Biopower, Otherness and Women's Agency in Assisted Reproduction. This sociological study analyses how, why and with what kind of consequences assisted reproductive technologies (ART) have become the primary technology for governing infertility in Finland both on the level of individuals and society. The phenomenon is construed as one the strategies of the Focaultian biopower since ART are political techniques of the beginning of life par excellence, as they are used to prepare the bodies of certain types of women to create certain kind of life, i.e. certain kind of children. Moreover, ART are interpreted to be gendered control techniques with which the pure, and at the same time prevailing, social order symbolised by a female body is maintained by naming and excluding otherness, unsuitable mother candidates and children. Finally, it is considered how the agency, subjectivity, of women experiencing infertility and seeking treatment appears in the prevailing context of ART. The introduction of IVF-based reproductive technologies to Finland and the treatment practices of the early 1990s have been studied on the basis of a clinic questionnaire, medical doctor interviews and articles of the Medical Journal Duodecim from 1969 to 2000. Opinions on the method of the treatment providers were studied by conducting a theme interview with fertilisation doctors in 1993. Experiences of women who have received treatment or experienced infertility were studied by means of a survey in 1994 and by analysing the content of messages in an online discussion forum in 2000. On the basis of the medical doctor interviews, significant criterion for choosing mother candidates turned out to be her vitality and her mental and physical health, which are considered prerequisites for a vitality of the child to be born. The hierarchies concerning children became evident. While people normally make their children on their own, this is what people experiencing infertility are trying to do as well. In the era of ART, the primary child is genetically the parents' own child, a secondary option for Finnish parents is a genetically Finnish child conceived by donated Finnish gametes or embryos and the last option is an adopted child of foreign origin. Women's agency mainly appears in their way of using ART as a technology of the self for self-control on one's own nature, which helps them to prepare their bodies in order to become pregnant in co-operation with a fertilisation doctor. Women's creative free agency exceeding governance appeared as a distinctive use of language with which they created shared meaning for their infertility experience, their own individual and group identity and distinctive reality. ART are very political techniques as they have a possibility to change the methods of having children and to shape life. Therefore, further sociological research on them is important and needed. The present cross-sectional study examined the effect of smoking on oral health in a birth cohort of 15 to 16-year-old Finnish adolescents. The hypothesis was that oral health parameters were poorer among smoking than non-smoking subjects and that a tobacco intervention program could be effective among the adolescents. The study was conducted in the Kotka Health Center, Kotka, Finland. Altogether 501 out of 545 subjects (15- to 16-year-old boys [n = 258] and girls [n = 243]) were clinically examined in 2004 and 2005. The sample frame was a birth cohort of all subjects in 1989 and 1990, living in Kotka. A structured questionnaire was also filled in by the participants to record their general health and health habits, such as smoking, tooth brushing, and medication used. The participants were classified into nonsmokers, current smokers, and former smokers. Subgingival pooled plaque samples were taken and stimulated salivary samples were also collected. The subjects were asked from which of seven professional groups (doctors, school nurses, dental nurses, general nurses, dentists, teachers and media professionals) they would prefer to receive information about tobacco. The two most popular groups they picked up were dentists and school nurses. Current smokers (n=127) were then randomly assigned into three groups: the dentist group (n =44), the school-nurse group (n =42), and the control group (n =39). The intervention was based on a national recommendation of evidence based guidelines by The Finnish Medical Society Duodecim ( 5A counseling system). Two months after the intervention, a second questionnaire was sent to the smokers in the intervention groups. Smoking cessation, smoking quantity per week, and self-rated addiction for smoking (SRA) were recorded. The results were analyzed using the R-statistical program. The results showed that 15% of the subjects had periodontitis. Smokers (25%) had more periodontitis than non-smokers (66%) (p < 0.001). Smoking boys (24%) also had more caries lesions than non-smokers (69%) (p < 0.001), and they brushed their teeth less frequently than non-smokers. Smoking significantly impaired periodontal health of the subjects, even when the confounding effects of plaque and tooth brushing were adjusted. Smoking pack-years, intensified the effects of smoking. Periodontal bacteria Prevotella nigrescens, Prevotella intermedia, Tannerella forsythia and Treponema denticola were more frequently detected among the smokers than non-smokers, especially among smoking girls. Smoking significantly decreased the values of both the salivary periodontal biomarkers MMP-8 (p=0.04) and PMN elastase (p=0.02) in boys. The effect was strengthened by pack years of smoking (MMP-8 p=0.04; elastase p0.01). Of those who participated in the intervention, 19 % quit smoking. The key factors associated with smoking cessation were best friend`s influence, nicotine dependence and diurnal type. When the best friend was not a smoker, the risk ratio (RR) of quit smoking after the intervention was 7.0 (Cl 95% 4.6 10.7). Of the diurnal types, the morning people seemed to be more likely to quit (RR 2.2 [Cl 95% 1.4 3.6]). Nicotine dependence also elicited an opposite effect: those who scored between 3 and 5 dependence scores were less likely to quit. In conclusion, smoking appears to be a major etiological risk factor for oral health. However, the early signs of periodontal disease were mild in the subjects studied. Based on the opinions of the adolescent s, dental professionals may have a key position in their smoking cessation. The harmful effects of smoking on oral health could be used in counselling. Best friend`s influence, nicotine dependence and diurnal type, all factors associated with smoking cessation, should be taken more carefully into account in the prevention programs for adolescents.

Decía Tomás de Aquino que “lex non est ipsum ius, proprie loquendo, sed aliqualis ratio iuris” 1: “[…] la ley no es el mismo derecho, propiamente hablando, sino cierta racionalización del derecho”. En concordancia con esto, entre nosotros enseñaba Alberdi que “saber, pues, leyes, no es saber derecho”, dado que “las leyes no son más que la imagen imperfecta y frecuentemente desleal del derecho que vive en la armonía viva del organismo social”, del cual hay que “conocer su genio, su misión, su rol”, porque “es el alma, la vida, el espíritu de las leyes” 2. Esto lleva, según el maestro argentino, a que “en materia de leyes, no se puede hacer nada, si no se sabe el derecho”3. El derecho no es la ley, entonces, pero sin embargo la ley tiene una relación estrecha con el derecho, del cual a veces es su causa eficiente, como ocurre con las materias de mero Derecho Positivo, y otras, es una suerte de causa ejemplar, cuando refleja la justicia natural de las cosas. La causa final inmediata de toda ley, por otra parte, debe ser el derecho, y la mediata, el bien común. El hecho, entonces, de que las leyes tengan una función segunda con respecto al derecho no las vuelve menos importantes. El conocimiento de las leyes, así, no es algo ajeno al oficio del jurista, sino que es un elemento fundamental para la búsqueda de la justicia en los casos concretos...

O clareamento dental é o meio disponível mais simples, comum e conservador para o cirurgião-dentista proporcionar aos pacientes o padrão de cor de seus dentes mais desejado. Em alguns casos, os dentes que vão ser clareados podem apresentar restaurações realizadas com compósitos dentais, que são mais suscetíveis a alterações químicas, quando comparados a outros materiais restauradores. Alguns estudos mostraram que diferentes concentrações de agentes clareadores levaram a um aumento significativo da rugosidade superficial e das porosidades em compósitos dentais. Este estudo avaliou o efeito de dois agentes clareadores (Whiteness HP Blue 20%, Whiteness HP Max) sobre a rugosidade superficial de dois compósitos dentais, um micro-híbrido (Esthet X, Denstply) e outro nanoparticulado (Z 350, 3M ESPE). Um total de oito corpos de prova (9 x 2 mm) foram confeccionados com auxílio de uma matriz de teflon, sendo divididos em 4 grupos (Esthet X + Whiteness HP Blue 20%; Esthet X + Whiteness HP Max; Z 350 + Whiteness HP Blue 20%; Z 350 + Whiteness HP Max), sendo n=2. Os corpos de prova foram armazenados em saliva artificial neutra e, após 24 horas, foram polidos com discos de óxido de Alumínio (Sof-lex, 3M ESPE). Após sete dias de imersão salivar, cada corpo de prova foi levado a um microscópio de força atômica para obtenção do valor inicial de rugosidade superficial (Ra em nm). Em seguida, sem remover o corpo de prova do microscópio, o agente clareador foi aplicado sobre a superfície do corpo de prova, segundo as instruções do fabricante, de modo que permitisse uma posterior observação da mesma área do corpo de prova observada inicialmente, para obtenção do valor final de rugosidade superficial. Imagens em duas e três dimensões foram obtidas de cada corpo de prova para observação de alterações da topografia. Os resultados foram tratados estatisticamente por ANOVA e pelo teste de contraste Student-Newman-Keuls (p < 0,05). Não houve alteração significativa na rugosidade superficial (Ra) dos corpos da prova de compósitos micro-híbrido e nanoparticulado, submetidos aos agentes clareadores Whiteness HP Blue 20% e Whiteness HP Maxx. No entanto, independente do agente clareador utilizado, foram observadas maiores alterações topográficas nas imagens de microscopia de força atômica da superfície do compósito micro-híbrido do que nas imagens do nanoparticulado.

Este trabalho trata do funcionamento da prescrição extintiva relacionada a ações pessoais, além da decadência, no âmbito do direito internacional privado. Primeiramente é feita uma breve análise histórica e comparatista do direito de regência da prescrição em relações de caráter internacional antes de se demonstrar a solução abarcada pelo direito brasileiro: a regência pela lei que rege a obrigação (lex causae). Apesar de ser um instituto de direito civil, substantivo, a prescrição possui muitas ligações com o direito processual, uma vez que o principal efeito de sua consumação é tonar inexigível uma obrigação e, em decorrência, pôr fim a um processo. Assim, o autor detalha em seguida as questões que são regidas pela lex causae e as que são regidas pela lex fori (aqui abrangendo também a lex arbitri) em matéria de prescrição no direito brasileiro, antes de tratar minuciosamente de como se opera a exceção da ordem pública para afastar a aplicação da lex causae estrangeira em matéria de prescrição no Brasil (incluindo também regras de aplicação imediata lois de police brasileiras). Ao final, cuida-se da prescrição na homologação e execução de sentenças estrangeiras no Brasil.

O objetivo deste estudo foi avaliar pinos pré-fabricados de fibra de vidro (White Post DC/FGM) submetidos à customização por desgaste da porção apical. Experimento 1: 5 pinos n. 4 foram divididos em 5 grupos (G) de acordo com o instrumento de desgaste: GA - sem desgaste, GB- mini torno industrial (Dentsply), GC - ponta diamantada n. 3195F (KG Sorensen), GD - disco de lixa de granulação média (Sof-Lex/3M/ESPE), GE- alicate (Tramontina). Observou-se a micromorfologia dos pinos em microscópio eletrônico de varredura (ZEISS/DSM 960). Experimento 2: 60 pinos de diferentes diâmetros foram divididos em 6 grupos: G0 - pinos n. 0,5, G1 - pinos n. 1, G2 - pinos n. 2, G3 - pinos n. 3, G4 - pinos n.4, G5 - pinos n. 4 com terço apical desgastado com discos de lixa até o equivalente ao terço apical dos pinos n. 2. Os pinos foram submetidos ao teste de flexão de 3 pontos na máquina de ensaios universal (Instron 5500 R), conforme ISO 10477. Experimento 3: 20 caninos humanos permanentes sofreram tratamento endodôntico e remoção das coroas clínicas padronizando 15 mm de remanescente radicular. Os dentes foram incluídos em resina acrílica com simulação do ligamento periodontal, receberam férula de 2 mm e foram divididos em 2 grupos: GI - pinos n. 4 cimentados em condutos preparados com broca equivalente ao pino (FGM), GII - pinos n. 4 customizados no terço apical cimentados em condutos preparados com brocas (FGM) equivalentes aos pinos n. 2 em 10 mm e n. 4 em 5 mm. Os pinos foram cimentados com cimento resinoso (Rely X U100/3M/ESPE), os corpos de prova receberam coroas diretas de resina composta (Enforce Core/Dentsply) padronizadas com coras de policarbonato (TDV) e foram submetidos ao teste de resistência à fratura na Instron a 45da ferramenta cilíndrica, com força de 500 N aplicada a 2 mm da incisal na face palatina/lingual, com velocidade de 0,5 mm/min até falha. O padrão de fratura foi classificado em favorável ou desfavorável. Os resultados foram tratados estatisticamente por teste de análise de variância (ANOVA, p<0,05). Os resultados dos testes de flexão e fratura foram respectivamente: G0 - 58,406,40; G1 - 83,959,43; G2- 103,4219,17; G3 - 160,7817,30; G4 - 170,4711,28; G5 - 106,3521,96; GI - 303,0262,21 e GII - 402,81131,97. O padrão de fratura foi tratado por Mann-Whitney que observou semelhança estatística entre os grupos. Concluiu-se que o desgaste de pinos de fibra de vidro com pontas diamantadas ou discos de lixa produz alterações micromorfológicas aceitáveis. O corte com alicate deve ser evitado. A customização por desgaste da porção apical de pinos de fibra de vidro diminui a resistência à flexão a valores aceitáveis. Dentes restaurados com pinos de fibra de vidro customizados por desgaste possuem resistência à fratura superior a dentes restaurados com pinos intactos. A customização por desgaste facilita a adaptação do pino ao conduto radicular e preserva a estrutura dental.

Millions of crabs are sorted and discarded in freezing conditions each year in Alaskan fisheries for Tanner crab (Chionoecetes bairdi) and snow crab (C. opilio). However, cold exposures vary widely over the fishing season and among different vessels, and mortalities are difficult to estimate. A shipboard experiment was conducted to determine whether simple behavioral observations can be used to evaluate crab condition after low-temperature exposures. Crabs were systematically subjected to cold in seven different exposure treatments. They were then tested for righting behavior and six different ref lex actions and held to monitor mortality. Crabs lost limbs, showed ref lex impairment, and died in direct proportion to increases in cold exposure. Righting behavior was a poor predictor of mortality, whereas reflex impairment (scored as the sum of reflex actions that were lost) was an excellent predictor. This composite index could be measured quickly and easily in hand, and logistic regression revealed that the relationship between reflex impairment and mortality correctly predicted 80.0% of the mortality and survival for C. bairdi, and 79.4% for C. opilio. These relationships provide substantial improvements over earlier approaches to mortality estimation and were independent of crab size and exposure temperature.

Lymphangioleiomyomatosis (LAM) is a rare lung-metastasizing neoplasm caused by the proliferation of smooth muscle-like cells that commonly carry loss-of-function mutations in either the tuberous sclerosis complex 1 or 2 (TSC1 or TSC2) genes. While allosteric inhibition of the mechanistic target of rapamycin (mTOR) has shown substantial clinical benefit, complementary therapies are required to improve response and/or to treat specific patients. However, there is a lack of LAM biomarkers that could potentially be used to monitor the disease and to develop other targeted therapies. We hypothesized that the mediators of cancer metastasis to lung, particularly in breast cancer, also play a relevant role in LAM. Analyses across independent breast cancer datasets revealed associations between low TSC1/2 expression, altered mTOR complex 1 (mTORC1) pathway signaling, and metastasis to lung. Subsequently, immunohistochemical analyses of 23 LAM lesions revealed positivity in all cases for the lung metastasis mediators fascin 1 (FSCN1) and inhibitor of DNA binding 1 (ID1). Moreover, assessment of breast cancer stem or luminal progenitor cell biomarkers showed positivity in most LAM tissue for the aldehyde dehydrogenase 1 (ALDH1), integrin-beta 3 (ITGB3/CD61), and/or the sex-determining region Y-box 9 (SOX9) proteins. The immunohistochemical analyses also provided evidence of heterogeneity between and within LAM cases. The analysis of Tsc2-deficient cells revealed relative over-expression of FSCN1 and ID1; however, Tsc2-deficient cells did not show higher sensitivity to ID1-based cancer inhibitors. Collectively, the results of this study reveal novel LAM biomarkers linked to breast cancer metastasis to lung and to cell stemness, which in turn might guide the assessment of additional or complementary therapeutic opportunities for LAM.

利用LB技术制备了2-十八烷基-7,7,8,8-四氰基对醌二甲烷(C18TCNQ)和3,3,′5,5′-四甲基联苯胺(TMB)的电荷转移配合物(CT comp lex)薄膜,即TMB.C18TCNQ LB膜.利用红外(IR)光谱、紫外-可见-近红外(UV-V is-NIR)光谱以及原子力显微镜(AFM)研究了TMB.C18TCNQ在LB膜中的分子取向、结构及表面形貌.结果表明,配合物为混合堆积类型,LB膜中电子给体TMB和电子受体C18TCNQ的环面分别垂直于固体基板表面,而且给体和受体以面对面的方式堆积.5层TMB.C18TCNQ LB膜的AFM照片显示,其表面形貌是由许多堆积在一起的六边形片状微晶组成的,微晶的宽度约为180 nm.与通过LB技术和掺杂技术制备的TMB.C18TCNQ掺杂膜比较,TMB.C18TCNQ LB膜具有明显不同的结构,其长的脂肪烃链有向垂直于基板表面方向变化的趋势,LB膜与掺杂膜的表面形貌也有明显不同.这表明不同的制备方法可以影响薄膜的结构和形貌.

The power of human rights idea and its expansion are connected with the experience of so far unprecedented pain and cruelty caused by man to man during the Second World War. Doctrine of legal positivism strenghtened totalitarian systems. One of the essential goals that were set by totalitarian systems was ethnic cleansing within both one’s and subjugated communities. To achieve this goal, concentration camps were established. This Second World War’s events gave raise to a question: does the common morality of the whole mankind exist? The Nuremberg Trials based on conviction that this common morality of the whole mankind exists. In this lawsuits Nazis were on trials for mass murder and crimes against humanity despite the fact that this crimes did not exist as a criminal offences in international law of that time. Lawyers of Nazis argued that their clients should not have been on trials for crimes against humanity because the rule “lex retro non agit” (“the law does not operate retroactively”) should have been in force. International Military Tribunal dismissed this argument – it was stated they tried Nazis are responsible for acts resulting from breach of the natural law. Therefore, the primacy of natural law over civil law (was approved and they admitted that morality and law are essential components of international reality. Since The Nuremberg Trials, the process of making international relations more ethical proceeded consistently through positivisationi.e. introducing human rights ideas to civil law (this issue is included in the Part I of the book: Positivisation of human rights idea). In this way, contemporary human rights as civil law arose, established on the basis of international agreement. Using them in order to legitimize and validate humanitarian interventions undertaken in various parts of the world became the common standard. However, positivisation of human rights idea did not mean that one common paradigm was accepted. Many interpretation of human rights arose and many new human rights formed in concrete cultures. It gives raise to a question about validity of interventions especially in the context of cultural differences in various parts of the world that influence perception, understanding and interpretation of human rights (this issues are discussed in Part II of this book). At present human rights are not only relativized to cultural contexts but undergo semantic changes as a result of globalisation process as well (Part II of the book: Human rights idea vs globalisation). Moreover, the propositions of establishing institutions and global structures that would strengthen human rights idea appear, interalia new propositions of citizenship defining (ujmowanie jako definiowanie)in response to a decreasing role and significance of nation states in the age of globalization. The idea of human rights dominated present-day law, culture and daily life both in local and global dimension. Human rights issue became essential for philosophy, especially political philosophy.

Natural and human-made disasters cause on average 120,000 deaths and over US$140 billion in damage to property and infrastructure every year, with national, regional and international actors consistently responding to the humanitarian imperative to alleviate suffering wherever it may be found. Despite various attempts to codify international disaster laws since the 1920s, a right to humanitarian assistance remains contested, reflecting concerns regarding the relative importance of state sovereignty vis-à-vis individual rights under international law. However, the evolving acquis humanitaire of binding and non-binding normative standards for responses to humanitarian crises highlights the increasing focus on rights and responsibilities applicable in disasters; although the International Law Commission has also noted the difficulty of identifying lex lata and lex ferenda regarding the protection of persons in the event of disasters due to the “amorphous state of the law relating to international disaster response.” Therefore, using the conceptual framework of transnational legal process, this thesis analyses the evolving normative frameworks and standards for rights-holders and duty-bearers in disasters. Determining the process whereby rights are created and evolve, and their potential internalisation into domestic law and policy, provides a powerful analytical framework for examining the progress and challenges of developing accountable responses to major disasters.

Self-regulation of blood glucose in diabetics via insulin administration introduces the risk of hypoglycemia. Previous studies have shown hypoglycemia damages the dentate gyrus, an area of the hippocampus associated with anxiety- and depressive-like behavior. To date, only depressive-like behaviors have been observed following moderate hypoglycemia. This study sought to examine whether acute moderate hypoglycemia induces both behaviors due to high clinical comorbidity. One episode of moderate hypoglycemia was induced in a male Sprague-Dawley rat. Twenty-four hours later, hippocampal function was evaluated via the elevated plus maze and the forced swim test to assess anxiety-like and depressive-like behavior. Results, though not statistically significant, suggested that acute moderate hypoglycemia may increase anxiety- and depressive-like behavior. These findings may elucidate hypoglycemia-related behavioral changes.

This paper uses a case study approach to consider the effectiveness of the electronic survey as a research tool to measure the learner voice about experiences of e-learning in a particular institutional case. Two large scale electronic surveys were carried out for the Student Experience of e-Learning (SEEL) project at the University of Greenwich in 2007 and 2008, funded by the UK Higher Education Academy (HEA). The paper considers this case to argue that, although the electronic web-based survey is a convenient method of quantitative and qualitative data collection, enabling higher education institutions swiftly to capture multiple views of large numbers of students regarding experiences of e-learning, for more robust analysis, electronic survey research is best combined with other methods of in-depth qualitative data collection. The advantages and disadvantages of the electronic survey as a research method to capture student experiences of e-learning are the focus of analysis in this short paper, which reports an overview of large-scale data collection (1,000+ responses) from two electronic surveys administered to students using surveymonkey as a web-based survey tool as part of the SEEL research project. Advantages of web-based electronic survey design include flexibility, ease of design, high degree of designer control, convenience, low costs, data security, ease of access and guarantee of confidentiality combined with researcher ability to identify users through email addresses. Disadvantages of electronic survey design include the self-selecting nature of web-enabled respondent participation, which tends to skew data collection towards students who respond effectively to email invitations. The relative inadequacy of electronic surveys to capture in-depth qualitative views of students is discussed with regard to prior recommendations from the JISC-funded Learners' Experiences of e-Learning (LEX) project, in consideration of the results from SEEL in-depth interviews with students. The paper considers the literature on web-based and email electronic survey design, summing up the relative advantages and disadvantages of electronic surveys as a tool for student experience of e-learning research. The paper concludes with a range of recommendations for designing future electronic surveys to capture the learner voice on e-learning, contributing to evidence-based learning technology research development in higher education.
