Ce mémoire traite du droit de l’adoption dans une perspective comparative entre régimes arabo-musulman, français et québécois. Dans un premier temps est abordée la place de l’enfant dans l’Islam : de sa conception au sein de la famille musulmane à l’ensemble de ses droits selon le droit religieux. Ce tour d’horizon permet d’aborder l’épineux problème de l’interdiction de l’adoption par le Coran et les alternatives qui ont été développées pour y remédier, plus particulièrement la kafala. La kafala sera expliquée et située dans l’ordre public international, puis examinée au regard de quatre législations arabes : le Maroc, la Tunisie, l’Algérie et le Liban. Dans un deuxième temps, la question sera examinée d’un point de vue occidental. Il y sera analysé la possibilité et les difficultés entourant l’application des règles musulmanes de statut personnel en France et au Québec. Finalement sera abordé l’accueil que ces deux sociétés ont réservé à la kafala dans leur système respectif.

La présente étude examine les causes de déchéance du droit à limitation de responsabilité du transporteur maritime de marchandises. En règle générale, les plafonds d’indemnisation fixés par les conventions internationales écartent la réparation intégrale du préjudice causé par le transporteur maritime de marchandises. Cependant, il est également prévu un certain nombre de causes de déchéance de ce droit à limitation, pour lesquelles les conditions d’application diffèrent d’une convention internationale à l’autre (Règles de La Haye, Règles de La Haye-Visby, Règles de Hambourg et Règles de Rotterdam). Parallèlement, les tribunaux nationaux, par le recours à des notions propres de leurs systèmes juridiques, modifient l’étendue des causes de déchéance de ce droit. En somme, la déchéance du droit à limitation de responsabilité variera selon la convention internationale appliquée et selon la juridiction compétente. Ce qui, en définitive, porte atteinte à la structuration rationnelle du régime de responsabilité du transporteur maritime dans sa globalité et à l’objectif d’uniformisation poursuivi jusqu’ici.

Le droit international prend de plus en plus d’expansion au sein de la société internationale. En fait, grâce à plusieurs acteurs, le droit international s’étend maintenant à de nombreux domaines tels que l’environnement, le droit humanitaire, l’énergie, etc. Or, parallèlement à cette expansion du droit international, on craint maintenant sa fragmentation. Face à ce nouveau phénomène, il y a lieu de se poser la question suivante : s’il y existe un phénomène de fragmentation du droit international, cela signifie-t-il qu’une unité, qui semblait exister a priori dans ce droit, est en train de disparaître, ou bien assistons-nous plutôt à un changement de paradigme? Pour répondre, à cette interrogation, l’auteur analyse tout d’abord les différents facteurs de fragmentation du droit international et observe que ce droit devient de plus en plus complexe, voire même désordonné. Le tout, à l’opposé de la vision traditionnelle d’unité que l’on a du droit. Quels éléments de solution peuvent alors être apportés pour réduire cette fragmentation? Pour le savoir, l’auteur analyse l’unité du droit en fonction de deux paradigmes : le normativisme et le pluralisme juridique. Dans le premier, c'est la hiérarchie des normes qui va donner lieu à un ordre et à une unité du droit. Dans le second, le droit est perçu comme une institution qui apporte la cohésion et il existe autant d’ordres juridiques qu’il y existe d’institutions. C'est dans ce contexte que naît une certaine unité générale grâce à divers types de rapports entre les différents ordres juridiques. Mais en droit international, l’idée d’organisation hiérarchique des normes ne pourrait englober toute la complexité grandissante de la société pluraliste internationale. C'est pourquoi, l’auteur conclu que la fragmentation du droit international signifie un changement de paradigme : ce n’est plus la théorie normativiste qui permet d’englober la toute la complexité naissante du droit international mais bien la théorie du pluralisme juridique.

La Bosnie-Herzégovine est sous supervision internationale depuis 1995. Les principaux acteurs de cette communauté internationale soit l’Union Européenne (UE) et le Bureau du Haut-Représentant à la Communauté Internationale (OHR) ont exprimé à de nombreuses reprises leur intention de transformer la mission internationale en s’éloignant du pouvoir discrétionnaire du OHR en le remplaçant par la perspective d’intégration offerte par l’UE. Malgré les bonnes intentions, cette transition semble être dans une impasse. Depuis 2006, l’organisation et la distribution des responsabilités au sein de la communauté internationale sont restées inchangées. Ce mémoire s’intéresse à ces deux principaux acteurs et à leur rôle dans l’impasse. L’objectif est de tester trois cadres d’analyse soit le rationalisme, le constructivisme et la complexité des régimes pouvant expliquer cette impasse. En se basant sur des interviews avec des experts et des représentants des deux institutions, ce mémoire explore dans quelle mesure et dans quels contextes chaque cadre d’analyse est apte à expliquer le comportement des acteurs.

Internationalization of higher education has become one of the most important policies for institutions of higher education worldwide. Though universities are international by nature, the need for intensified quality activities of international nature has promoted internationalization to be under spotlight of researchers, administrators and policy makers and to be an area for research. Each institution follows its certain way to govern its international affairs. Most Universities, especially in the 'Developed World' started to plan it strategically. This study explores the meanings and importance of internationalization especially that it means different things to different people. It also studies the rationales behind internationalizing higher education. It focuses on the four main prevailing rationales; political, cultural/social, economic/financial, and academic on both national and institutional levels. With the increasing need to strategically plan, the study explores internationalization strategies in terms of how to develop them, what are their approaches and types, and their components and dimensions. Damascus University has witnessed an overwhelming development of its international relations and activities. Therefore, it started to face a problem of how to deal with this increasing load especially that its International Office is the only unit that deals with the international issues. In order to study the internationalization phenomenon at Damascus University, the 2WH approach, which asks the what, why, and how questions, is used and in order to define the International Office's role in the internationalization process of the University, it studies it and the international offices of Kassel University, and Humboldt University in Germany, The University of Jordan, and Al Baath University in Syria using the 'SOCIAL' approach that studies and analyses the situation, organization, challenges, involvement, ambitions, and limitations of these offices. The internationalization process at the above-mentioned Universities is studied and compared in terms of its meaning, rationales for both the institution and its academic staff, challenges and strategic planning. Then a comparison is made among the international offices of the Universities to identify their approaches, what led to their success and what led to their failure in their practices. The aim is to provide Damascus University and its International Office with some good practices and, depending on the experiences of the professionals of the case-studies, a suggested guidance to the work of this Office and the University in general is given. The study uses the interviews with the different officials and stakeholders of the case-studies as the main method of collecting the information in addition to site visits, studying their official documents and their websites. The study belongs to qualitative research that has an action dimension in it since the recommendations will be applied in the International Office. The study concludes with few learned lessons for Damascus University and its International Office depending on the comparison that was done according to a set of dimensions. Finally a reflection on the relationship between internationalization of higher education and politics, the impact of politics on Middle Eastern Universities, and institutional internationalization strategies are presented.

We aim at mapping out a detailed framework that reveals the proportionate flow of cassava and its products along the value chain (VC). Furthermore, we aim at establishing the role of institutions and the linkages between institutions and other VC actors that influence the cassava VC in Uganda. We use both primary and secondary data obtained from four regions in Uganda. Results show that farmers, processors, transporters, traders, consumers and institutions are the major actors. There are four categories of institutions, viz, government, non-government, community based organisations and international agencies. Roles performed by institutions include: development and enforcement of policies, Research and Development (R&D), capacity building, and creation of market access linkages for cassava and its products. Findings reveal that there is no clear nexus and no coordination among farmers/producers, processors, traders, transporters and consumers. However, institutions are well coordinated and play various roles along the VC to influence the dynamics of actors. Policy-wise it is important to establish strong private-public partnerships to bridge the impaired linkages between the actors (farmers/producers, processors, traders, transporters, and consumers) and institutions. Strong partnerships are envisaged to reduce the associated transaction costs amongst the actors.

In the context of the digital business ecosystems, small organizations cooperate between them in order to achieve common goals or offer new services for expanding their markets. There are different approaches for these cooperation models such as virtual enterprises, virtual organizations or dynamic electronic institutions which in their lifecycle have in common a dissolution phase. However this phase has not been studied deeply in the current literature and it lacks formalization. In this paper a first approach for achieving and managing the dissolution phase is proposed, as well as a CBR process in order to support it in a multi-agent system

The international dimension of democratisation is a major concern in the study of contemporary political systems. The analysis of domestic political transformations in which International Organisations (IOs) may be salient actors compromises the traditional inward-looking approach of comparative politics that holds democracy to be a domestic affair par excellence. Nevertheless, the maturity of any process of democratisation relies upon the establishment and sustainability of institutions that genuinely reflect the interests and socio-political identity of the citizens of that polity. The role of external influence, whether progressive or abrupt, is clearly limited in constructing and sustaining this process. However, the relevance of international variables in influencing the renaissance or enhancement of democracy has not been overlooked by either scholars or politicians over the past fifteen years. As a number of political systems went through what became known as the third wave of democratization, the role of IOs in breaking down undemocratic strongholds and in neutralising possible reversals began to gain momentum. Contending approaches and controversial case studies alike appear to elicit very different conclusions concerning the legitimacy and the effectiveness of international actors in this field. This analysis addresses the rationale underpinning the deployment of multilateral external actors as agents of democratisation. Drawing on an integrative theoretical approach and a comparative case study involving the democratisation agendas of the Organization of American States (OAS) and the United Nations (UN) in Latin America (LA), contrasting international models of deployment are assessed. It is argued that IOs’ democratisation strategies are based on institutional roadmaps leading towards the attainment of targets which vary according to three key ´guidelines’: how democracy is conceptualised, what cooperative strategies are used, and what frameworks for democratisation are adopted.-----La dimensión internacional de la democratización representa un fenómeno importante de los sistemas políticos contemporáneos. El hecho de que la transformación política interna sea incluida bajo el título de organizaciones internacionales (OI) indica un rompimiento con el enfoque tradicional de observación interna de la política comparativa, si se parte de la suposición de que la “democracia” es un asunto interno por excelencia. Hay procesos complejos que limitan la viabilidad de la fortuna democrática en la política interior, los cuales dependen de las estructuras representativas del poder que fluye de la legitimidad nacional y la identidad política. No obstante, los estímulos internacionales que sostienen a los sistemas nacionales de gobierno, estructurados alrededor de la construcción y la consolidación de la democracia, están en el centro de la política comparativa contemporánea. Cuando varios sistemas políticos atravesaban la tercera ola de democratización, las OI asumieron rápidamente una posición significativa como agentes que neutralizaban los miedos a la inversión de políticas, rompiendo lazos con formas antidemocráticas de gobierno y eliminando las normas informales de los juegos democráticos. Las dinámicas mencionadas dan fundamento para abordar el debate sobre los modelos externos de apoyo. Mediante un enfoque teórico integrador y un estudio comparativo de casos de las agendas de democratización de la Organización de Estados Americanos y las Naciones Unidas dirigidas a la problemática democrática latinoamericana, se aclaran modelos internacionales “ocultos” de despliegue. Se argumenta que las estrategias de las OI para democratizar se fundamentan en que los planes de desarrollo institucionales para la democratización lleguen a los objetivos democráticos a través de tres “guías” multilaterales: conceptualización de la democracia, estrategias de cooperación y marcos de referencia especiales para la democratización.

The inclusion of subnational entities in international politics, breaks with the exclusive privilege of handling external relations by the States. Regions and municipalities have developed international policies that strengthen local affairs in cultural, economic, politic, security and strategic cooperation aspects, through the so-called parallel diplomacy activities. The influence of regional institutions in global affairs is growing; however paradiplomacy practice is not institutionalized and received little attention in international relation studies.

This paper analyzes the measure of systemic importance ∆CoV aR proposed by Adrian and Brunnermeier (2009, 2010) within the context of a similar class of risk measures used in the risk management literature. In addition, we develop a series of testing procedures, based on ∆CoV aR, to identify and rank the systemically important institutions. We stress the importance of statistical testing in interpreting the measure of systemic importance. An empirical application illustrates the testing procedures, using equity data for three European banks.

We propose and estimate a financial distress model that explicitly accounts for the interactions or spill-over effects between financial institutions, through the use of a spatial continuity matrix that is build from financial network data of inter bank transactions. Such setup of the financial distress model allows for the empirical validation of the importance of network externalities in determining financial distress, in addition to institution specific and macroeconomic covariates. The relevance of such specification is that it incorporates simultaneously micro-prudential factors (Basel 2) as well as macro-prudential and systemic factors (Basel 3) as determinants of financial distress. Results indicate network externalities are an important determinant of financial health of a financial institutions. The parameter that measures the effect of network externalities is both economically and statistical significant and its inclusion as a risk factor reduces the importance of the firm specific variables such as the size or degree of leverage of the financial institution. In addition we analyze the policy implications of the network factor model for capital requirements and deposit insurance pricing.

The guidelines presented in this document are a preliminary strategy for establishing a comprehensive policy for the needs of training and education wiyhin the sector and adjoining areas, across fields of knowledge and professions concerned, on relevant levels and for the varies institutions and operators. The objective of these guidelines is to analysis the problems, objectives and goals for development of a far reaching system of educational and training programs and courses for museums, cultural heritage and related fields of activities. This objective comprises a close collaboration between museum, cultural heritage organizations and educating organizations, notably within universities and colleges, but also other kinds of educating bodies.

Je remercie Raul Mendez Lugo, le Président de MINOM et Alfredo Tinoco, le Président de MINOM-Portugal… Mesdames et messieurs, amis et collègues, c’est un honneur de représenter le Conseil international des musées aujourd’hui ici à Lisbonne pour l’ouverture d’un atelier qui promet d’être fructueux et instructif de tous les points de vue, notamment en nous esquissant les grandes lignes d’actions à mener en plus étroite collaboration. Parmi les musées que les participants à cet atelier pourraient visiter dimanche, nous prenons note du “Museu nacional do azulejo” et de l’écomusée “Ecomuseu do Seixal”. D’une part, un musée national présente à un public international une forme d’artisanat traditionnel et mondialement connu par des moyens muséologiques contemporains et d’autre part une communauté qui a fondé et qui gère l’écomusée s’attache à son patrimoine au sein de son territoire.
