The dissertation, which is based on the deductive method, by using general concepts of the theory of the administrative participation in the administrative process, addresses the importance of strengthening administrative and procedural activities of citizen involvement in public administration for the administrative consolidation of democracy in Brazil. The emergence of Administrative Law has particular importance for the understanding of its institutions and, of course, for the different fields of public administration. The authoritarian profile of this area of law still exists as a clear recollection of their origin, mainly based on a relationship of superiority of the state over the individuals. Indeed, does not even modern constitutionalism could print a true democracy administrative, since the constitutions were not properly observed by the Government. Furthermore, only the process of constitutionalization of administrative law legal relations took a more democratic profile. That is, the creation of an environment of dialogue with civil society is a recent achievement of the Brazilian government. As the administrative process involves dilemmas and solutions of state action, because it is revealed the expression government, the strengthening of institutions and principles related to the administrative procedure is important for role in making a more participatory relationship between state and citizen. Thus, administrative participation can be considered not only a mechanism of control and legitimacy of state action, but also for improvement and reduction of administrative costs, as a requirement of the principle of efficiency. The objective of this investigation is to assert as the administrative legal relation, the administrative legality, the administrative jurisdiction, the processuality administrative, the consensuality administrative and administrative justice, together with administrative participation, can contribute to a more democratic role of the Public Administration and, therefore, more dialogic and consolidator of the fundamental rights of citizens. The health pact arises in the Brazilian scene after a number of attempts for the improvement of the Unified Health System (SUS), so as to consolidate social equity. In this perspective, this paper discusses the pact using documental analysis, in order to help the public administration process in Brazil. This new policy, still in the initial phase of implementation, is a unique reality and highly feasible for the improvement of national practices in public health. Its performance is intimately related to overcoming the political barriers inherent to each rank of the administration.

The Brazilian democratic transition, still underway today, has run up against enormous difficulty in incorporating penal action. Or, put in yet stronger terms, we could say that the boundaries of democratization processes, delineated through the action of that sector of the State, reveal the possibility that the juridical field remains immune to democratizing change. Although prevailing discourse among law professionals asserts that Penal Justice is undergoing democratization, what we have observed in practice is a strong resistance within the juridical field to assuming political responsibilities within the consolidation of democracy. This article reports analyses and conclusions formulated through observation of the Brazilian penal justice system that gave origin to the thesis entitled Penal Justice in Brazil today: democratic discourse, authoritarian practice. The research sought to reflect on contemporary criminal justice policy, which has been guided by the widening of repression and the continued use of incarceration. Such policy, carried out in Brazil since the beginning of the 1985 political opening has adjusted itself to the liberal project that is also currently underway in the country, as well as in almost the entire Western capitalist world. As we can observe, Penal Justice, even during the execution of sentences, operates in authoritarian and exclusive ways, suppressing the rights guaranteed by law to those who have been sentenced and adopting extremely repressive forms as demonstrated by the extremely sparse benefits that it concedes. Thus, in Brazil, criminality has generally been responded through severe sentences, reflected in the absence of guarantees of constitutional rights and ample recourse to incarceration. In this vein, our contemporary democratic governments have frequently adopted a punitive stance that seeks to reaffirm the State's aptitudes for punishing and controlling criminality. © 2009 Revista de Sociologia e Política.

This paper reports on the trajectory of knowledge in educational administration, as published by the Brazilian National Association of Educational Policy and Administration (ANPAE). It reviews four early booklets on school administration – Cadernos de Administração Escolar – published between 1961 and 1968, and selected issues of ANPAE´s journal – Revista Brasileira de Política e Administração da Educação – published between 1983 and 2000, under different categories, and analyses those classified under the concepts of administration and management. The author refers to conceptual limitations, but concedes that the publications present relevant contributions on the theoretical development of educational administration in Brazil.

O ensino de Administração no Brasil, assim como em outros países, teve início para atender à demanda por profissionais capacitados a responder a necessidade de organização das grandes empresas que estavam em processo de surgimento. Três grandes eixos sustentam o direcionamento desses cursos, ainda nos dias de hoje: econômico, político e educacional. A proposta do presente trabalho é a da reavaliação do paradigma que determinou a construção dos programas das Instituições de Ensino Superior da área de Administração, considerando-se que em tempos atuais, a estrutura sócio-econômica que demanda jovens e adultos formados por esses cursos, configura-se diferentemente daquela que motivou seu surgimento. Naquela época, tendo como inspiração as universidades norte-americanas, as IES brasileiras também visavam atender à demanda das grandes empresas aqui instaladas dentro do processo desenvolvimentista iniciado no governo Vargas. Atualmente, essas grandes empresas, tendo como foco a inovação tecnológica, não mas absorvem adequadamente os profissionais. Novas estruturas organizacionais como aquelas relacionadas com as Economias Solidárias, surgem como possibilidades para os estudantes.(AU)
