This article investigates the ethics of intervention and explores the decision to invade Iraq. It begins by arguing that while positive international law provides an important framework for understanding and debating the legitimacy of war, it does not cover the full spectrum of moral reasoning on issues of war and peace. To that end, after briefly discussing the two primary legal justifications for war (implied UN authorization and pre-emptive self-defence), and finding them wanting, it asks whether there is a moral 'humanitarian exceptions to this rule grounded in the 'just war' tradition. The article argues that two aspects of the broad tradition could be used to make a humanitarian case for war: the 'holy war' tradition and classical just war thinking based on natural law. The former it finds problematic, while the latter it argues provides a moral space to justify the use of force to halt gross breaches of natural law. Although such an approach may provide a moral justification for war, it also opens the door to abuse. It was this very problem that legal positivism from Vattel onwards was designed to address. As a result, the article argues that natural law and legal positivist arguments should be understood as complementary sets of ideas whose sometimes competing claims must be balanced in relation to particular cases. Therefore, although natural law may open a space for justifying the invasion of Iraq on humanitarian terms, legal positivism strictly limits that right. Ignoring this latter fact, as happened in the Iraq case, opens the door to abuse.

The study aimed to examine the factors influencing referral to rehabilitation following traumatic brain injury (TBI) by using social problems theory as a conceptual model to focus on practitioners and the process of decision-making in two Australian hospitals. The research design involved semi-structured interviews with 18 practitioners and observations of 10 team meetings, and was part of a larger study on factors influencing referral to rehabilitation in the same settings. Analysis revealed that referral decisions were influenced primarily by practitioners' selection and their interpretation of clinical and non-clinical patient factors. Further, practitioners generally considered patient factors concurrently during an ongoing process of decision-making, with the combinations and interactions of these factors forming the basis for interpretations of problems and referral justifications. Key patient factors considered in referral decisions included functional and tracheostomy status, time since injury, age, family, place of residence and Indigenous status. However, rate and extent of progress, recovery potential, safety and burden of care, potential for independence and capacity to cope were five interpretative themes, which emerged as the justifications for referral decisions. The subsequent negotiation of referral based on patient factors was in turn shaped by the involvement of practitioners. While multi-disciplinary processes of decision-making were the norm, allied health professionals occupied a central role in referral to rehabilitation, and involvement of medical, nursing and allied health practitioners varied. Finally, the organizational pressures and resource constraints, combined with practitioners' assimilation of the broader efficiency agenda were central factors shaping referral. What does the world's engagement with the unfolding crisis in Darfur tell us about the impact of the Iraq war on the norm of humanitarian intervention? Is a global consensus about a "responsibility to protect" more or less likely? There are at least three potential answers to these questions. Some argue that the merging of strategic interests and humanitarian goods amplified by the intervention in Afghanistan makes it more likely that the world's most powerful states will act to prevent or halt humanitarian crises. Others insist that the widespread perception that the United States and its allies "abused" humanitarian justifications to legitimate its invasion of Iraq has set back efforts to build a global consensus about humanitarian action. A third group argues that the "responsibility to protect" inhibits the potential for abuse and, as a result, consensus is likely to strengthen post-Iraq for precisely this reason. Through a detailed study of the international engagement with Darfur, I suggest that the latter two arguments have merit but need to be adjusted. I argue that the humanitarian intervention norm has changed in two subtle ways. First, while the strength of the norm itself has not changed, the credibility of the United States and U.K. as "norm carriers" has been significantly undermined. Second, while the "responsibility to protect" has been invoked to support international activism, it has also re-legitimated anti-interventionist arguments.

O objetivo central deste trabalho é verificar a influência das teorias econômicas na decisão das empresas de comércio atacadista em terceirizar o despacho aduaneiro na cidade de São Paulo. Para isso, a história da terceirização é apresentada brevemente, seguida do levantamento e estudos sobre terceirização e fundamentação das teorias econômicas que mostram possíveis influências na decisão das empresas em terceirizar o despacho aduaneiro: a Teoria do Custo das Transações, a Teoria da Agência, a Teoria do Resource-Based View (RBV) e a Teoria das Competências Essenciais. Além de contextualizar o comércio exterior brasileiro, levando em conta sua história e representatividade econômica, foram apresentadas as atividades ligadas ao despacho aduaneiro, que podem levar as empresas a terceirizar este serviço na cidade de São Paulo. Após a explanação sobre o tema, por meio de pesquisa empírica valendo-se de questionário de perguntas fechadas, aplicado a uma amostra não probabilística por conveniência, verificou-se a relação existente entre as teorias mencionadas acima e o quanto elas influenciam o processo das empresas importadoras e exportadoras do comércio atacadista para terceirizarem o despacho aduaneiro, foi usado o teste ANOVA e possíveis complementações como o do Teste de Dunnett T3 e do Teste de Tukey que constataram a diferença de respostas entre os respondentes que terceirizam totalmente, parcialmente ou não terceirizam esta atividade, além da diferença entre estes níveis de terceirização verificou-se que todas as teorias econômicas apresentadas neste trabalho possuem alguma influência sobre a terceirização do despacho aduaneiro.

A tese divide-se em três capítulos: no primeiro, estudam-se a forma e o lugar de Oseias 4,4-19; no segundo, os conteúdos da passagem bíblica em foco; e, no terceiro capítulo, abordam-se outros textos do livro de Oseias que corroborem com a tese apresentada a partir da análise de Oseias 4,4-19, feita nos capítulos anteriores. Estudar Oseias é abrir possibilidade de dar voz, novamente, ao antigo profeta e ouvir-lhe falar para a sua situação de israelita e representar seus irmãos na dura realidade da vida em Israel no século 8º a. C. O trecho selecionado para estudo apresenta muitos aspectos dessa vida, caracterizada por declarações, expressões e imagens vívidas, como a montar um quadro do seu cotidiano. E aqui reside o ponto nevrálgico das reflexões sobre a passagem bíblica: um cotidiano condenado pelo profeta, em nome de Javé, por encobrir, por meio de suas aparências e justificativas, o abuso de pessoas, até mediante a religião. O profeta não condena os israelitas, tampouco as mulheres (4,13-14), mas os senhores do poder , dentre os quais estão os sacerdotes, por deixarem suas responsabilidades em favor do povo de Javé para seguirem seus próprios interesses, a custa desse mesmo povo. Para reforçar suas acusações (e lamentações, vv.6 e 11), Oseias se utiliza, metaforicamente, de termos como a raiz hebraica hnz znh e palavras derivadas, a qual é entendida nesta tese como ser ou tornar-se independente , pois aqueles que mandam no país, têm procedido de maneira autônoma, longe das tradições javistas pautadas no verdadeiro conhecimento (tu^D^ da at) e na instrução (hr*oT torah) de deus, que podem ser percebidos na prática do direito (fP*v=m! mispat) e da solidariedade (ds#j# hesed). Oseias não pretende desmascarar cultos idolátricos pela simples preocupação de preservar ideias religiosas, e nem se preocupa com práticas, mesmo as de prostituição, por questões moralistas. Ele protesta contra a realidade de uma vida condenada ao esmagamento por grupos que, mostrando-se tão religiosos, tornaram-se, de fato, independentes do Javé do êxodo, do Javé dos pobres.

A presente pesquisa propõe-se a estudar possíveis relações entre idade, tempo de serviço como clérigo ou clériga na Igreja Metodista e auto-imagem destes últimos acerca de altruísmo. O tema do altruísmo é abordado a partir da filosofia, da psicanálise, dos estudos evolucionistas e da psicologia cognitiva do desenvolvimento moral. Examina as críticas e contribuições que a psicanálise de Sigmund Freud e Jacques Lacan deu aos debates sobre altruísmo, bem como as possíveis relações com o tema proporcionadas pelas investigações de Jean Piaget e Lawrence Kohlberg sobre a elaboração de juízos éticos pelas pessoas. Analisa a imagem que pastores(as) metodistas no Brasil têm ou apresentam acerca de si mesmos(as), no tocante a ações visando ao bem-estar de outros seres humanos, levando-se em conta suas respostas e justificativas ao questionário apresentado, no qual aparecem situações hipotéticas em que o altruísmo é requerido. Os resultados evidenciam que clérigos(as) mais idosos possuem uma auto-imagem mais positiva do que a apresentada pelos mais jovens, no tocante ao altruísmo.(AU)

Background Changing the relationship between citizens and the state is at the heart of current policy reforms. Across England and the developed world, from Oslo to Ontario, Newcastle to Newquay, giving the public a more direct say in shaping the organization and delivery of healthcare services is central to the current health reform agenda. Realigning public services around those they serve, based on evidence from service user's experiences, and designed with and by the people rather than simply on their behalf, is challenging the dominance of managerialism, marketization and bureaucratic expertise. Despite this attention there is limited conceptual and theoretical work to underpin policy and practice. Objective This article proposes a conceptual framework for patient and public involvement (PPI) and goes on to explore the different justifications for involvement and the implications of a rights-based rather than a regulatory approach. These issues are highlighted through exploring the particular evolution of English health policy in relation to PPI on the one hand and patient choice on the other before turning to similar patterns apparent in the United States and more broadly. Conclusions A framework for conceptualizing PPI is presented that differentiates between the different types and aims of involvement and their potential impact. Approaches to involvement are different in those countries that adopt a rights-based rather than a regulatory approach. I conclude with a discussion of the tension and interaction apparent in the globalization of both involvement and patient choice in both policy and practice. © 2009 Blackwell Publishing Ltd.

This paper considers the impact of new media on freedom of expression and media freedom within the context of the European Convention on Human Rights and European Court of Human Rights jurisprudence. Through comparative analysis of US jurisprudence and scholarship, this paper deals with the following three issues. First, it explores the traditional purpose of the media, and how media freedom, as opposed to freedom of expression, has been subject to privileged protection, within an ECHR context at least. Secondly, it considers the emergence of new media, and how it can be differentiated from the traditional media. Finally, it analyses the philosophical justifications for freedom of expression, and how they enable a workable definition of the media based upon the concept of the media-as-a-constitutional-component.

PURPOSE: Myopia is a global public health issue; however, no information exists as to how potential myopia retardation strategies are being adopted globally. METHODS: A self-administrated, internet-based questionnaire was distributed in six languages, through professional bodies to eye care practitioners globally. The questions examined: awareness of increasing myopia prevalence, perceived efficacy and adoption of available strategies, and reasons for not adopting specific strategies. RESULTS: Of the 971 respondents, concern was higher (median 9/10) in Asia than in any other continent (7/10, p<0.001) and they considered themselves more active in implementing myopia control strategies (8/10) than Australasia and Europe (7/10), with North (4/10) and South America (5/10) being least proactive (p<0.001). Orthokeratology was perceived to be the most effective method of myopia control, followed by increased time outdoors and pharmaceutical approaches, with under-correction and single vision spectacles felt to be the least effective (p<0.05). Although significant intra-regional differences existed, overall most practitioners 67.5 (±37.8)% prescribed single vision spectacles or contact lenses as the primary mode of correction for myopic patients. The main justifications for their reluctance to prescribe alternatives to single vision refractive corrections were increased cost (35.6%), inadequate information (33.3%) and the unpredictability of outcomes (28.2%). CONCLUSIONS: Regardless of practitioners' awareness of the efficacy of myopia control techniques, the vast majority still prescribe single vision interventions to young myopes. In view of the increasing prevalence of myopia and existing evidence for interventions to slow myopia progression, clear guidelines for myopia management need to be established.

The purpose of this study was to examine whether the manner in which civil defendants account for their behavior influences compensatory and punitive damage awards. Jurors read three civil trial summaries, in which I manipulated injury severity (high vs. low), defendant reprehensibility (high vs. low), defendant status (individual vs. corporate), and account (concession, excuse, justification or refusal) in a factorial design. I also included four control groups in which the defendant stipulated liability. In all other conditions, participants read that a jury had found the defendant negligent. Only defendant reprehensibility influenced punitive awards. Both plaintiff injury and defendant reprehensibility influenced compensatory awards. When individuals offered justifications and when corporations offered excuses, jurors awarded lower compensatory awards against low reprehensibility defendants than against high reprehensibility defendants. Negligence stipulations led to lower damage awards for individuals than for corporations. Additionally, concessions tended to produce lower awards when combined with a stipulation of negligence as opposed to a jury decision. These findings support the hypothesis that in cases in which the defendant is clearly negligent, circumstances exist in which stipulating negligence and offering an apologetic account will lead to reduced damage awards decisions. Results indicate that individual and corporate defendants offering justifications and refusals should first consider the reprehensibility of their actions. In a broader realm, findings demonstrate that the manner in which a jury perceives the explanation given by the defendant is dependent upon defendant characteristics and case-specific factors. ^

Ornamental plant production in the State of Florida is an anomaly with respect to current theories of globalization and particularly their explanation of the employment of low-wage, immigrant labor. Those theories dictate that unskilled jobs that do not need to be performed within highly developed countries are outsourced to where labor is cheaper and more flexible. However, the State of Florida remains an important site of ornamental plant production in the US amidst a global economic environment of outsourcing and transnational corporate expansion. This dissertation relies on 50 semi-structured interviews with insiders of the Florida plant nursery industry, focus groups, and participant observation to explain how US trade, labor, and migration policy-making at local levels are not removed from larger global processes taking place in the world since the 1970s. In Florida, elite market players of the plant nursery industry have been able to resist global trends in free trade, operating instead in a protected market. They have done this by appealing to scientific justifications and through arbitrary implementations of neoliberal ideology that keeps small and middle range business alive, while maintaining a seemingly endless supply of marginalized and exploited low-wage, immigrant workers.^

The overall objective of this research is to identify and analyze social representations of (the) teachers(the) Ranciere the Initial Training Program for Teachers in Office in Early Childhood Education - PROINFANTIL - UFRN/MEC on the teaching work, seeking to identify their constituent elements and understand the dynamics of your organization. We assume that these teachers work fundamentally, in the institutions of Early Childhood Education, with knowledge of common sense and related cultural inherent to be/do professor in the design of education guardian/giving handouts to ensure the physical integrity of children, causing a rift between the caring and educating. From this general objective, we elected as specific objectives: identify the social, economic and cultural backgrounds of these (the) teachers (sa); identify what is teaching work for them (the) as well as identify which the psychosocial implications driven by RS on teaching work that point to tensions between the training and the exercise teacher as activity profissional.Como theoretical foundation we opted for Social Representations Theory of Moscovici (2003), Jodelet (2001); Specificities of the teaching Work in Early Childhood Education: Kramer (2002; 2006); OliveiraFormosinho (2007); Zilma de Oliveira (2007), Teacher Training: Ramalho, Nunez and Galthier (2003) and Tardif and Lessard (2008), content Analysis: Bardin (2004). As methodological procedure, we chose the Central Nucleus theory, developed by Jean Claude Abric (2000). Contributed to the scope of this objective the 171 teachers (the) that concluded the Proinfantil NBs to participate of TALP with justifications. The corpus arising from evocations around the words suggested by Carlos Chagas Foundation: give classrooms, teacher, pupil and added the word Child Education, were subjected to a treatment with the aid of the EVOC software (2000), identifying the central nucleus. The results indicate the words more evoked and significant: Planning, child care, educating, and play. Indicating that for these (the) teachers (the) the teaching work in Early Childhood Education must have a systematic pedagogical to educate children. These words correspond to the specificity of being/doing teaching in Early Childhood Education. However, the data shows that it is a job with different characteristics of the teaching work in other stages of education
