O comércio internacional vem desempenhando um papel cada vez mais vital no cenário da economia mundial. O fluxo de investimentos estrangeiros vem crescendo exponencialmente com potencial de gerar desenvolvimento econômico e oportunidades de lucro para os investidores. O crescimento da importância dessas duas disciplinas desafia as regras do Direito Internacional. Por um lado, o Direito Internacional dos Investimentos objeto de críticas em virtude da fragmentação normativa gerada pelo bilateralismo. Por outro lado, o Direito do Comércio Internacional consagrado através do multilateralismo da Organização Mundial do Comércio considerado, por muitos, como ultrapassado. As tentativas de regular em nível multilateral os investimentos estrangeiros restaram fracassadas e o existente sistema multilateral no comércio internacional rechaçado. Nessa dualidade entre investimentos estrangeiros e comércio internacional resta duvidoso o seu caráter de complementaridade. No entanto, a crescente e inegável interconexão entre investimentos estrangeiros e comércio internacional não somente representa um desenvolvimento para o panorama normativo de ambos, como também, contribui para o crescimento do padrão de tratamento, desenvolvimento econômico e trocas comerciais. Deixa de se tratar de uma relação entre duas disciplinas isoladas que, na verdade, são elementos complementares que devem ser desenvolvidos em conjunto para um crescimento econômico mais avançado e um desenvolvimento contributivo.

Dutos de transmissão são tubulações especialmente desenvolvidas para transportar produtos diversos a longas distâncias e representam a forma mais segura e econômica de transporte para grandes quantidades de fluidos. Os dutos de gás natural, denominados gasodutos, são usados para transportar o gás desde os campos de produção até os centros consumidores, onde o gás é inserido em redes de distribuição para entrega aos consumidores finais. Os gasodutos de transporte apresentam diversas características de monopólio natural, que são o principal argumento econômico para sua regulação. A regulação visa garantir que esta atividade seja explorada de maneira eficiente, refletindo em tarifas de transporte justas para os consumidores e que proporcionem o retorno adequado aos investidores, levando-se em consideração a quantidade de gás transportado. Neste contexto, o presente trabalho tem como objetivo propor metodologias de otimização multi-objetivo de projetos de redes de gasodutos de transporte, envolvendo métodos a posteriori. O problema de otimização formulado contempla restrições associadas ao escoamento do gás e o comportamento das estações de compressão. A solução do problema fornece um conjunto de projetos ótimos de redes de transporte em função da maximização da quantidade de gás natural transportado e da minimização da tarifa associada a esse serviço. A ferramenta foi aplicada a diversos estudos de caso com configurações típicas da indústria de transporte de gás natural. Os resultados mostraram que as metodologias propostas são capazes de fornecer subsídios que permitem ao tomador de decisão do ponto de vista regulatório realizar uma análise de trade-off entre a quantidade de gás transportado e a tarifa, buscando assim atender ao interesse da sociedade em relação à exploração do serviço de transporte

Como forma de impulsionar o crescimento econômico, governos de diversos países incentivam o empreendedorismo, a inovação e o desenvolvimento tecnológico. Para isto, se utilizam de programas governamentais por meio de políticas de incentivo ou subvenção econômica a empreendimentos com este perfil. No Brasil, o capital de risco público vem sendo oferecido à empresas inovadoras através dos fundos da série Criatec, com recursos do BNDES. Estas empresas possuem, principalmente, ativos intangíveis, que devem ser considerados pelos investidores em suas avaliações que antecedem o aporte de recursos. Neste contexto, esta pesquisa foi desenvolvida com o objetivo de analisar como a metodologia de avaliação de intangíveis utilizada pelo Fundo Criatec I do BNDES, como ferramenta de apoio de decisão de investimento de capital de risco público, considera os indicadores de inovação frente aos modelos teóricos propostos na literatura contábil. Para isto foi realizado estudo de campo através de entrevistas realizadas com os gestores do Fundo e com diversas empresas investidas por este. Por meio da pesquisa foi observado que é realizada profunda análise das empresas candidatas ao aporte de recursos através da avaliação de três fatores de risco. Foi possível verificar indicadores de inovação presentes nas metodologias de avaliação de intangíveis propostas na literatura contábil na análise de um destes fatores. Contudo foi possível identificar que os indicadores de inovação não são avaliados de forma pré definida e parametrizada no modelo utilizado pelo Fundo.

Inicialmente, o presente trabalho busca trazer um panorama geral sobre a relação entre o Estado hospedeiro e o investidor estrangeiro. Para tanto, faz-se um breve estudo sobre a soberania do Estado sobre os recursos naturais, destacando-se, dentre outros aspectos, a importância deste tema para o desenvolvimento dos povos, e sobre a contratação com o Estado, de forma a destacar, dentre as principais cláusulas presentes nos contratos entre Estado hospedeiro e investidor estrangeiro, a cláusula de arbitragem internacional de investimentos como um dos principais meios de equilíbrio desta relação. Analisa-se, por consequinte, a estrutura da arbitragem internacional de investimento, buscando trazer suas principais regras. O trabalho culmina em um breve estudo sobre alguns dos principais laudos arbitrais que envolvem não apenas os temas tratados ao longo do trabalho, mas também a relação entre o Estado e as empresas petrolíferas, dando-se destaque ao papel da arbitragem internacional de investimento na indústria do petróleo, dado ser esta uma indústria essencialmente internacional e de grande importância estratégica para o Estado.

Where natural resources are a key component of the rural economy, the ability of the poor to realize their visions for the future depends significantly on institutional structures that govern resource access and management. This case study reports on an initiative on the shores of Lake Kariba in Zambia, where lakeshore residents face competition over fishing, tourism, and commercial aquaculture. Multistakeholder dialogue produced agreements with investors and increased accountability of state agencies and traditional leaders, enabling communities to have greater influence over their futures through improvements in aquatic resource governance. The report documents the rationale for the approach followed and steps in the capacity-building process, discusses obstacles encountered, and identifies lessons for policymakers and practitioners seeking to implement a similar approach.

Raising design quality and value in the built environment requires continuous improvement, drawing on feedback from clients or occupiers and other industry players. The challenging task for architectural and engineering designers has always been to use their intellectual knowledge to deliver both forms of benefits, tangibles and intangibles, in the built environment. Increasingly as clients demand best value for money, there is a greater need to understand the potential from intangibles, to see projects not as ends in themselves but as means to improved quality of life and wealth creation. As we begin to understand more about how - through the design of the built environment - to deliver these improvements in outcomes, clients will be better placed to expect their successful delivery from designers, and designers themselves will be better placed to provide them. This paper discusses cross-disciplinary issues about intangibles and is aimed at designers, clients, investors and entrepreneurs within the built environment. It presents some findings from a minuscule study that investigated intangible benefits in a new primary school. © 2004 IEEE.

The experience of the Government in the recovery of loans for 28 foot mechanized vessels has been unsatisfactory. The author examines the various aspects which have contributed to this situation, and considers arrangements for financing purchase of such vessels. The risks associated with the investment in 38 foot vessels are high, and it seems that the reluctance of private investors to make the required contribution from personal funds is a result of fear of the unknown. Current incentives provided by the Government to the private sector for the purchase of 38 foot vessels are considered to be adequate.

Water service providers (WSPs) in the UK have statutory obligations to supply drinking water to all customers that complies with increasingly stringent water quality regulations and minimum flow and pressure criteria. At the same time, the industry is required by regulators and investors to demonstrate increasing operational efficiency and to meet a wide range of performance criteria that are expected to improve year-on-year. Most WSPs have an ideal for improving the operation of their water supply systems based on increased knowledge and understanding of their assets and a shift to proactive management followed by steadily increasing degrees of system monitoring, automation and optimisation. The fundamental mission is, however, to ensure security of supply, with no interruptions and water quality of the highest standard at the tap. Unfortunately, advanced technologies required to fully understand, manage and automate water supply system operation either do not yet exist, are only partially evolved, or have not yet been reliably proven for live water distribution systems. It is this deficiency that the project NEPTUNE seeks to address by carrying out research into 3 main areas; these are: data and knowledge management; pressure management (including energy management); and the associated complex decision support systems on which to base interventions. The 3-year project started in April of 2007 and has already resulted in a number of research findings under the three main research priority areas (RPA). The paper summarises in greater detail the overall project objectives, the RPA activities and the areas of research innovation that are being undertaken in this major, UK collaborative study. This study mainly evaluated the profitability of Fish Seed Multiplication Farms (FSMFs) having hatchery, nursery and hatchery-cum-nursery located in the districts of Jessore, Jhenidah and Narail in Bangladesh. The general findings of the study were that the investment in FSMFs with hatchery, nursery and hatchery-cum-nursery was highly profitable business. The results clearly indicated that the investment on hatchery was the most profitable than those of nursery and hatchery-cum-nursery operations from the viewpoints of individual investors. The results of sensitivity analysis suggested that the investment in nursery farm was a risky business with 20 per cent increase in operation and management as well was production costs or 20 per cent reduction in benefits if other things remaining the same. It was also evident from the study that the investors of FSMFs had currently been facing some crucial problems, which among others are: problems of inbreeding, shortage of brood fish, incidence of diseases, unavailability of certain inputs and lack of credit.

Innovation policies play an important role throughout the development process of emerging industries. However, existing policy studies view the process as a black-box, and fail to understand the policy-industry interactions through the process. This paper aims to develop an integrated technology roadmapping tool, in order to facilitate the better understanding of policy heterogeneity at the different stages of new energy industries in China. Through the case study of Chinese wind energy equipment manufacturing industry, this paper elaborates the dynamics between policy and the growth process of the industry. Further, this paper generalizes some Chinese specifics for the policy-industry interactions. As a practical output, this study proposes a policy-technology roadmapping framework that maps policy-market-product- technology interactions in response to the requirement for analyzing and planning the development of new industries in emerging economies (e.g. China). This paper will be of interest to policy makers, strategists, investors, and industrial experts. © 2011 IEEE.

The objective of the current report produced for the CGIAR Research Program on Aquatic Agricultural Systems (AAS) is to provide basic information on key constraints driving poverty and vulnerability in aquatic agricultural systems in the Tonle Sap region in Cambodia. Six objectives and corresponding research themes are included in the program: sustainable increases in productivity; equitable access to markets; resilience and adaptive capacity; empowering policies and institutions; reduced gender disparity; and expanded benefits for the resource-poor. In this report, the authors review the main aquatic agricultural systems (status, specific policies and strategies, interventions, challenges, and options), then review the main drivers of change. This leads to an identification of plans and strategies important to AAS, with a particular focus on perspectives, gaps and opportunities in national policies, community engagement, increased benefits, adaptive capacity, and gender. This review, of potential interest to decision makers and all development partners, leads to conclusions and recommendations aimed at policymakers and institutional as well as private investors in development.

New investors in aquaculture probably know that they can make mistakes as they continue to operate their farms. Whether the mistakes happen immediately or not are risks they take as long as the mistakes are manageable and can easily be corrected. But many aquaculturists who have long been in the business say that there are costly mistakes that can wipe out one's investment. This paper is based on interviews with experienced aquaculturists and some popular articles from other aquaculture newsletters (Lindberg and Pryor on ways to lose money in aquaculture, Proceedings, Sustainable Aquaculture 95) and shares some insights regarding mistakes that may be hidden to new investors but obvious to experienced aquaculturists.

This research aims to develop a capabilities-based conceptual framework in order to study the stage-specific innovation problems associated with the dynamic growth process of university spin-outs (hereafter referred to as USOs) in China. Based on the existing literature, pilot cases and five critical cases, this study attempts to explore the interconnections between the entrepreneurial innovation problems and the configuration of innovative capabilities (that acquire, mobilise and re-configure the key resources) throughout the lifecycle of a firm in four growth phases. This paper aims to contribute to the literature in a holistic manner by providing a theoretical discussion of USOs' development through adding evidence from a rapid growth emerging economy. To date, studies that have investigated the development of USOs in China recognised the heterogeneity of USOs in terms of capabilities still remain sparse. This paper aims to develop a multi-dimensional roadmapping tool to better analyse the dynamics between policy and industrial growth for new industries in China. Through reviewing the emergence process of Chinese wind turbine industry, this paper elaborates how policy and other factors influence the emergence of this industry along this path. Further, this paper generalises some Chinese specifics for the policy-industry dynamics. As a practical output, this study proposes a roadmapping framework that generalises some patterns of policy-industry interactions for the emergence process of new industries in China. Usually, firms that produce innovative global products are discussed within the context of developed countries. New ventures in developing countries are typically viewed as low-cost product providers that generate technologically similar products to those produced by developed economies. However, this paper argues that some Chinese university spin-outs (USOs), although rare, have adopted a novel 'catch-up' strategy to build global products on the basis of indigenous platform technologies. This paper attempts to develop a conceptual framework to address the question: how do these specific Chinese USOs develop their innovation capabilities to build global products? In order to explore the idiosyncrasies of the specific USOs, this paper uses the multiple case studies method. The primary data sources are accessed through semi-structured interviews. In addition, archival data and other materials are used as secondary sources. The study analyses the configuration of capabilities that are needed for idiosyncratic growth, and maps them to the globalisation processes. This paper provides a strategic 'roadmap' as an explanatory guide to entrepreneurs, policy makers and investors to better understand the phenomena. © 2014 Inderscience Enterprises Ltd.
