The objective of this study was to evaluate the push-out bond strength of fiberglass resin reinforced bonded with five ionomer cements. Also, the interface between cement and dentin was inspected by means of SEM. Fifty human canines were chose after rigorous scrutiny process, endodontically treated and divided randomly into five groups (n = 3) according to cement tested: Group I – Ionoseal (VOCO), Group II – Fugi I (GC), Group III – Fugi II Improved (GC), Group IV – Rely X Luting 2 (3M ESPE), Group V – Ketac Cem (3M ESPE). The post-space was prepared to receive a fiberglass post, which was tried before cementation process. No dentin or post surface pretreatment was carried out. After post bonding, all roots were cross-sectioned to acquire 3 thin-slices (1 mm) from three specific regions of tooth (cervical, medium and apical). A Universal test machine was used to carry out the push-out test with cross-head speed set to 0.5mm/mim. All failed specimens were observed under optical microscope to identify the failure mode. Representative specimens from each group was inspected under SEM. The data were analyzed by Kolmogorov-Smirnov and Levene’s tests and by two-way ANOVA, and Tukey’s port hoc test at a significance level of 5%. It was compared the images obtained for determination of types of failures more occurred in different levels. SEM inspection displayed that all cements filled the space between post and dentin, however, some imperfections such bubles and voids were noticed in all groups in some degree of extension. The push-out bond strength showed that cement Ketac Cem presented significant higher results when compared to the Ionoseal (P = 0.02). There were no statistical significant differences among other cements.

[ES] En este trabajo se editan y analizan varios documentos que pretenden ayudar a conocer mejor las tropas que participaron en la conquista de la isla de Gran Canaria, destacando con ellos algunos de los sistemas de reclutamiento y pago de sueldos empleados para formar el ejército que intervino en la incorporación de la isla a la Corona de Castilla. [EN] Through the edition and analysis of diverse records, this work intends to achieve a deeper knowledge about the condition of those troops participating in the conquest of Gran Canaria. Among the issues under scrutiny, special attention will be devoted to conscription systems and the payment of wages as these may have determined how this army was organised and could therefore partake in the process of integration of the island into the Crown of Castile.

The progresses of electron devices integration have proceeded for more than 40 years following the well–known Moore’s law, which states that the transistors density on chip doubles every 24 months. This trend has been possible due to the downsizing of the MOSFET dimensions (scaling); however, new issues and new challenges are arising, and the conventional ”bulk” architecture is becoming inadequate in order to face them. In order to overcome the limitations related to conventional structures, the researchers community is preparing different solutions, that need to be assessed. Possible solutions currently under scrutiny are represented by: • devices incorporating materials with properties different from those of silicon, for the channel and the source/drain regions; • new architectures as Silicon–On–Insulator (SOI) transistors: the body thickness of Ultra-Thin-Body SOI devices is a new design parameter, and it permits to keep under control Short–Channel–Effects without adopting high doping level in the channel. Among the solutions proposed in order to overcome the difficulties related to scaling, we can highlight heterojunctions at the channel edge, obtained by adopting for the source/drain regions materials with band–gap different from that of the channel material. This solution allows to increase the injection velocity of the particles travelling from the source into the channel, and therefore increase the performance of the transistor in terms of provided drain current. The first part of this thesis work addresses the use of heterojunctions in SOI transistors: chapter 3 outlines the basics of the heterojunctions theory and the adoption of such approach in older technologies as the heterojunction–bipolar–transistors; moreover the modifications introduced in the Monte Carlo code in order to simulate conduction band discontinuities are described, and the simulations performed on unidimensional simplified structures in order to validate them as well. Chapter 4 presents the results obtained from the Monte Carlo simulations performed on double–gate SOI transistors featuring conduction band offsets between the source and drain regions and the channel. In particular, attention has been focused on the drain current and to internal quantities as inversion charge, potential energy and carrier velocities. Both graded and abrupt discontinuities have been considered. The scaling of devices dimensions and the adoption of innovative architectures have consequences on the power dissipation as well. In SOI technologies the channel is thermally insulated from the underlying substrate by a SiO2 buried–oxide layer; this SiO2 layer features a thermal conductivity that is two orders of magnitude lower than the silicon one, and it impedes the dissipation of the heat generated in the active region. Moreover, the thermal conductivity of thin semiconductor films is much lower than that of silicon bulk, due to phonon confinement and boundary scattering. All these aspects cause severe self–heating effects, that detrimentally impact the carrier mobility and therefore the saturation drive current for high–performance transistors; as a consequence, thermal device design is becoming a fundamental part of integrated circuit engineering. The second part of this thesis discusses the problem of self–heating in SOI transistors. Chapter 5 describes the causes of heat generation and dissipation in SOI devices, and it provides a brief overview on the methods that have been proposed in order to model these phenomena. In order to understand how this problem impacts the performance of different SOI architectures, three–dimensional electro–thermal simulations have been applied to the analysis of SHE in planar single and double–gate SOI transistors as well as FinFET, featuring the same isothermal electrical characteristics. In chapter 6 the same simulation approach is extensively employed to study the impact of SHE on the performance of a FinFET representative of the high–performance transistor of the 45 nm technology node. Its effects on the ON–current, the maximum temperatures reached inside the device and the thermal resistance associated to the device itself, as well as the dependence of SHE on the main geometrical parameters have been analyzed. Furthermore, the consequences on self–heating of technological solutions such as raised S/D extensions regions or reduction of fin height are explored as well. Finally, conclusions are drawn in chapter 7.

A novel screening platform for potential retroviral fusion inhibitors on the basis of fully functional membrane‐anchored coiled coil lipopeptide receptors has been established. The work comprises the scrutiny of lateral organization of functional lipids in phase separated bilayers and an in‐depth investigation of the biophysical properties of lipopeptide‐based receptors. Lateral sorting of lipids was detected by the recognition of streptavidin of biotinylated lipids in phase separated bilayers and by nanoscopic patterns in mixed fluorocarbon / hydrocarbon lipid bilayers, employing temperature controlled atomic force microscopy (AFM) as a versatile characterization method. Particular features of fluorocarbon bilayers were additionally investigated in great detail by means of ellipsometry and ATR‐IR spectroscopy. Lipopeptide‐receptors were synthesized on the basis of a robust and reliable in situ coupling reaction by coupling terminal cysteine modified receptor‐peptides to a maleimide functionalized lipid bilayer. Receptor functionality of the lipopeptides was visualized by specific binding of vesicles and nanoparticles tracked by a multiplicity of characterization methods, such as AFM, ellipsometry, CLSM and fluorescence spectroscopy. Finally, in situ coupling of viral peptides, originating from the fusion protein of HIV resulted in a mimic of the pre‐hairpin intermediate of gp41. Structural analysis of N36‐lipopepides by means of CD‐spectroscopy in combination with FT‐IR spectroscopy revealed a coiled coil assembly of lipopeptides, which render the aggregates fully functional receptors for potent fusion inhibitors. Thereby, reversible inhibitor binding of T20 and the corresponding C‐ peptides was detected by AFM and ellipsometry, rendering coiled coil lipopeptides a new promising technique for screening of retroviral fusion inhibitors.

Eco-labels and certification are one of the many environmental policy tools that have been under scrutiny in recent years. This is because the damages of environmental degradation are becoming more apparent over time. Hence there is a pressure to come up with tools that help solve even small parts of the problem. Eco-labels have been around for over 30 years. However the market, the environment and eco-labels have changed drastically during this period. Moreover, in the last 5 years there has been a sudden increase in eco-labels making them more visible in the market and to the average consumer. All this has made evident that little is known about the effectiveness of eco-labels as environmental policy tools. Hence, there is a call to find answers regarding the actual effects of eco-labels on the market and on the environment. While this work cannot address whether eco-labels have an environmental impact it addresses the effects of eco-labels on the markets. Moreover, this work aimed to find the role of law in eco-labelling. In addition, it aims to find a legal solution that would improve the performance of eco-labelling and certification.

Entro l’approccio concettuale e metodologico transdisciplinare della Scienza della Sostenibilità, la presente tesi elabora un background teorico per concettualizzare una definizione di sostenibilità sulla cui base proporre un modello di sviluppo alternativo a quello dominante, declinato in termini di proposte concrete entro il caso-studio di regolazione europea in materia di risparmio energetico. La ricerca, attraverso un’analisi transdisciplinare, identifica una crisi strutturale del modello di sviluppo dominante basato sulla crescita economica quale (unico) indicatore di benessere e una crisi valoriale. L’attenzione si concentra quindi sull’individuazione di un paradigma idoneo a rispondere alle criticità emerse dall’analisi. A tal fine vengono esaminati i concetti di sviluppo sostenibile e di sostenibilità, arrivando a proporre un nuovo paradigma (la “sostenibilità ecosistemica”) che dia conto dell’impossibilità di una crescita infinita su un sistema caratterizzato da risorse limitate. Vengono poi presentate delle proposte per un modello di sviluppo sostenibile alternativo a quello dominante. Siffatta elaborazione teorica viene declinata in termini concreti mediante l’elaborazione di un caso-studio. A tal fine, viene innanzitutto analizzata la funzione della regolazione come strumento per garantire l’applicazione pratica del modello teorico. L’attenzione è concentrata sul caso-studio rappresentato dalla politica e regolazione dell’Unione Europea in materia di risparmio ed efficienza energetica. Dall’analisi emerge una progressiva commistione tra i due concetti di risparmio energetico ed efficienza energetica, per la quale vengono avanzate delle motivazioni e individuati dei rischi in termini di effetti rebound. Per rispondere alle incongruenze tra obiettivo proclamato dall’Unione Europea di riduzione dei consumi energetici e politica effettivamente perseguita, viene proposta una forma di “regolazione per la sostenibilità” in ambito abitativo residenziale che, promuovendo la condivisione dei servizi energetici, recuperi il significato proprio di risparmio energetico come riduzione del consumo mediante cambiamenti di comportamento, arricchendolo di una nuova connotazione come “bene relazionale” per la promozione del benessere relazionale ed individuale.

This work provides several policy proposals capable to strengthen the private enforcement of EU competition law in arbitration. It focuses on the procedural law aspects that are permeated by legal uncertainty and that have not yet fallen under the scrutiny of the law and economics debate. The policy proposals described herein are based on the functional approach to law and economics and aim to promote a more qualified decision making process by: adjudicators, private parties and lawmakers. The resulting framework of procedural rules would be a cost-effective policy tool that could sustain the European Commission’s effort to guarantee a workable level of competition in the EU internal market. This project aims to answer the following broad research question: which procedural rules can improve the efficiency of antitrust arbitration by decreasing litigation costs for private parties on the one hand, and by increasing private parties’ compliance with competition law on the other hand?Throughout this research project, such broad question has been developed into research sub-questions revolving around several key legal issues. The chosen sub-research questions result from a vacuum in the European enforcement system that leaves several key legal issues in antitrust arbitration unresolved. The legal framework proposed in this research project could prevent such a blurry scenario from impairing the EU private enforcement of competition law in arbitration. Therefore, our attention was triggered by those legal issues whose proposed solutions lead to relevant uncertainties and that are most suitable for a law and economics analysis.

La tesi analizza, sotto vari aspetti del diritto dell’Unione Europea, i servizi che sono offerti su spazi demaniali. Si articola in quattro capitoli: Il primo capitolo ricostruisce, valutandone l’impatto sui servizi che sono oggetto della presente indagine, lo sviluppo giurisprudenziale della Libertà di Stabilimento e della Libera Prestazione di Servizi, analizzando, altresì, i principi generali e l’art.16 della Carta dei Diritti Fondamentali dell’Unione. Il secondo capitolo è, invece, dedicato al diritto secondario, ossia alla Direttiva 2006/123/CE, alle Direttive “Appalti” e alla Direttiva “Concessioni”. La prima, che nulla aggiunge al quadro normativo trattato nel primo capitolo, svolge, pertanto una vera e propria funzione appaltante e concessoria. Le seconde, invece, seppur non applicabili alle fattispecie ivi esaminate, restano utili per comprendere quale declinazione possano avere i principi di eguaglianza, di non discriminazione, di trasparenza, di pubblicità e di concorrenza nella regolazione dei servizi offerti su spazi demaniali. La terza, invece, in quanto a rilevanza, presenta alcuni punti critici che fanno propendere per una sua non applicabilità. Resta comunque utile sempre in materia di principi, i quali, come evidenziato nell’ultima parte del secondo capitolo, sono stati utilizzati dalla Corte di Giustizia, pur nella totale assenza, fino alla recente direttiva, di strumenti di diritto secondario applicabili alle concessioni. Il terzo capitolo, invece, affronta le problematiche emerse all’interno dell’ordinamento italiano e attua una comparazione tra il sistema italiano e quello portoghese, croato, francese, spagnolo. Il quarto capitolo, da ultimo, prende in considerazione il delicato equilibrio, sempre più attuale, tra principi in materia di appalti pubblici e aiuti di Stato, valutando come, sia il permanere dello status quo, sia un riordino non conforme alla Direttiva 2006/123/CE e ai principi da essa richiamati possa costituire un aiuto di Stato incompatibile con il mercato interno.

Market manipulation is an illegal practice that enables a person can profit from practices that artificially raise or lower the prices of an instrument in the financial markets. Its prohibition is based on the 2003 Market Abuse Directive in the EU. The current market manipulation regime was broadly considered as a big success except for enforcement and supervisory inconsistencies in the Member States at the initial. A review of the market manipulation regime began at the end of 2007, which became quickly incorporated into the wider EU crisis-era reform program. A number of weaknesses of current regime have been identified, which include regulatory gaps caused by the development of trading venues and financial products, regulatory gaps concerning cross-border and cross-markets manipulation (particular commodity markets), legal uncertainty as a result of various implementation, and inefficient supervision and enforcement. On 12 June 2014, a new regulatory package of market abuse, Market Abuse Regulation and Directive on criminal sanctions for market abuse, has been adopted. And several changes will be made concerning the EU market manipulation regime. A wider scope of the regime and a new prohibition of attempted market manipulation will ensure the prevention of market manipulation at large. The AMPs will be subject to strict scrutiny of ESMA to reduce divergences in implementation. In order to enhance efficiency of supervision and enforcement, powers of national competent authorities will be strengthened, ESMA is imposed more power to settle disagreement between national regulators, and the administrative and criminal sanctioning regimes are both further harmonized. In addition, the protection of fundamental rights is stressed by the new market manipulation regime, and some measures are provided to guarantee its realization. Further, the success EU market manipulation regime could be of significant reference to China, helping China to refine its immature regime.

La definizione dell’ordinamento dell’Unione come ordinamento costituzionale è centrale, ma resta frammentata. Per restituirle sistematicità è importante individuare un principio sul quale poggiarne il consolidamento. Per questo si è scelto di esaminare il principio di non discriminazione attraverso l’analisi della giurisprudenza, con l’obiettivo di verificare se questo principio è parte fondamentale dell’identità costituzionale dell’Unione Europea. Nella prima parte della tesi si analizza la struttura del giudizio sulla discriminazione davanti alla CGUE e davanti alla CEDU, mettendo in evidenza come la struttura ricordi sempre di più quella del giudizio di costituzionalità. Nella seconda parte ci si concentra sul contributo dato dal principio di non discriminazione all’identità costituzionale dell’Unione Europea attraverso la lotta contro specifiche tipologie di discriminazione. Poiché i motivi di discriminazione sono molto numerosi, si è stabilito di esaminare quei motivi che sono regolati dal diritto derivato. Per questo la seconda parte dell’analisi si è concentrata sulle discriminazioni a motivo della nazionalità (dir. 2004/38/CE), della razza (dir. 2000/43/CE), del genere (dir. 2006/54/CE, dir. 2004/113/CE) dell’età, disabilità, religione ed orientamento sessuale (dir. 2000/78/CE). Dall’analisi della giurisprudenza e del diritto derivato che ne dà attuazione è possibile comprendere che questo principio, oltre ad essere sostenuto da un vero e proprio giudizio di legittimità costituzionale (il rinvio pregiudiziale), ha gli strumenti necessari a permetterne lo sviluppo tenendo conto delle identità costituzionali degli stati membri e può aiutare ad offrire delle risposte rispetto a uno dei problemi fondamentali inerenti all’efficacia del diritto dell’Unione Europea: la tensione fra il principio di attribuzione e la dottrina degli effetti diretti. Le conclusioni di questo lavoro portano a sostenere che è possibile individuare una giurisprudenza della Corte che, attraverso alcuni passaggi fondamentali (le sentenze Mangold, Kucukdeveci, Hay, Deckmyn e Zambrano), definisce il principio di non discriminazione come principio fondamentale, e costituzionale, del diritto dell’Unione Europea.

Biobanken sind Sammlungen von Körpersubstanzen, die mit umfangreichen gesundheits- und lebensstilbezogenen sowie geneologischen Daten ihrer Spender verknüpft sind. Sie dienen der Erforschung weit verbreiteter Krankheiten. Diese sog. Volkskrankheiten sind multifaktoriell bedingte Krankheiten. Dies bedeutet, dass diese Krankheiten das Ergebnis eines komplizierten Zusammenspiels von umwelt- und verhaltensrelevanten Faktoren mit individuellen genetischen Prädispositionen sind. Forschungen im Bereich von Pharmakogenomik und Pharmakogenetik untersuchen den Einfluss von Genen und Genexpressionen auf die individuelle Wirksamkeit von Medikamenten sowie auf die Entstehung ungewollter Nebenwirkungen und könnten so den Weg zu einer individualisierten Medizin ebnen. Menschliches Material ist ein wichtiger Bestandteil dieser Forschungen und die Nachfrage nach Sammlungen, die Proben mit Daten verknüpfen, steigt. Einerseits sehen Mediziner in Biobanken eine Chance für die Weiterentwicklung der medizinischen Forschung und des Gesundheitswesens. Andererseits lösen Biobanken auch Ängste und Misstrauen aus. Insbesondere wird befürchtet, dass Proben und Daten unkontrolliert verwendet werden und sensible Bereiche des Persönlichkeitsrechts und der persönlichen Identität betroffen sind. Diese Gefahren und Befürchtungen sind nicht neu, sondern bestanden schon in der Vergangenheit bei jeglicher Form der Spende von Körpersubstanzen. Neu ist aber der Umfang an Informationen, der durch die Genanalyse entsteht und den Spender in ganz besonderer Weise betreffen kann. Bei der Speicherung und Nutzung der medizinischen und genetischen Daten ergibt sich somit ein Spannungsfeld insbesondere zwischen dem Recht der betroffenen Datenspender auf informationelle Selbstbestimmung und den Forschungsinteressen der Datennutzer. Im Kern dreht sich die ethisch-rechtliche Bewertung der Biobanken um die Frage, ob diese Forschung zusätzliche Regeln braucht, und falls ja, wie umfassend diese sein müssten. Im Zentrum dieser Diskussion stehen dabei v.a. ethische Fragen im Zusammenhang mit der informierten Einwilligung, dem Datenschutz, der Wiederverwendung von Proben und Daten, der Information der Spender über Forschungsergebnisse und der Nutzungsrechte an den Daten. Ziel dieser Arbeit ist es, vor dem Hintergrund des Verfassungsrechts, insbesondere dem Recht auf informationelle Selbstbestimmung, das Datenschutzrecht im Hinblick auf die Risiken zu untersuchen, die sich aus der Speicherung, Verarbeitung und Kommunikation von persönlichen genetischen Informationen beim Aufbau von Biobanken ergeben. Daraus ergibt sich die weitere Untersuchung, ob und unter welchen Voraussetzungen die sich entgegenstehenden Interessen und Rechte aus verfassungsrechtlichem Blickwinkel in Einklang zu bringen sind. Eine wesentliche Frage lautet, ob die bisherigen rechtlichen Rahmenbedingungen ausreichen, um den Schutz der gespeicherten höchstpersönlichen Daten und zugleich ihre angemessene Nutzung zu gewährleisten. Das Thema ist interdisziplinär im Schnittfeld von Datenschutz, Verfassungsrecht sowie Rechts- und Medizinethik angelegt. Mitral regurgitation (MR) involves systolic retrograde flow from the left ventricle into the left atrium. While trivial MR is frequent in healthy subjects, moderate to severe MR constitutes the second most prevalent valve disease after aortic valve stenosis. Major causes of severe MR in Western countries include degenerative valve disease (myxomatous disease, flail leaflet, annular calcification) and ischaemic heart disease, while rheumatic disease remains a major cause of MR in developing countries. Chronic MR typically progresses insidiously over many years. Once established, however, severe MR portends a poor prognosis. The severity of MR can be assessed by various techniques, Doppler echocardiography being the most widely used. Mitral valve surgery is the only treatment of proven efficacy. It alleviates clinical symptoms and prevents ventricular dilatation and heart failure (or, at least, it attenuates further progression of these abnormalities). Valve repair significantly improves clinical outcomes compared with valve replacement, reducing mortality by approximately 70%. Reverse LV remodelling after valve repair occurs in half of patients with functional MR. Percutaneous, catheter-based to mitral valve repair is a novel approach currently under clinical scrutiny, with encouraging preliminary results. This modality may provide a valuable alternative to mitral valve surgery, especially in critically ill patients.

The in vitro production of recombinant protein molecules has fostered a tremendous interest in their clinical application for treatment and support of cancer patients. Therapeutic proteins include monoclonal antibodies, interferons, and haematopoietic growth factors. Clinically established monoclonal antibodies include rituximab (targeting CD20-positive B-cell lymphomas), trastuzumab (active in HER-2 breast and gastric cancer), and bevacizumab (blocking tumor-induced angiogenesis through blockade of vascular-endothelial growth factor and its receptor). Interferons have lost much of their initial appeal, since equally or more effective treatments with more pleasant side effects have become available, for example in chronic myelogenous leukaemia or hairy cell leukaemia. The value of recombinant growth factors, notably granulocyte colony stimulating factor (G-CSF) and erythropoietin is rather in the field of supportive care than in targeted anti-cancer therapy. Adequately powered clinical phase III trials are essential to estimate the true therapeutic impact of these expensive compounds, with appropriate selection of clinically relevant endpoints and sufficient follow-up. Monoclonal antibodies, interferons, and growth factors must also, and increasingly so, be subjected to close scrutiny by appropriate cost-effectiveness analyses to ensure that their use results in good value for money. With these caveats and under the condition of their judicious clinical use, recombinant proteins have greatly enriched the therapeutic armamentarium in clinical oncology, and their importance is likely to grow even further.

The US penitentiary at Lewisburg, Pennsylvania, was retrofitted in 2008 to offer the country’s first federal Special Management Unit (SMU) program of its kind. This model SMU is designed for federal inmates from around the country identified as the most intractably troublesome, and features double-celling of inmates in tiny spaces, in 23-hour or 24-hour a day lockdown, requiring them to pass through a two-year program of readjustment. These spatial tactics, and the philosophy of punishment underlying them, contrast with the modern reform ideals upon which the prison was designed and built in 1932. The SMU represents the latest punitive phase in American penology, one that neither simply eliminates men as in the premodern spectacle, nor creates the docile, rehabilitated bodies of the modern panopticon; rather, it is a late-modern structure that produces only fear, terror, violence, and death. This SMU represents the latest of the late-modern prisons, similar to other supermax facilities in the US but offering its own unique system of punishment as well. The US penitentiary at Lewisburg, Pennsylvania, was retrofitted in 2008 to offer the country's first federal Special Management Unit (SMU) program of its kind. This model SMU is designed for federal inmates from around the country identified as the most intractably troublesome, and features double-celling of inmates in tiny spaces, in 23-hour or 24-hour a day lockdown, requiring them to pass through a two-year program of readjustment. These spatial tactics, and the philosophy of punishment underlying them, contrast with the modern reform ideals upon which the prison was designed and built in 1932. The SMU represents the latest punitive phase in American penology, one that neither simply eliminates men as in the premodern spectacle, nor creates the docile, rehabilitated bodies of the modern panopticon; rather, it is a late-modern structure that produces only fear, terror, violence, and death. This SMU represents the latest of the late-modern prisons, similar to other supermax facilities in the US but offering its own unique system of punishment as well.
