In Julstar Pty Ltd v Lynch Morgan Lawyers [2012] QDC 272 Dorney QC DCJ considered whether an applicant for an assessment of all or part of their costs under s 335 of the Legal Profession Act 2007 (Qld) (LPA) must provide grounds on which they dispute the amount of the costs charged or their liability to pay them. His Honour also made an order for inspection of the solicitor’s file, despite a claimed lien for unpaid fees.

Over the past decade, most Australian universities have moved increasingly towards online course delivery for both undergraduate and graduate programs. In almost all cases, elements of online teaching are part of routine teaching loads. Yet detailed and accurate workload data are not readily available. As a result, institutional policies on academic staff workload are often guided more by untested assumptions about reduction of costs per student unit, rather than being evidence-based, with the result that implementation of new technologies for online teaching has resulted in poorly defined workload expectations. While the academics in this study often revealed a limited understanding of their institutional workload formulas, which in Australia are negotiated between management and the national union through their local branches, the costs of various types of teaching delivery have become a critical issue in a time of increasing student numbers, declining funding, pressures to increase quality and introduce minimum standards of teaching and curriculum, and substantial expenditure on technologies to support e-learning. There have been relatively few studies on the costs associated with workload for online teaching, and even fewer on the more ubiquitous ‘blended’, ‘hybrid’ or ‘flexible’ modes, in which face-to-face teaching is supplemented by online resources and activities. With this in mind the research reported here has attempted to answer the following question: What insights currently inform Australian universities about staff workload when teaching online?

The international tax system, designed a century ago, has not kept pace with the modern multinational entity rendering it ineffective in taxing many modern businesses according to economic activity. One of those modern multinational entities is the multinational financial institution (MNFI). The recent global financial crisis provides a particularly relevant and significant example of the failure of the current system on a global scale. The modern MNFI is increasingly undertaking more globalised and complex trading operations. A primary reason for the globalisation of financial institutions is that they typically ‘follow-the-customer’ into jurisdictions where international capital and international investors are required. The International Monetary Fund (IMF) recently reported that from 1995-2009, foreign bank presence in developing countries grew by 122 per cent. The same study indicates that foreign banks have a 20 per cent market share in OECD countries and 50 per cent in emerging markets and developing countries. Hence, most significant is that fact that MNFIs are increasingly undertaking an intermediary role in developing economies where they are financing core business activities such as mining and tourism. IMF analysis also suggests that in the future, foreign bank expansion will be greatest in emerging economies. The difficulties for developing countries in applying current international tax rules, especially the current traditional transfer pricing regime, are particularly acute in relation to MNFIs, which are the biggest users of tax havens and offshore finance. This paper investigates whether a unitary taxation approach which reflects economic reality would more easily and effectively ensure that the profits of MNFIs are taxed in the jurisdictions which give rise to those profits. It has previously been argued that the uniqueness of MNFIs results in a failure of the current system to accurately allocate profits and that unitary tax as an alternative could provide a sounder allocation model for international tax purposes. This paper goes a step further, and examines the practicalities of the implementation of unitary taxation for MNFIs in terms of the key components of such a regime, along with their their implications. This paper adopts a two-step approach in considering the implications of unitary taxation as a means of improved corporate tax coordination which requires international acceptance and agreement. First, the definitional issues of the unitary MNFI are examined and second, an appropriate allocation formula for this sector is investigated. To achieve this, the paper asks first, how the financial sector should be defined for the purposes of unitary taxation and what should constitute a unitary business for that sector and second, what is the ‘best practice’ model of an allocation formula for the purposes of the apportionment of the profits of the unitary business of a financial institution.

Research on attrition has focused on the economic significance of low graduation rates in terms of costs to students (fees that do not culminate in a credential) and impact on future income. For a student who fails a unit and repeats the unit multiple times, the financial impact is significant and lasting (Bexley, Daroesman, Arkoudis & James 2013). There are obvious advantages for the timely completion of a degree, both for the student and the institution. Advantages to students include fee minimisation, enhanced engagement opportunities, effectual pathway to employment and a sense of worth, morale and cohort-identity benefits. Work undertaken by the QUT Analytics Project in 2013 and 2014 explored student engagement patterns capturing a variety of data sources and specifically, the use of LMS amongst students in 804 undergraduate units in one semester. Units with high failure rates were given further attention and it was found that students who were repeating a unit were less likely to pass the unit than students attempting it for the first time. In this repeating cohort, academic and behavioural variables were consistently more significant in the modelling than were any demographic variables, indicating that a student’s performance at university is far more impacted by what they do once they arrive than it is by where they come from. The aim of this poster session is to examine the findings and commonalities of a number of case studies that articulated the engagement activities of repeating students (which included collating data from Individual Unit Reports, academic and peer advising programs and engagement with virtual learning resources). Understanding the profile of the repeating student cohort is therefore as important as considering the characteristics of successful students so that the institution might be better placed to target the repeating students and make proactive interventions as early as possible.

Strawberry breeding aims to provide cultivars that maximise consumer satisfaction and producer profitability in a changing environment. In this paper some concepts of profitability, consumer satisfaction and sustainability are explored for a subtropical climate using Queensland Australia, and Florida USA, as examples. The typical production environment is annual autumn planting of bare rooted runners into polythene covered raised beds at about 40000 plants/ha. Harvesting is late autumn to early spring, with fruit arriving at the major markets up to 2000km away from the production area within 1-4 days of harvest. The basic premise in the breed-big work is that consumers must enjoy the experience of eating strawberries, and that perceived flavour, sweetness, and juiciness are the major contributors to this experience. Using market chain information, we developed a basic value model comprised of costs, returns, and sustainability of market. To this basic outline are applied operational descriptors, such as 'speed of harvest', and associated plant characteristics, such as 'fruit display'. The expression of each plant characteristic is ascribed a value or level and together numerically describe the phenotype. This description is mathematically manipulated to provide a 'value index' for the cultivar. Nine cultivars including 'Strawberry Festival', 'Kabarla', 'DPI Rubygem' and 'Sweet Charlie' are described, and environmental issues that may impact on the subtropical strawberry breeding objectives are discussed. Product differentiation and the use of exotic germplasm as a new source of genes for flavour and resistance to disease and environmental stress will likely be the cornerstones of future progress in subtropical strawberry breeding. This approach should satisfy both consumers and producers.

Attention is given to the results of optimization studies with a 16-micron CO2-N2-H2 GDL employing two-dimensional wedge nozzles. The optimum value of the achievable gain reaches 12.7 percent/cm on the P(15) line for a 30:50:20 percent respective apportionment of the aforementioned gases. The corresponding optimum values for reservoir pressure and area ratio are computed as functions of reservoir temperature, and presented graphically.

Prescribed burnings are conducted in Queensland each year from August until November aiming to decrease the impact of bushfire hazards and maintain the health of vegetation. This study reports chemical characteristics of the ambient aerosol, with a focus on source apportionment of the organic aerosol (OA)fraction, during the prescribed biomass burning (BB) season in Brisbane 2013. All measurements were conducted within the International Laboratory for Air Quality and Health (ILAQH) located in Brisbane’s Central Business District. Chemical composition, degree of ageing and the influence of BB emission on the air quality of central Brisbane were characterized using a compact Time of Flight Aerosol Mass Spectrometer (cToF-AMS). AMS loadings were dominated by OA (64 %), followed by, sulfate (17 %), ammonium (14 %) and nitrates (5 %). Source apportionment was applied on the AMS OA mass spectra via the multilinear engine solver (ME-2) implementation within the recently developed Source Finder (SoFi) interface. Six factors were extracted including hydrocarbon-like OA (HOA), cooking-related OA (COA), biomass burning OA (BBOA), low-volatility oxygenated OA (LV-OOA), semivolatile oxygenated OA (SV-OOA), and nitrogen-enriched OA (NOA). The aerosol fraction that was attributed to BB factor was 9 %, on average over the sampling period. The high proportion of oxygenated OA (72 %), typically representing aged emissions, could possess a fraction of oxygenated species transformed from BB components on their way to the sampling site.

An economic expert working group (STECF/SGBRE-07-05) was convened in 2007 for evaluating the potential economic consequences of a Long-Term Management Plan for the northern hake. Analyzing all the scenarios proposed by biological assessment, they found that keeping the F in the status quo level was the best policy in terms of net present values for both yield and profits. This result is counter intuitive because it may indicate that effort costs do no affect the economic reference points. However, it is well accepted that the inclusion of costs affects negatively the economic reference points. In this paper, applying a dynamic agestructured model to the northern hake, we show that the optimal fishing mortality that maximizes the net present value of profits is lower than Fmax.

After having described in our first paper (Haase et al. 2005) the main features of an easy and fast method for determination of carbon monoxide in fish and the equipment and chemicals necessary as well as first results measured on fish samples, this part deals with the influence of sample preparation, variation of the size of samples, type of solvent, duration of extraction and further conditions on the result of analyses. Both variants of the method are evaluated with regard to measuring expected errors. The single components of the equipment, including prises, are listed to allow a reliable assessment of costs. Additional instrumental colour and DSC measurements on both untreated and CO-treated tuna illustrate the effects.

Trata-se de estudo dirigido à afirmação da natureza objetiva da responsabilidade objetiva da Administração Pública por atos omissivos. Defende-se a correta aplicação do artigo 37 parágrafo 6 da Constituição da República, em que se fora estabelecida a responsabilidade objetiva da Administração em todas as hipóteses em que esteja configurado nexo causal entre sua atuação, comissiva ou omissiva, e um dano injusto ocorrido. É novo o enfoque que norteia a reparação civil, não mais a atividade realizada pelo agente, mas as conseqüências sofridas pela vítima deste dano injusto. Exercitada na seara da responsabilidade civil do Estado, considerado em sentido lato, parece ainda mais lógica a mudança de enfoque mencionada, em razão do princípio norteador do seu dever de reparar, que é o da repartição eqüitativa dos encargos da Administração. De fato, sempre que a atividade administrativa estatal, exercida em benefício de toda a coletividade, gerar dano injusto a um particular específico, configurar-se-á sua responsabilidade de reparar este dano, já que, se é em nome da coletividade que se adotou a conduta geradora do dano, esta a idéia principal daquela diretriz enunciada. Daí por que a verificação da presença do elemento subjetivo culpa, em sede de responsabilidade do Poder Público, fora tornada inteiramente estranho ao exame. A correta leitura do artigo constitucional, com reconhecimento da responsabilidade objetiva do Estado nas hipóteses de ato comissivo e omissivo da Administração Pública, realiza, ainda, o princípio da solidariedade social, que implica preponderância do interesse da reparação da vítima lesada sobre o interesse do agente que realiza, comissiva ou omissivamente, o ato lesivo. Essa a legitimidade da teoria do risco administrativo adotada, a adoção de coerente verificação do nexo causal, com admissão da oposição de excludentes de responsabilidade. Ademais, entre a vítima e o autor do dano injusto, a primeira não obtém, em geral, beneficio algum com o fato ou a atividade de que se originou o dano. Se assim é, a configuração do dever de indenizar da Administração Pública dependerá, apenas, da comprovação, no caso concreto, de três pressupostos que se somam: a atuação do Estado, a configuração do dano injusto e o nexo de causalidade. Será referida a jurisprudência espanhola consagrada à regra de responsabilidade objetiva da Administração Pública por atos omissivos, com considerações acerca da resposta da Jurisprudência daquele país ao respectivo enunciado normativo. Buscou-se, desta forma, elencar-se os elementos básicos à compreensão do tema, e também os pressupostos essenciais à afirmação da natureza objetiva da responsabilidade da Administração Pública por atos omissivos, que são, primordialmente, a compreensão do fundamento da regra constitucional, a correta delimitação do conceito de omissão e de causalidade omissiva. Destacados os pressupostos necessários à correta compreensão do tema, conclui-se pela afirmação da natureza objetiva da responsabilidade da Administração Pública por dano injusto advindo de ato omissivo, desde que assim o seja, querendo-se significar, desta forma, que a responsabilidade mencionada não prescinde da configuração do nexo causal entre o comportamento omissivo ocorrido e o dano injusto que se quer reparar.

How animals use sensory information to weigh the risks vs. benefits of behavioral decisions remains poorly understood. Inter-male aggression is triggered when animals perceive both the presence of an appetitive resource, such as food or females, and of competing conspecific males. How such signals are detected and integrated to control the decision to fight is not clear. Here we use the vinegar fly, Drosophila melanogaster, to investigate the manner in which food and females promotes aggression.

In the first chapter, we explore how food controls aggression. As in many other species, food promotes aggression in flies, but it is not clear whether food increases aggression per se, or whether aggression is a secondary consequence of increased social interactions caused by aggregation of flies on food. Furthermore, nothing is known about how animals evaluate the quality and quantity of food in the context of competition. We show that food promotes aggression independently of any effect to increase the frequency of contact between males. Food increases aggression but not courtship between males, suggesting that the effect of food on aggression is specific. Next, we show that flies tune the level of aggression according to absolute amount of food rather than other parameters, such as area or concentration of food. Sucrose, a sugar molecule present in many fruits, is sufficient to promote aggression, and detection of sugar via gustatory receptor neurons is necessary for food-promoted aggression. Furthermore, we show that while food is necessary for aggression, too much food decreases aggression. Finally, we show that flies exhibit strategies consistent with a territorial strategy. These data suggest that flies use sweet-sensing gustatory information to guide their decision to fight over a limited quantity of a food resource.

Following up on the findings of the first chapter, we asked how the presence of a conspecific female resource promotes male-male aggression. In the absence of food, group-housed male flies, who normally do not fight even in the presence of food, fight in the presence of females. Unlike food, the presence of females strongly influences proximity between flies. Nevertheless, as group-housed flies do not fight even when they are in small chambers, it is unlikely that the presence of female indirectly increases aggression by first increasing proximity. Unlike food, the presence of females also leads to large increases in locomotion and in male-female courtship behaviors, suggesting that females may influence aggression as well as general arousal. Female cuticular hydrocarbons are required for this effect, as females that do not produce CH pheromones are unable to promote male-male aggression. In particular, 7,11-HD––a female-specific cuticular hydrocarbon pheromone critical for male-female courtship––is sufficient to mediate this effect when it is perfumed onto pheromone-deficient females or males. Recent studies showed that ppk23+ GRNs label two population of GRNs, one of which detects male cuticular hydrocarbons and another labeled by ppk23 and ppk25, which detects female cuticular hydrocarbons. I show that in particular, both of these GRNs control aggression, presumably via detection of female or male pheromones. To further investigate the ways in which these two classes of GRNs control aggression, I developed new genetic tools to independently test the male- and female-sensing GRNs. I show that ppk25-LexA and ppk25-GAL80 faithfully recapitulate the expression pattern of ppk25-GAL4 and label a subset of ppk23+ GRNs. These tools can be used in future studies to dissect the respective functions of male-sensing and female-sensing GRNs in male social behaviors.

Finally, in the last chapter, I discuss quantitative approaches to describe how varying quantities of food and females could control the level of aggression. Flies show an inverse-U shaped aggressive response to varying quantities of food and a flat aggressive response to varying quantities of females. I show how two simple game theoretic models, “prisoner’s dilemma” and “coordination game” could be used to describe the level of aggression we observe. These results suggest that flies may use strategic decision-making, using simple comparisons of costs and benefits.

In conclusion, male-male aggression in Drosophila is controlled by simple gustatory cues from food and females, which are detected by gustatory receptor neurons. Different quantities of resource cues lead to different levels of aggression, and flies show putative territorial behavior, suggesting that fly aggression is a highly strategic adaptive behavior. How these resource cues are integrated with male pheromone cues and give rise to this complex behavior is an interesting subject, which should keep researchers busy in the coming years.

Trata-se de um estudo de Avaliação Econômica Parcial cujo objeto é os custos diretos do protocolo assistencial da Casa de Parto David Capistrano Filho/RJ. O objetivo geral é realizar analise dos custos diretos assistenciais destinados ao ciclo gravídico puerperal na Casa de Parto David Capistrano Filho (CPDCF), situada no município do Rio de Janeiro. Os objetivos específicos deste estudo são: estimar o tipo e a quantidade dos recursos consumidos na execução do cuidado ao ciclo gravídico puerperal de acordo com o protocolo assistencial da CPDCF; analisar os custos diretos relacionados ao protocolo assistencial da CPDCF; comparar os custos avaliados no período da pesquisa ao orçamento municipal destinado a assistência das gestantes de baixo risco no mesmo período. O método utilizado foi a Avaliação de Economia em Saúde, a perspectiva adotada foi o Sistema Único de Saúde (SUS) como órgão gestor, foram avaliados os prontuário das gestantes que realizaram o pré-natal na CPDCF no ano de 2010, excluindo destes as que não pariram na unidade, computando um total de 161 prontuários. Na análise foi realizada a descrição dos custos diretos envolvidos na assistência ao ciclo gravídico puerperal, para isso, foram relacionados e contados os recursos utilizados, definidos como unidades de custo, para a assistência na CPDCF durante o pré-natal, trabalho de parto/parto e pós-parto, e posteriormente esses recursos foram valorados de acordo com as tabelas do Sistema de Gerência da Tabela de Procedimentos (SIGTAP), Medicamentos, Próteses e Materiais Especiais do Sistema Único de Saúde/Ministério da Saúde do Banco de Preços em Saúde (BPS) e da Secretaria Municipal de Saúde Defesa Civil/Rio de Janeiro (SMSDC/RJ). Os resultados apontaram que o custo do pré-natal por gestante foi de R$ 271,91, com prevalência de custos para os exames realizados no pré-natal. Em relação ao trabalho de parto e parto, os custos foram de R$ 352,50 por gestante, neste item os maiores custos foram com os recursos humanos. A pesquisa demonstrou que a CPDCF apresentou menor valor que o orçamento municipal destinado para o parto de acordo com a tabela do SIGTAP (R$ 443,40 a R$ 475,16). Apesar desses dados, e de acordo com o relato das diretoras, a CPDCF é ociosa, e esta influência pode ser negativa para os custos do parto. Em relação ao pós-parto foi avaliado o custo por binômio com uma média de custo de R$ 269,94, os maiores custos de pós-parto foram com os recursos humanos. O custo geral da assistência na CPDCF foi de R$ 894,36 por gestante, desse valor, 39,42% correspondeu aos custos com o parto, 30,40% correspondeu ao custo com o pré-natal e 30,18% com a assistência pós-natal. Para afirmar a eficiência e eficácia das ações na CPDCF, é preciso a realização de uma avaliação de economia em saúde completa; o trabalho de parto/parto foram os que mais representaram os custos; o custo do parto é menor que o valor orçado para o parto de baixo risco, mas medidas de ação sobre a ociosidade são necessárias, pois esta pode influenciar nos custos do parto.
