This dissertation aims to study the loyalty clauses present in most of the long lasting service contracts. We introduce its main features and the consequences that arise from breaching of contract. We analyze the presence of loyalty periods in the Portuguese legislation. In this sense, we discuss Decree-Law 446/85, Law 24/96, Decree-Law 57/2008 and Decree-Law 56/2010. The loyalty period is the minimum period of time for which the contract should be maintained. In most cases, when this obligation is not fulfilled a penalty clause is set, intending to push the weaker party to comply with the contract or sanction it when the party fails to do so. We conclude that the contractual relationship where there is a loyalty period is usually an unbalanced relationship because it only protects the interest of one party. The penalty clause should not be admitted between parties with unequal bargaining powers. The contractual imbalance is not limited to consumer contracts.

Choline supplementation improving memory functions in rodents is assumed to increase the synthesis and release of acetylcholine in the brain. We have found that a combined pre- and postnatal supplementation results in long-lasting facilitation of spatial memory in juvenile rats when training was conducted in presence of a local salient cue. The present work was aimed at analysing the effects of peri- and postnatal choline supplementation on spatial abilities of naive adult rats. Rats given a perinatal choline supplementation were trained in various cued procedures of the Morris navigation task when aged 5 months. The treatment had a specific effect of reducing the escape latency of the rats when the platform was at a fixed position in space and surrounded by a suspended cue. This effect was associated with an increased spatial bias when the cue and platform were removed. In this condition, the control rats showed impaired spatial discrimination following the removal of the target cue, most likely due to an overshadowing of the distant environmental cues. This impairment was not observed in the treated rats. Further training with the suspended cue at unpredictable places in the pool revealed longer escape latencies in the control than in the treated rats suggesting that this procedure induced a selective perturbation of the normal but not of the treated rats. A special probe trial with the cue at an irrelevant position and no escape platform revealed a significant bias of the control rats toward the cue and of the treated rats toward the uncued spatial escape position. This behavioural dissociation suggests that a salient cue associated with the target induces an alternative "non spatial" guidance strategy in normal rats, with the risk of overshadowing of the more distant spatial cues. In this condition, the choline supplementation facilities a spatial reliance on the cue, that is an overall facilitation of learning a set of spatial relations between several visual cues. As a consequence, the improved escape in presence of the cue is associated with a stronger memory of the spatial position following disappearance of the cue. This and previous observations suggest that a specific spatial attention process relies on the buffering of highly salient visual cues.to facilitate integration of their relative position in the environment.

To specifically induce a mucosal antibody response to purified human papillomavirus type 16 (HPV16) virus-like particles (VLP), we immunized female BALB/c mice orally, intranasally, and/or parenterally and evaluated cholera toxin (CT) as a mucosal adjuvant. Anti-HPV16 VLP immunoglobulin G (IgG) and IgA titers in serum, saliva, and genital secretions were measured by enzyme-linked immunosorbent assay (ELISA). Systemic immunizations alone induced HPV16 VLP-specific IgG in serum and, to a lesser extent, in genital secretions but no secretory IgA. Oral immunization, even in the presence of CT, was inefficient. However, three nasal immunizations with 5 microgram of VLP given at weekly intervals to anesthetized mice induced high (>10(4)) and long-lasting (>15 weeks) titers of anti-HPV16 VLP antibodies in all samples, including IgA and IgG in saliva and genital secretions. CT enhanced the VLP-specific antibody response 10-fold in serum and to a lesser extent in saliva and genital secretions. Nasal immunization of conscious mice compared to anesthetized mice was inefficient and correlated with the absence of uptake of a marker into the lung. However, a 1-microgram VLP systemic priming followed by two 5-microgram VLP intranasal boosts in conscious mice induced both HPV16 VLP-specific IgG and IgA in secretions, although the titers were lower than in anesthetized mice given three intranasal immunizations. Antibodies in serum, saliva, and genital secretions of immunized mice were strongly neutralizing in vitro (50% neutralization with ELISA titers of 65 to 125). The mucosal and systemic/mucosal HPV16 VLP immunization protocols that induced significant titers of neutralizing IgG and secretory IgA in mucosal secretions in mice may be relevant to genital HPV VLP-based human vaccine trials.

Lyme disease has been associated with many systemic and ocular complications. The authors' patient, a 26-year-old man, developed recurrent pars planitis with two episodes of acute pericarditis. Extensive medical investigations were negative except for a highly positive western blot for Borrelia burgdorferi. Specific antibiotic treatment for Lyme disease was followed by a long lasting period without any relapse.

We examined the cognitive and emotional sequelae following mild head injury (MHI; e.g., concussion) in high-functioning individuals and whether persons with MHI pre~ent, both physiologically and via self-report, in a manner different from (i.e., underaroused) that of persons who have no history of head injury. We also investigated the effect arousal state ~as on the cognitive performance of this population. Using a quasiexperimental research design (N = 91), we examined changes in attention, working memory, and cognitive flexibility (subtests ofthe WAIS-III, 1997,WMS-III, 1997, & DKEFS, 2002) as a function of manipulated arousal (i.e., induced psychosocial stress/activation; reduced activation/relaxation). In addition to self-reported arousal and state anxiety (State-Trait Anxiety Inventory; Speilberger, 1983a) measures, physiological indices of arousal state (i.e., electrodermal responsivity, heart rate, and respiration activity) were recorded (via Polygraph Professional Suite, 2008) across a 2.5 hour interval while completing various cognitive tasks. Students also completed the Post-concussive Symptom Checklist (Gouvier et aI., 1992). The results demonstrate that university students who report a history ofMHI (i.e., "altered state of consciousness") experience significantly lower levels of anxiety, were physiologically underaroused, and were less responsive to stressors in their environment, compared to their non-~HI cohorts. As expected, cognitive flexibility (but not other neuropsychological measures of cognition) was advantaged with increased stress, and disadvantaged with reduced stress, in persons with reported MHI, but not for those without reported MHI which provided limited support for our hypothesis. Further, university students who had no complaints related to their previous MHI endorsed a greater number of traditional post-concussive symptoms in terms of intensity, duration and frequency as compared to students who did not report a MHI. The underarousal in traumatic brain injury has been associated with (ventromedial prefrontal cortex) VMPFC disruption and may be implicated in MHI generally. Students who report sustaining a previous MHI may be less able to physiologically respond and/or cognitively appraise, stressful experiences as compared to their no-MHI cohort and experience persistent, long-lasting consequences despite the subtle nature of a history of head injury.

Exposure to chronic stress can alter the structure and function of brain regions involved in learning and memory, and these effects are typically long-lasting if the stress occurs during sensitive periods of development. Until recently, adolescence has received relatively little attention as a sensitive period of development, despite marked changes in behaviour, heightened reactivity to stressors, and cognitive and neural maturation. Therefore, the purpose of the present study was to investigate the long-term effects of chronic stress in adolescence on two spatial learning and memory tasks (Morris water maze and Spatial Object Location test) and on a working memory task (Delayed Alternation task). Male rats were randomly assigned to chronic social instability stress (SS; daily 1 hour isolation and subsequent change of cage partner between postnatal days 30 and 45) or to a no-stress control group (CTL). During acquisition learning in the Morris water maze task, SS rats demonstrated impaired long-term memory for the location of the hidden escape platform compared to CTL rats, although the impairment was only seen after the first day of training. Similarly, SS rats had impaired long-term memory in the Spatial Object Location test after a long delay (240 minutes), but not after shorter delays (15 or 60 minutes) compared to CTL rats. On the Delayed Alternation task, which assessed working memory across delays ranging from 5 to 90 seconds, no group differences were observed. These results are partially in line with previous research that revealed adult impairment on spatial learning and memory tasks after exposure to chronic social instability stress in adolescence. The observed deficits, however, appear to be limited to long-term memory as no group differences were observed during brief periods of retention.

During infection, the model plant Arabidopsis thaliana is capable of activating long lasting defence responses both in tissue directly affected by the pathogen and in more distal tissue. Systemic acquired resistance (SAR) is a type of systemic defence response deployed against biotrophic pathogens resulting in altered plant gene expression and production of antimicrobial compounds. One such gene involved in plant defence is called pathogenesis-related 1 (PR1) and is under the control of several protein regulators. TGA II-clade transcription factors (namely TGA2) repress PR1 activity prior to infection by forming large oligomeric complexes effectively blocking gene transcription. After pathogen detection, these complexes are dispersed by a mechanism unknown until now and free TGA molecules interact with the non-expressor of pathogenesis-related gene 1 (NPR1) protein forming an activating complex enabling PR1 transcription. This study elucidates the TGA2 dissociation mechanism by introducing protein kinase CK2 into this process. This enzyme efficiently phosphorylates TGA2 resulting in two crucial events. Firstly, the DNA-binding ability of this transcription factor is completely abolished explaining how the large TGA2 complexes are quickly evicted from the PR1 promoter. Secondly, a portion of TGA2 molecules dissociate from the complexes after phosphorylation which likely makes them available for the formation of the TGA2-NPR1 activating complex. We also show that phosphorylation of a multiserine motif found within TGA2’s N terminus is responsible for the change of affinity to DNA, while modification of a single threonine in the leucine zipper domain seems to be responsible for deoligomerization. Despite the substantial changes caused by phosphorylation, TGA2 is still capable of interacting with NPR1 and these proteins together form a complex on DNA promoting PR1 transcription. Therefore, we propose a change in the current model of how PR1 is regulated by adding CK2 which targets TGA2 displacing it’s complexes from the promoter and providing solitary TGA2 molecules for assembly of the activating complex. Amino acid sequences of regions targeted by CK2 in Arabidopsis TGA2 are similar to those found in TGA2 homologs in rice and tobacco. Therefore, the molecular mechanism that we have identified may be conserved among various plants, including important crop species, adding to the significance of our findings.

Direct high fat (HF) feeding has adverse effects on body composition and bone development in rodents. However, it is unclear whether maternal HF feeding has similar effects in male rat offspring. The objectives of this thesis were to determine if maternal HF feeding altered body composition, plasma hormones, bone development, and bone fatty acid composition in male offspring at weaning and 3 months of age. Maternal HF feeding increased bone mass and altered femur fatty acid composition at weaning, without differences in fat mass, lean mass, plasma hormones, or bone mass (femur or lumbar vertebrae). However, early differences did not persist at 3 months of age or contribute to lower bone strength – following consumption of a control diet post-weaning. These findings suggest that maternal HF feeding can alter body composition and bone development in weanling male offspring, without long-lasting effects if a healthy control diet is consumed post-weaning.

High fat diet (HFD) consumption in rodents alters body composition and weakens bones. Whether female offspring of mothers consuming a HFD are similarly affected at weaning and early adulthood is unclear. This research determined whether maternal HFD contributes to long-lasting alterations in body composition and bone health of female offspring. Rats were fed control or HFD for 10 weeks prior to and throughout pregnancy and lactation. Female offspring were studied at weaning or 3 months of age (consumed control diet). Main findings in female offspring: maternal HFD decreased lean mass, increased fat mass and femoral BMD at weaning, but not at 3 months; weanling femoral lipid composition reflected maternal diet, persisting to 3 months of age (decreased total and n6 polyunsaturates, increased saturates); and no differences in femoral strength at 3 months. In summary, 3 month old female offspring have similar body composition and bone health regardless of maternal diet.

In mice, exposure to isoflavones (ISO), abundant in soy infant formula, during the first 5 d of life alters structural and functional development of reproductive organs. Effects of longer exposures are unknown. The study objective was to evaluate whether exposure to a combination of daidzein and genistein in the first 10 compared to 5 d of life results in greater adverse effects on ovarian and uterine structure in adult mice. Thirteen litters of 8–12 pups were cross-fostered and randomized to corn oil or ISO (2 mg daidzein + 5 mg genistein/kg body weight/d) for the first 5 or 10 d of life. The 10-d protocol mimicked the period when infants are fed soy protein formula (SPF) but avoids the time when suckling pups can consume the mother’s diet. Body and organ weights and histology of ovaries and uteri were analyzed. There were no differences in the ovary or uterus weight, number of ovarian follicles, number of multiple oocyte follicles, or percent of ovarian cysts with 5 or 10 d of ISO intervention compared to respective controls. The 10-d ISO group had higher body weights from 6 d to 4 mo. of age and a higher percent of hyperplasia in the oviduct than the respective control. Lower numbers of ovarian corpus lutea and a higher incidence of abnormal changes were reported in the uteri of both ISO groups compared to their respective controls. Five- and 10-d exposure to ISO had similar long-lasting adverse effects on the structures of ovaries and uterus in adult mice. Only the 10-d ISO exposure resulted in greater body weight gain at adulthood.

Diatoms are renowned for their robust ability to perform NPQ (Non-Photochemical Quenching of chlorophyll fluorescence) as a dissipative response to heightened light stress on photosystem II, plausibly explaining their dominance over other algal groups in turbulent light environs. Their NPQ mechanism has been principally attributed to a xanthophyll cycle involving the lumenal pH regulated reversible de-epoxidation of diadinoxanthin. The principal goal of this dissertation is to reveal the physiological and physical origins and consequences of the NPQ response in diatoms during short-term transitions to excessive irradiation. The investigation involves diatom species from different originating light environs to highlight the diversity of diatom NPQ and to facilitate the detection of core mechanisms common among the diatoms as a group. A chiefly spectroscopic approach was used to investigate NPQ in diatom cells. Prime methodologies include: the real time monitoring of PSII excitation and de-excitation pathways via PAM fluorometry and pigment interconversion via transient absorbance measurements, the collection of cryogenic absorbance spectra to measure pigment energy levels, and the collection of cryogenic fluorescence spectra and room temperature picosecond time resolved fluorescence decay spectra to study excitation energy transfer and dissipation. Chemical inhibitors that target the trans-thylakoid pH gradient, the enzyme responsible for diadinoxanthin de-epoxidation, and photosynthetic electron flow were additionally used to experimentally manipulate the NPQ response. Multifaceted analyses of the NPQ responses from two previously un-photosynthetically characterised species, Nitzschia curvilineata and Navicula sp., were used to identify an excitation pressure relief ‘strategy’ for each species. Three key areas of NPQ were examined: (i) the NPQ activation/deactivation processes, (ii) how NPQ affects the collection, dissipation, and usage of absorbed light energy, and (iii) the interdependence of NPQ and photosynthetic electron flow. It was found that Nitzschia cells regulate excitation pressure via performing a high amplitude, reversible antenna based quenching which is dependent on the de-epoxidation of diadinoxanthin. In Navicula cells excitation pressure could be effectively regulated solely within the PSII reaction centre, whilst antenna based, diadinoxanthin de-epoxidation dependent quenching was implicated to be used as a supplemental, long-lasting source of excitation energy dissipation. These strategies for excitation balance were discussed in the context of resource partitioning under these species’ originating light climates. A more detailed investigation of the NPQ response in Nitzschia was used to develop a comprehensive model describing the mechanism for antenna centred non-photochemical quenching in this species. The experimental evidence was strongly supportive of a mechanism whereby: an acidic lumen triggers the diadinoxanthin de-epoxidation and protonation mediated aggregation of light harvesting complexes leading to the formation of quencher chlorophyll a-chlorophyll a dimers with short-lived excited states; quenching relaxes when a rise in lumen pH triggers the dispersal of light harvesting complex aggregates via deprotonation events and the input of diadinoxanthin. This model may also be applicable for describing antenna based NPQ in other diatom species.

La dépression est une maladie chronique, récurrente et potentiellement mortelle qui affecte plus de 20 % de la population à travers le monde. Les mécanismes sous-jacents de la dépression demeurent incompris et la pharmacothérapie actuelle, largement basée sur l’hypothèse monoaminergique, fait preuve d’une efficacité sous optimale et d’une latence thérapeutique élevée. Par conséquent, la recherche est amenée à élaborer de nouveaux traitements pharmacologiques. Pour détecter leur action, il est avant tout nécessaire de développer des outils expérimentaux adéquats. Dans cette optique, notre but a été de mesurer l’anhédonie, un symptôme cardinal de la dépression, chez le rat de laboratoire. L’anhédonie a été définie comme une réduction de la récompense et a été mesurée avec le test de consommation de sucrose et la technique d’autostimulation intracérébrale. En vue d’induire l’anhédonie, nous avons effectué une bulbectomie olfactive, une procédure qui entraîne divers changements biochimiques, cellulaires et comportementaux similaires à ceux de l’état dépressif et qui peuvent être renversés par un traitement antidépresseur chronique. Nos résultats montrent que la bulbectomie olfactive produit également l’anhédonie, reflétée par une réduction durable de la consommation de sucrose et par une réduction de l’efficacité de l’amphétamine dans le test d’autostimulation intracérébrale. Ces effets ont été présents jusqu’à trois à quatre semaines suivant la chirurgie. La bulbectomie olfactive a aussi été associée à une augmentation de l’élément de réponse liant l’AMPc dans le striatum, un index moléculaire associé à l’anhédonie. Ces découvertes suggèrent que l’anhédonie peut être produite et étudiée de façon fiable dans le modèle de bulbectomie olfactive et que le circuit de récompense pourrait constituer une cible cohérente pour de nouvelles drogues en vue du traitement de la dépression.

Avant-propos: La résolution de conflits s’est installée dans les cursus universitaires comme une discipline à part entière sinon comme une orientation au sein de plusieurs sciences sociales. En effet, ce champ d’étude fait de plus en plus l’objet de réflexions en sciences politiques, en sociologie, en anthropologie, etc, et ce, de par l’interdisciplinarité des questionnements qui en relèvent. Toutefois, la dimension religieuse, souvent considérée comme source de conflits, est quasi inexistante lorsqu’il est question d’approches de résolution. Nous nous proposons donc d’examiner la solha, une pratique proche orientale au sein de laquelle le fait religieux est une composante essentielle à la réconciliation escomptée. Note concernant la translittération: Les termes provenant de l’arabe feront l’objet d’une translittération phonétique basée sur le français. Notez que les translittérations en langue française sont différentes de celle en langue anglaise. Par exemple, le terme solha trouvera son équivalent anglais dans le terme sulha (d’où la différence d’orthographe entre le contenu de cette étude et les citations qui proviennent d’articles anglophones). De plus, notez que le genre (féminin, masculin) des termes translittérés reprendra celui de la langue d’origine, l’arabe. Objectifs. L’objectif de ce mémoire est de parfaire nos connaissances quant à l’effet des actions policières sur les collisions routières au Québec. Ultimement, ce mémoire permettra d’identifier les conditions nécessaires pour que l’action policière influe sur les comportements des automobilistes. Pour se faire, deux études de cas sont employées. Dans un premier temps, nous évaluons l’effet d’un relâchement d’environ 60 % dans l’émission de constats d’infraction par les policiers de la ville de Québec sur les collisions avec blessures. Dans cet article, nous distinguons également les effets respectifs des constats d’infraction, des interceptions policières sans constat et des médias. Dans un second temps, nous évaluons l’impact d’une stratégie de sécurité routière mise en place conjointement par l’Association des directeurs de police du Québec (ADPQ) et la Société de l’assurance automobile du Québec (SAAQ). Dans les deux cas, un changement important est survenu dans l’émission de constats d’infraction émis en vertu du Code de la sécurité routière (CSR). Méthodologie. Afin d’évaluer l’effet de ces deux stratégies, nous avons agrégé les données sur les collisions et infractions au CSR sur une base mensuelle. Ces données proviennent principalement des rapports de collisions et des constats d’infraction remplis par les policiers et transmis à la SAAQ. Dans l’ensemble, nous avons utilisé un devis quasi-expérimental, soit celui des séries chronologiques interrompues. Résultats. Les résultats des deux articles démontrent que les policiers sont des acteurs clés en matière de sécurité routière. Les collisions avec blessures sont affectées par les fluctuations de leurs activités. La première série d’analyses établit qu’un relâchement d’environ 60 % dans le nombre de constats émis par les policiers se traduit par une hausse d’environ 10 % des collisions avec blessures, ce qui correspond à 15 collisions avec blessures supplémentaires par mois sur le territoire du Service de police de la ville de Québec. De plus, nos résultats montrent qu’une interception policière suivie d’un avertissement verbal n’est pas suffisante pour prévenir les collisions. De même, l’effet observé n’est pas attribuable aux médias. La deuxième série d’analyse montre que la stratégie conjointe de l’ADPQ et de la SAAQ, caractérisée par une hausse des constats émis et des campagnes médiatiques, fut suivie de baisses variant entre 14 et 36 % des collisions avec blessures graves. Interprétation. Les résultats démontrent que les actions policières ont une influence sur le bilan routier. Par contre, avant d’influer sur le comportement des automobilistes, certaines conditions doivent être respectées. Premièrement, l’intensité des contrôles policiers doit être suffisamment modifiée par rapport à son niveau initial. Deuxièmement, que ce soit une hausse ou une baisse, ce niveau doit être maintenu sur une période relativement longue (entre 12 et 24 mois environ) pour que les automobilistes soient exposés au message pénal et qu’ils considèrent ce changement dans le niveau de répression comme étant crédible. Troisièmement, l’émission de constats est un élément clé; la simple présence policière n’est pas suffisante pour prévenir les collisions. Enfin, les campagnes de sensibilisation semblent importantes, mais d’autres études sont nécessaires pour mieux apprécier leur rôle.

À l’aube du IXe siècle, les Carolingiens prétendent imposer à l’Occident l’unité dans la foi et le culte. Cet idéal domine les pensées des empereurs qui se conçoivent comme protecteurs, législateurs et juges, mais aussi vicaires du Christ et recteurs de l’Église. De telles ambitions stimulent l’élaboration d’un gouvernement original. Comme les conquêtes avaient composé une vaste mosaïque de populations, de cultures et d’intérêts, la concorde posait un grand défi. Pour y répondre, Charlemagne et Louis le Pieux ont fait des communications leur premier outil politique. Leur inventivité et leur efficience furent appréciables, mais elles n’ont pas suffi à leur gagner toutes les adhésions : la discorde s’est installée là où l’empereur ne parvenait pas à maintenir une relation forte avec les élites régionales. Les distances et les modalités des communications déterminaient la nature de leurs échanges, donc leurs limites et, de ce fait, le destin de l’Empire carolingien. L’enquête aborde un vaste éventail documentaire : actes, capitulaires, correspondances, monnaies... Elle s’intéresse particulièrement aux relations du pouvoir impérial avec les élites du sud-ouest de l’empire. Ses résultats dépendent d’un étayage complexe : dispositifs de représentation du pouvoir, conséquences politico-sociales des distances et des vitesses de déplacement, anthropologie de la rencontre et des relations à distance, étude des réseaux. Au-delà des considérations propres à l’histoire des VIIIe-IXe siècles, elle démontre l’intérêt d’aborder les réalités politiques prémodernes du point de vue des défis que présentent les distances géographiques, les rencontres et les communications.
