O presente estudo tem como objeto analisar a efetividade do direito à educação na Constituição de 1988. Examina-se o conceito, a natureza, os custos (como a criação de reserva de fundos no FUNDEB e as designações sobre os percentuais a serem usados para a manutenção e desenvolvimento do ensino pelas entidades federativas), o papel do Estado e da sociedade e os princípios constitucionais que regulam a implementação do direito à educação na realidade brasileira. A partir do postulado de que o Estado Social e Democrático de Direito é protetor dos direitos sociais, foi relevante considerar que os argumentos sobre o mínimo existencial e a escassez de recursos devem ser apreciados com o máximo de cuidado. Além disso, são analisadas duas decisões judiciais proferidas em dois casos concretos que foram levados ao Supremo Tribunal Federal, fenômeno denominado por maior parte da doutrina de “judicialização de políticas públicas”, trata-se do caso Santo André/SP e do caso Queimados/RJ. Por fim, as referidas decisões são analisadas conforme os princípios e valores constitucionais tendo sido concluído que as demandas coletivas de satisfação do direito à educação são prioritárias em relação as demandas individuais, embora ambas sejam exigíveis.

Taking as starting the environmental, social and economic impact of construction and demolition waste in Brazilian cities were created legal mechanisms for management and administration, seeking to minimize the impacts to the maximum, since the irregular deposition can be characterized as environmental crime. CONAMA Resolution No. 307 of 2002 establishing the mandatory implementation of an Integrated Management System Construction Waste and Demolition, guiding the classification and designation of the waste generating agents, collection agents and transporters, and the areas of culling and disposal of waste. The technical partnership between the Ministry of Cities, the Environment Ministry and the Caixa Econômica Federal, coordinated by Pinto & Gonzales (2005) Management in the work and management of construction waste, proposed a guidance manual to guide the implementation of a System Integrated Management of Construction Waste in Municipalities. The municipality of Guanambi in the state of Bahia, in full economic rise, lacks a waste management of construction and demolition, since there has areas for the disposal of waste being proposed in this paper the diagnosis of waste generation in the municipality as part of the methodology proposed by the work of Pinto & Gonzales (2005).

This work approaches the main methods of plastic deformation of metals, with a focus on the deep drawing process. The mechanical properties were evaluated with the tension tests. It is presented the aluminum alloys designation, followed by applying heat treatments and the designation of tempers. The manufacture of aluminum beverage cans is described step by step, in general terms. The main objective is to analyze how different cans background geometries have great influence on the dome reversal. To be able to achieve the goal it was necessary to use cans of different manufacturers, which were used in buckle tests to obtain the reversal pressures, tensile tests and geometric analysis. Finally empirical equations were obtained correlating these variables, and it was observed that the conformation of reforming change significantly it's behavior

Diabetes interferes with bone formation and impairs fracture healing, an important complication in humans and animal models. The aim of this study was to examine the impact of diabetes on mesenchymal stem cells (MSCs) during fracture repair.Fracture of the long bones was induced in a streptozotocin-induced type 1 diabetic mouse model with or without insulin or a specific TNF alpha inhibitor, pegsunercept. MSCs were detected with cluster designation-271 (also known as p75 neurotrophin receptor) or stem cell antigen-1 (Sca-1) antibodies in areas of new endochondral bone formation in the calluses. MSC apoptosis was measured by TUNEL assay and proliferation was measured by Ki67 antibody. In vitro apoptosis and proliferation were examined in C3H10T1/2 and human-bone-marrow-derived MSCs following transfection with FOXO1 small interfering (si)RNA.Diabetes significantly increased TNF alpha levels and reduced MSC numbers in new bone area. MSC numbers were restored to normal levels with insulin or pegsunercept treatment. Inhibition of TNF alpha significantly reduced MSC loss by increasing MSC proliferation and decreasing MSC apoptosis in diabetic animals, but had no effect on MSCs in normoglycaemic animals. In vitro experiments established that TNF alpha alone was sufficient to induce apoptosis and inhibit proliferation of MSCs. Furthermore, silencing forkhead box protein O1 (FOXO1) prevented TNF alpha-induced MSC apoptosis and reduced proliferation by regulating apoptotic and cell cycle genes.Diabetes-enhanced TNF alpha significantly reduced MSC numbers in new bone areas during fracture healing. Mechanistically, diabetes-enhanced TNF alpha reduced MSC proliferation and increased MSC apoptosis. Reducing the activity of TNF alpha in vivo may help to preserve endogenous MSCs and maximise regenerative potential in diabetic patients.

We reviewed the subspecies listed by Rice (1998) and those described since (a total of 49, in 19 species), assessing them against the criteria recommended by the recent Workshop on Shortcomings of Cetacean Taxonomy in Relation to Needs of Conservation and Management (Reeves et al., 2004). The workshop suggested that the subspecies concept can be construed to cover two types of entities: a) lineages diverging but not quite far along the continuum of divergence (still having significant gene flow with another lineage or lineages) to be judged as species, and b) lineages that may well be species but for which not enough evidence is yet available to justify their designation as such. As a criterion for support of a subspecies, the workshop suggested as a guideline that there be at least one good line of either morphological or appropriate genetic evidence. "Appropriate" was not defined; the recommendation was that that be left up to the taxonomist authors of subspecies and to their professional peers. A further recommendation was that evidence on distribution, behavior and ecology should be considered not as primary but as supporting evidence, as there was not agreement at the workshop that such characters are necessarily stable (in the case of distribution) or inherent (behavior and ecology).

Based on the morphology of workers, gynes and males, we revise the taxonomy of nominal taxa traditionally included by authors in the fungus-growing ant genus Mycetophylax. Our results indicate that Mycetophylax Emery (Myrmicocrypta brittoni Wheeler, 1907, type species, by designation of Emery, 1913; junior synonym of Cyphomyrmex conformis Mayr, 1884 by Kempf, 1962) includes M. conformis, M. simplex (Emery, 1888), and M. morschi (Emery, 1888) new combination (formerly in Cyphomyrmex), with several synonymies. Mycetophylax bruchi (Santschi, 1916) does not belong to the same genus and is diagnosed, in addition to other characters, by a psammophore arising at the anterior margin of the clypeus. For this species we are resurrecting from synonymy Paramycetophylax Kusnezov, 1956 (Mycetophylax bruchi as type species, by original designation, with M. cristulatus as its new synonym). Myrmicocrypta emeryi Forel, 1907 is the only attine in which females lack the median clypeal seta and have the antennal insertion areas very much enlarged and anteriorly produced, with the psammophore setae arising from the middle of the clypeus and not at its anterior margin as in Paramycetophylax. Notwithstanding its inclusion in Mycetophylax by recent authors, it is here recognized as belonging to a hitherto undescribed, thus far monotypic genus, Kalathomyrmex new genus (Myrmicocrypta emeryi as its type species, here designated). We redescribe workers, gynes and males of all species in the three genera and describe for the first time gynes of Mycetophylax conformis and M. simplex, males of M. simplex and M. morschi, and gynes of P. bruchi. Furthermore we present a key to the workers of the taxa treated here (most formerly included under the name Mycetophylax), a key to workers of the Mycetophylax in the revised sense, SEM pictures and high resolution AutoMontage(C) photographs of the species, along with maps of collection records and a summary of biological observations.
