, se plantea el problema de si puede considerarse a la educación como un derechofundamental. Se analizan las implicaciones que ha tenido su no inclusión como tal derechoen la Constitución en el capítulo de los derechos fundamentales. Se estudian dos grandes tradicionessobre los derechos fundamentales: el neoliberalismo afirma que los derechos fundamentalesson únicamente los derechos liberales civiles y políticos. Y el liberalismo social concibe quelos derechos fundamentales son, además de los derechos liberales civiles y políticos, los económicosy sociales. En la parte final, se hace una reconstrucción del desarrollo del derechoa la educación en la jurisprudencia de la Corte Constitucional; termina con unas críticas alproyecto de reforma de la educación superior y unas sugerencias con miras a proponer a laeducación como un derecho fundamental.

El artículo examina el impacto social y político que tuvo lugar con el cambio constitucional ocurrido en Colombia desde la década de los noventa, y resultante del modelo consagrado en la Constitución Política de 1991.Partiendo de ese proceso, el análisis revisa las principales características de la introducción y posterior coexistencia de dos modelos de Estado antagónicos: el Estado Social de Derecho y el Estado Neoliberal, convergentes en el articulado de la Constitución de 1991. Así mismo, se revisan las innovaciones institucionales que ambos modelos le introducen al régimen político colombiano, especialmente en lo atinente a la administración de justicia, la estructura del poder público y la articulación de la participación como eje de la democracia.Simultáneamente, se estudian los elementos característicos de la coexistencia de estos dos modelos mediante el análisis del comportamiento de actores individuales y colectivos y de los hechos políticos concretos que han configurado dicha relación durante la última década del siglo XX, así como su incidencia en la inestabilidad del régimen político colombiano. Finalmente, se consideran las deficiencias en la cultura política y la constante interferencia de los sectores tradicionales y de los actores armados como rasgo estructural que impide concretar las aspiraciones del proyecto de reforma y progresión democráticas contemplado en la Constitución de 1991.-----From a critical perspective, this essay examines the root socioeconomic and political impact of the constitutional change that occurred in Colombia during the decade of the 90s, and the resultant model consecrated in the Political Constitution of 1991.Taking that process as a starting point, the analysis reviews the principal characteristics of the introduction and subsequent coexistence of two antagonistic models of state: The Social State of Right and the Neoliberal State convergent in the articulation of the Constitution of 1991. Also, the article studies the institutional innovations that both models introduce to the Columbian political regime, especially in regards to the justice administration, the structure of public power and the srticulation of participation as the axis of democracy.At the same time, the article reviews the elements that exemplify the coexistence of these two models, by means of analytical pursuit of the behabior of the individual and collective actors and of the concrete political facts that have formed said relation throughout the last decade of the 20th century, as well as its impact on the instability of the Columbian political regime. Finally, the essay considers the deficiencies in the political culture and the constant interference of the traditional sectors and of the armed actors as a characteristically structural obstacle to the achievement of the aspirations of the great project of democratic reform and progress contemplated in the Constitution of 1991.

A year away from leaving the presidency, this article analyses Lula government in light of the many corruption scandals that erupted afterwards. These events showed that despite the almost unanimous conclusion of its balance sheet, Lula government leaves a big task ahead: the political reform. Priority of the Workers’ Party during the years 1980 and 1990, and subject of many academic studies, this issue has been abandoned in the 2000s, with the accession to power of Lula Da Silva. This paper evaluates the state-of-the-art on this matter and defends the need for further consideration in light of current events, and in a broader theoretical perspective than the institutional engineering one that prevailed earlier.

With security being viewed as ensuring protection from physical and mental harm, freedom from want and fear, human security has moved to the centre stage of the global development agenda. This paper argues that even with low income, one can achieve higher human development like higher life expectancy, lower fertility and high literacy. Amartya Sen, Nobel Laureate of India, has characterised it as “development as freedom”. Lack of substantive freedom is inexorably linked to economic poverty and backwardness. Nearly all States in India have succeeded in reducing poverty, but those States with better human development have fared better. The trickle-down alone will not spread the benefits of reform. Measured State intervention and adequate provision of safety nets for the vulnerable sections of people are needed to make development more sustainable. Democracy and development go hand in hand. The democratic, accountable and transparent governance is the best insurance against poverty and marginalisation. The test of good governance must be premised on how the State and civil society negotiate differences via constitutional guarantees and political institutions. Good governance is the key to equitable growth.-----Con la visión de la seguridad como la garantía de protección contra daños físicos y mentales, de estar liberados de necesidades y temores, la seguridad humana ha pasado a ser la estrella central del programa del desarrollo global. En este trabajo se argumenta que, incluso con ingresos bajos, uno puede lograr un mayor desarrollo humano, como una esperanza de vida más larga, una menor fertilidad y una mejor educación. Amartya Sen, Premio Nobel de India, lo ha caracterizado como “el desarrollo como libertad”. La falta de libertad fundamental está vinculada inexorablemente a la pobreza económica y el retraso. Casi todos los Estados de la India han reducido la pobreza con éxito, pero aquellos que tienen un mejor desarrollo humano han salido mejor. Tan solo esta reducción paulatina no va a difundir los beneficios de la reforma. La intervención medida del Estado y su adecuado suministro de redes de seguridad para los sectores vulnerables de la población son necesarios para hacer más sostenible el desarrollo. La democracia y el desarrollo van de la mano. El gobierno democrático, responsable y transparente es el mejor seguro contra la pobreza y la marginalización. La prueba del buen gobierno debe tener como premisa la forma en que el Estado y la sociedad civil negocien las diferencias a través de garantías constitucionales e instituciones políticas. El buen gobierno es la clave para el crecimiento justo.

The paper analyzes the effects of land reform on social development – poverty and land distribution-at the local level. Land reform in Colombia, understood as the allocation of public land to peasant, has granted 23 million hectares which comprises around 20% of Colombian territory and about 50% of usable productive land. Theoretically, the net impact of land reform on development is the combination of a poverty effect and a land distribution effect. Our findings suggest that land reform from 1961 onwards has slightly reduced poverty and mildly improved land distribution. Nonetheless,municipalities with strong presence of latifundia prior to1961 have experienced both a slower drop in poverty and a weaker improvement of land distribution .This paper finds that prevalence of latifundia partially offset the positive effect of land reform in promoting social development.

We analyze the effect of a parametric reform of the fully-funded pension regime in Colombia on the intensive margin of the labor supply. We take advantage of a threshold defined by law in order to identify the causal effect using a regression discontinuity design. We find that a pension system that increases retirement age and the minimum weeks during which workers must contribute to claim pension benefits causes an increase of around 2 hours on the number of weekly worked hours; this corresponds to 4% of the average number of weekly worked hours or around 14% of a standard deviation of weekly worked hours. The effect is robust to different specifications, polynomial orders and sample sizes.

Transfers to women may affect their bargaining power within the household and consequently their well-being. We analyze the effects of the 2004/2005 pension reform in Argentina, that resulted in an unexpected and substantial increase in permanent income for around 1.8 million women, on outcomes arguably related to women’s bargaining power within the household. We estimate the effects of the reform in the probability of divorce/separation, the distribution of household chores, and the probability of women being the head of the household, using a Difference-in-Differences approach. Our results show that despite the low divorce probability among seniors, transfers to senior women have substantial effects on their situation in the household. More specifically, we find that the reform had statistically significant effects on the probability of divorce/separation increasing it by 1.8 − 2.7 percentage points implying an increase of around 18 − 19% on the divorce/separation rate of 60 − 65 year old women. Moreover, the probability of being the head of the household also increased by 2.8−3.3 percentage points representing an increase of 7−19% in the probability amongst women of 60 − 65 years of age. In the case of married women, the probability of being the head of the household increased by 1.3 − 1.5 percentage points, which represents an increase of 20 − 22%. Results show that the distribution of household chores within the couples was also affected by the reform. More precisely, the probability that the wife is the only person in charge of the housework decreased by 5 percentage points, an 11% decrease. The participation of husbands in housework, however, did not change significantly.

In this paper I evaluate the impact of the 2001 decentralization reform in Colombia. I use data from Colombia's municipalities. I look at the effect of the 2001 reform on enrolment in pre-college schools. While all municipalities received earnmarked national transfers, withthe reform some of then now have more responsabilities to provide education (deeper decen-tralization) than others. Particulary important, the reform entitle the more decentralizedmunicipalities to sign subsidy contracts with private school. Departments (the regional gov-ernments) are entitle to sign this type of contracts for the less decentralized municipalities.Since the rule for municipalities to receive more responsabilities follows and exogenous popu-lation threshold, I can implement Regression Discontinuity Design. Enrolment is measuredthrough two variables: the number of students enroled in public schools and the number of subsidized students enroled in private schools. Results sugest that more decentralized mu-nicipalities subsidize more students in private schools. The difference is significant at all thelevels of pre-college school for the period 2004-2006. In 2005, the difference accounts for20% of enrolment in private schools and 3% of population of school age. Besides, there are not significant differences among municipalities regarding enrolment in public schools.
