In 2007 the first Quality Enhancement Meeting on sampling in the European SocialSurvey (ESS) took place. The discussion focused on design effects and inteviewereffects in face-to-face interviews. Following the recomendations of this meeting theSpanish ESS team studied the impact of interviewers as a new element in the designeffect in the response s variance using the information of the correspondent SampleDesign Data Files. Hierarchical multilevel and cross-classified multilevel analysis areconducted in order to estimate the amount of responses variation due to PSU and tointerviewers for different questions in the survey. Factor such as the age of theinterviewer, gender, workload, training and experience and respondent characteristicssuch as age, gender, renuance to participate and their possible interactions are alsoincluded in the analysis of some specific questions like trust in politicians and trustin legal system . Some recomendations related to future sampling designs and thecontents of the briefing sessions are derived from this initial research.

Assuming that the degree of discretion granted to judges was the main distinguishing feature between common and civil law until the 19th century, we argue that constraining judicial discretion was instrumental in protecting freedom of contract and developing the market order in civil law. We test this hypothesis by analyzing the history of Western law. In England, a unique institutional balance between the Crown and the Parliament guaranteed private property and prompted the gradual evolution towards a legal framework that facilitated market relationships, a process that was supported by the English judiciary. On the Continent, however, legal constraints on the market were suppressed in a top-down fashion by the founders of the liberal state, often against the will of the incumbent judiciary. Constraining judicial discretion there was essential for enforcing freedom of contract and establishing the legal order of the market economy. In line with this evidence, our selection hypothesis casts doubts on the normative interpretation of empirical results that proclaim the superiority of one legal system over another, disregarding the local conditions and institutional interdependencies on which each legal system was grounded.

[eng] The Creative Commons project in Spain has its beginnings in early 2003, but until one year ago it was not possible to access licenses adapted to Spanish legislation on intellectual property. In addition to this effort of adaptation, other activities have been carried out -centred especially on the dissemination and explanation of the licensing system- and the level of acceptance has been quite positive. This article covers the history of the project and provides an explanation of the licenses and a description of some of the initiatives that this legal system is carrying out.

The "Yearbook of Private International Law" provides all about the conflict of laws developments of 2012 and 2013 in one book: Volume XIV (2012/2013) includes contributions on the proposed codification of the General Part of Private International Law in Europe, on the reform of the Chinese legal system as well as on defamation and violation of personality rights (the latter in a whole section). Furthermore, the book deals with the application of EU legislation on jurisdiction and enforcement of judgements, the recognition of judgements overturned by another judgement, and the conflict of decisions in international arbitration. Reports and court decisions from the Netherlands, Turkey, India, Finland, Croatia and Switzerland and a summary of two dissertations on the role of sovereignty and choice of courts agreements complete the book.

Little is known about the health of ambulance personnel, especially in Switzerland. This lack of knowledge is particularly striking in the specific field of occupational health. This study aims to identify and better understand protective and risk factors affecting the health of ambulance personnel. Both mental and physical health are considered. The approach used comprised two steps. The first step began in July 2008 and consisted in a qualitative study of real work activities performed by ambulance crews involved in pre-hospital emergency interventions. Researchers shadowed ambulance personnel for the duration of their entire work shift, in average for one week. The paper-pen technique was used to note dialogues, interactions, postural aspects, etc. When the situation allowed it, interventions were filmed. Some selected video sequences were used as a support for selfconfrontation interviews. Observations were performed by three researchers and took place in eleven services, for a total of 416 hours of observations (including 72 interventions + waiting time). Analysis, conducted by a multidisciplinary team (an ergonomist, an occupational therapist and a health psychologist), focused on individual and collective strategies used by ambulance personnel to protect their health. The second step, which is currently ongoing, aims to assess global health of ambulance personnel. A questionnaire is used to gather information about musculoskeletal complaints (Nordic questionnaire), mental health (GHQ-12), stress (Effort-Reward imbalance questionnaire), strategies implemented to cope with stress (Brief COPE), and working conditions. Specific items on strategies were developed based on observational data. It will be sent to all ambulance personnel employed in the French-speaking part of Switzerland. Preliminary analyses show different types of strategies used by ambulance personnel to preserve their health. These strategies involve postural aspects (e.g. use doorframe as a support to ease delicate manipulations), work environment adaptations (e.g. move furniture to avoid awkward postures), coping strategies (e.g. humor), as well as organisational (e.g. formal and informal debriefing) and collective (e.g. cooperation) mechanisms. In-depth analysis is still ongoing. However, patient safety and comfort, work environment and available resources appear to influence the choice of strategies ambulance personnel use. As far as possible, the strategies identified will be transformed into educational materials for professional ambulance personnel.

What is a virtual person? What is it used for? What is its added value? Virtual persons sometimes describe avatars and new forms of identities in online games. They also appear in other contexts; some authors use them in the legal domain. Within FIDIS, the concept of virtual person has been extended in order to better describe and understand new forms of identities in the Information Society in relation to rights, duties, obligations and responsibilities. Virtual persons, as other virtual entities, exist in the virtual world, the collection of all (abstract) entities which are or have been the product of the mind or imagination. The virtual world -not to be confused with the digital world- allows a unified description of many identity-related concepts that are usually defined separately without taking into consideration their similarities: avatars, pseudonyms, categories, profiles, legal persons, etc. The legal system has a long experience of using abstract entities to define rules, categories, etc., in order to associate legal rights, obligations, and responsibilities to persons that can be considered instances of these abstract entities in specific situations. The model developed within FIDIS intentionally uses a similar construction. n this chapter, after having explained the model, we apply it to pseudonyms. Then we explore the concept of virtual persons from a legal perspective. Eventually, we introduce trust in the light of virtual persons.

Usean nykypäivän yrityksen tietojärjestelmäinfrastruktuuri on muotoutunut heterogeeniseksi ympäristöksi, jossa eri käyttöjärjestelmä- ja laitealustoilla toimii usean eri valmistajan toimittamia järjestelmiä. Heterogeenisen ympäristön hallitsemiseksi yritykseltä vaaditaan keskitettyä tietovarastoa, johon on tallennettu tietoa käytetystä järjestelmäympäristöstä sekä sen komponenteista. Tähän tarkoitukseen Microsoft toi markkinoille vuonna 1999 Active Directory 2000 -hakemistopalvelun. Heterogeenisessa ympäristössä käyttäjien autentikointi ja auktorisointi on erittäin vaativaa. Pahimmassa tapauksessa käyttäjällä voi olla kymmeniä käyttäjätunnus-salasana-yhdistelmiä yrityksen eri tietojärjestelmiin. Lisäksi jokaisessa tietojärjestelmässäon ylläpidettävä käyttäjäkohtaisia toimintavaltuuksia. Niin käyttäjän kuin ylläpitäjänkin näkökulmasta tällainen skenaario on painajainen. Tässä diplomityössä kartoitetaan mahdollisuuksia Oracle-tietokantojen käyttäjien autentikoinnin sekä auktorisoinnin keskittämiseksi Active Directory -hakemistopalveluun. Työssä tarkastellaan tarkoitukseen soveltuvia valmiita kaupallisia ratkaisuja sekä tutkitaan mahdollisuuksia oman ratkaisumallin toteuttamiseksi umpäristöstä löytyvien ohjelmointirajapintojen avulla.

Virtualisoinnin ideana on kuvata tietotekniikkaan liittyvät laiteresurssit ryhminä. Kun jonkin tehtävän suoritukseen tarvitaan resursseja, ne kerätään erikseen jokaisesta ryhmästä. Virtualisoinnin yksi osa-alue on palvelimen tai palvelinten virtualisointi, jossa pyritään hyödyntämään palvelinlaitteisto mahdollisimman tehokkaasti. Tehokkuus saavutetaan käyttämällä erillisiä instansseja, joita kutsutaan virtuaalikoneiksi. Tässä diplomityössä esitellään ja verrataan erilaisia palvelinten virtualisointimalleja ja tekniikoita, joita voidaan käyttää IA-32 arkkitehtuurin kanssa. Eroa virtualisoinnin ja eri partitiointitekniikoiden välillä tarkastellaan erikseen. Lisäksi muutoksia, joita palvelinten virtualisointi aiheuttaa infrastruktuuriin, ympäristöön ja laitteistoon käsitellään yleisellä tasolla. Teorian oikeellisuutta todistettiin suorittamalla useita testejä käyttäen kahta eri virtualisointiohjelmistoa. Testien perusteella palvelinten virtualisointi vähentää suorituskykyä ja luo ympäristön, jonka hallitseminen on vaikeampaa verrattuna perinteiseen ympäristöön. Myös tietoturvaa on katsottava uudesta näkökulmasta, sillä fyysistä eristystä ei virtuaalikoneille voida toteuttaa. Jotta virtualisoinnista saataisiin mahdollisimman suuri hyöty tuotantoympäristössä, vaaditaan tarkkaa harkintaa ja suunnitelmallisuutta. Parhaat käyttökohteet ovat erilaiset testiympäristöt, joissa vaatimukset suorituskyvyn ja turvallisuuden suhteen eivät ole niin tarkat.

The connection between road traffic safety and criminal behavior has recently become a topic of interest in the literature, although little emphasis placed on the relationship with road accidents. Evidence worldwide shows that people who commit other offences characteristic of antisocial attitudes, are more prone to suffer road traffic accidents and infringe traffic laws. Here we examine the records of the 28 current member states of the European Union over the period 1999 - 2010. Our aim is to test the hypothesis that crime rates (and specifically, motor vehicle-related crimes) may be considered as predictors of fatal road traffic accidents. If they may, this could justify, at least prima facie, the tendency in several countries to consider traffic offences as crimes in their penal codes and to toughen the punishment imposed on those who commit them. We also analyze the effect of the severity of the legal system applied to traffic offences. Our results reveal that road traffic fatality rates are higher in countries whose inhabitants have more aggressive behavior, while the rates are lower in countries with more severe penal systems.

Asiakkaiden kiinnostus tuotteiden raaka-aineiden alkuperää kohden on kasvanut. Puuraaka-aineesta tehtyjen tuotteiden alkuperä voidaan todentaa sertifikaatilla, jos puu on peräisin sertifioidusta metsästä ja sen alkuperäketju tunnetaan. Tieto sertifioidusta tuotteesta kulkeutuu asiakkaalle leimaamalla tuotteita sertifioinnista kertovin merkein tai merkitsemällä esimerkiksi tuotteen asiakirjaan sertifioinnista kertova teksti. Tutkimus tehtiin Stora Enson Imatran tehtaalle, jolla oli tarve uudelle tietojärjestelmälle. Tutkimuksen tarkoituksena oli määritellä sertifioidun puuraaka-aineen käytön ja sertifioituina myytävien tuotteiden seurannan mandollistava tietojärjestelmä. Puun alkuperäketjun hallinnan standardit määiittävät, paljonko sertifioitua puuta kohdennettava tuotteelle, jos tuotteita halutaan myydä sertifioituna. Tietojärjestelmän määrittelyn lisäksi oli tarve selvittää prosessi, kuinka tuotteisiin ja asiakirjoihin saataisiin sertifioinnista kertova leima. Tutkimusta tehdessä selvisi, että tehtaan nykyiset myyntitoiminnot ja tietojärjestelmät asettavat rajoituksia tuotteiden ja asiakirjojen leimaukselle. Prosessia kartoitettiin mm. haastatt elemalla tehtaan ti etojärj estelmi en, myynti- ja varastotoimintojen parissa työskenteleviä ihmisiä. Haastattelujen perusteella koottiin myös tietojärjestelmän asiakasvaatimukset. Vaatimusmäärittelyä tehdessä huomioitiin myös alkuperäketjun hallinnan standardien vaatimukset. Määriteltävän tietojärjestelmän toimintaa pyrittiin havainnollistamaan tehtaan edustajille prototyyppien avulla. Lisäksi tutkimuksessa on pyritty havainnollistamaan järjestelmän toimintaa erilaisin kaavioin ja kuvin. Haasteena työssä oli tulkita standardeja ja kerätä yhteen toisistaan poikkeavia asiakasvaatimuksia.

The purpose of the present thesis was to explore different aspects of decision making and expertise in investigations of child sexual abuse (CSA) and subsequently shed some light on the reasons for shortcomings in the investigation processes. Clinicians’ subjective attitudes as well as scientifically based knowledge concerning CSA, CSA investigation and interviewing were explored. Furthermore the clinicians’ own view on their expertise and what enhances this expertise was investigated. Also, the effects of scientific knowledge, experience and attitudes on the decision making in a case of CSA were explored. Finally, the effects of different kinds of feedback as well as experience on the ability to evaluate CSA in the light of children’s behavior and base rates were investigated. Both explorative and experimental methods were used. The purpose of Study I was to investigate whether clinicians investigating child sexual abuse (CSA) rely more on scientific knowledge or on clinical experience when evaluating their own expertise. Another goal was to check what kind of beliefs the clinicians held. The connections between these different factors were investigated. A questionnaire covering items concerning demographic data, experience, knowledge about CSA, selfevaluated expertise and beliefs about CSA was given to social workers, child psychiatrists and psychologists working with children. The results showed that the clinicians relied more on their clinical experience than on scientific knowledge when evaluating their expertise as investigators of CSA. Furthermore, social workers possessed stronger attitudes in favor of children than the other groups, while child psychiatrists had more negative attitudes towards the criminal justice system. Male participants held less strong beliefs than female participants. The findings indicate that the education of CSA investigators should focus more on theoretical knowledge and decision making processes as well as the role of beliefs In Study II school and family counseling psychologists completed a Child Sexual Abuse Attitude and Belief Scale. Four CSA related attitude and belief subscales were identified: 1. The Disclosure subscale reflecting favoring a disclosure at any cost, 2. The Pro-Child subscale reflecting unconditional belief in children's reports, 3. The Intuition subscale reflecting favoring an intuitive approach to CSA investigations, and 4. The Anti Criminal Justice System subscale reflecting negative attitudes towards the legal system. Beliefs that were erroneous according to empirical research were analyzed separately. The results suggest that some psychologists hold extreme attitudes and many erroneous beliefs related to CSA. Some misconceptions are common. Female participants tended to hold stronger attitudes than male participants. The more training in interviewing children the participants have, the more erroneous beliefs and stronger attitudes they hold. Experience did not affect attitudes and beliefs. In Study III mental health professionals’ sensitivity to suggestive interviewing in CSA cases was explored. Furthermore, the effects of attitudes and beliefs related to CSA and experience with CSA investigations on the sensitivity to suggestive influences in the interview were investigated. Also, the effect of base rate estimates of CSA on decisions was examined. A questionnaire covering items concerning demographic data, different aspects of clinical experience, self-evaluated expertise, beliefs and knowledge about CSA and a set of ambiguous material based on real trial documents concerning an alleged CSA case was given to child mental health professionals. The experiment was based on a 2 x 2 x 2 x 2 (leading questions: yes vs no) x (stereotype induction: yes vs no) x (emotional tone: pressure to respond vs no pressure to respond) x (threats and rewards: yes vs no) between-subjects factorial design, in which the suggestiveness of the methods with which the responses of the child were obtained were varied. There was an additional condition in which the material did not contain any interview transcripts. The results showed that clinicians are sensitive only to the presence of leading questions but not to the presence of other suggestive techniques. Furthermore, the clinicians were not sensitive to the possibility that suggestive techniques could have been used when no interview transcripts had been included in the trial material. Experience had an effect on the sensitivity of the clinicians only regarding leading questions. Strong beliefs related to CSA lessened the sensitivity to leading questions. Those showing strong beliefs on the belief scales used in this study were even more prone to prosecute than other participants when other suggestive influences than leading questions were present. Controversy exists regarding effects of experience and feedback on clinical decision making. In Study IV the impact of the number of handled cases and of feedback on the decisions in cases of alleged CSA was investigated. One-hundred vignettes describing cases of suspected CSA were given to students with no experience with investigating CSA. The vignettes were based on statistical data about symptoms and prevalence of CSA. According to the theoretical likelihood of CSA the children described were categorized as abused or not abused. The participants were asked to decide whether abuse had occurred. They were divided into 4 groups: one received feedback on whether their decision was right or wrong, one received information about cognitive processes involved in decision making, one received both, and one did not receive feedback at all. The results showed that participants who received feedback on their performance made more correct positive decisions and participants who got information about decision making processes made more correct negative decisions. Feedback and information combined decreased the number of correct positive decisions but increased the number of correct negative decisions. The number of read cases had in itself a positive effect on correct positive decision.

[spa] Actualmente, nos encontramos inmersos en un proceso de globalización y tecnificación al que las Administraciones públicas, como parte integrante de l a sociedad, no pueden permanecer ajenas. Todas las Administraciones, en sus distintos niveles y ámbitos de actuación, han introducido en su actividad las nuevas tecnologías de la información y la comunicación, y han puesto en marcha un proceso transformación de carácter cultural, organizativo y jurídico que ha fructificado en un nuevo modelo de gestión de la actividad pública conocido bajo el nombre de Administración electrónica. El uso de las nuevas tecnologías y la transición de una Administración «en pa pel» a una Administración electrónica han conllevado una serie de reformas de nuestro ordenamiento jurídico: nuevas normas y reforma de otras ya existentes que regulan los aspectos técnicos derivados de la utilización de las nuevas tecnologías por parte de la Administración, así como los derechos y garantías de los que están revestidos los ciudadanos cuando se relacionan con la Administración por medios telemáticos. Con este telón de fondo, podemos definir un elenco de principios que regirán la actuación de la Administración electrónica y en los que se erigen como protagonistas aquellos que persiguen garantizar la igualdad y la no discriminación de los ciudadanos, combatiendo la denominada brecha digital.
