The apportionment of natural resources between sovereign States is a subject that relates many aspects of International law, as long as Constitutional Law, at the execution and application phases of international treaties that regulates the exploration of common goods. In this sense, because of their natural characteristics that creates an environment of constant migration and fixation in transboundary regions, terrestrial or maritime, the petroleum and the natural gas bound a complex juridical apparatus that can control the sovereign rights involved. This research is aim at accomplishing a study concerning the international agreements that enable the non-unilateral action, specifically the unitization treaties between sovereign States, as a manner to resolve situations related to the individualization of oil and/or gas reservoirs that go across their national borders. These agreements will be analyzed considering the international public law sources theory, bearing in mind yet the already existed experiences in this sense, not disregarding the way that this fact could affect Brazil. It will begin with an historical incursion over the unitization institute, covering its main characteristics and its formation and execution procedures, and finally it will address the Brazilian legal system and the comparative law threats the institute. The clauses of these relevant agreements will be analyzed in details, concerning its particularities and its contents. Because these agreements are international obligatory rules of law, it is indispensable that they are considered under the auspices of the international law system, focusing their nature and the subjects of international law and establishing them as sources of the international law, analyzing them, then, as international rules and the applicable law to these juridical relations, the conventional established, the consolidated international custom and the applicable International Law principles, appearing the State s responsibility as an important subject for the verification of the acts lawful practiced by States. The analysis of the apportionment of these natural resources ends with the individualization of possible exploitable marine oil fields located between the exclusive economic zone and the continental platform ends and the region administrated by the International Seabed Authority. At last, the Brazilian constitutional system appears as the mechanism of integration, application and execution of the international unitization agreements in Brazil, detaching the format and the proceedings that the international treaties take to acquire validity at the national legal system, passing through the treaties interpretation and the applicable constitutional principles, coming to its application in Brazil, considering the existing constitutional peculiarities and the role played by the National Agency of Petroleum, Natural Gas and bio-fuel ANP

The economic changes occurred in the 90s, with the restructuring and privatization of various sectors of the economy have led to a redefinition of the State role, assuming a position of regulator and supervisor of public services in place to direct its role as straight intervenor. It is through the regulatory agencies, autarchies with special legal personality under public law, that the Regulator State will act. In this context, the first objective of this research is to analyze the legality of easements imposed by entities of the Direct Administration and Regulatory Agencies, whose execution is delegated to legal persons of private law, being those public service companies or mixed-economy societies. This examination in question the limits of servitude as a restrictive institute of property rights, observing the principles of function, supremacy of the public interests over the private ones, legality and the separation of powers. Defend the property rights like a fundamental right and your insurance as determining factor of economic development and social justice. Use the procedure in use will be the historiccomparative procedure, in order to demonstrate the legality of the public act as a maximum attempt to preserve the balance between the expansion of public services in various sectors of the economy, and the preservation of property rights, through regulation

O presente estudo teve como objeto central analisar as políticas públicas exaradas pelo Estado brasileiro, via espécies normativas para a educação superior. Tendo como categorias de análise a autonomia da universidade, e o financiamento da educação superior. A pesquisa parte da premissa de que as políticas públicas têm sido materializadas a partir de normas jurídicas. Assim, investigamos o Estado brasileiro, as políticas públicas por ele emanadas por meio de espécies normativas e suas implicações na educação superior. O estudo foi realizado por meio de pesquisa bibliográfica que consistiu num levantamento minucioso do ordenamento jurídico elaborado pelo Estado brasileiro para a educação superior a partir da Constituição Federal de 1988 até o ano de 2006. Detectamos que após a CF/88, no que concerne à autonomia da universidade e ao financiamento da educação superior, foram aprovadas quarenta e quatro normas jurídicas, sendo duas Emendas Constitucionais, onze Leis, três medidas provisórias, nove Decretos, dentre outras espécies normativas, que contribuíram para alterar de forma profunda o texto constitucional. No desenvolvimento do estudo iniciamos com a discussão sobre o Estado com vistas a estabelecer relações com o direito e as políticas públicas. Em seguida, traçamos uma contextualização histórica de todas as Constituições brasileiras, mas com ênfase no processo de redemocratização iniciado em 1974 e que culminou na CF/88, cuja característica essencial foi sua definição como a Carta Magna mais democrática que se tem nota no Brasil. Dessa carta, analisamos os artigos que inferem sobre a autonomia universitária e o financiamento da educação superior. Com base na discussão sobre o Estado regulador brasileiro e nas indicações fornecidas pela ciência do Direito constitucional, realizamos a análise da legislação pós-constitucional que define as políticas para a educação superior brasileira direcionada ao financiamento desse nível de ensino e à autonomia da universidade. Tendo como referência o texto constitucional, discorremos sobre o instituto jurídico do controle de constitucionalidade. O estudo apontou que grande parte das normas jurídicas infraconstitucionais, que regulamenta a educação superior brasileira, atua contra legem mater, quando, por exemplo, dispõe contra o art. 207 ao interferir sobre a escolha de dirigentes universitários, ferindo a capacidade da universidade se auto-legislar sobre assuntos que lhe são próprios, ou quando desvincula percentuais assegurados para o financiamento da educação superior, no caso da emenda constitucional de revisão n. 1/1994 e Emenda Constitucional n. 10/1996, ferindo princípios constitucionais e reproduzindo interesses do Estado capitalista neoliberal. O estudo apresenta contribuição para o campo das políticas públicas educacionais, vez que possibilita reflexões sobre a forma pela qual o direito público subjetivo à educação, assegurado no texto constitucional, vem sendo negado sistematicamente e de forma sucessiva pelos governos pós CF/88 que adotam o modelo de Estado neoliberal.

A presente dissertação configura-se em pesquisa bibliográfica de cunho analítico, crítico e reflexivo sobro o universo epistemológico que engloba os princípios e limites metafísicos do Estado Jurídico em Kant, o qual aborda os fundamentos racionais, enquanto arquétipos imutáveis e universais, do Estado Jurídico, a partir daquilo que Immanuel Kant leciona em sua Doutrina do Direito. Com essa diretriz e considerando as equivocadas interpretações dos princípios fundamentais do Direito, preliminarmente, esboçam-se algumas concepções destoantes da mencionada obra, as quais são ‘rechaçadas’ no transcurso desta dissertação. Em seguida, explana-se a função exercida pela razão nos usos teorético e prático, com o fito de fixar o locus ocupado por um Sistema Moral na Filosofia Prática. Sistema esse constituído por duas subdivisões, quais sejam a Ética e o Direito. Assim, estabelece-se o Direito como uma ciência prática, apresentando seu conceito. E ainda, discute-se o tema da liberdade, o qual permeia todo caminho trilhado no desenvolvimento, sua relação com a razão prática, bem como a distinção que há entre vontade e arbítrio. Essas considerações permitem, posteriormente, caracterizar o Direito, porém, sem olvidar de distingui-lo da Ética. Explica-se, também, o princípio e a lei universal do Direito enquanto critérios de legitimação e de justiça, princípio e lei esses que se referem à liberdade do arbítrio, dentro da qual a coação se apresenta como elemento integrante. A imputabilidade é outra questão abordada, a qual pressupõe a ideia de liberdade, cuja ausência destituiria o Direito de todo sentido. Deste modo, segue-se ao Direito Privado, discutindo-o até se chegar ao seu postulado, segundo o qual é possível ter direito sobre qualquer objeto exterior ao arbítrio. Examina-se, outrossim, os institutos do Direito Privado, a dizer, o Direito Real, o Direito Pessoal e o Direito Pessoal de caráter Real. Adentra-se, em seguida, no Direito Público, apresentando o Estado Jurídico como garantidor de direitos que lhe são pré-existentes. Nessa esteira, passa-se às condições formais desse Estado, qual seja a tripartição dos Poderes e suas relações. Outros pontos ligados ao Estado Jurídico são, também, enfrentados, como a cidadania e sua relação aos poderes estatais, o pretenso direito de revolução, o dever de reforma da Constituição Civil, o Direito de Punir. Vale ressaltar que tentamos superar uma dificuldade que não é solucionada em nenhum escrito consultado – a responsabilidade dos agentes públicos. Não obstante, a forma do Estado Jurídico é, igualmente, abordada. Ademais, tecem-se algumas linhas aos direitos individuais e sociais e sua relação aos fundamentos do Direito. Enfim, depois de todo percurso trilhado, infere-se que Estado Jurídico é um dever imposto pela razão prática - um fim em si mesmo que decorre de princípios metafísicos - únicos que podem nos oferecer um modelo imutável e insubstituível de Estado.

The issue addressed in this article is whether and to what extent a lawyer has an ethical responsibility to pursue implementation of the remedy in institutional reform litigation. Institutional reform litigation refers to cases in which an individual or class of individuals sues a large organization in order to vindicate constitutional or statutory rights. The types of cases with which this article is concerned are the "public law" type, such as school desegregation, prisoners' rights and patients' rights cases, although included under the rubric of institutional reform can be, inter alia, antitrust, reapportionment and bankruptcy cases. The implementation stage of institutional reform litigation arises after an individual or class of individuals prevails at the liability stage, or pursuant to a settlement, and a court orders the defendant organization to change in order to vindicate the plaintiffs' rights. At that point, the defendant organization, whether it be a prison, mental hospital or school district, usually has the burden of implementing the order. One conclusion drawn is that the ethical duty of the lawyer must always be consistent with the lawyer's "special responsibility for the quality of justice."

Public Law 107-171 of the U.S. Farm Security and Rural Investment Act of 2002 required country-of-origin labeling (COOL) for beef, lamb, pork, fish, perishable agricultural commodities (fresh and frozen fruits and vegetables) and peanuts. While a goal of this law was to benefit domestic consumers by allowing them to make informed consumption decisions, the effects of COOL on the interest groups involved have been the subject of a heated on-going debate.

Le profonde trasformazioni che hanno interessato l’industria alimentare, unitamente alle accresciute capacità delle scienze mediche ed epidemiologiche di individuare nessi causali tra il consumo di determinate sostanze e l’insorgere di patologie, hanno imposto al legislatore di intervenire nella materia della c.d. sicurezza alimentare mettendo in atto sistemi articolati e complessi tesi a tutelare la salute dei consociati. Quest’ultimo obiettivo viene perseguito, da un lato, mediante disposizioni di natura pubblicistica e di carattere preventivo e, dall’altro lato, dallo strumento della responsabilità civile. Le due prospettive di tutela della salute delle persone costituiscono parti distinte ma al tempo stesso fortemente integrate in una logica unitaria. Questa prospettiva emerge chiaramente nel sistema statunitense: in quel ordinamento la disciplina pubblicistica della sicurezza degli alimenti – definita dalla Food and Drug Administration – costituisce un punto di riferimento imprescindibile anche quando si tratta di stabilire se un prodotto alimentare è difettoso e se, di conseguenza, il produttore è chiamato a risarcire i danni che scaturiscono dal suo utilizzo. L’efficace sinergia che si instaura tra la dimensione pubblicistica del c.d. Public Enforcement e quella risarcitoria (Private Enforcement) viene ulteriormente valorizzata dalla presenza di efficaci strumenti di tutela collettiva tra i quali la class action assume una importanza fondamentale. Proprio muovendo dall’analisi del sistema statunitense, l’indagine si appunta in un primo momento sull’individuazione delle lacune e delle criticità che caratterizzano il sistema nazionale e, più in generale quello comunitario. In un secondo momento l’attenzione si focalizza sull’individuazione di soluzioni interpretative e de iure condendo che, anche ispirandosi agli strumenti di tutela propri del diritto statunitense, contribuiscano a rendere maggiormente efficace la sinergia tra regole preventive sulla sicurezza alimentare e regole risarcitorie in materia di responsabilità del produttore.

Il sistema comune europeo dell’imposta sul valore aggiunto privilegia caratteri e finalità economiche nel definire chi siano gli operatori economici soggetti all’IVA. Una disciplina particolare è, tuttavia, prevista per i soggetti di diritto pubblico che, oltre alla principale attività istituzionale, esercitano un’attività di carattere economico. Ai sensi dell’articolo 13 della Direttiva del 28 novembre 2006, 2006/112/CE, gli Stati, le Regioni, le Province, i Comuni e gli altri enti di diritto pubblico, in relazione alle attività ed operazioni che essi effettuano in quanto pubbliche autorità, non sono considerati soggetti passivi IVA anche se in relazione ad esse percepiscono diritti, canoni, contributi o retribuzioni. La vigente disciplina europea delle attività economiche esercitate dagli enti pubblici, oltre che inadeguata al contesto economico attuale, rischia di diventare un fattore che influenza negativamente l’efficacia del modello impositivo dell’IVA e l’agire degli enti pubblici. La tesi propone un modello alternativo che prevede l’inversione dell’impostazione attuale della Direttiva IVA al fine di considerare, di regola, soggetti passivi IVA gli organismi pubblici che svolgono - ancorché nella veste di pubblica autorità - attività oggettivamente economiche.

Earth observations (EO) represent a growing and valuable resource for many scientific, research and practical applications carried out by users around the world. Access to EO data for some applications or activities, like climate change research or emergency response activities, becomes indispensable for their success. However, often EO data or products made of them are (or are claimed to be) subject to intellectual property law protection and are licensed under specific conditions regarding access and use. Restrictive conditions on data use can be prohibitive for further work with the data. Global Earth Observation System of Systems (GEOSS) is an initiative led by the Group on Earth Observations (GEO) with the aim to provide coordinated, comprehensive, and sustained EO and information for making informed decisions in various areas beneficial to societies, their functioning and development. It seeks to share data with users world-wide with the fewest possible restrictions on their use by implementing GEOSS Data Sharing Principles adopted by GEO. The Principles proclaim full and open exchange of data shared within GEOSS, while recognising relevant international instruments and national policies and legislation through which restrictions on the use of data may be imposed.The paper focuses on the issue of the legal interoperability of data that are shared with varying restrictions on use with the aim to explore the options of making data interoperable. The main question it addresses is whether the public domain or its equivalents represent the best mechanism to ensure legal interoperability of data. To this end, the paper analyses legal protection regimes and their norms applicable to EO data. Based on the findings, it highlights the existing public law statutory, regulatory, and policy approaches, as well as private law instruments, such as waivers, licenses and contracts, that may be used to place the datasets in the public domain, or otherwise make them publicly available for use and re-use without restrictions. It uses GEOSS and the particular characteristics of it as a system to identify the ways to reconcile the vast possibilities it provides through sharing of data from various sources and jurisdictions on the one hand, and the restrictions on the use of the shared resources on the other. On a more general level the paper seeks to draw attention to the obstacles and potential regulatory solutions for sharing factual or research data for the purposes that go beyond research and education.

Digital technologies have profoundly changed not only the ways we create, distribute, access, use and re-use information but also many of the governance structures we had in place. Overall, "older" institutions at all governance levels have grappled and often failed to master the multi-faceted and multi-directional issues of the Internet. Regulatory entrepreneurs have yet to discover and fully mobilize the potential of digital technologies as an influential factor impacting upon the regulability of the environment and as a potential regulatory tool in themselves. At the same time, we have seen a deterioration of some public spaces and lower prioritization of public objectives, when strong private commercial interests are at play, such as most tellingly in the field of copyright. Less tangibly, private ordering has taken hold and captured through contracts spaces, previously regulated by public law. Code embedded in technology often replaces law. Non-state action has in general proliferated and put serious pressure upon conventional state-centered, command-and-control models. Under the conditions of this "messy" governance, the provision of key public goods, such as freedom of information, has been made difficult or is indeed jeopardized.The grand question is how can we navigate this complex multi-actor, multi-issue space and secure the attainment of fundamental public interest objectives. This is also the question that Ian Brown and Chris Marsden seek to answer with their book, Regulating Code, as recently published under the "Information Revolution and Global Politics" series of MIT Press. This book review critically assesses the bold effort by Brown and Marsden.

“Large-scale acquisition of land by foreign investors” is the correct term for a process where the verdict of guilt is often quicker than the examination. But is there something really new about land grab except in its extent? In comparison with colonial and post-colonial plantation operations, should foreign investors today behave differently? We generally accept coffee and banana exports as pro-growth and pro-development, just as for cars, beef and insurance. What then is wrong with an investment contract allowing the holder to buy a farm and to export wheat to Saudi Arabia, or soybeans and maize as cattle feed to Korea, or to plant and process sugar cane and palm oil into ethanol for Europe and China? Assuming their land acquisition was legal, should foreigners respect more than investment contracts and national legislation? And why would they not take advantage of the legal protection offered by international investment law and treaties, not to speak of concessional finance, infrastructure and technical cooperation by a development bank, or the tax holidays offered by the host state? Remember Milton Friedman’s often-quoted quip: “The business of business is business!” And why would the governments signing those contracts not know whether and which foreign investment projects are best for their country, and how to attract them? This chapter tries to show that land grab, where it occurs, is not only yet another symptom of regulatory failures at the national level and a lack of corporate social responsibility by certain private actors. National governance is clearly the most important factor. Nonetheless, I submit that there is an international dimension involving investor home states in various capacities. The implication is that land grab is not solely a question whether a particular investment contract is legal or not. This chapter deals with legal issues which seem to have largely escaped the attention of both human rights lawyers and, especially, of investment lawyers. I address this fragmentation between different legal disciplines, rules, and policies, by asking two basic questions: (i) Do governments and parliaments in investor home countries have any responsibility in respect of the behaviour of their investors abroad? (ii) What should they and international regulators do, if anything?
