El presente trabajo tiene como objeto analizar, desde una revisin documental, la utilizacin de los medios electrnicos a la que se enfrenta el Estado colombiano, en el procedimiento administrativo y en los procesos contencioso administrativos, en el marco del Cdigo de Procedimiento administrativo y de lo Contencioso Administrativo, (Ley 1437 de 2011). Con ese fin, daremos cuenta de las influencias, el anlisis de conceptos y alcances. Para luego hacer unas reflexiones sobre el uso de estos medios, el cual trae unas implicaciones, que estn sujetas a las expectativas, retos y perspectivas inherentes a todo cambio.

La relacin entre Ecuador y Colombia se ha visto afectada por su frontera conjunta, donde la inseguridad nacional y la desconfianza mutua han creado un ambiente de tensin poltica y diplomtica entre ambos Estados. Entre el 2008 y el 2011 se experimentaron diversas crisis fronterizas producto de las polticas de seguridad implementadas por Colombia para el combate a la narcoguerrilla. As, las constantes intervenciones militares y los episodios de transgresin fronteriza, producto de la poltica de seguridad preventiva de mano dura, llegaron a su punto ms lgido con el bombardeo colombiano a un campamento de las FARC en Angostura-Ecuador. As, el incidente de Angostura, como resultado del uso de una preemptive strike doctrine, marc la historia de ambas naciones al provocar el ms duro quiebre de las relaciones bilaterales, que se tradujo en la alerta mxima de seguridad nacional para el Ecuador y un llamado de atencin a la regin sobre sus mecanismos de seguridad y lgicas de la geopoltica reinante. Este trabajo pretende analizar los factores que caracterizaron las relaciones bilaterales entre Ecuador y Colombia de 2008 al 2011 en el marco de las tensiones binacionales fronterizas y el ataque armado colombiano en la zona de Angostura (Ecuador), bajo el enfoque terico del realismo y el uso de la metodologa de estudio de caso. Se pretende evidenciar la manera en como la respuesta ecuatoriana a la crisis se orienta por lgicas realistas de las relaciones internacionales. Para ello, se han destacado tres momentos que marcan la secuencia de la investigacin emprica de esta tesis: primero se inicia con una retrospectiva de las relaciones bilaterales colombo-ecuatorianas con un enfoque histrico de carcter general; segundo, una exposicin de los antecedentes del bombardeo que demuestran los altibajos bilaterales que fueron marcando distancias. Finalmente, una descripcin del ataque y sus alcances en el campo diplomtico, militar y geopoltico, que introdujeron una nueva visin sobre la poltica de seguridad regional.

If urban planning is to support the equitable distribution of public goods and services, it must recognize and address the dismal condition of millions of poor people who are living in a city. The primary focus of contemporary planners and planning students should be on finding and advocating solutions that help eliminate the problems of todays cities. Any meaningful solution will need to be grounded in a thorough understanding of the social class inequities of citizens. With the rapid development of national economy and urbanization process in Brazil over the last two decades, the number of vehicles and their travels are dramatically increased. This is particularly evident in all large cities. Traffic congestion becomes more and more severe. Inadequate parking facilities often result in difficulty to find a parking space in large cities and many illegally parked vehicles can be seen on the crowed streets. These illegally parked vehicles further intensify traffic congestion and also pose a traffic safety hazard. The process of urbanization and motorization in Brazil is likely to continue in a rapid pace. The urban public passengers transport modes problems in large cities are likely to get even worse. There is an urgent need for the development of policy and criteria for public service of urban public passenger transport by bus in large cities. The purpose of survey is to develop policy guidelines for public transport services planning, design, construction and mobility management, that meet community needs for accessibility in large cities. So this thesis will present major comparative characteristics of urban mobility management, urban public passengers transport by bus services planning and the quality of social life in two towns of Brazil: Rio de Janeiro and Curitiba. The study case has been focused on Rio de Janeiro and Curitiba because of the major different results of the survey presented by the two cities. The objectives of this thesis are: a) to analyze and discus existing urban mobility related accessibility and economic development problems in large cities; b) to provide an overview of the relationship within city quality of social life urban mobility in Rio and Curitiba; c) to analyze and discuss existing urban mobility management related public transport services in Rio and Curitiba; d) to analyze and discuss existing quality of bus public transport services problems in Rio. Some preliminary recommendations for mobility management policies will also be presented.

A structure transports system is very necessary to attending many reasons of urban dislocations. This structuration is composed by many complex elements, as such as refer to: physical elements (rodoviary network, vehicles, garages, transboarding terminals), human elements (operational and administrative workmanship) and the institutional elements (management and fiscalization). This last one, especially, is our approach in this study, focusing the functions as the fiscalization of public organization. The purpose of this study was identifies how the public organization develops the management the system of public transport for urban intercity users and how can contributes for users satisfaction, feeding back avaluations, even, giving new direction or reavaluation of the fiscalization function. The methodology sdopted to get expected solutions is exploratory survey, due the unidentified any studies with the same focus or approaching to the citizens expectatives solutions by public organism manager point of view. Also it was realized an explanation survey to complement the study giving wide comprehension for the other elements used by organization to obtain success in the relationship with users. A field survey and bibliographical was realized thru documental investigation to get informations about necessary foundamentation based conclusion.

O transporte coletivo exerce uma funo essencial na vida urbana: ele possibilita a estruturao plena das cidades,j que atende as necessidades de deslocamento dirio dos trabalhadores, assegurando-lhes a sobrevivncia e possibilita o desenvolvimento das atividades econmicas. Alm disso ele materializa o acesso da populao a servios e equipamentos sociais fundamentais, o que lhe caracteriza como um direito meio, pois viabiliza a concretizao de outros direitos. por atender a uma necessidade social bsica do cidado, que o acesso, fsico e econmico, ao transporte coletivo deve ser garantido a todos, assim como o acesso sade, educao, habitao, etc. Ainda assim at a dcada de 80, o setor de transportes coletivos no Brasil foi historicamente relegado marginalizao como alvo de polticas sociais. Embora j em 1938 o Presidente Getlio Vargas, atravs do Decreto N9 339, estabelecesse que a participao do gasto com transporte no poderia ultrapassar 6% do salrio mnimo, o Estado jamais criou mecanismos que dessem condies de cumprimento de lei. A despeito de crescimento urbano, que agudeza a problemtica dos transportes coletivos ao longo do sculo, somente nos anos 80 se implanta a primeira poltica social

Trata da anlise da poltica de transporte coletivo na cidade de Santo Andr - SP em dois perodos distintos de governo (1989 a 1992 e 1997 a 2000) em que esteve frente da prefeitura o Partido dos Trabalhadores. Aborda a relao entre o Estado e o mercado e as propostas construdas no mbito do PT para conduo dessa poltica pblica. Faz uma descrio dos principais elementos de inovao no modelo de gesto adotado em cada um dos perodos e estabelece um paralelo entre as duas administraes, relacionando os pontos de contato e as diferenas, procurando inferir sobre a efetividade da poltica pblica implantada luz dos objetivos dos principais atores envolvidos

As primeiras regies metropolitanas brasileiras foram institudas de maneira vertical e autoritria como parte da estratgia de desenvolvimento nacional promovida pelo governo militar. Percebidas como instituies no-democrticas e rejeitadas como possvel quarto ente federativo, as regies metropolitanas, desde a Constituio de 1988, foram gradualmente esvaziadas dos seus propsitos originais. Em sua orfandade, os problemas socioeconmicos proliferaram e foram acentuados, e passaram a predominar relaes intergovernamentais competitivas em vez de cooperativas. Um dos principais desafios enfrentados pelo modelo federalista brasileiro, em especial quando se trata destas regies, est relacionado necessidade de estabelecer maior cooperao e coordenao, tidas como imprescindveis para garantir um relacionamento mais equilibrado entre os entes federativos, assim como para a efetiva implementao de polticas de enfrentamento das desigualdades e excluso social nas aglomeraes urbanas. Este trabalho analisa o Grande Recife Consrcio Metropolitano de Transportes (CMT), empresa pblica multifederativa estabelecida em 2008 entre os governos municipais e estadual da Regio Metropolitana de Recife (RMR). Responsvel pelo planejamento, gesto e implementao compartilhada da poltica de transporte pblico coletivo na RMR, o Grande Recife se tornou realidade com a aprovao e regulamentao da Lei Federal n 11.107 de 2005, conhecida como a Lei de Consrcios Pblicos. O Grande Recife uma experincia pioneira e inovadora, demonstrando que possvel encontrar uma maneira de superar conflitos e desafios comuns e, ao mesmo tempo, garantir a preservao da autonomia de cada ente, bem como os direitos cidados. Neste trabalho consideramos essa experincia de cooperao intergovernamental como um exemplo de multi-level governance (MLG), uma vez que ilustrativa de um novo arranjo institucional democrtico entre distintas esferas governamentais para a gesto compartilhada de um servio pblico.

O presente trabalho de concluso de curso tem por objetivo analisar e propor melhorias para o Sistema de Transporte Coletivo Urbano de Passageiros da Cidade de So Paulo, no que diz respeito, especificamente, ao processo de aplicao de multas aos operadores (concessionrios e permissionrios), em razo de faltas cometidas em decorrncia da prestao de servio pblico de transporte coletivo. Para tanto, inicialmente prope-se o estudo da prestao do servio pblico, assim como da poltica de mobilidade urbana e da estrutura do sistema de transporte coletivo na cidade de So Paulo. A partir desses conceitos, o trabalho pretende descrever detalhadamente o processo administrativo de multas praticado atualmente pela SPTrans, isto , desde a autuao do operador em campo at o julgamento do ltimo recurso realizado pela Comisso de Infraes e Multas COMIM. Posteriormente, prope-se um plano de melhorias e modernizao do processo de fiscalizao da SPTrans, visando enderear os problemas identificados durante a elaborao do trabalho e alcanar os objetivos que foram fixados no Termo de Referncia: fortalecer a gesto; melhorar a coordenao das reas e processos envolvidos; inovar e introduzir cultura de inovao; reduzir papel; retirar mo de obra de atividades mecnicas, e realoc-la para atividades criativas do core-business da empresa; aumentar a comunicao interna; revisar procedimentos; mudar a cultura organizacional; melhorar a comunicao com o usurio e outros solicitantes; aumentar a transparncia; agilidade no julgamento das multas.

O trabalho tem por objetivo analisar a importncia da fiscalizao do servio pblico como instrumento de gesto e poltica pblica. Para tanto, prope-se estudar o Sistema de Transporte Coletivo Urbano da Cidade de So Paulo, a partir do modelo institudo atravs da Lei n 13.241/01, assim como toda a estrutura jurdica e elementos caractersticos presentes nessa forma de delegao. Sem a preocupao de esgotar o tema, com base na doutrina, o trabalho pretende abordar os principais conceitos que envolvem a prestao de servios pblicos, o dever legal de fiscalizao e a estrutura legal da prestao dos servios de transporte coletivo. E, a partir disso, verificar se o sistema de transporte municipal possui instrumentos jurdicos adequados fiscalizao dos servios delegados. Alm disso, busca-se avaliar se isso suficiente para a prestao de um servio adequado, ou seja, se os instrumentos de fiscalizao utilizados, por si s, so efetivamente capazes de garantir as condies de regularidade, continuidade, eficincia, segurana, atualidade, generalidade, cortesia na prestao e modicidade das tarifas, conforme preceitua a lei. Em sntese, entende-se que o ordenamento jurdico dispe de diversos mecanismos que permitem a fiscalizao dos servios pblicos. Ademais, que encontra-se juridicamente adequado o modelo de fiscalizao adotado pelo Municpio de So Paulo, para o sistema de transporte pblico. Todavia, apesar de ser correto, o modelo ainda necessita de melhorias, tanto no que diz respeito s obrigaes estabelecidas nos contratos de concesso e permisso em vigor (e respectivos regulamentos, como o caso do RESAM Regulamento de Sanes e Multas), quanto na sua operao e, principalmente, na sua fiscalizao. Por fim, o trabalho aponta que, tanto a regulao, quanto a fiscalizao ou at mesmo a gesto, quando realizadas de forma inadequada, fomentam a prestao de um servio pblico com m qualidade, ou seja, inferior esperada pela populao.

The problem dealt with in this study concerns the analysis of bus drivers' working situation. It stemmed from the need to identify the difficulties faced by these professionals in accomplishing the results expected by the company. A case study was carried out in a public transportation company in the city of Natal. Records and observations made in the workplace, alongside perfomance indicators, such as absenteeism tax, staff turnover and traffic accidents, revealed problems in their activity. It was made clear that, in the company being studied, absenteeism was related to health problems, particularly psychiatric and musculoskeletal disorders, and that although the indicators of traffic accidents and staff turnover have declined over the years, they are still elevated. The interviews involved 50 of the 124 drivers who worked directly in the service, and contained questions covering eleven factors related to the drivers' work. They indicated a gap between the prescribed work and the work actually done, in that there were a series of embarassing or stressful situations involving traffic, itinerary length, road conditions, vehicle maintenance, physical environment (bus terminus), job post and supervision policies. On the other hand, factors such as enjoying driving, the work itself and being with workmates positively influenced the drivers' working conditions. In the propositions of the administration and human resources subsystems, some alternatives were found in order to remodel this activity

The use of Natural Gas Vehicle has had a fast increase lately. However, in order to have a continuous success this Program needs to develop converting devices of Otto-cycle engines, gasoline or alcohol, to the use of NGV (Natural Gas Vehicle) that presents low cost, maintaining the same original development of the vehicle and low level of emissions, considering the PROCONVE rules. Due to the need to diversify the matrix in order to avoid energetic dependence and due to strict pollution control, it has increased in the Brazilian market the number of vehicles converted to the use of NGV. The recent regulation of the PROCONVE, determining that the converted engines with kits should be submitted to emission testing, comes to reinforce the necessity of the proposed development. Therefore, if we can obtain kits with the characteristics already described, we can reach a major trust in the market and obtain an increase acceptance of the vehicle conversion for NGV. The use of natural gas as vehicle fuel presents several advantages in relation to liquid fuels. It is a vehicle fuel with fewer indexes of emissions when compared to diesel; their combustion gases are less harmful, with a major level of safety than liquid fuels and the market price is quite competitive. The preoccupation that emerges, and the motivation of this project, is to know which are the main justifications for such technology, well accepted in other countries, with a low index or emission, with a high level of safety, where its maintenance becomes low, reminding that for this it is necessary that this technology has to be used properly, and once available in the market will not motivate interest in the urban transportation companies in Brazil, in research centers in general. Therefore this project exists to show the society in a general way the current vision of the main governmental factors, of the national research centers and of the private companies concerning the use of natural gas vehicles in urban transport vehicles, in order to give a major reliability to the population as well as to motivate national market competitiveness with a low cost and reliable product and to enrich the national technology

This thesis carries through an application of Analysis of Multicriterion Decision with use of the method of Analytical Hierarchy Process (AHP) in the problematic one of taking of decision of the adoption of electronic collecting in the system of urban transport in the country, a subject that has been controversial. A modeling of criteria and alternatives is carried through and applied a questionnaire based on method AHP the excellent actors in the system of urban transport - Leading of the Managing Agency Public Municipal theatre of Urban Transports, Controller of Company of Bus, Controller of Labor union, Controller of Union of Companies, Communitarian Leader. The considered alternatives were: the maintenance of the current state with collectors, the implementation of electronic collection without collectors, and the implementation of electronic collection with collectors. The used criteria were: job, impact in the fare, control of the system, easiness of use, information. The study was carried through in the city of Natal, RN, where if the adoption of electronic collection argues and where this implementation in some bus lines between Natal and Parnamirim exists, city that integrates the region of the great Natal. The main results of the method evidence in a dimension, the viability of use of method AHP with questionnaire by means of validation of the judgments with analysis of variance beyond proper the normal mechanisms of analysis of consistency to the method, and in another one, the contribution of the analysis boarding multicriterion to become the judgments more clearly. The main results of the analysis help to show that although to models of criteria and distinct judgments of the actors, the method evidenced that it has inclination the adoption of the electronic collection on the current situation, even so with divergences between the maintenance or not of the collector. The research points to the possibility of accomplishment of the application of the AHP in successive rounds of judgments

Recognizing the importance the workplace has on mental health of the individual, the objective of this study was to investigate the relationship between the burnout syndrome and the sources of physical and emotional wear which permeate the work conditions of the urban public transport system of the city of Natal. Although existent in international literature, research on burnout in the professional transport category and studies directed to this category are not a tradition in Brazil. The research was carried out using 412 drivers and money-changers of two transport companies of Natal. To collect the data, two questionnaires and a semi-structured interview were used. The first instrument, developed and validated during the research, investigated the sources of wear and the second, the syndrome of burnout. As its main results, two sources of empirical wear were identified as follows: (1) the Conflict of Values and the Lack of Justice at the Workplace, (2) Union and Reward. Besides these, it was observed that there is an incidence of the syndrome of burnout among the drivers and money-changers of urban transport by bus, not only in the caring occupations studied before in Natal and Brazil and that this incidence is related to the sources of wear which permeate the work conditions of these professionals

This paper focuses public bus service as an essential component to urban dynamics in Natal, RN. Thereby, the approach of public bus service in Natal City, capital of Rio Grande do Norte State, has as analytical category the concept of territory used, in which techniques are seen as space elements allowing man and nature interact together. The result of this interaction, systematically analyzed in different historical phases, makes space to a geographical assessment of the theme. On a second moment, it is investigated how public bus system came to be and how it functions today in Natal City. In this sense, this paper looks for the main elements that contributed to explain the subject under investigation. For example, how public bus service has accompanied Natal s socio-spatial changes, and eventually, the use of territory carried out in the context of public bus system. These questions are highlighted in this paper because they play a fundamental role to an explanation about public bus circulation, urban vehicle policies and how they affect the use of territory nowadays.
