ResumenLa Corte Interamericana con las dos opiniones consultivas sobre la situación de la clase trabajadora migrante en los Estados Unidos, está enfatizando el hecho que los Estados tienen la obligación general de respetar y garantizar los derechos fundamentales. Con este propósito deben adoptar medidas positivas, evitar tomar iniciativas que limiten o conculquen un derecho fundamental, y suprimir las medidas y prácticas que restrinjan o vulneren un derecho fundamental. El incumplimiento mediante cualquier tratamiento discriminatorio, de la obligación general de respetar y garantizar los derechos humanos, le genera responsabilidad internacional.El principio de igualdad y no discriminación posee un carácter fundamental para la salvaguardia de los derechos humanos, tanto en el derecho internacional como en el interno.El principio fundamental de igualdad y no discriminación forma parte del derecho internacional general, en cuanto es aplicable a todo Estado, independientemente de que sea parte o no en determinado tratado internacional. En la actual etapa de la evolución del derecho internacional,este principio ha ingresado en el dominio del jus cogens, es decir de principios universalmente aceptados que no admiten posición en contra. El principio fundamental de igualdad y no discriminación, revestido de carácter imperativo, acarrea obligaciones de protección que vinculan a todos los Estados y generan efectos con respecto a terceros, inclusive particulares.Palabras clave: migración, derechos humanos, corte interamericana, opinión consultiva. AbstractThe Inter-American Court with the two advisory opinions on the situation of migrant workers in the United States is emphasizing the fact that the United States has the obligation to respect and guaranteefundamental rights. With this purpose, it should take positive actions, avoiding taking initiatives to limit or infringe a fundamental right, and eliminate measures and practices that restrict or violate afundamental rights. Failure by any discriminatory treatment of the general obligation to respect and guarantee human rights, gives rise to international responsibility. The principle of equality and nondiscrimination is fundamental for the protection of human rights both in international law and the domestic. The fundamental principle of equality and non discriminationforms part of the general international law as applicable to all States, regardless of party or a specific international treaty. At the current stage of evolution of international law, the fundamentalprinciple of equality and non-discrimination has entered the domain of jus cogens, ie of universally accepted principles that do not support position against it. The fundamental principle of equality andnondiscrimination, a peremptory nature, entails obligations to protect that bind all States and generate effects on third parties, including individuals.Keywords: migration, human rights, Inter-American Court, advisory opinion.

The impact of the Vietnam War conditioned the Carter administration’s response to the Nicaraguan revolution in ways that reduced US engagement with both sides of the conflict. It made the countries of Latin America counter the US approach and find their own solution to the crisis, and allowed Cuba to play a greater role in guiding the overthrow of Nicaraguan dictator Anastasio Somoza Debayle. This thesis re-evaluates Carter’s policy through the legacy of the Vietnam War, because US executive anxieties about military intervention, Congress’s increasing influence, and US public concerns about the nation’s global responsibilities, shaped the Carter approach to Nicaragua. Following a background chapter, the Carter administration’s policy towards Nicaragua is evaluated, before and after the fall of Somoza in July 1979. The extent of the Vietnam influence on US-Nicaraguan relations is developed by researching government documents on the formation of US policy, including material from the Jimmy Carter Library, the Library of Congress, the National Security Archive, the National Archives and Records Administration, and other government and media sources from the United Nations Archives, New York University, the New York Public Library, the Hoover Institution Archives, Tulane University and the Organization of American States. The thesis establishes that the Vietnam legacy played a key role in the Carter administration’s approach to Nicaragua. Before the overthrow of Somoza, the Carter administration limited their influence in Nicaragua because they felt there was no immediate threat from communism. The US feared that an active role in Nicaragua, without an established threat from Cuba or the Soviet Union, could jeopardise congressional support for other foreign policy goals deemed more important. The Carter administration, as a result, pursued a policy of non-intervention towards the Central American country. After the fall of Somoza, and the establishment of a new government with a left wing element represented by the Sandinistas, the Carter administration emphasised non-intervention in a military sense, but actively engaged with the new Nicaraguan leadership to contain the potential communist influence that could spread across Central America in the wake of the Nicaraguan revolution.

La monografía buscó realizar un análisis crítico del concepto de Seguridad Humana en relación con la actuación de la MINUEE en el período de guerra(1998-2000) y luego del retiro de la Misión (Julio de 2008), para establecer una crítica constructiva al funcionamiento de las OMP de la ONU, determinar los aciertos y desaciertos de la Misión en el uso del concepto de Seguridad Humana y sus múltiples dimensiones definidas en el PNUD(Seguridad: de la comunidad, de la salud, política, alimentaria, ambiental y personal) y comprender por qué la Misión fracasó en su intento de dirimir la crisis humanitaria y dar fin al conflicto.

In this study, observations and numerical simulations are used to investigate how different El Nino events affect the development of SST anomalies in the Atlantic and how this relates to the Brazilian northeast (NE) precipitation. The results show that different types of El Nino have different impacts on the SST anomalies of the equatorial and tropical South Atlantic but a similar SST response in the tropical North Atlantic. Strong and long (weak and short) El Ninos with the main heating source located in the eastern (central) Pacific generate cold (warm) anomalies in the cold tongue and Benguela upwelling regions during boreal winter and spring. When the SST anomalies in the eastern equatorial and tropical South Atlantic are cold (warm), the meridional SST gradient across the equator is positive (negative) and the ITCZ is not allowed (allowed) to move southward during the boreal spring; as a consequence, the precipitation is below (above) the average over the NE. Thus, strong and long (weak and short) El Ninos are followed by dry (wet) conditions in the NE. During strong and long El Ninos, changes in the Walker circulation over the Atlantic and in the Pacific-South Atlantic (PSA) wave train cause easterly wind anomalies in the western equatorial Atlantic, which in turn activate the Bjerknes mechanism, establishing the cold tongue in boreal spring and summer. These easterly anomalies are also responsible for the Benguela upwelling. During short and weak El Ninos, westerly wind anomalies are present in the western equatorial Atlantic accompanied by warm anomalies in the eastern equatorial and tropical South Atlantic; a positive phase of the South Atlantic dipole develops during boreal winter. The simulations highlight the importance of ocean dynamics in establishing the correct slope of the equatorial thermocline and SST anomalies, which in turn determine the correct rainfall response over the NE.

Foreword Throughout the preparatory process for the World Summit on Sustainable Development and at the Summit itself, which was held in Johannesburg, South Africa, from 26 August to 4 September 2002, discussions were dominated by one central concern: the need to define and reach consensus on concrete, quantitative goals, with fixed deadlines for implementation, which were to supplement the Millennium Development Goals and facilitate progress towards an effective transition to sustainable development. Participants at the Summit explicitly affirmed the need, as a matter of urgency, to identify the financial and technical resources whereby sustainable development would become a reality and benefit directly and particularly rural and urban communities in the developing countries. The document we are now presenting is the outcome of extensive discussions held at a high-level forum during the Johannesburg Summit. Led by representatives of the Government of Mexico, the Economic Commission for Latin America and the Caribbean (ECLAC), the United Nations Development Programme (UNDP) and the Andean Development Corporation, those discussions were based on the ECLAC/UNDP study entitled Financing for sustainable development in Latin America and the Caribbean: from Monterrey to Johannesburg, which considers the opportunities and challenges for improving prospects for investment and financing for sustainable development and underscores the need to establish a new balance between the market economy and public interest through joint public/private initiatives that combine market innovation, social responsibility and appropriate regulations. Other eminent persons attending the event included heads of State, such as Gustavo Noboa, then President of Ecuador; Enrique V. Iglesias, President of the Inter-American Development Bank (IDB); José María Figueres, Managing Director of the Global Agenda of the World Economic Forum and former President of Costa Rica; and Gro Harlem Brundtland, the legendary figure who pioneered sustainable development. Valuable contributions to the discussions were made by Yolanda Kakabadse, President of the World Conservation Union; Xóchitl Gálvez Ruiz, head of the Unit for the Development of Indigenous Peoples of the Office of the President of Mexico; Cecilia López, former Minister for the Environment of Colombia; and Juan Carlos Maqueda, then Vice President of Argentina. The views emerging from the forum as set forth in this document are designed to facilitate and promote application of the Plan of Implementation of the World Summit on Sustainable Development within the framework of the Millennium Development Goals and the commitments assumed at the International Conference on Financing for Development, which was held in Monterrey, Mexico. We also aspire to continue moving forward with the adoption of measures and policies to increase investment and financing for sustainable development as well as to foster partnerships between the public and private sectors and nongovernmental organizations. We recognize, in this context, the importance of strengthening and improving public and private institutions in order to meet the operational needs associated with the effort to achieve the Millennium Development Goals and pursue the Plan of Implementation formulated in Johannesburg. We trust that this document will contribute to in-depth discussions on the application of the Plan of Implementation in the relevant forums, in particular the United Nations Commission on Sustainable Development. The Plan of Implementation of the World Summit on Sustainable Development opens up new opportunities for Latin America and the Caribbean to renew and revive their own regional agenda -with emphasis on global and especially regional public goods- and to interweave it more cohesively with the global agenda in order to promote the common interests of Latin America and the Caribbean more forcefully in international development forums. The regional agenda and the global agenda cannot be separated in a contrived manner; indeed, to an increasing degree, what we are witnessing are global environmental processes which call for action at the local level. The achievement of sustainable development in Latin America and the Caribbean, where the necessary economic, social, environmental and geopolitical conditions are combined, requires a subtle balance between the market economy, the State and the citizen. Such a balance will result in the consolidation of democratic governance in the service of human development. The third ordinary meeting of the Conference of South American Ministers of Transport, Communications and Public Works was held from 6 to 8 November 1996 in Montevideo, Uruguay. Representatives of Argentina, Bolivia, Brazil, Chile, Colombia, Ecuador, Paraguay, Peru, Uruguay and Venezuela took part. Representatives of the following organizations were present as observers: the Latin American and Caribbean Federation of National Associations of Cargo Agents, the Latin American Railways Association, the Latin American Association for Automated Highway Transport, the Inter-American Development Bank, the Economic Commission for Latin America and the Caribbean (ECLAC), the United Nations Conference on Trade and Development (UNCTAD), the International Road Federation/German Agency for Technical Cooperation (IRF/GTZ); and other representatives from both the private and public sectors.

More than 30% of Buccella peruviana (D'Orbigny), Globocassidulina crassa porrecta (Earland & Heron-Allen), Cibicides mackannai (Galloway & Wissler) and C. refulgens (Montfort) indicate the presence of cold Sub Antarctic Shelf Water in winter, from 33.5 to 38.3 degrees S, deeper than 100 m, in the southern part of the study area. In summer, the abundance of this association decreases to less than 15% around 37.5-38.9 degrees S where two species (Globocassidulina subglobosa (Brady), Uvigerina peregrina (Cushman) take over. G. subglobosa, U. peregrina, and Hanzawaia boueana (D'Orbigny) are found at 27-33 degrees S in both seasons in less than 55 m deep in the northern part, and are linked with warm Subtropical Shelf Water and Tropical Water. Freshwater influence was signalized by high silicate concentration and by the presence of Pseudononion atlanticum (Cushman), Bolivina striatula (Cushman), Buliminella elegantissima (D'Orbigny), Bulimina elongata (D'Orbigny), Elphidium excavatum (Terquem), E. poeyanum (D'Orbigny), Ammobaculites exiguus (Cushman & Bronnimann), Arenoparrella mexicana (Kornfeld), Gaudryina exillis (Cushman & Bronnimann), Textularia earlandi (Parker) and thecamoebians in four sectors of the shelf. The presence of Bulimina marginata (D'Orbigny) between 34.1-32.8 degrees S in the winter and 34.2-32.7 degrees S in the summer indicates that the influence of the Subtropical Shelf Front on the sediment does not change seasonally, otherwise, the presence of Angulogerina angulosa (Williamson) in the winter, only in Mar del Plata (38.9 degrees S), show that Malvinas currents are not influencing the sediment in the summer.

Tendo como referência as pesquisas de Kathryn Sikkink sobre justiça de transição, procura-se identificar a maneira como o Sistema Interamericano de Direitos Humanos vem expandindo o sentido da responsabilidade criminal individual e também sugerir a incompatibilidade com a proteção dos direitos humanos que esse novo modelo pode ter.
